HomeMy WebLinkAbout2009-10-14 - City Commission Regular Meeting MinutesE 1 1 CITY OF TAMARAC REGULAR CITY COMMISSION MEETING CITY HALL - COMMISSION CHAMBERS WEDNESDAY OCTOBER 14, 2009 CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City Commission to order at 7:00 p.m. on Wednesday, October 14, 2009 in Chambers, Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL 33321. PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Patricia Atkins -Grad, Commissioner Pamela Bushnell, Commissioner Diane Glasser, and Commissioner Harry Dressler. ALSO PRESENT: City Manager Jeffrey L. Miller, Assistant City Attorney Julie Klahr, and City Clerk Marion Swenson. PLEDGE OF ALLEGIANCE: Commissioner Glasser led the pledge of allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a proclamation by Mayor Beth Flansbaum-Talabisco proclaiming October 24, 2009 as "350.org Day". (Requested by Valerie J. Amor, US Green Building Council, Programs Chair, Broward Branch, South Florida Chapter) b. Presentation of a proclamation by Mayor Beth Flansbaum-Talabisco proclaiming October 2009 as "Fire Prevention Month". (Requested by Interim Fire Chief Jeff Moral) c. Presentation of a proclamation by Mayor Beth Flansbaum-Talabisco proclaiming October 14, 2009 as "Maria Londono Day". (Requested by Commissioner Harry Dressler) d. Presentation of a proclamation by Mayor Beth Flansbaum-Talabisco proclaiming October 18 - 24, 2009 as "Florida City Government Week". (Requested by City Manager Jeffrey L. Miller) City Manager Miller said over the past few years, as resources have become scarcer, we have forged new partnerships and he thanked the Mayor and City Commission for taking the lead in this area. 2. REPORTS: City Commission a. Commissioner Bushnell acknowledged Floyd Bass who was in the audience and who had agreed to serve as Commissioner Bushnell's legislative aide to help with partnerships on the east side of Tamarac. Commissioner Bushnell said the next Commission meeting will mark one year that she has served on the Commission. Commissioner Bushnell reported on the three-day seminar she attended for newly elected officials, and said she has attended many community meetings and association meetings over the past weeks. The District 1 meeting will be held next Tuesday. b. Vice Mayor Atkins Grad said she has been very busy attending community meetings. c. Commissioner Glasser reported she will attend the BLC meeting tomorrow evening and she has kept up with her constituents over the past weeks while she was under the weather. d. Mayor Flansbaum-Talabisco said she has covered the City from the Sawgrass Expressway on the west to Prospect Road on the east, attending homeowner and condominium association meetings, as well as religious organization meetings with her colleagues, and the residents are thrilled to see the Mayor and City Commission out working together. Mayor Flansbaum-Talabisco reported that INTEL Direct, a business located in both Tamarac and Miami, will add 50 more jobs to the Tamarac location, which directly impacts our economic development. 3. Assistant City Attorney Klahr had no report. 4. City Manager Miller said the City received notification from the Broward County Environmental Protection and Growth Management Department that our funding application for solar safety lighting and Water's Edge Park has been granted; a total of $144,400. City Manager Miller said he would let the Mayor and City Commission know when the application appears on the County Commission agenda. Tamarac Fire Department reports the first week in October fire staff visited several local schools to deliver safety information. Free seasonal flu shots will be available October 15th at the Tamarac Community Center from 10:00 a.m. — 1:00 p.m. Proof of residency is required. The public is invited to join the Mayor and City Commission for a ribbon cutting ceremony at the new Multi Purpose Recreation Center on Saturday, October 17th from 10:00 a.m. — 1:00 p.m. Approximately 200 people were in attendance at the Caporella Aquatic Center Open House. The Tamarac Community Center will host classes in "A matter of Balance" in conjunction with the Aging Resource Center. The classes will instruct people on how to handle falls. Mayor Flansbaum-Talabisco added Horizon Bay is a vibrant community and they are interested in coming to the Caporella Aquatic Center for swimming. They are also interested in becoming part of the food drive and they would like to see the Parks and Recreation Video. 