REGULAR CITY COMMISSION MEETING
CITY HALL - COMMISSION CHAMBERS
WEDNESDAY AUGUST 26, 2009
CALL TO ORDER: 9:00 a.m.
PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Patricia Atkins -Grad,
Commissioner Pamela Bushnell, Commissioner Diane Glasser (attended telephonically), and
Commissioner Harry Dressler.
ALSO PRESENT: City Manager Jeffrey L. Miller, Assistant City Attorney Julie Klahr, and City
Clerk Marion Swenson.
PLEDGE OF ALLEGIANCE: Mayor Flansbaum-Talabisco led the pledge of allegiance and
asked for a moment of silence in memory of Senator Ted Kennedy who passed away early this
morning.
PROCLAMATIONS AND PRESENTATIONS:
a. EMPLOYEE SERVICE AWARDS:
5 Year Awards: Wade Clair, Recreation Programmer II - Parks and Recreation; Juan Ocasio,
Water System Operator I, Utilities; Germania Roman, Office Specialist, Parks and Recreation
10 Year Awards: Alexander Arias, Paramedic, Fire Rescue; David Moore, Project Manager,
Public Works; Diane Phillips, Assistant City Manager
20 Year Award: Ricky Anderson, Chief Structural Inspector, Building
REPORTS
2. CITY COMMISSION:
a. Commissioner Bushnell said with the exception of the Commission meetings, work went
on as usual during the Commission hiatus. The Florida League of Cities meeting was
extremely informative, and Commissioner Bushnell wished Commissioner Glasser a speedy
recovery.
b. Vice Mayor Atkins -Grad said she has been busy during the Commission hiatus and met
many friends and residents during the past weeks. The City of Tamarac was awarded the
Environmental Stewardship Award at the Florida League of Cities conference in Orlando.
C. Commissioner Glasser thanked everyone for their good wishes and hopes to be back at
City Hall very soon. Commissioner Glasser said she continues to receive calls from her
constituents and those she is unable to handle have been taken care of by her office staff.
d. Commissioner Dressler reported the MPO will take up the 1-95 proposed study when the
County Commissioners are all back from vacation. The City's credit rating is now investment

grade and it is a credit to staff and everyone who worked on this project. The City completed
its bond refinancing successfully because our credit rating is so very good.
e. Mayor Flansbaum-Talabisco said she attended the Florida League of Cities Conference
in Orlando, and she serves as Secretary to the League. Broward County and the City of
Tamarac were very well represented. The Environmental Stewardship Award is the first one
given, and Tamarac is the only City to receive this award. Mayor Flansbaum-Talabisco
commended Community Development Director Bramley and Deputy City Manager/Interim
Financial Services Director Cernech on their participation at the FLC Conference Orlando and
particularly Community Development Director Bramley for the great presentation. Mayor
Flansbaum-Talabisco spoke of the elimination of the 18% water surcharge and said she has
received positive feedback; she will be communicating this information as she goes forward
over the next few months. Mayor Flansbaum-Talabisco wished Commissioner Glasser a
speedy recovery.
3. Assistant City Attorney Klar had no report.
4. City Manager Miller welcomed everyone back and congratulated Deputy City
Manager/Interim Financial Services Director Cernech for sitting in for him over the past few
weeks. City Manager Miller also thanked Assistant City Manager Phillips for her work while he
was on vacation and for receiving her 10-year award. City Manager Miller reported on the
opening of the Hampton Inn & Suites Hotel last week at Tamarac Commerce Park, and
thanked the Tamarac Chamber of Commerce for their participation. With regard to the Florida
League of Cities Environmental Stewardship Award, over the past 20 years Tamarac has been
environmentally conscious. BSO reminds everyone school is in session and to please drive
carefully. BSO is monitoring all school zones and working on traffic issues. The NSP is going
well; so far eight families have moved into their new homes and there are six more scheduled
for the end of August. Tamarac is the most progressive City in Florida with regard to the NSP
money. City Manager Miller congratulated Housing Administrator Bauldree and Community
Development Director Bramley as well as their staff for their efforts and added he believes we
will be recognized by HUD with a visit from a representative in the near future. The annual
Muscular Distrophy Drive starts today and Fire Department personnel will be out with their
boots. The Fire Department reports CERT members are participating in the first responder
program. Parks and Recreation reports the Transportation Division received $10,000 from the
Beverly Foundation: Star Award and the grant money will go for trips for the elderly population.
Summer camp was very successful with 375 enrolled in the eight -week session. We extend
gratitude to North Lauderdale for allowing us to utilize their facilities on Fridays.
Mayor Flansbaum-Talabisco said senior transportation is a passion of the Mayor and City
Commission and especially Commissioner Glasser. Mayor Flansbaum-Talabisco said Mayor
Brady of North Lauderdale, who has served Broward County for over 20 years, is a dear friend
and she is delighted to have a good relationship with North Lauderdale, especially when it
affects our youth. Mayor Flansbaum-Talabisco said she and Vice Mayor Atkins -Grad were at
Challenger Elementary School on Friday where they met many parents and received

