REGULAR CITY COMMISSION MEETING
WEDNESDAY MARCH 24, 2004
CALL TO ORDER: Mayor Schreiber called the regular meeting of the City Commission
to order on Wednesday, March 24, 2004 at 9:00 a.m. in Chambers at Tamarac City
Hall, 7525 NW $$ Avenue, Tamarac, FL 33321.
PRESENT: Mayor Joe Schreiber, Vice Mayor Karen L. Roberts, Commissioner Edward
C. Portner, Commissioner Beth Flansbaum-Talabisco, and Commissioner Marc L.
Sultanof.
ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Mitchell S. Kraft and City
Clerk Marion Swenson.
Commissioner Beth Flansbaum-Talabisco led the Pledge of Allegiance
INTRODUCTION
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation by Mayor Schreiber of Employee Service Awards:

b. Presentation of a proclamation by Mayor Schreiber welcoming the return of Staff
Sergeant Jeffrey Haynes from his one year service to the Army during Operations Noble
Eagle and Enduring Freedom. Mr. Haynes accepted and Utilities Director Gagnon read
into the record a letter from the Department Of The Army (a copy of which is attached
hereto and made a part of the minutes) and presented the City with a certificate of
appreciation received from the Commanding General Headquarters, US Army Forces
Command, Fort McPherson, Georgia.
REPORTS
2. City Commission: Mayor Schreiber said it is rewarding and pleasing to see
employees who have been with the City for years rewarded. Tamarac is the best City in
the County and the City looks great thanks to the employees.
Commissioner Portner distributed a written report on his trip to Washington, D.C. (a
copy of which is attached hereto and made a part of the minutes.)

Vice Mayor Roberts congratulated the employees who received awards this morning
and said Tamarac has the best employees in the County. Vice Mayor Roberts thanked
everyone for their help over the past year and said serving as Vice Mayor has been a
great experience. Vice Mayor Roberts added that she hoped the new Vice Mayor would
continue with civility. Vice Mayor Roberts reported that over 1,100 trees were
distributed during Replant Broward, and thanked everyone for their participation. Both
she and Commissioner Flansbaum-Talabisco worked very hard for Replant Broward.
Vice Mayor Roberts said the final elementary school boundary hearing was held last
night and Tamarac gave 100 choice seats to Riverside Elementary School. Vice Mayor
Roberts stated that she and Commissioner Flansbaum-Talabisco would continue to
work on boundary issues and think outside the box to relieve overcrowding in the
schools.
Commissioner Sultanof thanked the employees for their efforts on behalf of the City,
and said we are fortunate to have Jeffrey Miller as our City Manager, with the
directorship, confidence and ability that he demonstrates. Commissioner Sultanof said
it is an honor to serve with the Tamarac employees and the City Manager.
Commissioner Flansbaum-Talabisco agreed with Commissioner Sultanof's statements
and said this is the best staff she has ever worked with, both in government and in the
private arena. Commissioner Flansbaum-Talabisco said she is happy to see the
Woodlands Overlay Zoning District item that she has worked on over the past year on
the agenda today. There are many residents in attendance this morning and
Commissioner Flansbaum-Talabisco thanked them for their support and for being here.
Commissioner Flansbaum-Talabisco also thanked the Commission, staff, City
Manager's Office and City Attorney's office for their efforts on this project.
3. CityAttorney: City Attorney Kraft said it has been an honor to work on the
Woodlands Overlay Zoning District project and it is a team effort. City Attorney Kraft
said he is happy to see the project coming to fruition today.
4. City Manager: City Manager Miller reported that on March 131", Tamarac Fire
Rescue, the CERT Team and Cadets distributed and installed 43 smoke detectors at
Westwood 17; the area will be completed on May 17th. Smoke detectors will be
distributed at Sunflower Heathgate over the summer, with a definite time to be
announced at a future date. Chief Budzinski was appointed to the SE/SW Fire Code
Action Committee for the International Association of Fire Chiefs. The Parks and
Recreation Department reports that the Community Garage Sale will be held on March
27th at the Tamarac Community Center from 7:00 a.m. — 12:00 noon. The final concert
of the year will be held on April 2nd at the Sports Complex.
5. PUBLIC PARTICIPATION: Dr. John Pisaciano, 5504 Mulberry Drive, Tamarac,
spoke about storage of building material and rubble outside of homes in his
neighborhood, in particular a residence located at 4610 King Palm Drive. City Manager
Miller responded that there are rules against this and Code Compliance will be alerted.

