HomeMy WebLinkAbout2004-11-10 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING WEDNESDAY NOVEMBER 10, 2004 CALL TO ORDER: Mayor Schreiber called the regular meeting of the City Commission to order on Wednesday, November 10, 2004 at 7:00 p.m. in Chambers at Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL. PRESENT: Mayor Joe Schreiber, Vice Mayor Marc L. Sultanof, Commissioner Edward C. Portner, Commissioner Beth Flansbaum-Talabisco and Commissioner Karen L. Roberts. ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Mitchell S. Kraft, and City Clerk Marion Swenson. Vice Mayor Marc L. Sultanof led the pledge of allegiance. INTRODUCTION 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation by Mayor Schreiber of a proclamation proclaiming November 12, 2004 as "A Day Against Human Trafficking". BSO Chief Ken Dugger accepted. REPORTS 2. City__ Commission:, Mayor Schreiber reminded everyone that tomorrow is Veterans Day. The City of Tamarac's parade will begin at 9:00 a.m. at Tamarac City Hall followed by a memorial service at Veterans Park. Mayor Schreiber said this is a great event and a day we should all be proud of; everyone should try to attend. Mayor Schreiber wished everyone a happy Thanksgiving. Commissioner Portner said Veterans Day is a very difficult day for many people; to date 1,200 soldiers have been killed in Iraq. Commissioner Portner asked that beginning tonight and through Thanksgiving we bear in mind those who are not able to be with their families because they are defending our rights and creating democracy for others. Many men and women put their lives on the line every day and we appreciate them. Commissioner Roberts said she is hopeful many veterans will join in our parade and thanked those who fight for us by serving their country and giving us the rights we have. Vice Mayor Sultanof said it is not easy to follow the remarks made by his colleagues, but he would like us to remember the greatest generation that went before us and the wonderful generation going forward. The United States is the greatest democracy and melting pot in the world. Vice Mayor Sultanof invited everyone who is able, to come out and honor those who went before us, and added we cannot forget our special young people who are fighting for us. November 10, 2004 1 Commissioner Flansbaum-Talabisco said she extends her prayers for the men and women abroad and hopes to see everyone at the Veterans Day ceremony tomorrow. Commissioner Flansbaum-Talabisco reported that the Parks and Recreation Advisory Board had a presentation by sixth through eighth grade students from Millennium Middle School, and this was a direct result of the partnership between the City of Tamarac and Millennium Middle School. Commissioner Flansbaum-Talabisco said she is delighted with the results of the program and looks forward to more to come. Today she attended a celebration of art and culture from the Cultural Arts Advisory Committee in Broward County. Tamarac is in the forefront of public art and design, and Commissioner Flansbaum-Talabisco said she is honored to be able to participate in this project. 3. City Attorney: City Attorney Kraft reported that Assistant City Attorney Steinerts was awarded three professional distinctions as well as the City of Tamarac Mars Award. Assistant City Attorney Steinerts received an AV rating in Marti ndale-Hubbell@, which rating was achieved as a result of extensive, confidential peer and judicial review, and reflects the highest caliber of professional excellence and ethical standards. Additionally, Assistant City Attorney Steinerts qualified for admission to practice law before the United States Eleventh Circuit Court of Appeals and the United States Supreme Court. 4. City Manager: City Manager Miller reported that the Broward County Board of County Commissioners approved a $5,000.00 grant for additional trees at Caporella Park. The Fire Department participated in the 'Safety' and 'Say No To Drugs' fair at Millennium Middle School on October 30th, and there were 150 participants. City Manager Miller reminded everyone of the Veterans Day parade and memorial ceremony scheduled for Thursday, November 11th. The Tamarac Chamber of Commerce and the City of Tamarac are hosting a "Taste of Tamarac" on November 13th beginning at noon at the Tamarac Community Center. Admission is $5.00 and tickets are available at the door. Twenty-five restaurants will participate in the event. The Turkey Trot will be held on November 25t", and applications are available at Parks and Recreation. The City is looking forward to a bigger crowd than in past years. 