compliments regarding the fact that we have kept the SRO's in our schools. Mayor
Flansbaum-Talabisco said economic development is the backbone of Tamarac, and the fact
that Hampton Inn chose Tamarac speaks volumes. There is room for more development in
the Commerce Park as well as redevelopment in the City.
Commissioner Dressler congratulated Community Development Director Bramley and Housing
Administrator Bauldree on their work. Moving families into homes is an unbelievable
achievement and many other cities received NSP funding but were not as successful as
Tamarac. It takes skill and hard work to deal with federal documentation.
Mayor Flansbaum-Talabisco said she would like Public and Economic Affairs Officer Berns
and the City Manager's Office to provide a unified statement of recent accomplishments so the
Mayor and City Commission can send the information in blast emails to the residents.
Vice Mayor Atkins -Grad said she attended an award ceremony for our campers held at North
Lauderdale, which was very nice. It was also a pleasure attending the crime lab presentation
from BSO; our BSO is very advanced.
5. PUBLIC PARTICIPATION: Mary Riedel, President and CEO, Women in Distress, Ft.
Lauderdale, FL, thanked the Mayor and City Commission for their past support and asked for
consideration for the coming year. Mayor Flansbaum-Talabisco said the budget has not yet
been finalized, and there are many ways the Mayor and City Commission reach out to
organizations in addition to monetary contributions.
City Manager Miller thanked staff for their assistance in bringing Hampton Inn to Tamarac, in
particular Public and Economic Affairs Officer Berns, Chief Building Official/Director Grande,
Chief Structural Inspector Anderson, Public Works Director Strain and staff, and Community
Development Director Bramley and staff.
6. CONSENT AGENDA:
Vice Mayor Atkins -Grad seconded by Commissioner Dressler moved approval of all items on
the consent agenda. On roll call Commissioner Bushnell voted "yes", Vice Mayor Atkins -Grad
"yes", Commissioner Glasser "yes", Commissioner Dressler "yes", and Mayor Flansbaum-
Talabisco "yes". Motion carried.
a. APPROVE THE MINUTES OF THE JULY 22, 2009 COMMISSION MEETING
APPROVED
b. TR11656 PURCHASE OF WATER METER FITTINGS AND WATER LINE
ACCESSORIES: Utilizing the City of Deerfield Beach Bid Number 2008-09/28, entitled "Water
Meter Fittings and Water Line Accessories" issued on behalf of the Southeast Florida
Governmental Purchasing Group as renewed for the period of July 1, 2009 through June 30,
2010; authorizing the purchase of water meter fittings, water line accessories and meter boxes
in an amount not to exceed $87,800.

C. TR11664 INTERLOCAL AGREEMENT-BROWARD COUNTY UNSAFE STRUCTURES
BOARD: Authorizing the appropriate city officials to execute an interlocal agreement between
Broward County and the City of Tamarac providing for hearings by the Broward County
Minimum Housing/Unsafe Structures Board at a rate of sixty-six dollars ($66.00) per hour for
the Code Enforcement Officer and thirty dollars and no cents ($30.00) per hour for clerical
support, with a maximum case cost of five hundred dollars ($500.00) unless written
authorization from the city has been received; per noticed case, for a two year period through
September 30, 2011.

d. TR11665 INTERLOCAL AGREEMENT - BROWARD COUNTY INSPECTION
SERVICES: Authorizing the appropriate city officials to execute the Interlocal Agreement for
Emergency/Non Guaranteed Supplemental Support between Broward County and the City of
Tamarac for Inspection and Plan Review Services to be performed by the Broward County
Building Code Services Division in the event there is a staff shortage at a rate of sixty-six and
00/100 ($66.00) per hour for a Building Code Inspector, seventy-six and 00/100 ($76.00) per
hour for a Plans Examiner, eighty dollars and fifty cents ($80.50) for a Chief Building Code
Inspector, ninety and 00/100 ($90.00) per hour for Building Official Services. Overtime, when
approved by the City, shall be at one and one half the normal hourly rate, including annual
increase of 5%, for a two year period commencing October 1, 2009.

e. TR11671-FY 2007-2009 LHAP 3RD AMENDMENTA: Approving an amendment to the
City's Local Housing Assistance Plan ("LHAP") for fiscal years 2007-2009 to provide for the
inclusion of additional State Housing Initiative Partnership ("SHIP") funds for the Florida
Homebuyer Opportunity Program ("FHOP"), to assist first timehomebuyers; providing for
certification of consistency with the City's Comprehensive Plan providing for conflicts; providing
for severability; and providing for an effective time.

