HomeMy WebLinkAbout2007-12-12 - City Commission Regular Meeting MinutesCITY OF TAMARAC REGULAR CITY COMMISSION MEETING CITY HALL CHAMBERS WEDNESDAY, DECEMBER 12, 2007 CALL TO ORDER: Mayor Flansbaum-Talabisco called the regular meeting of the City Commission to order at 7:00 p.m. on Wednesday, December 12, 2007 in Chambers at Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL. PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Marc L. Sultanof, Commissioner Edward C. Partner, Commissioner Patte Atkins -Grad, and Commissioner Harry Dressler. ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Samuel S. Goren, and City Clerk Marion Swenson. PLEDGE OF ALLEGIANCE: Vice Mayor Sultanof led the pledge of allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentations by Mayor and City Commission of Veterans' Day Parade Trophies: (i) Mayor's Cup: Ramblewood Middle School Band — Assistant Principal James Cecil and Band Parent President Leslie Kins accepted. (ii) Vice Mayor's Cup: Tamarac Elementary School — Commissioner Dressler accepted on behalf of Nancy Seiler, Principal. (iii) Commissioners' Cup: Commerce Bank — Seth Dreyfuss, Marketing Manager; Regional Manager Grace Szambelin, and Kierstin Boullea accepted. (iv) Spirit Of Broward Award: JP Taravella High School — Principal Shawn Cerra accepted. RFPORTS 2. City Commission: Mayor Flansbaum-Talabisco commended and congratulated Vice Mayor Sultanof on being named Veteran of the Month in "Kings Point Life", (a copy of said article is attached and incorporated as part of these minutes). Mayor Flansbaum-Talabisco reported on an article in the December 9t" Sun -Sentinel regarding three generations of Zangara family who are involved in model railroading. (A copy of said article is attached and incorporated as part of these minutes.) Mayor Flansbaum-Talabisco reported on her attendance at the County Commission meeting last Tuesday, to speak on behalf of Item 60 on their agenda, with regard to the walkway between the Tamarac Community Center and the library. Public Works Director Strain and Lobbyist Mitch Ceasar accompanied Mayor Flansbaum-Talabisco to the County Commission and the City was successful in being granted $265,000 toward this project. Mayor Flansbaum-Talabisco said this past year was wonderful and productive and it is a pleasure to serve with such a great commission, staff, City Manager and City Attorney. Mayor Flansbaum-Talabisco quoted the sentiment in a card she received from a bank: "Smiles are free, spend them extravagantly. Happy Holidays." December 12, 2007 Page 1 of 5 Commissioner Portner wished everyone a happy holiday season and said at the County Commission meeting Vice Mayor Ritter proposed money for the walkway but he spoke against it, even though he had voted for the project at a City Commission meeting. Commissioner Atkins -Grad said it has been a busy two weeks, where she has attended water summits and is pleased to find out that restaurants in Tamarac will never serve water to customers unless the customer requests a glass of water. Today was a special, festive day as department heads made a special party for staff and it was great spending time with people who work for the City. Commissioner Atkins -Grad attended ArtServe's Jazz Fest at the Tamarac Community Center and also a party given by Ari Porth. Commissioner Atkins -Grad wished everyone a happy and healthy holiday. Vice -Mayor Sultanof clarified the Tamarac branch library is our library, run and furnished by the County. Vice Mayor Sultanof spoke of the survey completed by residents and businesses in Tamarac and said he is extremely happy to note the residents and businesses think Tamarac is the best place to live and raise children. Vice Mayor Sultanof complimented the Mayor and City Commission on the camaraderie and said he will have served 13 years on this commission when he leaves office in 2008 and this is the best commission he has ever served on; we have been able to accomplish all that came before us. Vice Mayor Sultanof complimented and thanked the staff, who are the best in the County, and wished everyone a happy and healthy holiday. Commissioner Dressler said this past week he attended Tamarac Elementary School's Winter Fest, for which the city provided the space behind the recreation center. It was an amazing event, attended by 4,000 — 5,000 parents and children. BSO was present with their Mounted Brigade, and city staff was also present. Commissioner Dressler thanked Director of Parks and Recreation Warner and the Parks and Recreation staff for their work, and added this represents what Tamarac really is all about: good intentions, family and pride in the community. Commissioner Dressler thanked staff for all their hard work and support over the past year. Commissioner Dressler wished everyone a happy holiday and new year and wished each family health and peace of mind. Commissioner Portner spoke of Vice Mayor Sultanof s leading a convoy from Burma in 1942, and the interstate system. Commissioner Portner thanked Vice Mayor Sultanof for his service to his country, the commission and his devotion to his wife, Sylvia. 