6. Commissioner Sultanof seconded by Commissioner Flansbaum-Talabisco
moved approval of all items on the Consent Agenda. On roll call Commissioner
Sultanof voted "yes", Commissioner Flansbaum-Talabisco "yes", Mayor Schreiber "yes",
Vice Mayor Roberts "yes", and Commissioner Portner "yes". Motion carried.
a. APPROVE the minutes of the March 10, 2004 Regular City Commission
meeting.

b. AUTHORIZING A FOUR -WEEK CONSECUTIVE PERIOD DURING WHICH
THE CITY COMMISSION WILL NOT SCHEDULE REGULAR MEETINGS:
(TR10359) Authorizing a four -week consecutive period (July 18, 2004 --- August
15, 2004) during which time the City Commission will not schedule any regular
meetings pursuant to Section 4.06 of the City Charter.

d. BILL OF SALE ABSOLUTE —DEPENDABLE MEDICAL SUPPLY: (TR10360)
Accepting a Bill of Sale Absolute from Dependable Medical Supply, Inc., for the
Water Distribution System Improvements installed for the Dependable Medical
Supply Project, located at 7835 West Commercial Boulevard, for City ownership;
authorizing and directing the City Clerk to record said document in the public
records of Broward County.

traffic control and enforcement within the property of the Weldon Neighborhood
Association, Inc.

h. WAIVER OF ROOM FEES — MENTAL HEALTH ASSOCIATION OF
BROWARD COUNTY: (TR10377) Approving a request from Mental Health
Association of Broward County to waive room rental fees in the amount of
$800.00 for their Resource Fair to be held in the Ballroom at the Tamarac
Community Center on April 1, 2004.

k. PURCHASE OF EIGHT PASSENGER VAN: (TR10371) Approving the
purchase of a 2004 Freightliner Sprinter eight passenger van at a cost not to
exceed $29,999.00, utilizing the Florida Sheriffs Association and Florida Fire
Chiefs' Association Bid #03-11-0825; utilizing funding from the appropriate
Community Development Block Grant (CDBG) Program Year 4 account.

I. AGREEMENT FOR PURCHASE AND SALE OF REAL PROPERTY —
SPIRITUAL WARFARE CHURCH & TRAINING INSTITUTE INC.: (TR10373)
Executing an Agreement and Addendum to Agreement for purchase and sale of
real property between Spiritual Warfare Church & Training Institute, Inc. (seller)
and the City of Tamarac (buyer) in the amount of One Million Five Hundred
Thousand Dollars ($1,500,000) for the City to purchase 2.58 acres +/- of vacant
land for open space and recreational purposes.

SHATHER TRUSTEE OF UNIVERSITY BUSINESS PARK TRUST: (TR10374)
Executing an Agreement for purchase and sale of real property between Alex
Shather, as Trustee of the University Business Park Trust Agreement dated June
7, 2002 (seller) and the City of Tamarac (buyer) in the amount of One Million Five
Hundred Fifty Five Thousand Dollars ($1,555,000.00) for the City to purchase
5.95 +/- acres of vacant land for open space and recreational purposes.

n. GRANT APPLICATION DEPARTMENT OF HOMELAND SECURITY — FIRE
ACT GRANT FOR THERMAL IMAGING AND RAPID INTERVENTION TEAM
EQUIPMENT: (TR10378) Seeking grant funding from U.S. Department of
Homeland Security Assistance to Firefighters Grant Program for Rapid
Intervention Team Equipment with total project costs not to exceed $95,000;
providing for a City match of project cost of 30% in cash upon approval of the
application.

