HomeMy WebLinkAbout2006-10-25 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING CITY HALL CHAMBERS WEDNESDAY OCTOBER 25, 2006 CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City Commission to order at 9:00 a.m. on Wednesday, October 25, 2006 in Chambers at Tamarac City Hall, 7525 N.W. 88th Avenue, Tamarac, FL. PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Edward C. Portner, Commissioner Patte Atkins -Grad, Commissioner Marc L. Sultanof, and Commissioner Harry Dressler. ALSO PRESENT: City Manager Jeffrey L. Miller, Assistant City Attorney Julie Klahr, and City Clerk Marion Swenson. Commissioner Dressler led the pledge of allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation by Mayor Flansbaum-Talabisco proclaiming October 28, 2006 as "National Make A Difference Day" in the City of Tamarac. (Requested by Marcia Bullard, President and CEO, USA Weekend Magazine) Mayor Flansbaum-Talabisco read the proclamation into the record and said Tamarac engages volunteers and volunteer programs, and neighbors help neighbors in our city. b. Presentation by Mayor Flansbaum-Talabisco of a proclamation proclaiming October 25, 2006 as City Government Day. (Requested by City Manager Jeffrey L. Miller) Mayor Flansbaum-Talabisco read the proclamation into the record and recognized the students present from Piper High School. The students accepted the proclamation. C. Presentation by John Pryor of the GFOA Distinguished Budget Award to the Financial Services Department. (Requested by Financial Services Director Chapman) Financial Services Director Chapman and Management and Budget Officer Sammartino accepted. Mr. Pryor said it is an honor to present the City of Tamarac with this award, which is a significant accomplishment, as less than 1,000 cities receive this award throughout the United States and Canada. This is the 9th year in a row that Tamarac has been honored. Financial Services Director Chapman thanked staff who put in many hours working on the budget, as well as the City Manager's office for their leadership which made it possible for us to produce such a quality document. d. Presentation by Mayor Flansbaum-Talabisco of a proclamation commending Suzanne Johnston for performing an unselfish act of heroism. (Requested by Mayor Flansbaum-Talabisco) Mayor Flansbaum-Talabisco read the proclamation into the record and said this is but one example of how we can help each other. October 25, 2006 Page 1 of 7 e. Presentation by Mayor Flansbaum-Talabisco of a proclamation congratulating Mary A. Egan on the celebration of her 1015t birthday. (Requested by Vice Mayor Edward C. Portner) Mayor Flansbaum-Talabisco read the proclamation into the record and Floyd Bass accepted on behalf of Mary A. Egan. Mayor Flansbaum-Talabisco said Mr. Bass is a Community Patriot. Mr. Bass thanked everyone on behalf of Mary Egan. f. Presentation by Mayor Flansbaum-Talabisco of a proclamation commending and congratulating Tamarac Fire Rescue upon receipt of the "2005 Life Safety Achievement Award". (Requested by Fire Chief Jim Budzinski) Mayor Flansbaum-Talabisco read the proclamation into the record and Fire Chief Budzinski accepted and encouraged residents and business owners to continue their vigilance. Fire Chief Budzinski explained the Fire Inspectors try to ensure the businesses and residents are safe and it has been over 10 years since there has been a loss of life in Tamarac from a structural fire. This proclamation corresponds to Fire Prevention Week, and Fire Chief Budzinski encouraged everyone to 'watch what you heat', not leave a stove unattended, and to check smoke detectors to make sure they are operating properly. g. Presentation by Mayor Flansbaum-Talabisco of Employee Service Awards: 5-Year Awards: Eduardo Benitez, Transportation Supervisor, Parks & Recreation; Rey Cabal, Mechanic II, Utilities; Michael Cernech, Deputy City Manager, City Manager; Cynthia Martin, Office Specialist, Public Works; Alisha Pingol, Lieutenant 6, Fire Rescue; Julio Ruiz, Building Maintenance Tech, Parks & Recreation; Thomas Sheridan, Fire Division Chief, Fire Rescue 15-Year Award: Lillian Pabon, Records Coordinator, City Clerk 20-Year Awards: Denise Krapf, Customer Service Rep II, Finance; Nancy Wilson, Administrative Coordinator, Parks & Recreation 2. City Commission: Mayor Flansbaum-Talabisco welcomed Piper High School students and said she