3. City Attorney: City Attorney Goren reported on the Charter Review Commission meeting that he attended and the discussions regarding the County adding a Mayor at large for a four-year term as well as another at -large seat. City Attorney Goren said the Broward League of Cities has scheduled two public forums on January 7, 2008 and January 9, 2008, both at 7:00 p.m., at which forums both he and City Manager Miller were scheduled to speak. These will be educational forums; however, there is a conflict with the January 9th City Commission meeting. Mayor Flansbaum-Talabisco said she and the Commissioners would like to be able to attend the forums. Commissioner Portner seconded by Commissioner Atkins -Grad moved to change the meeting time of the January 9th City Commission meeting from 7:00 p.m. to 5:05 p.m. On roll call December 12, 2007 Page 2 of 5 Commissioner Portner voted "yes", Commissioner Atkins -Grad "yes", Commissioner Dressler "yes", Vice Mayor Sultanof "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried. City Attorney Goren thanked staff and the Mayor and City Commission for their support over the past year and wished everyone a happy holiday. 4. City Manager: City Manager Miller wished everyone a healthy and happy holiday and said this past year has been an outstanding one for the City of Tamarac. City Manager Miller thanked the Mayor and City Commission for their leadership, and the Department Directors for their hard work. On December 17th there will be several presentations in Chambers (2:00 p.m., 3:30 p.m. and 6:00 p.m.) wherein the results of the survey will be rolled out to the public. This is a Sterling initiative and we take a resident/business survey every two years. This survey shows Tamarac ranks at the top of municipal governments in the nation with its delivery of public services. City Manager Miller said he would like the Mayor and City Commission to attend the 6:00 p.m. rollout, but they are, of course, invited to attend the other sessions if that is more convenient. The executive team will be at the 6:00 p.m. session, and staff members will also be at the 2:00 and 3:30 sessions, as well as the public. Community leaders have been invited and there should also be an article in the Sun -Sentinel about the roll out. PUBLIC PARTICIPATION 5. Pam Bushnell, President of Mainlands 1 & 2 Civic Association, 4706 NW 43 Terrace, thanked Mayor Flansbaum-Talabisco for coming to the 40t" Anniversary Party on December 15t for Mainlands 1 &2, 3, 4, 5, and 6, and thanked City Clerk Swenson for preparing the proclamation. Ms. Bushnell wished everyone a happy holiday. Barbara McNeil, 6961 NW 82nd Court, spoke about branding and said she would like the Mayor and City Commission to adopt option B as well as the already adopted option A. Ms. McNeil wished everyone a pleasant and safe holiday. Burt Schneider, 8016 NW 72 Street, wished everyone a healthy and happy New Year and holiday season. Mr. Schneider complimented the Mayor and City Commission on the way they work together. CONSENT AGENDA 6. Commissioner Portner seconded by Commissioner Atkins -Grad moved approval of all items on the consent agenda. On roll call Commissioner Dressler voted "yes", Commissioner Atkins -Grad "yes", Commissioner Portner "yes", Vice Mayor Sultanof "yes", and Mayor Flansbaum-Talabisco "yes". Motion carried. a. APPROVE the minutes of the November 28, 2007 Regular City Commission meeting. APPROVED b. TASK AUTHORIZATION NO. 08-01 E — WATER SYSTEM MASTER PLAN (STUDY): (TR11328) Executing Task Authorization No. 08-01 E with Mathews Consulting, Inc., to provide professional services to prepare a Water System Master Plan (Study) in accordance with the City's Consulting Engineering Agreement as authorized by Resolution No. R-2006-131, for an amount not to exceed $212,868.00; approving funding from the appropriate budgeted Utilities Operational and CIAC accounts; authorizing the appropriate City Officials to administer the contract. RESOLUTION NO. R2007-193 December 12, 2007 Page 3 of 5 C. APPROVING THE CITY'S FY2008 LEGISLATIVE AGENDA: (TR11329) Approving the City of Tamarac Legislative Agenda for the 2008 legislative session; directing the City Clerk to send a copy of the City of Tamarac Legislative Agenda for the 2008 legislative session to the Broward County Legislative Delegation and the Broward County Board of County Commissioners for consideration. RESOLUTION NO. R2007-194 d. CHANGE ORDER — NEW SIDEWALK REPAIR AND REPLACEMENT: (TR11330) Executing Change Order Number 2 to the Agreement with Straightline Engineering Group for the installation of new sidewalk and repair and replacement of existing sidewalk; authorizing an additional expenditure in an amount not to exceed $180,000.00 for said purpose; authorizing budget amendments as needed for proper accounting purposes. RESOLUTION