Commissioner Portner requested the addition of Item No. 4 from Monday's workshop
meeting, naming of Satellite City Hall for Past Commissioner Larry Mishkin, to today's
agenda as Item No. 15. Mayor Schreiber, Commissioner Flansbaum-Talabisco,
Commissioner Sultanof and Vice Mayor Roberts all agreed that the matter should be
brought back before the City Commission at the next workshop meeting and a policy be
created. Commissioner Portner seconded by Commissioner Sultanof moved to add the
naming of Satellite City Hall for Past Commissioner Larry Mishkin to today's agenda as
Item No. 15. On roll call, Vice Mayor Roberts voted "no", Commissioner Sultanof "yes",
Commissioner Portner "yes", Commissioner Flansbaum-Talabisco "no", and Mayor
Schreiber "no". Motion failed.
7. ELECTING A VICE MAYOR: (TR10325) Motion to approve Resolution electing
Commissioner to serve as Vice Mayor for a one (1) year term
beginning March 24, 2004 with no succession. City Attorney Kraft read Temporary
Resolution 10325 by title. Commissioner Portner seconded by Vice Mayor Roberts
moved approval. Vice Mayor Roberts nominated Commissioner Sultanof as Vice
Mayor. There being no objections, Commissioner Portner seconded by Vice Mayor
Roberts moved approval of Temporary Resolution 10325, as amended, electing
Commissioner Marc. L. Sultanof as Vice Mayor to serve a one year term beginning
March 24, 2004, with no succession. On roll call Vice Mayor Roberts voted "yes",
Commissioner Sultanof "yes", Commissioner Portner "yes", Commissioner Flansbaum-
Talabisco "yes", and Mayor Schreiber "yes". Motion carried.
RESOLUTION NO. R2004-62
8, ISSUING CAPITAL IMPROVEMENT REVENUE BONDS SERIES 2004:
(TR10367) Motion to approve Resolution authorizing the issuance of not to exceed
$10,000,000 in aggregate principal amount of City of Tamarac, Florida Capital
Improvement Revenue Bonds, Series 2004 for the purpose of paying the costs of

acquiring, constructing and equipping certain capital improvements for the City's water
and wastewater utility system and stormwater utility system; covenanting to budget and
appropriate legally available non -ad valorem revenues to provide for the payment
thereof; making certain covenants and agreements for the benefit of the owners of such
bonds; authorizing certain officials and employees of the City to take all actions required
in connection with the sale, issuance and delivery of such bonds; taking certain other
actions with respect to such bonds. City Attorney Kraft read Temporary Resolution
10367 by title. Commissioner Portner seconded by Commissioner Flansbaum-
Talabisco moved approval. On roll call Mayor Schreiber voted "yes", Commissioner
Roberts "yes", Vice Mayor Sultanof "yes", Commissioner Partner "yes", and

RESOLUTION NO. R2004-63
9. APPROVING SALE OF CAPITAL IMPROVEMENT REVENUE BONDS
SERIES 2004: (TR10368) Motion to approve Resolution supplementing Resolution No.
authorizing and approving the negotiated sale of not to exceed $10,000,000
City of Tamarac, Florida Capital Improvement Revenue Bonds, Series 2004; authorizing
the sale thereof to RBC Dain Rauscher Inc. subject to the terms and conditions
contained herein; appointing the Paying Agent and Registrar; appointing the Insurer and
approving the insurance policy commitment; providing certain other matters relating to
the Series 2004 bonds. City Attorney Kraft read Temporary Resolution 10368 by title.
Commissioner Portner seconded by Commissioner Roberts moved approval. Mayor
Schreiber asked for an explanation of the Resolution and Finance Director Newman
explained the bond issue was planned as part of the 2004 budget to fund stormwater
and water and wastewater treatment distribution systems capital projects. The bonds
are for 20 years and carry a good interest rate. Vice Mayor Sultanof asked for an
explanation of how the stormwater project pertains to the east side of Tamarac and
verified that the purchase of the bonds would be open to the public. Finance Director
Newman said a notice regarding sale of the bonds will be posted on the website as well
as an advertisement placed in the Sun Sentinel. Additionally, staff and the City
Commission will be informed about the sale of the bonds in the event there are
questions from residents. Public Works Director Strain explained the stormwater
projects included in the bonds and said in addition to the stormwater projects there are
some small drainage issues that will be addressed. On roll call Commissioner
Flansbaum-Talabisco voted "yes", Commissioner Portner "yes", Mayor Schreiber "yes",
Vice Mayor Sultanof "yes", and Commissioner Roberts "yes". Motion carried.
RESOLUTION NO. R2004-64
ORDINANCE — FIRST READING
10. AMENDING CHAPTER 6 OF THE TAMARAC CODE -INVESTMENT OF CITY
FUNDS: (T02041) Motion to adopt Ordinance on first reading amending Chapter 6,
"Finance and Taxation", Article II, "Fees and Funds", Section 6-26, "Investment of City
Funds" to recognize the Investment Policy as the governing document for the
investment of City funds and Section 6-27, "City Commission Investment Decisions"
requiring the City Commission to establish an Investment Policy by Resolution;

providing for codification. City Attorney Kraft read Temporary Ordinance 2041,
Revision 1, on first reading by title. Commissioner Roberts seconded by Commissioner
Flansbaum-Talabisco moved approval. On roll call Commissioner Portner voted "yes",
Commissioner Roberts "yes", Commissioner Flansbaum-Talabisco "yes", Mayor
Schreiber "yes", and Vice Mayor Sultanof "yes". Motion carried.

