HomeMy WebLinkAbout2006-10-11 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING CITY HALL CHAMBERS WEDNESDAY OCTOBER 11, 2006 CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City Commission to order at 7:05 p.m. on Wednesday, October 11, 2006 in Chambers at Tamarac City Hall, 7525 N.W. 88th Avenue, Tamarac, FL. PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Edward C. Portner, Commissioner Patte Atkins -Grad, Commissioner Marc L. Sultanof, and Commissioner Harry Dressler. ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Samuel S. Goren, and City Clerk Marion Swenson. Commissioner Marc L. Sultanof led the pledge of allegiance. Mayor Flansbaum-Talabisco welcomed School Board member Stephanie Kraft, Lori Plotnik (representing Representative Ari Porth) and Ms. Plotnik's daughter, Herb Hayes representing the president's council, Ralph Baer representing Senator -elect Jeremy Ring, and members of the community. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming October 2006 as "Breast Cancer Awareness Month" in the City of Tamarac. (Requested by Crystal D. Swann, Assistant Executive Director of the U.S. Conference of Mayors) Mayor Flansbaum-Talabisco said while breast cancer in men is not widely talked about, it is not swept under the rug, and men should be aware of the possibility of breast cancer. b. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming October 2006 as "Arts and Humanities Month" in the City of Tamarac. (Requested by Robert L. Lynch, President and CEO, Americans for the Arts and The Honorable Mufi Hannemann, Mayor of Honolulu, Chair of Tourism, Arts, Parks, Entertainment and Sports Committee) C. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming October 2006 as "National School Lunch Week" in the City of Tamarac. (Requested by Dr. Frank Till, Superintendent of Schools) School Board Member Stephanie Kraft said she appreciates the opportunity of accepting the proclamation on behalf of Broward County Schools. The healthy lunch program is nationally recognized and many foods are being replaced with healthy choices. Mrs. Kraft invited the Mayor and City Commission to come to local schools to lunch with the students and faculty. Mrs. Kraft said with regard to the proclamation for Arts and Humanities Month, Taravella High October 11, 2006 Page 1 of 9 School has a tremendous drama program, with student run and organized productions. There are many other arts programs in our schools of which we can be very proud. Mrs. Kraft said she appreciates the Mayor and City Commission's support of schools in this area. Vice Mayor Portner asked if trans fats are being eliminated from school lunches and Mrs. Kraft said they are. Mayor Flansbaum-Talabisco added the City of Tamarac had formed a partnership with the schools in Tamarac and Taravella High School and several times during the year the students' art is exhibited in City Hall. d. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming October 8-14, 2006 as "Fire Prevention Week" in the City of Tamarac. (Requested by Fire Chief Jim Budzinski) Fire Chief Budzinski accepted and thanked the Mayor and City Commission for the proclamation. Fire Chief Budzinski said statistics in Tamarac are higher than national statistics and Y2 of the structure fires are caused or begin in kitchens. Many can be prevented by moving things away from the stove and attending to what it is we are heating. Fire Chief Budzinski invited everyone to attend the Fire Open House on October 14t' beginning at 10:00 a.m. at Fire Station 41. There will be seat safety checks for children and infants, displays behind the station, and tables for emergency management and response agencies as well as city departments. 2. City Commission: Mayor Flansbaum-Talabisco said Saturday morning she was at Vanguard Village where 'Neighbors Assisting Neighbors' and members of the Christian Community Church were helping rehabilitate a home damaged by the storm. The church, which is being constructed on Nob Hill Road and Commercial Boulevard, has promised to be a good community partner, and they are working with Tamarac residents in Vanguard Village and Mainlands 8, along with 'Neighbors Assisting Neighbors' in rehabilitation programs. Members of the Church will begin meeting their new neighbors in Plum Bay Plum Harbor and the members of the church have assured Mayor Flansbaum-Talabisco