hoped any student who chooses to work in government has the privilege of working with a Commission and staff like Tamarac's, which is of the highest caliber, very helpful and professional. Economic Development Officer Berns had an article published in the IG Newsletter, entitled "Meeting the Needs of the Business Community Through Strategic Alliances". Mayor Flansbaum-Talabisco acknowledged Lori Plotnick, representing Representative Ari Porth. Mayor Flansbaum-Talabisco reported she was interviewed by people from Fuji Television News, which is similar to the Today Show. Mayor Flansbaum-Talabisco congratulated Commissioner Dressler and read into the record a certificate Commissioner Dressler recently received from the University of Pennsylvania, Wharton School for completion of the Public Pension Trust program (a copy of the certificate is incorporated herein and made part of these minutes.) Mayor Flansbaum-Talabisco said this is an example of the Commission being out in the public, learning and representing Tamarac. Vice Mayor Portner said this morning one of Tamarac's oldest citizens was honored. Vice Mayor Portner said he represents District 1 which is the 'oldest' area in Tamarac (45 years) and 'youngest' area in Tamarac providing the most affordable homes in the October 25, 2006 Page 2 of 7 City. Vice Mayor Portner urged the students to vote when they reach 18 years of age. Vice Mayor Portner said he was so excited to be able to vote for the president when he came of age. Vice Mayor Portner said public service is by far the greatest service one can give to the community and the country, and as a history buff recommended reading the biographies of George Washington, John Adams, Thomas Jefferson, and Ben Franklin. Vice Mayor Portner quoted Ben Franklin, who said on his tombstone he wanted the following: "He would rather be useful than rich". Vice Mayor Portner said usefulness will never be forgotten. Commissioner Atkins -Grad said she has been very busy the last two weeks attending several PTA and school advisory meetings as well as meetings of the Florida League of Cities, traveling to Orlando with the League, attending the Fire Department Open House and going up in the life surveillance lift. Commissioner Atkins -Grad said she also attended the concert at the Sunset Point Park and spoke at a Hadassah meeting at Sands Point. Commissioner Sultanof said his district is made up of baby boomers and the news crew from Japan came to Tamarac because their population is also getting into the baby boomer age. Commissioner Sultanof thanked staff for their input at the workshop on Monday. Commissioner Sultanof said the dictionary defines politics as the art and science of governing and our first response is to the community of Tamarac. As district representatives we are called upon to help people who are in trouble. Commissioner Sultanof expressed best wishes to Ari Porth and said he would like him to appear before the Mayor and City Commission and give an update on what is going on in Tallahassee. Commissioner Dressler welcomed the Piper High School students and said local government is extremely important. Commissioner Dressler quoted past Speaker of the House, Tip O'Neill, who said "all politics is local". Commissioner Dressler said democracy is based on people and each person who votes participates in the process. Commissioner Dressler congratulated Human Resources Director Swanson and staff for the tremendous employee health fair, and said he was overwhelmed at the extent of services offered. This is also part of city government, caring for the people who work for the city. Commissioner Dressler acknowledged and congratulated the Tamarac Chamber of Commerce on the Taste of Tamarac, which is an annual event held at the Tamarac Community Center and said events such as this bring a positive light to Tamarac. 3. City Attorney: Assistant City Attorney Klahr had no report. Mayor Flansbaum-Talabisco wished belated birthday congratulations to City Attorney Goren, who celebrated his birthday yesterday. 