5. PUBLIC PARTICIPATION: Phil Meyerson, 8300 Sands Point Boulevard requested speed humps at Sands Point Phase IV. City Manager Miller suggested Mr. Meyerson speak with Public Works Director Strain, who will advise him of the procedures the association needs to go through to obtain speed humps. Mayor Schreiber read a letter into the record from Phyllis R. Sandler (attached and made a part of the minutes). Mayor Schreiber said he did not agree with nor did he sponsor the letter, but he is reading it as requested by Ms. Sandler, who is disabled and unable to attend the meeting. Vice Mayor Sultanof seconded by Commissioner Roberts moved to go out of the regular order of business on the agenda and take up Item No. 11, Temporary Ordinance 2044. On Roll Call Vice Mayor Sultanof voted "yes", Commissioner Roberts "yes", Commissioner Flansbaum-Talabisco "yes", Commissioner Portner "yes", and Mayor Schreiber "yes". Motion carried. November 10, 2004 2 11. AMENDMENT TO LAND USE ELEMENT OF COMPREHENSIVE PLAN — "WOODLANDS COUNTRY CLUB" PLAT: (T02044) Motion to adopt Ordinance on second reading adopting an amendment to the Land Use Element of the City Comprehensive Plan in accordance with Chapter 163, Sections 163.3184 and 163.3187 of the Florida Statutes, concerning a Small -Scale Land Use Plan Amendment proposal by United Homes International, Inc. to change the use of land described as a portion of the "Woodlands Country Club" Plat, according to the Plat thereof as recorded in Plat Book 67, Page 30 of the Public Records of Broward County, Florida, located at the north side of NW 44t" Street approximately 3400 feet west of Rock Island Road, from Commercial Recreation to Low -Medium (5-10 du/ac) Residential to allow the construction of thirty (30) residential town home units comprising approximately of 2.67 net acres and 3.02 gross acres (Case No. 02-LUA-04); providing for amendment to the Land Use Element to reflect such change. City Attorney Kraft read Temporary Ordinance 2044 on second reading by title. Vice Mayor Sultanof seconded by Commissioner Portner moved approval. City Attorney Kraft announced that Commissioner Flansbaum-Talabisco has a statement regarding a voting conflict as it relates to this item. Commissioner Flansbaum-Talabisco read into the record a statement regarding a voting conflict with regard to this item as an economic benefit to the Woodlands Country Club, of which she is a member, could also be a benefit to members of the Country Club, and therefore she must recuse herself from voting on this item. (Copy of statement attached and made a part of the minutes.) Commissioner Portner questioned peak trips and asked for clarification of the figures for the schools. Community Development Director King explained the school board staff calculated the formula based on the number and type of units proposed for development. The formula has been under scrutiny by many commissions throughout Broward County and the school board is looking into modifying the formula. Commissioner Portner asked if the Woodlands community is still a 55 and over community and Jack Talabisco, President of Woodlands County Club responded that it is not. Vice Mayor Sultanof said he is concerned that this development may encroach on the rest of the Woodlands area and Community Development Director King explained the access and egress to the community would be only from 44t" Street, which is not a City road. Commissioner Roberts said she would like to get a copy of the school board's formula and asked which middle school the children from the proposed development would attend. City Manager Miller said they would attend Silver Lakes Middle School. Community Development Director King gave a presentation. Attorney Gerry Knight and President of United Homes, Tony Mijares appeared. Mr. Knight gave a presentation and said this community would be very similar to other communities in Tamarac built by United Homes. Mr. Knight said he would get a copy of the formula to Commissioner Roberts. Mayor Schreiber opened the public hearing. Lawrence Torn, 4500 King Palm spoke in favor of the development. Roy Kozcim, 6100 Orchard Tree Lane, Amy Buchar, 6101 Orchard Tree Lane, and Jeff Shapiro, 6104 Orchard Tree Lane spoke of the view, impact of new families on the Woodlands, and security issues. Mayor Schreiber said it is a financial issue for the Country Club and would benefit the neighborhood. Vice Mayor Sultanof said the community is stable now and he expected it would remain stable after the new development is completed. Mr. Mijares said the large trees buffering the community would remain, and additional landscaping would be added to create more of a buffer, and he would be happy to meet with homeowners to address their concerns. Commissioner Portner said he did not feel the townhouse development November 10, 2004 3 would lessen the value of any property in the Woodlands community, and Commissioner Roberts explained other neighborhoods had similar concerns when townhouses were being built, but the property values have continued to increase. Jack Talabisco, 5215 White Oak Lane said the neighbors on Orchard Tree Lane were considered when the deal was made; the trees will be retained and the buildings sheltered from view. With no one else wishing to speak, Mayor Schreiber closed the public hearing. On roll call Mayor Schreiber voted "yes", Commissioner Roberts "yes", Vice Mayor Sultanof "yes", and Commissioner Portner "yes". Commissioner