5. PUBLIC PARTICIPATION: There was no public participation 6. CONSENT AGENDA: Assistant City Attorney Klahr read Temporary Resolution 11712 by title. TR11712: A Resolution of the City Commission of the City of Tamarac, Florida, recognizing the importance of commuter rail as a critical component of regional and statewide mass transit; urging the Florida legislature to impose a two dollar and 00/100 ($2.00) per day surcharge on rental cars throughout the state to fund commuter rail transit; authorizing members of the City Commission, in their official capacity, to sign petitions supporting use and funding of commuter rails; directing the City Clerk to transmit a copy of this Resolution to the Governor, the members of the Florida legislature, the Board of County Commissioners for Broward County, and the Broward League of Cities; providing for conflicts; providing for severability; and providing for an effective date. Commissioner Dressler seconded by Vice Mayor Atkins -Grad moved the addition of TR11712 to the consent agenda as Item 6(f). On roll call Vice Mayor Atkins -Grad voted "yes", Commissioner Glasser "yes", Commissioner Dressler "yes", Commissioner Bushnell "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried. Vice Mayor Atkins -Grad seconded by Commissioner Bushnell moved approval of all items on the consent agenda. TR11706 Appointing Floyd Bass as Legislative Aide to Commissioner Pamela Bushnell. RESOLUTION NO. R2009-139 d. TR11698 Authorizing the appropriate City Officials to execute an Interlocal Agreement between the City of Tamarac and Broward County to provide cost share support of a NatureScape Irrigation Service to be operated by Broward County with the City of Tamarac water utility service areas and authorize Broward County to conduct specific technical activities required as part of landscape and irrigation system evaluations to be performed by Broward County Environmental Protection Department; providing for the City's cost share support of the NatureScape Irrigation Service. RESOLUTION NO. R2009-140 e. TR11699 Authorizing the appropriate City officials to grant a Waiver of Fees in the amount of $1,558.90 and extend the hours of operation to 11:00 p.m. on Thursday, November 5, 2009, and to 11:00 p.m. on Friday, November 6, 2009, and Saturday, November 7, 2009, and approve the sale of alcoholic beverages for the Saint Malachy Catholic Church Carnival, located at the Northeast corner of NW 61 st Street and University Drive, during the operation of the Saint Malachy Catholic Church Annual Carnival beginning Thursday, November 5, 2009 and ending Sunday, November 8, 2009; Case No. 25-MI-09; providing for conditions of approval. RESOLUTION NO. R2009-141 f. RESOLUTION NO. R2009-142 END OF CONSENT AGENDA Commissioner Bushnell acknowledged Hubert Klombers, who was in the audience, and said Mr. Klombers will be honored at Pioneer Days this Saturday. The event will be held in Hallandale Beach. REGULAR AGENDA -. ORDINANCE(S) — FIRST READING Assistant City Attorney Klahr read T02182 on first reading by title. T02182 An Ordinance of the City of Tamarac, Florida, amending Chapter 2 of the City's Code of Ordinances, entitled "Administration", by specifically creating Article II, Section 2-35, to be entitled "Vacancy in Candidacy for Member of City Commission"; providing a mechanism for filling a vacancy in candidacy for the City Commission pursuant to Section 166.031, F.S; providing for Page 3 of 4 City Commission Regular Meeting October 14, 2009 codification; providing for conflicts; providing for severability; and providing for an effective date. Vice Mayor Atkins -Grad seconded by Commissioner Glasser moved the addition of TO 2182 as Item 7 on the regular agenda. On roll call Vice Mayor Atkins -Grad voted "yes", Commissioner Glasser "yes", Commissioner Dressler "yes", Commissioner Bushnell "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried. 7 T02182: Motion to adopt Ordinance of the City of Tamarac, Florida, on first reading amending Chapter 2 of the City's Code of Ordinances, entitled "Administration", by specifically creating Article II, Section 2-35, to be entitled "Vacancy in Candidacy for Member of City Commission"; providing a mechanism for filling a vacancy in candidacy for the City Commission pursuant to Section 166.031,F.S; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. Commissioner Dressler seconded by Vice Mayor Atkins -Grad moved adoption. On roll call Commissioner Glasser voted "yes", Commissioner Dressler "yes", Commissioner Bushnell "yes", Vice Mayor Atkins -Grad "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried.
