HomeMy WebLinkAbout2006-06-28 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING CITY HALL CHAMBERS WEDNESDAY JUNE 28, 2006 CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City Commission to order at 9:00 a.m. on Wednesday, June 28, 2006 in Chambers at Tamarac City Hall, 7525 N.W. 88"' Avenue, Tamarac, FL. PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Edward C. Portner, Commissioner Patte Atkins -Grad, Commissioner Marc L. Sultanof and Commissioner Hart' Dressler. ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Samuel S. Goren, and City Clerk Marion Swenson. Mayor Beth Flansbaum-Talabisco led the pledge of allegiance. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a check in the amount of $297,600 by Theresa Brier on behalf of Congressman Robert Wexler to the City of Tamarac for construction of Tamarac Courtyard Phase 2. Ms. Brier congratulated the City of Tamarac on behalf of Congressman Wexler and said with the change in demographics in Tamarac, there is a need to expand our cultural and recreational services and programs. Lobbyist Mitch Ceasar said there has been much success over the years procuring grants for Tamarac, and this is one of our largest successes. Mayor Flansbaum-Talabisco thanked Mitch Ceasar, Congressman Wexler, and Theresa Brier on behalf of the Mayor and City Commission and the residents of Tamarac. b. Representative Ari Porth gave a legislative update and spoke of his accomplishments this past legislative session. Out of six Bills he sponsored, four passed and were signed by the Governor: a Bill that puts an end to predatory attorneys; the MADD Bill limiting how defense attorneys access breathalyzer tests; FDLE sexual predator law; and relief to computer users from spammers. Representative Porth said during the next session he will reintroduce a Bill that addresses people driving with suspended licenses. Representative Porth spoke of the approval of his budget request of $150,000 for stormwater treatment pumps, and said his door is always open and people can feel free to call him at any time. Representative Porth said it is a pleasure to represent Tamarac. Mayor Flansbaum-Talabisco responded on behalf of the Mayor and City Commission that it is a pleasure and delight to work with Representative Porth, and he and the City work as a team. June 28, 2006 Page 1 of 7 C. Micah Williams, of the Broward County Supervisor of Elections Office, gave a presentation regarding recent changes in election laws and recruitment of poll workers. Vice Mayor Portner questioned tabulating absentee ballots and Mr. Williams said they would be tabulated as they have been in the past. Commissioner Sultanof questioned the availability of loyalty oaths at the polls and Mr. Williams assured him they are available. Mayor Flansbaum-Talabisco thanked Mr. Williams for appearing before the Mayor and City Commission. d. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming the week of July 2 — 8, 2006 as "A Safe Haven for Newborns" week in the City of Tamarac. Deputy Fire Chief Schuldt and Mr. Silverio accepted. Mr. Silverio thanked the Mayor and City Commission for the proclamation which goes a long way in the continuing effort to further public awareness of this matter. Mr. Silverio thanked Fire Chief Budzinski and Deputy Fire Chief Schuldt for their efforts in helping with public awareness and recognized Deputy Fire Chief Schuldt as the Regional Director of the Florida Fire Chiefs' Organization. Mayor Flansbaum-Talabisco said the City of Tamarac is proud to be a part of this program and thanked Mr. Silverio for his efforts. e. Presentation by Mayor Flansbaum-Talabisco of a proclamation commending Jeff Adelman on being selected by the Tamarac Chamber of Commerce as the "Small Business Leader of the Year 2006". Don Fallenbaum appeared and said Mr. Adelman epitomizes what the Chamber is all about. Mr. Adelman thanked the Mayor and City Commission for the proclamation and said the Chamber is a welcoming group. Mayor Flansbaum-Talabisco thanked Mr. Adelman for his efforts in uniting the business community with government and the city. f. Presentation of a Certificate of Appreciation by Don Fallenbaum of the Tamarac Chamber of Commerce, for the City of Tamarac's support of the Tamarac Chamber of Commerce Annual Golf Tournament. Mr. Fallenbaum thanked the City of Tamarac for its continued support and said the business community in Tamarac is vibrant and growing. Mayor Flansbaum-Talabisco said it was a wonderful event with 90 golfers participating and a great deal of money was collected for the March of Dimes. g. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming June 2006 as Caribbean American Heritage Month. Louissaint LaFrance, Fire Rescue, representing Nassau Bahamas, Cleophat Lordeus, Parks and Recreation, representing Haiti, Hanil Milligan, Parks and Recreation, representing St. Croix, Harriram Preetam, Public Works, representing Trinidad, Rose Terrelonge, Financial Services, representing Jamaica, and Norma Richards, Human Resources, representing Jamaica, accepted. Ms. Richards thanked the Mayor and City Commission on behalf of the Caribbean American employees of the City of Tamarac. h. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming July 2006 as Parks and Recreation month. Parks and Recreation Director Warner accepted and thanked the Mayor and City Commission for recognizing Parks and Recreation month. Director of Parks and Recreation Warner asked members of the Parks and Recreation department present to stand and be recognized. Mayor Flansbaum- Talabisco thanked Director of Parks and Recreation Warner and staff on behalf of the June 28, 2006 Page 2 of 7 Mayor and City Commission and the residents of Tamarac for all they do and for the programs offered. I. Presentation by Mayor Flansbaum-Talabisco of a proclamation commemorating 50 years of the Federal Highway System. Vice Mayor Portner accepted and asked that the proclamation be forwarded to the Eisenhower Memorial Museum. j. Presentation by Mayor Flansbaum-Talabisco of employee service awards: 5-year awards: Theresa Backer, Recreation Programmer II, Parks & Recreation; Nickholas Butler, Distribution Supervisor, Utilities; Lucy Crockett, Public Information Officer, City Manager, Robin Delaware, Office Specialist, Fire Rescue; Michael Gresek, Special Projects Coordinator, City Manager; Marjorie Irizarry, Office Specialist, Utilities; Regina Mc Cremmon-Sneed, Bus Driver, Parks & Recreation; Joseph Meldish, Wastewater Service Worker I, Utilities; Michael Morrison, Service Worker II, Public Works; and Marshall Seals, Firefighter 4, Fire Rescue 10-year award: Rosemary Fisher, Administrative Coordinator, Building 20-year award: Leslie Rinard, Mechanic III, Utilities 25-year award: Randy Correll, Driver Engineer 1, Fire Rescue Mayor Flansbaum-Talabisco said we are 'Team Tamarac' and everything the employees do is appreciated. REPORTS 2. City Commission: Mayor Flansbaum-Talabisco said she was interviewed by Edith Lederberg for "Spotlight on Seniors", and would let everyone know when the program is scheduled to air. Mayor Flansbaum-Talabisco invited all to join in the July 4' Celebration. Mayor Flansbaum-Talabisco expressed deep sadness at the passing of Jerry Ginsberg, Chairperson to the Parks and Recreation Board, and Dr. Paul Sidowsky, a long time member of the Tamarac business/medical community. Vice Mayor Portner had no report. Commissioner Sultanof said it is heartwarming to see the people who work for the City receive their awards and this is truly a family. We are a shining example for Broward County and Commissioner Sultanof said he is proud to be a part of this City. Commissioner Dressler announced that he has been working with the executive staff and Social Services, bringing resources to people who are still enduring problems as a result of the last hurricane season. Commissioner Dressler said he is impressed with the quality of people on our staff and in our Social Services Division. Commissioner Dressler said as a Master Trustee of the FMIT, in which Tamarac funds are involved, he is proud to report it is being well administered. Commissioner Atkins -Grad reported Tamarac helped those displaced due to Hurricane Wilma and thanked everyone involved for their efforts. This past Saturday volunteers helped put back together one damaged home. June 28, 2006 Page 3 of 7 3. City Attorney: City Attorney Goren spoke of the FACC meeting this past week and said he lectured on ordinance drafting and legal implications. City Attorney Goren commended Tamarac City Clerk Swenson and Assistant City Clerk Schneider for their accuracy and support both on the dais, in meetings and throughout daily tasks. Mayor Flansbaum-Talabisco wished City Attorney Goren and his wife Shelley a happy 34t" anniversary. 