HomeMy WebLinkAbout2005-07-13 - City Commission Regular Meeting MinutesI CITY OF TAMARAC REGULAR CITY COMMISSION MEETING CITY HALL CHAMBERS WEDNESDAY JULY 13, 2005 CALL TO ORDER: Mayor Schreiber called the regular meeting of the City Commission to order at 7:00 P.M. on Wednesday, July 13, 2005 in Chambers at 7525 NW 88 Avenue, Tamarac, FL 33321. Mayor Schreiber thanked the residents for attending the meeting. PRESENT: Mayor Joe Schreiber, Vice Mayor Beth Flansbaum-Talabisco, Commissioner Edward C. Portner, Commissioner Marc L. Sultanof, and Commissioner Karen L. Roberts. ALSO PRESENT: City Manager Jeffrey L. Miller, Interim City Attorney Samuel S. Goren, and City Clerk Marion Swenson. Vice Mayor Beth Flansbaum-Talabisco led the pledge of allegiance. INTRODUCTION 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a plaque by Randy Hibshman to the City Commission for Tamarac's support of the Challenger Baseball League. Mayor Schreiber accepted and Commissioner Roberts indicated all those who work for Challenger Baseball League are volunteers. b. Rep. Ron Greenstein discussion of the Resource Recovery Board. Mayor Schreiber deferred this item pending Rep. Greenstein's arrival. REPORTS 2. City Commission: Mayor Schreiber thanked everyone for attending the commission meeting. Mayor Schreiber said this is the last meeting before the commission's vacation from mid -July to mid -August, and he wished all the commissioners a happy and healthy vacation. Commissioner Portner said he has been a commissioner for six years and this is the largest crowd he has seen at a meeting from the east side of Tamarac. Commissioner Portner said a few years ago he suggested purchasing the golf course; perhaps something can be done to assist the residents. Commissioner Roberts welcomed everyone to the meeting and said there are residents here tonight because of the sidewalk issue. Commissioner Roberts said she spoke with July 13, 2005 Page 1 of 10 residents regarding Monterey Golf Course; a notice was sent to some homeowners regarding Monterey Golf Course from D. R. Horton and Commissioner Roberts read the notice into the record (a copy of which is attached to these minutes and incorporated herein). Commissioner Roberts said due to a previous commitment she was unable to attend the meetings held by the developer. Commissioner Sultanof said it is wonderful to see so many bright faces in the audience, and added this is your government. Commissioner Sultanof said he appreciates the residents' dilemma and he is going to see what evolves. Vice Mayor Flansbaum-Talabisco said it is terrific to see everyone here; the issues the residents have come to discuss are very significant, and the elected officials are here to listen to you. Vice Mayor Flansbaum-Talabisco thanked the City Manager and department directors for the past two days' work on the budget workshops. Vice Mayor Flansbaum-Talabisco acknowledged Finance Director Chapman and Management and Budget Officer Sammartino for the great job they did. Vice Mayor Flansbaum-Talabisco spoke of the series of meetings she held for her district's leaders and read into the record a letter from the president of Lime Bay (a copy of which is attached to these minutes and incorporated herein). Vice Mayor Flansbaum-Talabisco said it is significant when community leaders come together and exchange ideas. Vice Mayor Flansbaum- Talabisco wished her colleagues a healthy and happy vacation break and said she looks forward to returning in August. Mayor Schreiber moved out of the regular order of business to return to Item 1(b). Rep. Ron Greenstein said he is before the Mayor and City Commission tonight as the executive director of the Resource Recovery Board. Since the inception of the resource recovery system the City of Tamarac has received $1.5 million in recycling monies. On June 215t of this year the County Commission approved $260,039 for Tamarac. Representative Greenstein spoke of the future of the resource recovery board and the ILA. Mayor Schreiber asked if the cities were to take over the resource recovery board would they also own the incinerator and Rep. Greenstein said the incinerator is owned by Wheelabrator; Wheelabrator pays the bond indebtedness and the cities guarantee tonnage. However, when the bonds are paid off there is no reason for the cities to pay an inflated rate. Commissioner Portner thanked Rep. Greenstein for nominating him to the resource recovery board and Commissioner Portner invited anyone who wished to tour the incinerator to call him and he would make the appropriate arrangements. 3. City Attorne . Interim City Attorney Goren reported that an attorney general opinion was issued yesterday stating it is legally permissive for cities to monitor intersections with red light cameras, but not lawful to charge for violations. 