HomeMy WebLinkAbout2009-09-09 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING CITY HALL - COMMISSION CHAMBERS WEDNESDAY SEPTEMBER 9, 2009 CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City Commission to order at 7:05 p.m. on Wednesday, September 9, 2009, in Chambers, at Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Patricia Atkins -Grad, Commissioner Pamela Bushnell, and Commissioner Harry Dressler ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Samuel S. Goren, and City Clerk Marion Swenson ABSENT: Commissioner Diane Glasser Commissioner Bushnell led the pledge of allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation to the Mayor and City Commission from Family Central, commending the City of Tamarac for coordinating the Interfaith Council Food Drive. b. Presentation of a proclamation by Mayor Flansbaum-Talabisco proclaiming September 2009 as "National Preparedness Month" in the City of Tamarac. C. Presentation by Mayor Beth Flansbaum-Talabisco of a proclamation proclaiming September 2009 as "National Alcohol and Drug Addiction Recovery Month". d. Presentation of Certificate of Appreciation to Mayor and City Commission from the Florida League of Cities in honor of the Tamarac University program. 2. REPORTS a. Commissioner Bushnell said it is the first time she has been involved in an interfaith council and it is enormously moving. She learned many children in Tamarac and other public schools have no food once the school year is over. She contacted the. Pastor from Calvary Chapel and within two days they delivered 250 bags of food. Commissioner Bushnell said she is also involving all the associations she can to recommend they collect food during their civic meetings once each month, and it is working out well. The Mayor and City Commission will be scheduling the district meetings and will talk about the food drive at those meetings also. Mayor Flansbaum-Talabisco added the Mayor and City Commission have discs of the video shown this evening and can get more from Community Christian Church to have at their disposal as they go through the community. b. Vice Mayor Atkins Grad said summer is officially over and she is struck with the sense of optimism throughout the community. At a breakfast of volunteers at Millennium Middle School, people were upbeat and want to have a successful year for the students. Homeowner Association group members are also putting forth positive energy to tackle the issues we all face. Vice Mayor Atkins -Grad participated on the Energy Environmental Committee for Broward Cities and she also serves on the Water Committee and the Green Cities Initiative. 1 The City received the Environmental Stewardship Award and at the AFUCIO dinner, Mayor Flansbaum-Talabisco received an award for outstanding leadership, which is well deserved. Mayor Flansbaum-Talabisco said she accepted this award on behalf of the City and acknowledged her colleagues. It was a proud moment. C. Commissioner Dressler said nothing is more gratifying than watching the video just shown; the highest privilege one can have is to come into public service and accomplish things that have a major impact on the people. Commissioner Dressler said as of 12:01 p.m. yesterday, he is considered reelected to another term as Tamarac City Commissioner and this is a great honor. Mayor Flansbaum-Talabisco congratulated Commissioner Dressler and said she could not be happier. Commissioner Dressler said the highest endorsement he can give is to Mayor Flansbaum-Talabisco and Vice Mayor Atkins -Grad who are the two hardest working people he knows, present company excluded. We have a professional team that works well together and it is a pleasure to work with his colleagues and staff on behalf of the citizens of Tamarac. d. Mayor Flansbaum-Talabisco agreed with Commissioner Dressler that the Mayor and City Commission work well together and have the common interests of the City at heart. To have the support of the entire commission is unprecedented. Mayor Flansbaum-Talabisco announced that 10 years ago tomorrow at 4:00 p.m., Jeffrey L. Miller was sworn in as Tamarac's City Manager. Mayor Flansbaum-Talabisco thanked City Manager Miller for 10 years of terrific service. Last Monday, August 31, Aging and Disability Research Center of Broward County held its first public hearing and Mayor Flansbaum-Talabisco came away learning so much about this entity and the services they offer to residents of Broward County. Tamarac is very supportive of the Agency,, and added she was appointed to the Board. 