4. City Manager: City Manager Miller reported Tamarac will receive an additional $150,000 from Broward County for the Safe Park Program for the Southgate Linear Park, and thanked Assistant City Manager Phillips, Special Projects Coordinator Gresek, and Lobbyist Mitch Ceasar for a great job in putting together the application. Finance reports that the City completed the sale of seven vehicles through the Internet, proceeds to the City were $14,435.19. The Building and Code Compliance Department reports over the past 30 day period they assisted 3,310 customers at their counter. Fire Rescue reports the ALS Competition Team came in 4th out of 25 teams from South Florida and they are on their way to Orlando for competitions in July. The three message boards have arrived and will be used for emergency, safety, and event information. City Manager Miller invited all to the Annual July 4t" Celebration that will be held from 6:00 p.m. — 9:00 p.m. at the Tamarac Sports Complex. PUBLIC PARTICIPATION 5. Joe Schreiber, 10504 E. Clairmont Circle, Tamarac spoke of a matter that came up at Monday's workshop meeting regarding the wearing of a shirt with the City logo and the word `mayor on it, and spoke of respect. City Attorney Goren said based on discussions at Monday's workshop meeting he is working with staff to draft an appropriate letter and policy to address those concerns. Commissioner Sultanof questioned a law relating to the use of the City seal and City Attorney Goren said state statute governs the use of a City seal in Florida; he had opined earlier in the year regarding the use of the seal, and it relates to the approval process of the Mayor and City Commission. Vice Mayor Portner spoke of respect and said the Mayor and City Commission must move forward with the business of the city. Commissioner Dressler thanked the citizens and voters of the City of Tamarac who elected the current commission and said the City has many challenges ahead on which he would like to focus. Tamarac is a positive, issue oriented City and the Mayor and City Commission work toward lower taxes and better services, and we are a government that cares about people. Mayor Flansbaum-Talabisco said she is extremely proud of the Commission and the meetings continue to be held in a positive vein. Mayor Flansbaum-Talabisco said the Commission is united and thanked the Commissioners for their support. Commissioner Sultanof spoke of politics and said the administration does a good job. CONSENT AGENDA 6. Commissioner Sultanof seconded by Commissioner Dressler moved approval of all items on the consent agenda. Motion carried. a. APPROVE the minutes of the June 14, 2006 Regular City Commission meeting. APPROVED b. AWARDING BID 006-208 TO SMITH BROTHERS CONTRACTING — PURCHASE OF REPLACEMENT HEAVY EQUIPMENT: (TR10975) Awarding Bid #06- 20B to Smith Brothers Contracting (Bobcat of Broward) for the purchase of replacement heavy equipment; authorizing an expenditure in an amount not to exceed $25,957.66; authorizing budget transfers as needed for proper accounting purposes. RESOLUTION NO. R2006-100 C. INSITUFORM TECHNOLOGIES, INC. AGREEMENT — INFLOW AND INFILTRATION PROJECT: (TR10980) Executing an agreement for the FY06 inflow and infiltration project for sanitary sewer rehabilitation with Insituform Technologies, Inc., utilizing City of Melbourne contract RFP #10-111-1-2005, valid through March 22, 2007, for an amount not to exceed $500,000.00; authorizing the appropriate city officials to administer the contract. RESOLUTION NO. R2006-101 d. DIESEL FUEL PURCHASE : (TR10984) Purchasing Diesel Fuel from BV Oil Company, Inc. and MacMillan Oil Company utilizing Coral Springs Co-op Contract #06- A-098; authorizing purchase of diesel fuel in the quantities needed based on the Oil Price Information Service Price Index cost at the time of delivery. RESOLUTION NO. R2006-102 e. JOINT PARTICIPATION AGREEMENT — HOUSEHOLD HAZARDOUS WASTE COLLECTION EVENTS: (TR10965) Executing an amendment to the Joint Participation Agreement with Broward County for Household Hazardous Waste Collection Events extending the agreement until June 27, 2007. RESOLUTION NO. R2006-103 f. AGREEMENT AMENDMENT — GRUBBS EMERGENCY SERVICES, INC.: (TR10977) Executing an amendment to the 2002 agreement between the City of Tamarac and Grubbs Emergency Services, Inc. for disaster recovery services. RESOLUTION NO. R2006-104 g. AGREEMENT — BECK DISASTER RECOVERY, INC.: (TR10978) Executing an agreement between the City of Tamarac and Beck Disaster Recovery, Inc. for disaster debris monitoring services utilizing Orange County Contract Number Y5-1000B. RESOLUTION NO. R2006-105 h. TAMARAC COURTYARD PHASE 2 FDOT LAP AGREEMENT: (TR10982) Executing a Local Agency Program Agreement with the State of Florida Department of Transportation for participation in the fiscal year 05/06 FDOT Work Program for the construction of the Tamarac Courtyard Phase 2. RESOLUTION NO. R2006-106 i. PURCHASE_ OF _ROOF TARPS: (TR10987) Awarding Bid Number 06-21 B to W.W. Grainger, Inc., for the purchase of the annual requirements for roof tarps for the City of Tamarac and on behalf of the Southeast Florida Govemmental Purchasing Cooperative for a period effective upon award of the agreement, for a period of one year, with the option to exercise up to three (3) additional one (1) year renewals, authorizing expenditure in an amount not to exceed $100,000.00. RESOLUTION NO. R2006-107 June 28, 2006 Page 5 of 7 j. AMENDING TERMS OF EMPLOYMENT: (TR10994) Amending the terms of employment of City Manager Jeffrey L. Miller, as set forth in Resolution No. R-99-226; as amended by Resolution Nos. R-2000-91, R-2001-123, R-2002-116, R-2003-90, R- 2004-72 and R-2005-136. RESOLUTION NO. R2006-108 k. 2006 EMERGENCY HURRICANE SUPPLEMENTAL URBAN AND COMMUNITY FORESTRY GRANT: (TR10991) Submitting of an application to the Florida Department of Agriculture and Consumer Services for an Emergency Hurricane Supplemental Urban and Community Forestry Grant in the amount of $50,000 for the provision of trees lost on public property or rights of way in Tamarac during Hurricane Wilma; authorizing adherence to the three-year maintenance plan and execution of the Maintenance Memoranda of Agreement between the City and the Department of Agriculture in the event the award is approved; providing for a cash match of 25% in local funds in the event of approval. RESOLUTION NO. R2006-109 END OF CONSENT AGENDA REGULAR AGENDA ORDINANCES — FIRST READINGS 7. AMENDING CHAPTER 12 "LICENSE AND BUSINESS REGULATIONS": (T02118) Motion to adopt Ordinance on first reading amending Chapter 12, "License and Business Regulations", of the Code of Ordinances of the City of Tamarac, Florida, by amending Article II, "Occupational Licenses", by repealing Section 12-39, "Amount of Fee" of the City of Tamarac Code of Ordinances in its entirety and creating a new Section 12-39, "Amount of Fee" to conform with Chapter 205, Florida Statutes; modifying occupational license fees and classifications and establishing equity between license fees and establishing additional license classifications and fees (Case No. 7-Z- 06); providing for codification. City Attorney Goren read Temporary Ordinance 2118, Revision No. 1 on first reading by title. Commissioner Sultanof seconded by Commissioner Dressler moved approval. Mayor Flansbaum-Talabisco opened the floor to a public hearing and with no one wishing to speak closed the public hearing. On roll call Commissioner Dressler voted "yes", Commissioner Sultanof "yes", Vice Mayor Portner "yes", Commissioner Atkins -Grad "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried. ADOPTED ON FIRST READING JUNE 28, 2006 PUBLIC HEARINGS 9:00 A.M. OR THEREAFTER 8. PROJECTS RECOMMENDED FOR INCLUSION IN THE FY06 ANNUAL ACTION PLAN: (TR10988) Motion to approve resolution approving projects recommended for inclusion in the Fiscal Year 2006 Annual Action Plan for expenditure of the U.S. Housing and Urban Development Community Development Block Grant Funds estimated to be $434,900 for the Seventh Program Year (Case No. 9-MI-06). City Attorney Goren read Temporary Resolution 10988 by title. Commissioner Dressler seconded by Vice Mayor Portner moved approval. Mayor Flansbaum-Talabisco opened the public hearing and with no one wishing to speak, closed the public hearing. Motion carried. RESOLUTION NO. R2006-110 ORDINANCES — SECOND READINGS There were no ordinances scheduled for second reading for this meeting. QUASI-JUDICIAL HEARINGS There were no quasi-judicial hearings scheduled for this meeting.