Flansbaum-Talabisco abstained from voting due to a voting conflict. Motion carried. ORDINANCE NO. 0-2004-29 Mayor Schreiber moved back to the regular order of business on the agenda. CONSENT AGENDA 6. Commissioner Roberts seconded by Vice Mayor Sultanof moved approval of all items on the consent agenda. On roll call Vice Mayor Sultanof voted "yes", Commissioner Flansbaum-Talabisco "yes", Commissioner Portner "yes", Mayor Schreiber "yes", and Commissioner Roberts "yes". Motion carried. a. APPROVE the minutes of the October 27, 2004 Regular City Commission meeting. APPROVED b. APPROVING LEGISLATIVE AGENDA FOR THE 2005 LEGISLATIVE SESSION: (TR10583) Approving the City of Tamarac Legislative Agenda for the 2005 Legislative Session; directing the City Clerk to send a copy of the City of Tamarac Legislative Agenda for the 2005 Legislative Session to the Broward County Legislative Delegation and the Broward County Board of County Commissioners for consideration. RESOLUTION NO. R2004-247 C. BSO PERMIT APPLICATION — SPECIAL DETAILS FOR POLICE SERVICES: (TR10574) Executing a Broward Sheriff's Office permit application for special details for police services to be used by the Parks and Recreation Department in an amount not to exceed $62,000 in FY 05; approving funding from the appropriate Parks and Recreation accounts. RESOLUTION NO. R2004-248 d. BID AWARD AND AGREEMENT - DUNBAR ARMORED INC.: (TR10569) Awarding Bid 04-26B, "Armored Car Services", and executing an agreement with Dunbar Armored, Inc. for a three-year term effective nunc pro tunc to 10/01/2004 through 9/30/2007, at a cost of $13,200 per year, not to exceed $39,600 for the three yearterm. RESOLUTION NO. R2004-249 e. INTERLOCAL AGREEMENT FOR MUTUAL BUILDING INSPECTION PLAN REVIEW BUILDING OFFICIAL OR OTHER SERVICES: (TR10580) Executing the Interlocal Agreement for Mutual Assistance between the City of Tamarac and the City of Margate for Building Inspection, Plan Review, Building Official, or other Services to be performed by the City of Margate Building Department or the City of Tamarac Building Department, services to be performed by either the City of Margate or the City of Tamarac in the event there is a staff shortage at a rate of forty dollars ($40.00) per hour for building code inspector, forty dollars ($40.00) per hour for plans examiner, fifty November 10, 2004 4 1 dollars ($50.00) per hour for temporary building official services, thirty dollars ($30.00) per hour for other building department services staff. RESOLUTION NO. R2004-250 f. BID AWARD AND AGREEMENT — TAMARAC COMMONS PARK FOUNTAIN AND POOL: (TR10575) Awarding Bid No. 04-29B and executing an agreement with Superior Pools, Spas & Waterfalls, Inc., for the fountain and pool for Tamarac Commons Park for a total cost not to exceed $47,838.00; approving funding from the appropriate Parks and Recreation account. RESOLUTION NO. R2004-251 END OF CONSENT AGENDA REGULAR AGENDA ORDINANCE — FIRST READING 7. RE -DESIGNATING SPECIAL MASTER TO SPECIAL MAGISTRATE: (T02068) Motion to adopt Ordinance on first reading re -designating Special Master to Special Magistrate pursuant to Chapter 2004-11 Laws of Florida and providing that all references to Special Master in Tamarac Ordinances and Resolutions are changed to Special Magistrate, City Attorney Kraft read Temporary Ordinance 2068, Revision #1, on first reading by title. Commissioner Portner seconded by Vice Mayor Sultanof moved approval. On roll call Commissioner Flansbaum-Talabisco voted "yes", Commissioner Portner "yes", Mayor Schreiber "yes", Vice Mayor Sultanof "yes", and Commissioner Roberts "yes". Motion carried. AMENDING CHAPTER 7 OF THE TAMARAC CODE — ADOPTING FLORIDA FIRE PREVENTION CODE: (T02047) Motion to adopt Ordinance on second reading amending Chapter 7 of the City Code entitled, "Fire Prevention and Protection", Article III, "Standards", Section 7-48, "Fire Prevention Code — Adoption" and Section 7-50, "Appeals from Decisions of Fire Chief', to remove conflicts with the Florida Fire Prevention Code; providing for codification. City Attorney Kraft read Temporary Ordinance 2047, Revision #3, on second reading by title. Vice Mayor Sultanof seconded by Commissioner Flansbaum-Talabisco moved approval. AMENDING CHAPTER 10 OF THE TAMARAC CODE — DELETING CONFLICTS WITH THE FLORIDA FIRE PREVENTION CODE: (T02048) Motion to adopt Ordinance on second reading amending Chapter 10 of the City Code entitled, "Land Development Regulations", Article IV, "Standards and Criteria", Section 10-128, "Fire Protection", deleting sections of the City Code in conflict with the Florida Fire Prevention Code; providing for codification. AMENDMENT TO LAND USE ELEMENT OF COMPREHENSIVE PLAN — SECTION 6 TOWNSHIP 49 SOUTH RANGE 41 EAST: (T02045) Motion to adopt Ordinance on second reading adopting an amendment to the Land Use Element of the City Comprehensive Plan in accordance with Chapter 163, Sections 163.3184 and 163.3187 of the Florida Statutes, concerning a Small -Scale Land Use Plan Amendment proposal by United Homes