4. City Manager: City Manager Miller welcomed the Piper High School students and said an enjoyable and educational day is planned for them. Taste of Tamarac was very successful; this is the first year we sold out the vendor spaces and the food was delightful. City Manager Miller congratulated the staff who attended the photo shoot October 25, 2006 Page 3 of 7 yesterday; over 200 people participated and the picture will appear on the annual report. The annual 'Spooktacular' event will be held on October 31 from 6:00 p.m. — 8:00 p.m. at Tamarac Park. The Annual Parks and Recreation Fashion Show will be held at Noon on November 3 at Woodlands Country Club. The Veterans Day Parade will be held on November 11 at 9:00 a.m. followed by the memorial ceremony. Applications are available for the 2006 Turkey Trot 5K race, beginning at 7:30 a.m. on Thanksgiving Day. This is the 26th year Tamarac has hosted this event. PUBLIC PARTICIPATION 5. Odiel Feyers, 7421 NW 70 Avenue, Tamarac, spoke of traffic calming on 70th Avenue and said speed humps are needed from 77th street to McNab Road, running north and south. Patti Lynn, 6411 NW 58 Street, Tamarac, spoke against the ballot initiative and spoke of decorum of the Commission. Vice Mayor Portner and Commissioner Sultanof left the room at 9:50 am and returned at 9:52 am. Joe Schreiber, 10504 E Claremont Circle, Tamarac, spoke about the conduct of the Vice Mayor, rules of procedure, providing the public an opportunity to speak on Item 6(f) on the consent agenda, the topic(s) included in the upcoming ballot referendum and commission salaries. Vice Mayor Portner left the room at 9:52 am and returned at 9:53 am. Commissioner Sultanof said the workshop sessions are for the Mayor and City Commission to listen to professionals who come before them. Residents and citizens have the opportunity to speak during the public participation section of the regular commission meetings. Commissioner Dressler asked that the public participation section of the meeting be closed and the Mayor and City Commission move on to the business on the agenda. CONSENT AGENDA 6. Commissioner Dressler seconded by Commissioner Sultanof moved approval of all items on the consent agenda. On roll call Commissioner Sultanof voted "yes", Commissioner Atkins -Grad "yes", Mayor Flansbaum-Talabisco "yes", Commissioner Dressler "yes", and Vice Mayor Partner "yes". Motion carried. a. APPROVED C. SALE OF ALCOHOLIC BEVERAGES — SAINT MALACHY CATHOLIC CHURCH: (TR11068) Waiving fees in the amount of $1,485.25 and extending the hours of operation to 11:00 P.M. on Thursday, November 9, 2006, and to 12:00 midnight on Friday, November 10, 2006, and Saturday, November 11, 2006, and approving the sale of alcoholic beverages for the Saint Malachy Catholic Church Carnival, located at the northeast corner of NW 61 st Street and University Drive, during the operation of the Saint Malachy Catholic Church Annual Carnival beginning Thursday, November 9, 2006 and ending Sunday, November 12, 2006 (Case No. 15-MI-06); providing for conditions of approval RESOLUTION NO. R2006-199 d. AGREEMENT - MICHELE MELLGREN & ASSOCIATES, INC.; (TR11069) Executing an agreement between the City of Tamarac and Michele Mellgren & Associates, Inc. to complete the Evaluation and Appraisal Report (EAR) based amendments and update to the City of Tamarac Comprehensive Plan (Case No. 16-MI- 06). RESOLUTION NO. R2006-200 e. PURCHASING MEDICAL/FIREFIGHTING SUPPLIES FROM BSO: (TR11078) Purchasing medical supplies and firefighting supplies from Broward County Sheriffs Office, Fire Rescue Division Logistics Warehouse during FY07, in an amount not to exceed One Hundred Thousand ($100,000.00) Dollars; authorizing the appropriate city officials to execute a liability waiver for the purchases. RESOLUTION NO. R2006-201 f. DESIGN/BUILD AGREEMENT — TAMARAC SPORTS COMPLEX EXPANSION PROJECT: (TR11060) Awarding RFP #06-02R and executing an agreement with DiPompeo Construction Corporation for the design/build of the Tamarac Sports Complex Expansion for an amount not to exceed $6,029,700; approving funding in the amount of $6,029,700 from the appropriate accounts. RESOLUTION NO. R2006-202 g. CIAC FEES: (TR11062) Increasing the Water and Sewer Contribution in Aid of Construction (CIAC) charges as established. RESOLUTION NO. R2006-203 h. CREDIT CARD PROCESSING SERVICES AGREEMENT — NOVA INFORMATION SYSTEMS AND WACHOVIA BANK: (TR11079) Executing an agreement with Nova Information Systems and Wachovia Bank, N.A. for the provision of merchant credit card processing services providing for a term of four (4) years with one (1) additional one (1) year renewal term. RESOLUTION NO. R2006-204 i. AWARDING BID #06-331B — FURNISH,-- DELIVER