3. City Attorney Goren reported on the pending lawsuit with regard to SB360 and said 25 cities in the county have joined the suit, but Tamarac is not one of them. The last outgrowth of SB360 is with regard to extending permits and development orders. City administration and staff are carefully reviewing each case as it comes forward. Mayor Flansbaum-Talabisco asked if there is any benefit to Tamarac joining the lawsuit and City Attorney Goren explained the outcome of the matter is applicable to all cities and therefore it is not necessary for Tamarac to join in the suit. 4. City Manager Miller congratulated Commissioner Dressler on his reelection and said he looks forward to working with him for five more years. Parks and Recreation set the date for the opening of the new Recreation Center at University Drive for Saturday, October 11, 2009 at 10:00 a.m. Our partnership with the Tamarac Chamber of Commerce continues; the Taste of Tamarac will be held on Saturday, November 14, 2009 at the Tamarac Community Center. 5. There was no public participation. CONSENT AGENDA 6. City Manager Miller explained item 6(h) was discussed at Monday's workshop and the resolution is amended with regard to the date; the Health Fair Business Expo will be held on January 27, 2010. Commissioner Dressler seconded by Vice Mayor Atkins -Grad moved 2 approval of all items on the consent agenda. On roll call Commissioner Bushnell voted "yes", Vice Mayor Atkins -Grad "yes", Commissioner Dressler "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried. a. Approval of the August 26, 2009 Commission Meeting Minutes APPROVED b. TR11676 AWARDING BID NO. 09-1013: Authorizing the appropriate City Officials to execute an Agreement with Tran Construction, Inc., for the construction of the NW 50th Avenue Neighborhood Enhancement Project, beginning at West Commercial Boulevard along the east side of NW 50th Avenue continuing to the south side of NW 50th Street terminating at Rock Island Road in accordance with Bid No. 09-10b, for an amount not to exceed $129,748.00 from the appropriate accounts; authorizing budget amendments as needed for proper accounting purposes. RESOLUTION NO. R2009-119 C. TR11678 APPROVAL OF SHIP ANNUAL REPORTS: Approving the Annual Report for the State Housing Initiative Partnership for FY 2006/2007 and the Interim Reports for FY 2007/2008 and FY 2008/2009. RESOLUTION NO. R2009-120 d. TR11680 AUTHORIZING CHANGE ORDER NO. 2 TO STRAIGHTLINE ENGINEERING GROUP FOR INSTALLATION OF BOAT RAMP AT VETERANS PARK: Authorizing the appropriate City Officials to approve Change Order No. 2 to the Agreement with Straightline Engineering Group, Inc. for the renovation of the boat ramp at Veterans Park for an amount not to exceed $48,584 from the appropriate accounts; authorizing budget amendments as needed for proper accounting purposes. RESOLUTION NO. R2009-121 e. TR11685 FY 05/06 HOME INTERLOCAL AGREEMENT: Approving the Interlocal Agreement between the City of Tamarac and Broward County to provide for the City of Tamarac to be designated as a subrecipient for the HOME Consortium and for disbursement of $64,273.55 in HOME funds for Fiscal Year 2005-2006. RESOLUTION NO. R2009-122 f. TR11686 FY 2006-2007 HOME INTERLOCAL AGREEMENT: Approving the Interlocal Agreement between the City of Tamarac and Broward County to provide for the City of Tamarac to be designated as a subrecipient for the HOME Consortium and for disbursement of $111,670.20 in HOME funds for Fiscal Year 2006-2007. RESOLUTION NO. R2009-123 g. TR11681 FY2010 FMIT INSURANCE RENEWAL: Authorizing the renewal of General Liability, Automobile Liability, Automobile Physical Damage, Workers' Compensation, and Property lines of coverage with the Florida Municpal Insurance Trust (FMIT) for abne-(1)_year period beginning October 1, 2009 at a cost of $1,017,282 and payment of ajiy- increase resulting from the annual premium audit. RESOLUTION NO. R2009-124 h. TR11688 REQUESTS FOR WAIVER OF FEES AND IN -KIND SUPPORT TAMARAC CHAMBER OF COMMERCE: Approving requests from the Tamarac Chamber of Commerce for waiver of room rental fees for their health business expo, and waiver of all fees, and the provision of in -kind support for the Taste of Tamarac event. RESOLUTION NO. R2009-125 i. TR11690 2010 CENSUS: Affirming support for a partnership with the 2010 Census (Case No. 24-MI-09); providing for conditions of approval. 3 RESOLUTION NO. R2009-126 j. TR11682 ECONOMIC DEVELOPMENT PERMIT FEE WAIVER: A Resolution of the City Commission of the City of Tamarac, designating KSM Electronics, Inc.'s relocation to the Westpoint Centre at the Tamarac Commerce Park as an economic development project of the City of Tamarac; approving an economic development permit fee waiver not to exceed 15% of the total building permit fees up to $10,000; authorizing the appropriate City Officials to take all necessary actions to effectuate the intent of this resolution.