International, Inc. to change the use of land described as a parcel of land lying in Section 6, Township 49 South, Range 41 East, Broward County, Florida, being more particularly described in Exhibit "A", located near the west end of Southgate Boulevard on the south side, from Utility to Low -Medium (5-10 du/ac) Residential to allow the construction of forty-four (44) residential town home units comprising approximately of 4.0 net acres and 4.40 gross acres (Case No. 03-LUA-04); providing for amendment to the Land Use Element to reflect such change. ORDINANCE NO. 0-2004-33 November 10, 2004 6 1 1 7 L QUASI-JUDICIAL HEARING 13. REVISED DEVELOPMENT ORDER AND MAJOR REVISED SITE PLAN — TOSHIBA BUSINESS SOLUTIONS: (TR10578) Motion to approve Resolution issuing Revised Development Order No. 318.4 and granting Major Revised Site Plan approval for Toshiba Business Solutions to increase the water detention area in order to meet surface water management requirements and eliminate the future expansion area for the building, including a Parking Waiver request to allow the reduction in width of sixty- nine (69) of the required 151 parking spaces from 10' x 18' to 9' x 18' in order to accommodate storm water storage needs, located at 6401 Nob Hill Road, specifically a portion of Parcel "A" of the "S & N Plat No. 2", according to the Plat thereof as recorded in Plat Book 171, Pages 112 through 115 of the Public Records of Broward County, Florida (Case No. 29-SP-04); providing for conditions of approval. City Attorney Kraft read Temporary Resolution 10578 by title. Vice Mayor Sultanof seconded by Commissioner Flansbaum-Talabisco moved approval. City Attorney Kraft explained the quasi-judicial procedures and Jonathan Keith, Keith and Balbe Engineers and Robert Vreeland, waived their quasi-judicial rights. Community Development Director King gave a presentation. Commissioner Portner questioned the water retention and Mr. Keith explained the water management system, lake, wetland and retention areas as they related to the property. Vice Mayor Sultanof questioned the staging area as it relates to the parking. Mr. Keith explained the staging area is not affected by the change in parking spaces. Mayor Schreiber opened the public hearing and with no one wishing to speak, closed the public hearing. On roll call Vice Mayor Sultanof voted "yes", Commissioner Flansbaum-Talabisco "yes", Mayor Schreiber "yes", Commissioner Roberts "yes", and Commissioner Partner "yes",". Motion carried. RESOLUTION NO. It has not been forgotten, or gone unnoticed, that you supported the seniors against a previous despicable action of the Tamarac Commission, taking the senior name off the new Community Center. It was based on the commitment for the name that the seniors supported and caused the passage of the bond approval for the center. Once again, we have been sold out by the Commissioners at the first opportunity they had to do so. Please include my letter to Mayor Lieberman and the members of the Board of Commissioners of Broward County in presenting this communication at the November 101h meeting. Except for one paragraph, referring to Commissioner Graber, the remainder of the letter is applicable to the Tamarac Commissioners. It wasn't until it was "all over" and our library was closed that I was told Tamarac had the opportunity to save it, for a few measly dollars a year, which the press was told Tamarac could not afford. Amazing, you do not have the money to support a staff of two or three people maybe three days a week, just for the purpose of allowing books and tapes to be taken in and out. Commissioner Flansbaum-Talabisco didn't even have the courtesy of returning a reporter's call regarding the closing. You do not have the money for the seniors to be able to use their library, shutting them out of free reading material. You do not have the money to support the business people, who put their dreams, their savings and their future on the line for Tamarac. But you do ;_ ( � /1� �r_ y have plenty of money to give away bonus handouts to well paid employees, who were only doing the jobs they were hired to do. That does not deserve a bonus. It means they deserve to keep their jobs, otherwise get rid of them. This is one more vile and insulting payback to the seniors who have made Tamarac successful with our voting support of all of your wild schemes. This is the payback to the business people who put everything on the line, before you got so involved with your industrial parks and big business perks. They never would have been possible without those small businesses all these years. Just wipe your feet on them and turn you backs, while they lose everything they have worked for. Take a ride over there and look at the ghost town you have made it — the empty parking lot. I reiterate my last paragraph in the letter to the County Mayor and Commissioners. In politics there is an old expression — "There is no such thing as impossible, only a thousand excuses for not wanting to do something." Disgustedly, Ph is R.