that when another hurricane hits Tamarac they will help in any way they can. Mayor Flansbaum-Talabisco said she attended a meeting in District 4 last evening, at Westwood 17, with 25 people in attendance. It was a positive and productive meeting, and Mayor Flansbaum-Talabisco received an e-mail today, which she read into the record (incorporated herein and made a part of these minutes) commending the City on its services. Mayor Flansbaum-Talabisco reported the Florida Special Needs Color Guard will participate in the Macy's Day Parade, and they are going to be on the Polar Float with Santa Claus. The Color Guard is very excited about this and they are raising money for their trip to New York. Vice Mayor Portner had no report at this time, but said he would provide two written reports to the Mayor and City Commission within 10 days, on conferences he attended in Colorado Springs, CO and Austin, TX. Vice Mayor Portner said for years he has wanted to take a train ride and he did get the opportunity to ride AmTrak from Chicago to Texas. Trains are not what they used to be, but the scenery was fabulous. Vice Mayor Portner said when he arrived in Texas there were several areas where cattle were grazing and there was one lone cowboy watching the cattle; Vice Mayor Portner said he envied the cowboy; as a child he wanted to be either a fireman or a cowboy. October 11, 2006 Page 2 of 9 Mayor Flansbaum-Talabisco said as much as Tamarac is represented locally, it is also represented throughout the country. Mayor Flansbaum-Talabisco traveled to Washington, Commissioner Dressler to Pennsylvania and Nevada, Commissioner Atkins -Grad was in Orlando, and Commissioner Sultanof spends much of his time in his District and in Kings Point, where he attends to his constituents. Everyone shares what they have learned when they return from their trips, and Mayor Flansbaum-Talabisco said she looks forward to Vice Mayor Portner's reports. Commissioner Atkins -Grad reported on the many meetings she has attended with homeowner associations and the schools. Commissioner Atkins -Grad said she reads to second grade students, which is wonderful and exciting. Commissioner Atkins -Grad has received many calls for assistance from her constituents and it is very important to her to be able to help people. Commissioner Sultanof said the Special Needs Color Guard will be representing Tamarac, and this is a great honor for us. Commissioner Sultanof said he is on the MPO and a while back reported that $8.7 million in government money for 2006, 2007, 2008, and 2009 will be available. This money is starting to move and will be used for landscaping throughout the city wherever possible. Commissioner Sultanof said the turnpike widening, from six to eight lanes, will take place in 2007 and 2008. We are fortunate money has been allocated to us and we will take advantage of everything that comes our way. Commissioner Sultanof said it is very important to vote or Florida will not be retained as a point of reference throughout the country. Florida is a pivotal state and we must take it back and make it a blue state so we will have the opportunity to do something for the presidential election. Commissioner Sultanof complimented staff with accolades from District 3 for public works, utilities and building/code compliance. Commissioner Dressler said he represented the City of Tamarac at two national level educational forums, the Advanced Investment Certification Program at Wharton School in Philadelphia, PA, and, at the International Federation that provides ongoing education for pension fund Trustees, he attended the Pension Trustee Certification Program. Tamarac as well as other cities, is facing significant challenges regarding the Pension Protection Act of 2006. This Act is designed to make sure employee pensions are properly funded, and this is a complex and challenging process. Both seminars were extremely successful and hopefully what he learned will help Tamarac address issues in the future. Commissioner Dressler reported on his attendance at the Tamarac Elementary School PTA meeting and on behalf of himself and the Mayor and City Commission, thanked the parents for getting involved in the education process for their children. Commissioner Dressler said he attended a breakfast meeting of the Chamber of Commerce and they are doing a fabulous job of bringing vibrancy to the small business community. Attendance at this meeting was tremendous, and Commissioner Dressler reminded everyone the Taste of Tamarac would take place soon. Commissioner Dressler said he is on the Broward League Advocacy Committee and Tamarac's voice is heard both at the Broward and Florida Leagues, October 11, 2006 Page 3 of 9 3. City Attorney: City Attorney Goren said when Temporary Resolution 11085 regarding Annexation is added to the consent agenda he would discuss the timing with the Mayor and City Commission. 