AND DISCHARGE OF QUICKLIME: (TR11082) Awarding Bid #06-33B, "Furnish, Deliver and Discharge of Quicklime" to, and executing agreements with, Chemical Lime Company of Alabama, Inc. for the City of Tamarac and on behalf of fifteen members of the Southeast Florida Governmental Purchasing Cooperative; and with Carmeuse Lime Sales Corporation on October 25, 2006 Page 5 of 7 behalf of two members of the Southeast Florida Governmental Purchasing Cooperative, for a period of one year with four (4) additional one-year renewal options. RESOLUTION NO. R2006-205 j. ENCOURAGING A HEART HEALTHY LIFESTYLE AND ELIMINATION OF TRANS FATS: (TR11086) Encouraging a heart healthy lifestyle and the elimination of trans fats from restaurant ingredient lists and everyone's diet; directing the City Clerk to provide a copy of this resolution to the Tamarac Chamber of Commerce. RESOLUTION NO. R2006-206 END OF CONSENT AGENDA REGULAR AGENDA ORDINANCES — FIRST READINGS There were no ordinances scheduled for this meeting for first reading. PUBLIC HEARINGS 9:00 A.M. OR THEREAFTER ORDINANCES — SECOND READINGS 7. AMENDING CHAPTER 10 OF THE TAMARAC CODE — ADDING SECTION 10- 226 ENTITLED, "STORMWATER MANAGEMENT": (T02123) Motion to adopt Ordinance on second reading amending Chapter 10 of the City Code of Ordinances entitled, "Land Development Regulations", by amending Article V entitled, "Improvements", by amending Division 4 entitled, "Drainage", by adding Section 10-226 entitled, "Stormwater Management", as required by the National Pollution Discharge Elimination System permit; providing for codification. Assistant City Attorney Klahr read Temporary Ordinance 2123, Revision #1, on second reading by title. Commissioner Sultanof seconded by Commissioner Dressler moved approval. Mayor Flansbaum- Talabisco opened the public hearing and with no one wishing to speak, closed the public hearing. On roll call Commissioner Dressler voted "yes", Commissioner Sultanof "yes", Vice Mayor Portner "yes", Commissioner Atkins -Grad "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried. ADOPTED ON FIRST READING OCTOBER 11, 2006 ADOPTED ON SECOND READING OCTOBER 25, 2006 ORDINANCE NO. 0-2006-18 8. AMENDING CHAPTER 13 OF THE TAMARAC CODE — SEXUAL OFFENDER RESIDENCY PROHIBITION FINDINGS AND INTENT: (T02125) Motion to adopt ordinance on second reading amending Chapter 13 of the City of Tamarac Code of Ordinances by specifically amending Section 13-20, entitled "Sex offender residency prohibition findings and intent," Section 13-21, entitled "Definitions," Section 13-22, entitled "Sexual offender and sexual predator residence prohibition; penalties; exceptions," and Section 13-23, entitled "Property owners prohibited from renting real property to certain sexual offenders and sexual predators; penalties;" providing for definitions of "sexual offender" and "sexual predator' that are consistent with Section 943.0435, Florida Statutes, and Section 775.21, Florida Statutes; providing for law October 25, 2006 Page 6 of 7 enforcement guidelines; providing a timeframe in which a sexual offender or sexual predator must vacate a premises after being notified of a violation; providing for codification. Assistant City Attorney Klahr read Temporary Ordinance 2125 on second reading by title. Commissioner Sultanof seconded by Commissioner Dressler moved approval. Mayor Flansbaum-Talabisco opened the public hearing and with no one wishing to speak, closed the public hearing. Commissioner Dressler thanked BSO Chief Dugger and City Attorney Goren for working on the amendment to Chapter 13 of the Tamarac Code. Commissioner Dressler said with regard to his earlier reference to Tip O'Neill, this is one way to impact people's lives at the local level. One of the City's top priorities is public safety and this ordinance restricts the ability of people who fall into the above categories from living near potential victims. Mayor Flansbaum-Talabisco said the Sun -Sentinel ran an article about this amendment the other day, and this amendment is consistent with State Statute. Mayor Flansbaum-Talabisco also thanked BSO Chief Dugger and City Attorney Goren for all their help in making this amendment possible. On roll call Mayor Flansbaum-Talabisco voted "yes", Commissioner Dressler "yes", Commissioner Sultanof "yes", Vice Mayor Portner "yes", and Commissioner Atkins -Grad "yes". Motion carried.