PUBLIC HEARINGS 9:00 A.M. OR THEREAFTER
11. ADOPTING THE SHIP LOCAL HOUSING ASSISTANCE PLAN FOR THE
YEARS 2004-2007: (TR10364) Motion to approve Resolution approving the Local
Housing Assistance Plan as required by the State Housing Initiatives Partnership
Program Act, subsections 420.907-420.9079, Florida Statutes and Rule 67-37 Florida
Administrative Code for the State of Florida Fiscal Years 2004-2005, 2005-2006, and
2006-2007; authorizing the Mayor to execute any necessary documents and
certifications required by the State; authorizing the appropriate City officials to submit
the Local Housing Assistance Plan for review and approval by the Florida Housing
Finance Corporation (Case No. 5-MI-04). City Attorney Kraft read Temporary
Resolution 10364, Revision 1, by title. Commissioner Flansbaum-Talabisco seconded
by Vice Mayor Sultanof moved approval. Community Development Director King gave
a presentation and Vice Mayor Sultanof asked for an explanation on how people can
apply for funds under the SHIP program. Community Development Director King said
qualification is based on income and outside consultants handle administration of the
paperwork for the City. Residents can contact the administrator of the program, which
currently is CRA, for an application. After filling out the application, if the applicant
meets the qualifications, they are placed on a waiting list and as money becomes
available the applicants are contacted. Mayor Schreiber added that the key is income
eligibility for home repairs and also for assistance with down payments. Commissioner
Portner asked about the income level and Community Development Director King said it
is determined based on the number of individuals in the household. Commissioner
Roberts asked if a person is on a waiting list and all the money is used up for the year,
does the person then move to the next year's list. Community Development Director
King said they remain on the list in the position they currently hold. Mayor Schreiber
opened the public hearing and with no one wishing to speak, closed the public hearing.
On roll call Vice Mayor Sultanof voted "yes", Commissioner Flansbaum-Talabisco "yes",
Mayor Schreiber "yes", Commissioner Roberts "yes", and Commissioner Portner "yes".
Motion carried.
RESOLUTION NO. R2004-65
ORDINANCE — SECOND READING
12. CORRECTING SCRIVENER'S ERROR IN LEGAL DESCRIPTION CONTAINED
IN ORDINANCE NO. 0-2004-07-BRUCE PLAT: (T02039) Motion to adopt Ordinance
on second reading correcting a scrivener's error in the legal description contained in
Ordinance No. 0-2004-07 amending the legal description previously described as
"Parcel 'A' of the 'Bruce Plat', according to the Plat thereof as recorded in Plat Book

135, Page 11 of the Public Records of Broward County, Florida", to read, a 'Portion of
Parcels 'A' and 'B' of the 'Bruce Plat', according to the Plat thereof as recorded in Plat
Book 135, Page 11 of the Public Records of Broward County, Florida, and a portion of
the northwest one -quarter of Section 10, Township 49 South, Range 41 East" in
Ordinance No. 0-2004-07 approved by the City Commission on second reading
February 25, 2004 regarding the Land Use Element of the City Comprehensive Plan in
accordance with Chapter 163, Sections 163.3184 and 163.3187 of the Florida Statutes,
concerning a Small -Scale Land Use Plan Amendment proposal by Prestige Homes of
South Florida, Inc. (Case No. 01-LUA-04); providing for amendment to the Land Use
Element to reflect such change. City Attorney Kraft read Temporary Ordinance 2039,
Revision 1, on second reading by title. Commissioner Portner seconded by Vice Mayor
Sultanof moved approval. Mayor Schreiber opened the public hearing and with no one