f. TR11674 STATE EMERGENCY RESPONSE TEAM (SERT) PROGRAM SUBGRANT
APPLICATION: Authorizing submission of a grant application to the US Department of
Homeland Security for State Emergency Response Team (SERT) subgrant funds through the
Florida Department of Emergency Management for equipment, supplies and training relating to
the City of Tamarac Community Emergency Response Team (CERT) program in an amount
not to exceed $15,000, and providing for acceptance of the award and execution of the grant
agreement upon approval of the application.

g. TR11670 - BROWARD SHERIFF'S OFFICE PERMIT APPLICATION FOR SPECIAL
DETAILS: Authorizing the appropriate City Officials to approve an expenditure in an amount
not to exceed $8,000 bringing the total amount to $52,900 in FY09 for a previously executed
Broward Sheriffs Office Permit Application for Special Details for police services to be used by
the Parks and Recreation Department.

Approving the Regional Interlocal Agreement (RILA) between the Sheriff of Broward County
and the City of Tamarac.
RESOLUTION NO. R2009-113
i. TR 11654 - AGREEMENT WITH POS IMPACT LLC: Authorizing the appropriate City
Officials to execute an agreement with POS Impact, LLC, for the provision of organizational
and Management development consulting services to the City of Tamarac for a one year
period at a cost not to exceed $75,000, providing for two additional one year renewals.
RESOLUTION NO. R2009-114
j. TR11668 VETERANS' PARK - GRANT ACCEPTANCE AND AGREEMENT:
Accepting a grant award in the amount of $48,584 from the Broward Boating Improvement
Program; authorizing the appropriate City Officials to execute an agreement between Broward
County and the City of Tamarac for the Veterans' Park Boat Ramp Project.
RESOLUTION NO. R2009-115
k. TR11675 RESTRICTIVE COVENANT: Approving a Declaration of Restrictive
Covenants on Lots 8-12, Block 4, Lyons Road Commercial as recorded in Plat Book 71, Page
1 of the public records of Broward County, Florida, to assign vested rights pertaining to transit
concurrency from the existing city -owned property to the future Temple Beth Torah property
(Case No. 20-MI-09).

7. TR 11672 - TAMARAC SQUARE PLAZA: Granting Limited Parking Waiver approval to
justify the shortage of nineteen (19) parking spaces when this site is fully occupied per parking
requirements stated in Section 24-581 of the City's Code of Ordinances for the Tamarac
Square Plaza project for the property located at 5201-99 North State Road 7 on the Southwest
corner of N.W. 53rd Street and State Road 7, (Case No. 10-Z-09); providing for conditions of
approval. Mayor Flansbaum-Talabisco suggested considering Items 7 and 8 on the agenda at
one time with separate motions and votes on each item. Commissioner DressleEse-conded by
Vice Mayor Atkins -Grad moved approval of TR11672. Assistant City Attorney Klahr read
TR11672 by title. City Clerk Swenson swore in those wishing to speak on the items.
Community Development Director Bramley gave a presentation and discussed the two
conditions of approval: all items in the site plan revision must be completed prior to issuance

of a certificate of occupancy for the new restaurant and there will be no outside seating or
outside music allowed for the restaurant. Commissioner Bushnell said she is delighted the
area will be fixed up as it will improve the corridor. Commissioner Dressler said 70% of all jobs
created in the United States are created by small business, and welcomed the restaurant to
Tamarac. Vice Mayor Atkins -Grad welcomed the restaurant to Tamarac. Glen Hanks, Civil
Traffic Engineer thanked the Mayor and City Commission for their kind comments. Mayor
Flansbaum-Talabisco welcomed the restaurant to Tamarac and opened the public hearing.
With no one wishing to speak, Mayor Flansbaum-Talabisco closed the public hearing for Items
7 and 8 on the agenda. On roll call Commissioner Dressler voted "yes", Commissioner
Glasser "yes", Commissioner Bushnell "yes", Vice Mayor Atkins -Grad "yes", and Mayor
Flansbaum-Talabisco "yes". Motion carried.
RESOLUTION NO. R2009-117
8. TR 11673 - WEST INDIAN AMERICAN RESTAURANT: Approving a Special Exception
to permit the operation of an accessory bar within a full service restaurant for the property
located at 5201 North State Road 7 specifically Parcel "3" of "Lembo" according to the Plat
thereof as recorded in the Plat Book 81, Page 11 of the public records of Broward County,
Florida and Parcel "A" of "Lembo Addition" according to the Plat thereof as recorded on Plat
Book 96, Page 46 of the public records of Broward County, Florida (Case No. 11-Z-09);
providing for conditions of approval. Vice Mayor Atkins -Grad seconded by Commissioner
Bushnell moved approval. Assistant City Attorney Klahr read Temporary Resolution 11673 by
title. On roll call Commissioner Glasser voted "yes", Commissioner Dressler "yes",
Commissioner Bushnell "yes", Vice Mayor Atkins -Grad "yes", and Mayor Flansbaum-Talabisco
"yes". Motion carried.