4. City Manager: City Manager Miller said the City of Tamarac is a member of the Innovation Group, which started with about eight cities and now has a membership of thousands of cities. A recently published article, regarding our strategic alliance with the Chamber of Commerce and economic development, was written by Economic Development Officer Bems and Management Analyst Hughes. Copies are available in the rear of the Chambers. Community Development reports the rehabilitation/purchase assistance program opened for new applicants as of October 1. Financial Services reports the adopted budget is available on the website. Parks and Recreation reports a seminar on how to deal with contractors will be held on October 17 at 6:30 p.m. in the Tamarac Community Center. Broward County will have the use of one of the City's conference rooms three times a week to network with displaced residents. The Southgate Gardens Support Group meets the 1 st Wednesday of each month. University Hospital expects a shipment of flu shots and will disburse them in November. The Tamarac Twilight Concert Series continues with a concert Friday evening at Sunset Point Park. Applications are available for the Turkey Trot and 48 vendors signed up for the Community Garage Sale. PUBLIC PARTICIPATION 5. Burton Schneider, 8016 NW 72 Street reported the Woodmont Board has agreed not to oppose the proposed resort and condominiums as long as there can be assurances the resort will come first and as part of the negotiations for the resort, golf courses will be included for a specified number of years. Commissioner Dressler thanked Mr. Schneider for sharing his communities' views with the Mayor and City Commission and staff. Commissioner Dressler said when he ran for office, people asked him why he was campaigning and he said he wanted to give something back and make a difference and represent the will of the people; he values what the community thinks. Mayor Flansbaum-Talabisco said the way Mr. Schneider presented himself to the Mayor and City Commission speaks volumes to how we communicate; it was not contentious, and it means the world to the success of the Board and Tamarac. Mayor Flansbaum-Talabisco added Mr. Schneider's community is vitally important and there are two beautiful golf courses as well as the club, and the Mayor and City Commission will do everything they can to maintain the integrity and vitality of the community. Patti Lynn, 6411 NW 58 Street, Tamarac, said the Tamarac Theater of Performing Arts has a scholarship program for young children and they are requesting assistance for the scholarships in the amount of $150.00 each. Ms. Lynn said people are unhappy with regard to the Sabal Palm and Monterey matters and spoke of open space. Ms. Lynn spoke in opposition to the Tamarac referendum that will appear on the November ballot. Mayor Flansbaum-Talabisco asked City Attorney Goren to clarify the referendum for the audience. City Attorney Goren said the Mayor and City Commission looked at various options and this option provides for staggered terms, extending terms to coincide with October 11, 2006 Page 4 of 9 County and State elections, and saving money the City would have to spend for stand alone elections in March, consistent with the Special Act for Broward County. Commissioner Dressler said any assumption that the referendum would not save the City money is wrong. Vice Mayor Portner said Ms. Lynn needs to understand that growth in this country is tremendous, he understands Ms. Lynn's concern about green space, and change is inevitable. Vice Mayor Portner said he has lived in Tamarac for 32 years and seen it grow from 22,000 people. People want to come here and there will be building and redevelopment. Vice Mayor Portner suggested Ms. Lynn look to other problems that need solving. Commissioner Sultanof said within