4. C11tv Manager: City Manager Miller reported the City of Tamarac was awarded a $200,000 grant from the Federal Land and Water Conservation Fund for the sports complex. A public meeting will be held on July 14th from 2:00 p.m. — 4:00 p.m. at the Tamarac Community Center to discuss design standards for the 57th Street Corridor. July 13, 2005 Page 2 of 10 5. PUBLIC PARTICIPATION: Jim Mort, 4610 NW 45 Street; Ron Applegate, 4205 NW 49th Street; William Vallie, 4723 NW 48th Avenue; Linda Villella, 4605 NW 45th Street; Harry Freire, 4707 Mainland Drive; and Ellen Tomas, 4111 NW Mainland Drive spoke in opposition to the purchase of the Monterey Golf Course by D. H. Horton and overgrown grass areas on the golf course. Interim City Attorney Goren reminded the Mayor and City Commission that there is currently no pending rezoning, site plan or land use application with respect to this property; the Mayor and City Commission should not offer any pre -conceived opinions on matters that have not come before them. This part of the meeting is to allow the public to speak and express their opinions; and while the collegial body should be mindful of the people making their requests to the commission there is nothing that can be legally responded to at this time. Mr. Mort handed the city clerk a petition in opposition to the purchase of the golf course by D. H. Horton, signed by residents of the Mainlands communities (a copy of which is attached to these minutes and incorporated herein). Sarah Godfry, 8000 NW 66th Terrace; Maria Barrenger, 7806 NW 72 Avenue; Marcia Mendes, 7701 NW 75th Avenue; Judy Camel, 8172 NW 68th Terrace; Lisa Norris Richards, 6951 NW 82" d Street; Stacy Rowe, 8140 NW 66th Terrace; and Iry Tutunick, 6820 NW 815t Street spoke in opposition to the citations given to residents of Heathgate/Sunflower with regard to sidewalk cracks, and asked to have the hearings before the Special Magistrate stayed until the commission returns from vacation and reviews the ordinance. Ms. Godfry and Ms. Mendes handed the city clerk photographs of the sidewalks and a petition signed by residents (a copy of which is attached to these minutes and incorporated herein). Mayor Schreiber said the citations will be delayed until the commission has time to review the ordinance after their vacation. City Manager Miller said a letter can be sent to the Special Magistrate if that is the Mayor and City Commission's wish, requesting a stay in the enforcement of the citations until the Mayor and City Commission have had time to review the ordinance. Commissioner Roberts asked if it would be beneficial for residents to call city hall and request a 60 day extension for the citations and Building Operations Manager McIntyre said nothing can be done until he received direction from the City Manager and Mayor and City Commission. Commissioner Roberts said it appears to be the wishes of the Mayor and City Commission for the City Manager to send a letter to the Special Magistrate and request a stay of enforcement for these citations. Interim City Attorney Goren added the City Manager described what the commission can ask for in an appropriate manner, but can not mandate a conclusion. Burt Schneider, 8016 NW 72 Street spoke in opposition to the sale of the golf course to a developer and suggested that before laying sidewalks in treed communities, the city should make sure there is some sort of a root diverter. Mr. Schneider said he is sorely disappointed at the lack of architectural design of the University Landings project on University Drive. Mayor Schreiber said the city should have an architectural review board. Mayor Schreiber said the Mayor and City Commission will address the sidewalk issue when they return from vacation and the residents will be notified when the citations are stayed. Vice Mayor Flansbaum- Talabisco said although the Mayor and City Commission will be on vacation, the city does not sleep; staff and the City Manager continue to work. Commissioner Portner added staff is always here and although the Mayor and City Commission may not come to city hall every day, they do come in for messages and the home phone numbers of the Mayor and City Commission are available to the residents. Vice Mayor Flansbaum-Talabisco requested items 6(f), Temporary Resolution 10742, 6(r), Temporary Resolution 10744 and 6(u), Temporary Resolution 10756 be pulled from the consent agenda for discussion. Commissioner Sultanof seconded by Vice Mayor Flansbaum-Talabisco moved approval of all items on the consent agenda, except items 6(f), 6(r) and 6(u) which were pulled for discussion. On roll call Commissioner Sultanof voted "yes", Vice Mayor Flansbaum- Talabisco "yes", Mayor Schreiber "yes", Commissioner Roberts "no", and Commissioner Portner "yes". Motion carried. a. REJECTING BID —FIRE STATION NO. 41 ROOF REPLACEMENT: (TR10750) Rejecting bid under Bid No. 05-14B for the Fire Station No. 41 roof replacement. RESOLUTION NO. R2005-131 d. ACCEPTING THE STATE HOUSING INITIATIVES PARTNERSHIP SHIP PROGRAM BUDGET: (TR10752) Accepting the State of Florida's State Housing Initiatives Partnership (SHIP) Program Budget in the amount of $422,978 by accepting the Fiscal Year 2005-2006 allocation of the program funds to be utilized according to the City's Local Housing Assistance Plan and Housing Delivery Goals Chart; appropriating said funds, during the next quarterly budget amendment (Case No. 9-MI- 05). RESOLUTION NO. R2005-132 e. Vice Mayor Flansbaum- Talabisco said the projects discussed are all fabulous and she is in favor of all the improvements. However, she is not in favor of raising taxes to fund the proposed projects and would rather look to alternative ways of funding the projects. Mayor Schreiber said the actual finalization of the increase will be during the public hearings on the budget in September. Once the