ORDINANCE NO. 0-2004-09
QUASI-JUDICIAL HEARINGS
13. AMENDING CHAPTER 24 OF THE TAMARAC CODE — CREATING ARTICLE
X ENTITLED "WOODLANDS OVERLAY ZONING DISTRICT": (T02038) Motion to
adopt Ordinance on first reading amending Chapter 24 of the City of Tamarac Code of
Ordinances entitled, "Zoning*", creating Article X entitled, "Woodlands Overlay Zoning
District", Sections 24-800 through 24-811 contained herein by establishing specific
regulations to preserve the neighborhood character, promote its high quality and
appearance, maintain property values and protect the health, welfare and quality of life
of its residents by ensuring properties are maintained in accordance with the community
standards (Case No. 6-Z-04); providing for codification. City Attorney Kraft read
Temporary Ordinance 2038 on first reading by title. Commissioner Portner seconded
by Commissioner Flansbaum-Talabisco moved approval. City Attorney Kraft explained
the quasi-judicial procedures and said the City is the petitioner and waived the quasi-
judicial rights on behalf of the City. Community Development Director King gave a
presentation and thanked the City Manager's office, City Attorney's office, Building and
Code Compliance, staff, Commissioner Flansbaum-Talabisco and the City Commission
as well as the Woodlands Associations for their work on bringing this to fruition, and
said this is truly a community effort. Commissioner Partner questioned fencing permits
in the Woodlands Overlay Zoning District and asked if other areas of the City would do
the same thing. Community Development Director King said there will be no permitting
for fences in the Woodlands Overlay Zoning District after the Ordinance passes second
reading; other areas of the City conform to existing Tamarac Code. Commissioner
Portner asked for clarification of weekends and holidays for open house signs, as Code
Enforcement does not work on weekends and holidays. Community Development
Director King said the intent is for Saturdays and Sundays, and if this poses a problem
after the Ordinance passes second reading, it will be reviewed at that time. In the event
there is a problem on a weekend, BSO can be contacted. Commissioner Flansbaum-
Talabisco read a letter from Broward County Mayor Ilene Lieberman into the record (a

copy of which is attached hereto and made a part of the minutes.) Commissioner
Roberts asked if there will be a cost to the City and perhaps another Code Enforcement
Officer may need to be hired to cover the Overlay Zoning District. Community
Development Director King said there will be no cost to the City and it is not anticipated
that another Code Enforcement Officer will need to be hired. Vice Mayor Sultanof
asked if the Association intends to work hand in hand with the documents and
Community Development Director King said all indications point to the fact that they will
work together with Code Enforcement. Mayor Schreiber opened the public hearing.
Mayor Schreiber said he received many e-mail messages and telephone calls regarding
the Woodlands Overlay Zoning District, which he wanted to be added to the record.
(Copies of e-mail messages and telephone messages are attached hereto and made a
part of the minutes.) Dr. Stan Bensen, 5305 Sago Palm Boulevard, spoke about the
Woodlands Community as the Crown Jewel of Tamarac. The following people spoke in
favor of the Overlay Zoning District: Les Weinberg, 4504 King Palm; Seymour Margolis,
4704 Queen Palm Lane; Robert Noskin, 4905 Umbrella Tree Lane; Phil Miller, 4903
Banyan Lane; Steve Fain, 4406 King Palm Lane; Ken Guillespie, 4603 Norfolk Pine;
Ellie Fine, 4903 Umbrella Tree Lane; Harvey Kram, 4802 Queen Palm Lane; and Larry
Torn, 4500 King Palm Drive. Herb Hayes, Westwood 20 spoke against the Overlay
Zoning District. Walter Rekuc, 5402 Red Cypress Lane spoke about Ambassador
Management and questioned costs. Dr. Harold Stein, 5201 Bayberry Lane spoke about
the road repaving and problems he is having with his driveway. Public Works Director
Strain said Mr. Lewis of the City's Engineering Division has been to Dr. Stein's house to
inspect the situation. Public Works Director Strain explained the difference in elevation

The City has used the best material available to repave the roads. With no one else
wishing to speak, Mayor Schreiber closed the public hearing. Vice Mayor Sultanof said
the people have a right to petition the government. On roll call Mayor Schreiber voted
"yes", Commissioner Roberts "yes", Vice Mayor Sultanof "yes", Commissioner Portner
"yes", and Commissioner Flansbaum-Talabisco "yes". Motion carried.