the next 12-20 years there will be an additional 1.6 million people in Broward County and there will have to be redevelopment to accommodate these people. If there is no change, society will suffocate. Commissioner Dressler said we need to have diverse opinions. This Mayor and City Commission and staff are activists for green space, water quality and air quality. The issue is not one group for and another against; the real question is change is inevitable; not how to try to stop something but rather how well it is managed. This Mayor and City Commission cares about the focus on qualify of life and it is a challenge to find solutions for those who work and live in this City. When we look back three to five years from now, we will see how the City addressed the issue of building parks and providing recreational facilities for the changing demographics. Mayor Flansbaum- Talabisco said she can sum this up in two words, 'smart growth'. This is an issue the board and staff are faced with and it is up to the Mayor and City Commission with input from the residents to decide what is the best approach going forward. We must do what is best for each district and make the best possible decisions. CONSENT AGENDA 6. Commissioner Sultanof seconded by Commissioner Dressler moved the addition of TR11084 to the consent agenda as item 6(I). TR11084, urging the State Legislature to adopt legislation providing for a one dollar ($1.00) increase in the State of Florida minimum wage. On roll call Commissioner Sultanof voted "yes", Commissioner Atkins - Grad "yes", Mayor Flansbaum-Talabisco "yes", Commissioner Dressler "yes", and Vice Mayor Portner "yes". Motion carried. City Attorney Goren said before a motion is made to add Temporary Resolution 11085 to the consent agenda he wished to clear up any misinterpretation of his discussion during Monday's presentation and explain the timing on annexation. Voluntary and involuntary annexation methods are parallel paths. We do not have control over the legislature and there is no guarantee our Bill will be adopted during this session. If it is not then the March 2007 Bill adoption and September 2007 effective dates will have to be moved up to adoption in March 2008 and annexation effective in September 2008. Commissioner Sultanof seconded by Commissioner Atkins -Grad moved the addition of TR11085 to the consent agenda as item 6(m). TR11085, authorizing the City Manager to file a local Bill with the Broward County Legislative Delegation to extend and enlarge the corporate limits of the City of Tamarac; requesting the local legislative delegation to hold a public hearing to consider approval of the local Bill in order to forward the local October 11, 2006 Page 5 of 9 Bill to the State of Florida Legislature for consideration during the 2007 legislative session. On roll call Commissioner Atkins -Grad voted "yes", Mayor Flansbaum- Talabisco "yes", Commissioner Dressler "yes", Vice Mayor Portner "yes", and Commissioner Sultanof "yes". Motion carried. Commissioner Dressler seconded by Commissioner Sultanof moved approval of all items on the consent agenda. On roll call Mayor Flansbaum-Talabisco voted "yes", Commissioner Dressler "yes", Vice Mayor Portner "yes", Commissioner Sultanof "yes", and Commissioner Atkins -Grad "yes". Motion carried. a. FIRST AMENDMENT TO SITE LEASE AGREEMENT - NEXTEL COMMUNICATIONS — SPORTS COMPLEX: (TR11039) Executing a first amendment to the Communications Site Lease Agreement with Nextel Communications to lease additional ground space at a cost of $350 per month, for the installation of a 60 KW propane generator at the cell tower site located at the Sports Complex. RESOLUTION NO. R2006-188 d. FIRST AMENDMENT TO SITE LEASE AGREEMENT - SPRINT SPECTRUM LP — WATER TREATMENT PLANT PROPERTY: (TR11037) Executing first amendment to the Communications Site Lease agreement with Sprint Spectrum LP to lease additional ground space at a cost of $350 per month, for the installation of a 30 KW propane generator at the cell tower site located at the water treatment plant property. RESOLUTION NO. R2006-189 e. FIRST AMENDMENT TO WATER AND SEWER DEVELOPER'S AGREEMENT — GOLFVIEW TOWNHOMES PROJECT: (TR11045) Executing a First Amendment to the Water and Sewer Developer's Agreement with 8400 McNab LLC, for the Golfview Townhomes Project, located at 8400 McNab Road, requiring payment of $22,400.00 in