HomeMy WebLinkAbout2005-09-14 - City Commission Special Meeting MinutesCITY OF TAMARAC SPECIAL CITY COMMISSION MEETING CITY HALL CHAMBERS WEDNESDAY SEPTEMBER 14, 2005 CALL TO ORDER: Mayor Schreiber called the Special Meeting of the City Commission to order on Wednesday, September 14, 2005 at 6:30 p.m., in the Commission Chambers at Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, Florida. PRESENT: Mayor Joe Schreiber, Vice Mayor Beth Flansbaum-Talabisco, Commissioner Edward C. Portner, Commissioner Marc L. Sultanof, and Commissioner Karen L. Roberts. ALSO PRESENT: City Manager Jeffrey L. Miller, Interim City Attorney Samuel S. Goren, and City Clerk Marion Swenson. Commissioner Roberts led the pledge of allegiance. Mayor Schreiber said this is a special meeting of the City Commission of the City of Tamarac for the public hearings on the proposed millage and tentative budget for Fiscal Year 2006. Before the first public hearing begins, the City Manager has a statement. City Manager Miller said in accordance with TRIM he is required to read the following statement: The tentative General Fund budget of $43,267,300 is more than the Fiscal Year 2005 adopted budget of $39,662,600. The City proposed to levy a millage rate of 6.2499 for General operating purposes, which is an 18.72% increase over the rolled - back rate of 5.2646 mills. The proposed Debt Service millage rate of .3530 mills is a decrease from the current Debt Service millage rate of .4097 mills. Mayor Schreiber opened the public hearing on the proposed millage rate for Fiscal Year 2006. Elayne Weisburd, 7997 Exeter Blvd. W., Bernard Herman, 7877 Granville Drive, Burt Schneider, 8016 NW 72 Street, Robert Verraster, 8120 NW 73 Terrace, Ami Adzer (sic), 7900 NW 71 Avenue, Jessica Schneider, 7804 Trent Drive, and Michael Karch, Tamarac, spoke in opposition to the increase in the ad valorem tax. Sheldon Kulik, 8905 NW 70 Street, questioned the Fire Assessment. Elayne Weisburd, 7997 Exeter Blvd W., and Burt Schneider, 8016 NW 72 Street, spoke in favor of the Fire Assessment. Kay Tatum, 6193 Rock Island Road, spoke on behalf of Family Central. Commissioner Sultanof spoke of the perceived surplus and the budget consistent with Florida Statutes and the City Charter. Director of Financial Services Chapman gave a presentation. Vice Mayor Flansbaum-Talabisco thanked everyone for coming to the meeting and spoke of leadership. Vice Mayor Flansbaum-Talabisco said the tax increase amounts to 7¢ a day and the programs and facilities will benefit all the residents. Over the past months she has stated she loves all the projects contemplated but would prefer to see alternative funding; however after doing some research on the numbers she is in favor of the increase. September 14, 2005 Page 1 of 3 Commissioner Portner said he appreciated everyone attending this evening's meeting, and said the increase amounts to $30.00 for each $100,000. There has not been a tax increase for the past five years, and as a citizen of Tamarac, Commissioner Portner said he is happy to contribute his tax increase to the development of the city. Commissioner Roberts agreed with Commissioner Portner and Vice Mayor Flansbaum- Talabisco, and expressed surprise at Burt Schneider's opposition to the tax increase. Additionally, Commissioner Roberts said that five years ago Woodmont residents decided instead of a utility tax they would rather the Mayor and City Commission raise the millage rate, which has stayed the same longer than was anticipated. Mayor Schreiber said he believes the Mayor and City Commission should listen to the people; the people own the government. Mayor Schreiber said he opposes the increase and read a report into the record (a copy of which is attached and incorporated as part of these minutes). Mayor Schreiber spoke about the contingency fund and the investment fund. 3. Mayor Schreiber opened the public hearing on the Fire Rescue Special Assessment. Tammy Moore, 5517 NW 59t" Place questioned the Four Dollar increase and also questioned whether this assessment has to do with the Pembroke Pines case. Commissioner Sultanof said it is the Ft. Lauderdale case. City Manager Miller explained each year the Fire Department is evaluated by consultants, and the $4.00 increase will maintain the services we already have. This assessment is paid by all residents and businesses in Tamarac. 4. Mayor Schreiber opened the public hearing on the tentative General Fund and Other Fund budgets and no one wished to speak. 5. ADOPTING MILLAGE FOR THE 2005 TAX ROLL: (TO2092) Motion to adopt ordinance on first reading adopting the millage for the 2005 tax roll; levying a tax for general operations on all properties for the Fiscal Year 2006; levying a tax for the payment of principal and interest for bonded indebtedness; providing for conflicts; providing for severability; and providing for an effective date. Interim City Attorney Goren read Temporary Ordinance 2092, Revised 09/08/05, on first reading by title. Commissioner Portner seconded by Commissioner Sultanof moved approval. On roll call Commissioner Sultanof voted "yes", Vice Mayor Flansbaum-Talabisco "yes", Mayor Schreiber "no", Commissioner Roberts "yes", and Commissioner Portner "yes". Motion carried. APPROVED ON FIRST READING SEPTEMBER 14, 2005 6. FIRE RESCUE ASSESSMENT: (TR10777) Motion to approve Resolution relating to the provision of fire rescue services, facilities and programs in the City of Tamarac, Florida; reimposing Fire Rescue Assessments against Assessed Property located within the City of Tamarac for the Fiscal Year beginning October 1, 2005; approving the rate of assessment; approving the Assessment Roll; providing for conflicts; providing for severability; providing an effective date. Interim City Attorney Goren read Temporary Resolution 10777 by title. Commissioner Sultanof seconded by September 14, 2005 Page 2 of 3 Commissioner Portner moved approval. On roll call Commissioner Roberts voted "yes", Commissioner Sultanof "yes", Commissioner Portner "yes", Vice Mayor Flansbaum- Talabisco "yes", and Mayor Schreiber "yes". Motion carried. RESOLUTION NO. R2005-162 7. TENTATIVE GENERAL FUND AND OTHER FUND BUDGETS FOR FY2006: (TO2091) Motion to adopt ordinance on first reading adopting the budget for the General Fund and each of the other Operating Funds and the Capital Improvements Fund for the fiscal year 2006; allocating, appropriating, and authorizing expenditures as presented in the budget; providing for the revenues necessary to fund the expenditures of each of the funds; authorizing budgetary control by department total for all appropriations; providing for conflicts; providing for severability; and providing for an effective date. Interim City Attorney Goren read Temporary Ordinance 2091 on first reading by title. Vice Mayor Flansbaum-Talabisco seconded by Commissioner Portner moved approval. On roll call Mayor Schreiber voted "yes", Commissioner Sultanof "yes", Commissioner Roberts "no", Commissioner Portner `yes", and Vice Mayor Flansbaum-Talabisco "yes". Motion carried. APPROVED ON FIRST READING SEPTEMBER 14, 2005 8. Mayor Schreiber announced the second public hearing on the budget will be held on Wednesday, September 21, 2005 at 6:30 p.m. in Chambers.