Community and Economic Development Meeting, 3/6/04
Meeting opened by the Honorable Tommy Baker, Chairman of the
CED. Charged Steering Committee to draft resolution for the meeting in
Indianapolis on Housing, Economic Development, Land Use, Parks, Job
retention and Affordable Housing.
First speaker Steven B. Nesmith, Assistant Secretary, Office of
Congressional and Inter -Governmental Relations. Tries to solve problems,
pledge for 2005 create new jobs (did not say how) and housing. Housing
keeps the economy growing. Home ownership at all time high (of course we
have more people). New budget for 2005 will be $3.5 billion (budget has to
be approved). The aims are:
1. increase home ownership
2. decent affordable housing for renters
3. ensure equal opportunity, have needed tools to do this
4. faith based to have equal footing with others seeking funds
S. Legislation that will enable 80,000 to be eligible for Five Thousand
Dollars in grants for a down payment or closing costs. Also, FHA
will allow zero down payments if they meet FHA requirements.
However, they will pay a higher premium on the mortgage. Wish to
increase minority homeownership by five percent. Once again, this is
only a proposal.
Next speaker Conrad Eagan, Attorney. Spoke about the present deficits,
expects this nation to run deficits for the next ten years @ $2.75 billion a
year, which will surely hamper the economic outlook. Also spoke about
home ownership and stressed what Mr. Nesmith said. He. stated that HUD
would like to eliminate homelessness in ten years. By some of the HUD
proposals, members questioned the idea of faith based organizations
receiving public funds. Supposedly separation of Church and State. This
question was never fully answered by Mr. Nesmith. Also, where do college
students go for housing. Answer, the American Dream Act as explained in

prior statement. RE: FHA, Commissioner from South Carolina questioned
job loss in his State (160,000) was told there would be retraining. However,
did not say what the retraining would be. There were many questions, but
basically they all related to the same subjects, jobs lost, and monies to faith
based organizations, few left with satisfied answers.
General Meeting 3/7/04
Greeted by Mayor Anthony A. Williams, Mayor of Washington DC.
Also 1" Vice President of National League of Cities. Presentation of colors,
National Anthem. Mayor Williams spoke about the next speaker, the Mayor
of Paris, France, had met him many times. Introduced Mayor Bertrand
Delanoe. The Mayor spoke in English with a very heavy French accent.
Said he had a very deep respect and friendship for the American people,
despite the differences we may have regarding the war in Iraq, loves this
country, has visited it many times. We must all be together to eradicate
terrorism. We all face a daily challenge for security, show solidarity against
drug abuse and are against any form of discrimination. That all cities of the
world should share ideas, create a partnership and create a strong union of
cities. His last comment was that the City of Paris was about to erect a
statue to honor Thomas Jefferson. He said that the people of France, and
especially Paris, much admired Jefferson. Mayor Delanoe certainly had all
the grace and charm that Europeans seem to have.
Mayor then introduced Bart Peterson, Mayor of Indianapolis, Host of
Congress of Cities in 2004. Started by saying to honor the Mayor of France
he would speak in French (joke). Said Indianapolis last hosted the National
League of Cities in 1984. Since then they have eliminated the horse and
buggy. Now have a thriving downtown area with new shopping, restaurants,
hotels. These are all connected by Sky Walks, host of things to see. Wishes
All have a great convention, to do a great deal of good work and enjoy the
City.
Mayor Williams then introduced Charles Lyons, Selectman of
Arlington, Massachusetts, President of the National League of Cities. The
NLC is the oldest organization of its kind. We must make sure that the
American people have strong cities. Join together and speak with one voice,
Homeland Security, Housing and Transportation are items we must lobby
for. A strong nation must have strong cities. All cities are suffering from
unfunded federal mandates. Stated that many cities had to raise taxes and