CIAC fees; ERC's; authorizing and directing the City Clerk to record said agreement in the public records of Broward County. RESOLUTION NO. R2006-190 f. TASK AUTHORIZATION NO. 06-08E — MATHEWS CONSULTING. INC. — DESIGN, PERMITTING, AND BIDDING FOR MAIN STREET INFRASTRUCTURE IMPROVEMENTS — PHASE 1: (TR11061) Executing Task Authorization No. 06-08E with Mathews Consulting, Inc., to provide professional services for the design, permitting, and bidding for the Main Street Infrastructure Improvements - Phase 1 along NW 57th Street from 94th Avenue to Pine Island Road and along 91St Avenue from NW 57th Street to Commercial Boulevard, in accordance with the City's Consulting Engineering Agreement as authorized by Resolution #R-2006-131, for an amount not to exceed $331,846.00; approving funding from the appropriate budgeted General Fund, October 11, 2006 Page 6 of 9 Stormwater Fund, and Utilities Operational and CIAC accounts; authorizing the appropriate city officials to administer the contract. RESOLUTION NO. R2006-191 g. CHANGE ORDER — EMERGENCY PURCHASE ORDER WITH RW BECK, INC. FOR DISASTER RECOVERY SERVICES: (TR11075) Executing Change Order Number 1 to the emergency purchase order with RW Beck, Inc. for Disaster Recovery Services following Hurricane Wilma; authorizing an additional expenditure in an amount not to exceed $65,000 for said purpose; authorizing budget amendments for proper accounting purposes. RESOLUTION NO. R2006-192 h. FIRST AMENDMENT TO WATER AND SEWER DEVELOPER'S AGREEMENT — FOUNTAINS PROFESSIONAL CENTER PROJECT: (TR11067) Executing a First Amendment to the Water and Sewer Developer's Agreement with Fountains Professional Center, L.L.C., for the Fountains Professional Center Project, formerly known as the Fountains Corporate Center, located on the northeast comer of West Commercial Boulevard and NW 62"d Avenue, providing for a reduction of 2.5 ERC's for water and sewer resulting in 18.9 ERC's from 21.4 ERC's; authorizing and directing the City Clerk to record said agreement in the Public Records of Broward County. RESOLUTION NO. R2006-193 i. FIRST AMENDMENT — PCS SITE LEASE AGREEMENT - SPRINT SPECTRUM L.P. — CITY HALL PROPERTY: (TR11074) Executing first amendment to the PCS Site Lease Agreement with Sprint Spectrum L.P., to amend the height of the existing antennas from one hundred and fifteen feet to a new elevation of eighty feet, on the cell tower site located at 7525 NW 88th Avenue. RESOLUTION NO. R2006-194 j. BROWARD COUNTY CHALLENGE GRANT PROGRAM FUNDS — TAMARAC SPORTS COMPLEX: (TR11072) Accepting an award from the Broward County Challenge Grant Program in the amount of $300,000; authorizing the appropriate City officials to execute an agreement between the City of Tamarac and Broward County for Broward County Challenge Grant Program funds for the Tamarac Sports Complex in the amount of $300,000 providing for a cash match in local funds from the capital improvement budget for development of the Tamarac Sports Complex. RESOLUTION NO. R2006-195 k. BROWARD SHERIFF'S OFFICE PERMIT APPLICATION FOR SPECIAL DETAILS: (TR11073) Executing a Broward Sheriffs Office Permit Application for. Special Details for Police Services to be used by the Parks and Recreation department in an amount not to exceed $72,200 in FY07; approving funding from the appropriate Parks and Recreation accounts. RESOLUTION NO. R2006-196 I. URGING ADOPTION OF LEGISLATION PROVIDING FOR A ONE DOLLAR ($1.00) INCREASE IN THE MINIMUM WAGE: (TR11084) Urging the State Legislature to adopt legislation providing for a one dollar ($1.00) increase in the State of Florida minimum wage. RESOLUTION NO. R2006-197 October 11, 2006 Page 7 of 9 M. AUTHORIZING CITY MANAGER TO FILE LOCAL BILL WITH BROWARD COUNTY LEGISLATIVE DELEGATION TO EXTEND AND ENLARGE CORPORATE LIMITS OF THE CITY OF TAMARAC: (TR11085) Authorizing the City Manager to file a local Bill with the Broward County Legislative Delegation to extend and enlarge the corporate limits of the City of Tamarac; requesting the local legislative delegation to hold a public hearing to consider approval of the local Bill in order to forward the local Bill to the State of Florida Legislature for consideration during the 2007 legislative session. RESOLUTION NO. R2006-198 END OF CONSENT AGENDA REGULAR AGENDA ORDINANCES — FIRST READINGS 7. AMENDING CHAPTER 10 OF THE TAMARAC CODE — ADDING SECTION 10- 226 