numbers are sent to the property appraiser, the Mayor and City Commission can not raise them. Commissioner Roberts asked why the second budget hearing was set for 5:15 p.m. while the first was set for 6:30 p.m. Mayor Schreiber replied that was because the first public hearing would be held just prior to a regular commission meeting, while there is no other meeting set for the same day as the second public hearing. Commissioner Roberts said many people do not get out of work until 6:00 p.m. and she would prefer the second public hearing on the budget be held at 6:30 also. Commissioner Sultanof seconded by Commissioner Portner moved to change the time for the second public hearing on the budget to 6:30 p.m. on September 21, 2005. On roll call Commissioner Portner voted "yes", Commissioner Sultanof "yes", Vice Mayor Flansbaum-Talabisco "yes", Mayor Schreiber "yes", and Commissioner Roberts "yes". Motion carried. Commissioner Portner seconded by Commissioner Sultanof moved approval of Temporary Resolution 10756, as amended. On roll call Commissioner Sultanof voted "yes", Vice Mayor Flansbaum-Talabisco "no", Mayor Schreiber "yes", Commissioner Roberts "yes", and Commissioner Portner "yes". Motion carried. RESOLUTION NO. R2005-150 REGULAR AGENDA PUBLIC HEARINGS 7:00 P.M. OR THEREAFTER 7. ADOPTING CITY OF TAMARAC CONSOLIDATED PLAN: (TR10717) Motion to approve Resolution adopting the City of Tamarac Consolidated Plan; authorizing the appropriate City officials to submit said consolidated plan program funds for HUD's Fiscal Year 2005-2010; together with the Fiscal Year 2005 (City's Sixth Program Year) Annual Action Plan to the U.S. Department of Housing and Urban Development (HUD) for the Community Development Block Grant (CDBG); (Case No. 7-MI-05). Interim City Attorney Goren read Temporary Resolution 10717 by title. Commissioner Roberts seconded by Commissioner Sultanof moved approval. Community Development Director King gave a presentation. Mayor Schreiber opened the public hearing and with no one wishing to speak, closed the public hearing. On roll call Commissioner Roberts voted "yes", Commissioner Sultanof "yes", Commissioner Portner "yes", Vice Mayor Flansbaum-Talabisco "yes", and Mayor Schreiber "yes". Motion carried. RESOLUTION NO. R2005-151 ORDINANCES — SECOND READINGS Interim City Attorney Goren said Items 8, 9, and 10 are companion items and could be considered together with separate motions and votes on each. July 13, 2005 Page 8 of 10 8. AMENDING CHAPTER 24 OF THE TAMARAC CODE — ADDITION OF DEFINITIONS AND ILLUSTRATIONS TO ASSIST IN IMPLEMENTATION OF MIXED USE ZONING DISTRICT: (T02083) Motion to adopt Ordinance on second reading amending Chapter 24, "Zoning", Article I "In General", Section 24-1, "Definitions" of the City of Tamarac Code of Ordinances through the addition of definitions and illustrations to assist in the implementation of the Mixed Use Zoning District (Case No. 12-Z-05); providing for codification. Interim City Attorney Goren read Temporary Ordinance 2083 on second reading by title. Commissioner Sultanof seconded by Commissioner Roberts moved approval. 9. Interim City Attorney Goren read Temporary Ordinance 2085, Revision No. 1, on second reading by title. Commissioner Roberts seconded by Vice Mayor Flansbaum-Talabisco moved approval. Community Development Director King gave a presentation on items 8, 9, and 10. Community Development Director King said there have been meetings with the property owners and all parties are satisfied with changes made to Temporary Ordinance No. 2085. Attorney Mike Moskowitz appeared on behalf of R & B Commercial Properties, LLB. Mr. Moskowitz said the property is situated between Walgreens and Wendy's on Commercial Boulevard and it would have been difficult for the property to meet the dictates of the MXD use ordinance. On June 22, 2005 there was a complete presentation by the applicant, whereby the applicant expressed concerns and objections regarding the MXD use ordinance. At that time, the Mayor and City Commission asked staff to work with the applicant, and Mr. Moskowitz complimented Community Development Director King and his staff, as they did more than was asked July 13, 2005 Page 9 of 10 for as far as making themselves available to work with the applicant. Mr. Moskowitz said he is grateful for those efforts and a conceptual plan will be forthcoming. Mr. Moskowitz asked that his comments and concerns from the June 22nd meeting be incorporated into these minutes (the minutes of June 22nd are available for review in the office of the City Clerk). Mayor Schreiber opened the public hearing for items 8, 9 and 10. Burt Schneider, 8016 NW 72 Street questioned the objective of the three ordinances, and asked if people would still be able to request variances. Mayor Schreiber explained this is a new zoning district created to enable development of Main Street, consisting of residential and commercial zoning. Richard Viele, 6961 NW 82 Street asked for a definition of a temporary ordinance. Interim City Attorney Goren explained it is a term of art; while in progress and until final approval by the Mayor and City Commission the ordinance is temporary in nature. Once approved by the Mayor and City Commission it is issued a permanent number. With no one else wishing to speak, Mayor Schreiber closed the public hearing.