NO. R2007-195 e. CONTRACT AWARD — UPDATE TO THE CITY'S FIRE ASSESSMENT METHODOLOGY: (TR11327) Awarding a professional services contract for an amount of $40,270 to Government Services Group, Inc. for an update to the City's Fire Assessment Methodology; authorizing budget amendments for proper accounting purposes. RESOLUTION NO. R2007-196 REGULAR AGENDA ORDINANCE — FIRST READING PUBLIC HEARINGS 7:00 P.M. OR THEREAFTER 7. AMENDMENT TO CITY OF TAMARAC COMPREHENSIVE LAND USE PLAN: (T02155) Motion to adopt Ordinance on first reading adopting an amendment to the Capital Improvement and Intergovernmental Coordination Elements of the City of Tamarac Comprehensive Land Use Plan concerning a text amendment to incorporate new goals, objectives and related policies and the addition of the Public School Facilities Element to the Comprehensive Plan all pertaining to public school facility planning to address the implementation of school facilities concurrency through the establishment of a financially feasible Public School Capital Facilities Program; adoption of level of service standards to establish maximum permissible school utilization rates relative to capacity and coordinated procedures for implementing school concurrency (Case No. 2-LUA-07). City Attorney Goren read Temporary Ordinance 2155 on first reading by title. Commissioner Portner seconded by Commissioner Atkins -Grad moved approval. Community Development Director Bramley gave a presentation. Mayor Flansbaum-Talabisco opened the public hearing and with no one wishing to speak, closed the public hearing. Vice Mayor Sultanof left the meeting at 8:00 p.m. On roll call Commissioner Portner voted "yes", Commissioner Dressler "yes", Commissioner Atkins -Grad "yes", and Mayor Flansbaum-Talabisco "yes". AMENDING CHAPTER 2 OF THE CITY'S CODE OF ORDINANCES — CREATING ARTICLE X "CODE OF ETHICS": (TO2154) Motion to adopt Ordinance on second reading amending Chapter 2 of the City's Code of Ordinances, entitled "Administration", creating Article X, to be entitled "Code of Ethics"; providing for a code of ethics for elected and appointed City officials; providing for intent and purpose; providing for definitions; incorporating Chapter 112, Florida Statutes, as amended from time to time; providing for standards of conduct; providing for penalties and enforcement; providing for codification. City Attorney Goren read Temporary Ordinance 2154, Revision #2 on second reading by title. Commissioner Dressler seconded by Commissioner Atkins -Grad moved approval. Mayor Flansbaum-Talabisco opened the public hearing and with no one wishing to speak, closed the public hearing. All KPIT residents and other citizens of our beautiful city are well acquainted with ,Vlarc Sultanof, our Commissioner and Vice Mayor. After growing up in Trenton, flew .lersey, attending Junior High School there, 'Marc's fatuity moved to Philadelphia where his father was in business. Upon graduation from Olney High School, he applied to and was accepted by the University of Pennsylvania's Wharton School •f Finance. While a student there, the dark and ominous clouds of World War II hovered over the USA and Marc enrolled in the V-12 program. In October 1942, the program was completed. Marc was summoned to active duty and reported to Camp Crowder, Missouri. A short time later, new orders were issued and he .shipped out to the CBI, the Chinese -Burma - Indian Theater. There he was assigned to the center under the command of the famous General "Vinegar Joe" Stillwell who, incidentally, was native of Palatka, Florida- Appointed as an aide on the General's staff, he soon rose through the ranks and was promoted to Battalion Sergeant Major, the highest non-commissioned rank that can be achieved. His duties consisted of coordinatinil communications between the American teams and Generalissimo Chiang Kai-Shek's Chinese Nationalist. Army. One of his outstanding assignments was to help lead a motorized convoy of thirty-six vehicles loaded with ammunition and other supplies for the Chinese from the Bhamo, Burma to Kunming, China. After a torrurous and difficult journey. the convoy arrived safely at its destination with the loss of only one truck. Honorably discharged in January 1946. after nearly three and one half years of service.. Marc returned to civilian life and entered the field of labor negotiations. Most of his work was acting as arbitrator between labor unions and managemont in the construction and trucki!12 industries. 1988 witnessed the arrival of the Sultanof family in the city of Tamarac where he soon became involved in civic affairs. Marc as represented our District as Commissioner since t 992 and has been %."ice Mayor for three terms. Happily man -led to Sylvia for sixty-four years, they reside in our Fairfax neighborhood. He is an active participant in many organizations; President of the Kings Point Democratic Club, a member of the Kings Point Veterans Club, The Jewish War Veterans and tnanv others.