ENTITLED, "STORMWATER MANAGEMENT": (TO2123) Motion to adopt Ordinance on first reading amending Chapter 10 of the City Code of Ordinances entitled, "Land Development Regulations", by amending Article V entitled, "Improvements", by amending Division 4 entitled, "Drainage", by adding Section 10-226 entitled, "Stormwater Management", as required by the National Pollution Discharge Elimination System permit; providing for codification. City Attorney Goren read Temporary Ordinance 2123, Revision #1, on first reading by title. Commissioner Sultanof seconded by Commissioner Dressler moved approval. Mayor Flansbaum- Talabisco opened a public hearing on this item and with no one wishing to speak, closed the public hearing. On roll call Commissioner Dressler voted "yes', Commissioner Sultanof "yes", Vice Mayor Portner "yes", Commissioner Atkins -Grad "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried. ADOPTED ON FIRST READING OCTOBER 11, 2006 8. AMENDING CHAPTER 13 OF THE TAMARAC CODE — SEXUAL OFFENDER RESIDENCY PROHIBITION FINDINGS AND INTENT: (TO2125) Motion to adopt ordinance on first reading amending Chapter 13 of the City of Tamarac Code of Ordinances by specifically amending Section 13-20, entitled "Sex offender residency prohibition findings and intent," Section 13-21, entitled "Definitions," Section 13-22, entitled "Sexual offender and sexual predator residence prohibition; penalties; exceptions," and Section 13-23, entitled "Property owners prohibited from renting real property to certain sexual offenders and sexual predators; penalties;" providing for definitions of "sexual offender" and "sexual predator" that are consistent with Section 943.0435, Florida Statutes, and Section 775.21, Florida Statutes; providing for law enforcement guidelines; providing a timeframe in which a sexual offender or sexual predator must vacate a premises after being notified of a violation; providing for codification. City Attorney Goren read Temporary Ordinance 2125 on first reading by title. Commissioner Sultanof seconded by Commissioner Atkins -Grad moved approval. Mayor Flansbaum-Talabisco asked for clarification of the ordinance and City Attorney Goren said the ordinance is an outgrowth of occurrences during the last session in Tallahassee, where the definitions of sexual offender and sexual predator were October 11, 2006 Page 8 of 9 modified. This ordinance reflects and embraces the change in State law and is in no way a reaction to a problem or Tamarac having done something incorrectly. The ordinance also addresses notice to vacate premises. Mayor Flansbaum-Talabisco opened a public hearing on the ordinance. Patti Lynn, 6411 NW 58 Street asked for clarification on 'know or should have known'. City Attorney Goren said there is a website available, to which BSO also has access, and it puts the burden on the owner or manager to know to whom they are renting. Joel Davidson, 4608 Norfolk Island, Tamarac, questioned the time frame. BSO Chief Dugger said this ordinance provides for two weeks once notification of violation is given. Mayor Flansbaum-Talabisco closed the public hearing. On roll call Mayor Flansbaum-Talabisco voted "yes", Commissioner Dressler "yes", Commissioner Sultanof "yes", Vice Mayor Portner "yes", and Commissioner Atkins -Grad "yes". Motion carried. ADOPTED ON FIRST READING OCTOBER 11, 2006 PUBLIC HEARINGS 7:00 P.M. OR THEREAFTER ORDINANCES — SECOND READINGS There were no ordinances scheduled for this meeting for second reading. QUASI-JUDICIAL HEARINGS There were no quasi-judicial items scheduled for this meeting. First of all the sidewalks on 70th Avenue have made walking a safe and enjoyable activity for the community and myself. Previous to the sidewalks, 70th Avenue was too dangerous to walk on therefore limiting the area we could cover during our walks. Now we can traverse the neighborhoods for a longer more enjoyable walk. Personally, now, I can walk to my aging mothers neighborhood which is catty cornered to mine and check on her welfare without having to drive there. As a full time working person I especially enjoy the extended hours of the library. I work in Miami and often do not return until 6 PM. Now there are evenings where I can stop by the library on my way home as well as Sundays which are my favorite day to go to the Iibrary.It is important that us working people also have access to our resources.