lay off personnel. The 1862 Homestead Act and Land Grant Colleges
provided 75% of engineers, created a middle class. Ten days after the
Normandy Invasion in 1943, President Roosevelt created the G. I. Bill of
Rights. Shows that strong leadership gets the right results. No pandering as
many federal and local officials do. Federal government should invest in
downtown America. Congress should follow this lead. This is not the time
to retreat from the cities that make this nation great: cities make the
American Dream possible. Our priorities to ask Congress to strengthen
cities. We protect the Homeland, fight crime, give affordable housing and
work as partners with the Federal Government.
1. Local support for first responders.
2. Help for the COPS program, Gun Safety, $15 Billion in Highway
Trust Fund not used. For each billion spent will create 47,000 jobs.
3. No Child Left Behind Act under funded; puts burden on states and
cities.
4. Affordable housing, large cuts in CBGB.
President Lyons spoke with great passion and spirit.
Mayor Williams then introduced Mark Sheilds, the next speaker who
is a political commentator, columnist and moderator for CNN's Capital
Gang. This man spoke for approximately 45 to 60 minutes, apparently
without any written notes. Unfortunately he was so good and hilariously
funny I could take but few notes. The one liners were as witty as could be
and came so fast it was not possible to record them. He did speak earnestly
about elected officials who seek public office and risk rejection as we do so.
Mr. Sheilds worked for Morris Udall and Michael Dukakis. So he is aware
of what rejection is. Many of us, Thank God, are the eternal optimists and
are interested in results rather than votes.
General Meeting 3
Speaker Bill Frist, Senate Majority Leader, Republican, Tennessee.
This administration accepted a recession when it was inaugurated left from
the previous administration (ha -ha-ha), then they had 9-11, then Iraq (I
question how long they are going to rely on 9-11 and accept responsibility
for their intelligence or lack thereof). Says this administration is very
sensitive to our local challenges. His concerns are health care (he is a
physician), pensions and public and this administration is working on all

these problems. For the first time since 1931 the Federal Reserve Dollars
have declined. Knows what has to be done, also knows what will be done.
He did not elaborate. Says 18% of the Federal Budget goes to grants, new
Medicare bill was budgeted for $450 billion but as we are now aware, the
cost has risen by another $140 billion (in all candor no one really knows the
answer). On education: schools are not performing as well as they should.
$40 billion budgeted for the year 2005. Still the No Child Left Behind Bill
is considerably under funded and locals will have to pick up the slack. On
welfare, the case load has been cut in half since 1996. However, the budget
dollars remain the same. On transportation, passed $290 billion for 6 years
as of 2/12/04. Finally we must all work together.
Our next speaker Orin Hatch, Chairman of the Judiciary Committee,
has been in Congress for 48 years. Also states that 9-11 has changed our
lives. On homeland security, Federal Government should be responsible on
the highest level. S.B. 1245 will ensure the equitable allocation of monies,
is a strong believer in the (so-called) Patriot Act, says it only enforces
certain aspects of the law. To date there have not been any abuses..
However, further hearings will be held on the Act. On public safety (does
not include first responders) Federal grants in the amount of $880 million
dollars will be awarded in 2004. On gun violence, he voted against the
Assault Weapon bill. Last he very much admired the work that local people
are charged with and do.
Next Senator Susan Collins, Republican, Maine. That 9-11 added to
the burden of our responsibilities. Cities may become the new battleground.
We can no longer accept the pettiness between the various agencies. She
chairs the Homeland Security Committee. Seaports are our biggest
vulnerability. However, small cities just as vulnerable. Proposed legislation
to make sure monies flow from State to local cities. This year's budget One
Billion Dollars for Homeland Security, Seven Hundred Million less than last
year (1 can't figure that one out). A couple of points she made to those in
the audience:
1. Our advocacy matters because we are closest to the people.
2. Urge the National League of Cities to listen to smaller cities,
work together so that we may receive the proper funding.
Next was J.C. Watts, former Congressman from Oklahoma. Sees two
different futures in the coming election. Thinks Bush will be re-elected in a

very close race. The war in Iraq is going well (where has he been), tax
reductions are good for the economy. Says demand on consumer goods
going well, believes the Republicans will keep the majority in the House and
Senate. On welfare, if married and father in the house take all assistance
away regardless of income level. On education, he made what I believe to
be a great statement "If the President can live in public housing and send his
children to private schools, so should poor people be able to do the same".
Next Mike McCurry, former press secretary to President Clinton.
Says humility, kindness and justice sorely missing in Washington. That 16
to 18 states will decide the election. Karl Rove is a genius in organization
for the Republican Party. We are being pillared from many countries
throughout the world, although the USA wants respect, however at this time
with this administration's arrogance and unilateral decisions, it's a tough
item to get. Now that we are in this position we need someone who can
truly inspire us to our deserved greatness. The huge deficit that we are
incurring ($500 Billion and counting) will continue to put crimps in the
Federal Budget. This can be one of the nastiest election years, or we, the
public can demand that they debate the true issues: economy, homeland
security, taxes. Wished us all good luck in our endeavors.

I had an appointment with the Turkish Ambassador, Mr. Faruk
Logoglu, PHD. If we talk about security, we can certainly learn from these
people. I arrived by cab at about 1:30 PM for my 2:00 PM appointment. As
I walked to the iron gate, a security agent approached me. I informed him I
had an appointment with the Ambassador. He asked for identification, then
phoned into the Embassy. I was then let though the iron gate to walk into
the Embassy. I was greeted by another security agent again, identified
myself, put my case and coat on a system used by the airport. I was buzzed
through a door that seemed to weigh a ton. I was then escorted to the
elevator (which was steel encased) up to the Ambassador's office.
Ambassador Logoglu, a soft-spoken gentleman introduced himself and
asked what he can do to help in my endeavor. I explained that I had visited
his country and more specifically, the City of Fatsa which is our sister city. I
explained that I was working with several Turkish -American businessmen
and we were attempting to set up a form of a bazaar which would display the
wares that could be sold. I informed the Ambassador that we were looking
at a space in Tamarac Commerce Park of about 50,000 square feet. We

spoke for about 15 minutes and then introduced me to his assistant for Trade
and Commerce Mr. Fikert Artan. Went through the same verbiage as with
the Ambassador. He then asked me to send him all the information that I
have on the subject which I will be doing very shortly. I was then escorted
to another elevator to return to the first floor where they graciously phoned a
cab for me.
Then went to the Hart Building for a meeting with Senator Nelson's
Legislative correspondent Susan Perez. I discussed with her my concerns
about the No Child Left Behind Act which is about $8 Billion dollars under
funded, the Transportation Act and the Notch Baby problem. She assured
me she would speak to the Senator about my concerns and would let me
know how the Senator sees these issues.

resident of the Woodlands Community, I commend you for your advocacy on behalf of

Please allow this a mail to serve as further records of what was verbally said by me at the Woodlands Country
Club..At this time i would like to itemize for you some of the problem areas that will be of concern in making this
decision...
1. Approximately 200 or less people attended the meeting representing approximately 100 homes or less at the
meeting. They were mostly retirees which no longer make up the bulk of the people moving into the woodlands.
This is no longer an inexpensive retirement community as it had been in the late 1960's and can no longer be
treated as such -we now have additional schools in Tamarac. There have been many law suits filed and won in
favor of the younger generations against the 55 and over communities which have now been forced to open their
doors.
2. Verbage on this overlay was ambiguous on many points ,leaving openings for future lawsuits in many
areas ... one of these areas was Truck use..Many people today are driving trucks and SUVs and this is the way of
the future.
3. As there was only 10% of the homeowners represented at the meeting it is unfair for a municipality to follow the
guidelines given to them by a few people. This city needs to have an individual vote when it creates overlays that
exceed the cities already fine restrictions.
Many areas therefore need to be addressed and an actual vote from all 892 homeowners is really needed for an
action such as this. The amount of homeowners required to implement these new changes should be at least
75%.
My personal opinion as previously stated at the meeting was: I feel that the city of Tamarac has one of the finest
reputations for both safety and presentation of a community and as a result the prices are on the rise.
Furthermore we are becoming a younger community and this is no longer a retirement environment. Let me point
out that years ago the Woodlands was sued and lost in federal appeals court when they tried to keep out young
people with children. We are a progressive environment and that is one of the main reasons that there should be
a vote of all the 892 homeowners.

There were approximately 200 attending the Woodlands CC Overlay District meeting on Feb 10th which
represents approximately 100 homeowners,assuming 2 from each home attended. This represents approximately
11 % of the 892 existing homes in the Woodlands. Of the 14 homeowners who spoke at this meeting, 2 were
against the proposed Overlay which represents 15% in opposition. Because this proposal is a very important
matter to all 892 homeowners, it is in the best interest of those 892 homeowners and the City of Tamarac to
obtain a more accurate opinion of this new Overlay proposal with it's implications by mailing a questionnaire to
those homeowners effected for their approval or disapproval and that questionnaire should be mailed directly
back to City officials. If there is a 75% approval of the Overlay, the City should implement the Overlay.lf there is
not a 75% approval, the City should not implement the Overlay. If the Overlay is implemented by Tamarac, you
may be sure other deed restricted communities will want similar City Overlays for their communities because it
would be less expensive and less time consuming for those communities to have Tamarac manage their
communities, while on the other hand, it would be more expensive and time consuming for the City of Tamarac. I
would appreicate some of your feelings regarding the above matter.
