SPECIAL CITY COMMISSION MEETING
CITY HALL CHAMBERS
FRIDAY, SEPTEMBER 15, 2000
CALL TO ORDER: Mayor Schreiber called the Special Meeting of the City Commission
to order at 9:05 A.M. on Friday, September 15, 2000 in Chambers at 7525 NW 88
Avenue, Tamarac, FL.
ROLL CALL: Mayor Joe Schreiber, Vice Mayor Karen L. Roberts, Commissioner
Edward C. Portner, and Commissioner Marc L. Sultanof
ABSENT AND EXCUSED FOR CAUSE: Commissioner Larry Mishkin
ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Mitchell S. Kraft, and
City Clerk Marion Swenson
PLEDGE OF ALLEGIANCE: Mayor Schreiber called for the pledge of allegiance.
Vice Mayor Roberts, Commissioner Portner and Commissioner Sultanof apologized to
the residents for Wednesday evening's meeting, and asked Mayor Schreiber to extend
an apology to Commissioner Portner and the rest of the Commissioners. Mayor
Schreiber extended an apology to the residents of Tamarac.
1. Commissioner Sultanof seconded by Commissioner Partner moved to approve
all items on the consent agenda. On roll call Commissioner Sultanof voted "yes",
Commissioner Partner "yes", Vice Mayor Roberts "yes", and Mayor Schreiber "yes".
a. APPROVE the minutes of the August 23, 2000 Commission meeting.

b. NORTH SECTION 7 ASSESSMENT AREA: (TR9114) Approving an
assessment roll for the North Section 7 Assessment Area, including delinquency
amounts; establishing the lien associated therewith; directing that the
assessment rolls be certified to the Broward County Tax Collector; and providing
an effective date.

C. UTILITY EASEMENT ENCROACHMENT AND HOLD HARMLESS
AGREEMENT - ALAZHAR SCHOOL: (TR9102) Accepting and executing a
Utility Easement Encroachment and Hold Harmless Agreement with Alazhar
School for curbing and sidewalks placed in a utility easement at the Alazhar
School Project located at 7201 West McNab Road,

d. MODULAR BUILDING RENTAL: (TR9111) Accepting a proposal from
Advanced Modular Systems, Inc. and issuing a Purchase Order for the rental of
an office trailer for an initial two-year period with month -to -month extensions as
required and/or necessary; authorizing an expenditure of funds in an amount not
to exceed $37,258.00.
RESOLUTION NO. R-2000-230
e. AWARD OF BID 00-17B LIME SLUDGE REMOVAL, HAULING AND
DISPOSAL: (TR9097) Authorizing the award of bid #00-1713 "Lime Sludge
Removal, Hauling, and Disposal" to DRD Enterprises, Inc. of Davie for an
amount not to exceed $63,250 annually beginning October 1, 2000 through
September 30, 2002 with two additional two year renewal options.

f. WAIVER OF PERMIT FEES - LOWES: (TR9130) Approving a request from
Lowe's to waive all permit fees for the installation of hurricane shutters at 7809
and 7619 NW 71" Ave.

g. WAIVER OF FEES PERMITS AND OCCUPATIONAL LICENSE FEES FOR
TAMARAC DAY: (TR9122) Approving a request from the Tamarac Chamber of
Commerce to Waive all Permit Fees and Occupational License Fees for the
Tamarac Days Events to be held at the Tamarac Parks & Recreation Center on
Saturday, October 28, 2000 from 10:00 A.M. to 9:00 P.M., and Sunday, October
29, 2000 from 10:00 A.M. to 4:00 P.M.
RESOLUTION NO. R-2000-233
h. TAMARAC DAYS — IN KIND SERVICES: (TR9120) Approving the provision of
requested in kind services to the Tamarac Chamber of Commerce by the City for
Tamarac Days.
RESOLUTION NO. R-2000-234
i. SOLID WASTE MONTHLY FEE INCREASE - ALL SERVICE REFUSE:
(TR9112) Increasing the single family Solid Waste collection rate from $14.74 to
$15.57 per month; authorizing All Service Refuse Company, Inc. to increase the
cost of City logo bags from $1.15 to $1.22 per bag, effective October 1, 2000.

j. MUTLI-FAMILY GARBAGE RATE INCREASE - SOUTHERN SANITATION:
(TR9113) Approving the rate increase by Southern Sanitation for residential
multi -family solid waste service by $0.18 per cubic yard and an aggregate
increase of 3% effective October 1, 2000.

k. RELEASE PERFORMANCE BOND - COMMERCIAL BOULEVARD AND
PROSPECT ROAD: (TR9121) Releasing performance bond (letter of credit
#1172) in the amount of $2,779.92 posted for the paving and drainage for
Commercial Shoppes Project located on the southwest corner of Commercial
Boulevard and Prospect Road,

I. SAFE PARKS AND LAND PRESERVATION BOND REFERENDUM: (TR9137)
Endorsing the Safe Parks and Land Preservation Bond Program and urging the
voters to approve the Safe Parks and Land Preservation Bond Referendum on
November 7, 2000.
RESOLUTION NO. R-2000-238
M. SUPPORTING "THE EVERGLADES, AN AME_ RICAN LEGACY ACT," S. 2797:
(TR9128) Supporting the "Restoration of The Everglades, an American Legacy
Act," S.2797. Directing the City Clerk to send a certified copy of this Resolution
to the Speakers of the United States Senate and the House of Representatives.
RESOLUTION NO. R-2000-239
n. THREE PERCENT 3% ADJUSTMENT IN THE BARGAINING UNIT PAY
PLAN: (TR9131) Authorizing a three percent (3%) adjustment to the minimum
and a three percent (3%) adjustment to the maximum of the pay ranges in the
bargaining unit pay plan.
RESOLUTION NO. R-2000-240
o. SERVING ALCOHOL AT THE GRAND OPENING OF THE COMMUNITY
CENTER: (TR9133) Permitting the sale and consumption of alcoholic beverages
at the Tamarac Community Center for the grand opening ceremonies taking
place on Sunday, September 17, 2000.

2. AWARD FROM THE FLORIDA MOTOR VEHICLE THEFT PREVENTION
AUTHORITY: (TO1911) Motion to adopt Ordinance on first reading granting an award
from the Florida Motor Vehicle Theft Prevention Authority in the amount of $14,410 and
authorizing an agreement between the Authority and the City. City Attorney Kraft read
Temporary Ordinance 1911 on first reading by title. Commissioner Portner seconded
by Commissioner Sultanof moved approval. On roll call Commissioner Portner voted
"yes", Commissioner Sultanof "yes", Vice Mayor Roberts "yes", and Mayor Schreiber
"yes". Motion carried.

EMERGENCY ORDINANCES
3. MOTION TO APPROVE TEMPORARY ORDINANCE 1908 AS AN
EMERGENCY ORDINANCE: CHAPTER 16, PENSIONS AND RETIREMENT,
ARTICLE VII POLICE OFFICERS: (TO1908) Motion to adopt ordinance on second
reading amending Chapter 16, Pensions and Retirement, Article VII Police Officers
Declaration of Trust and Article VIII Police Officer Pension Plan; providing for the
deletion of all -references to employees and replacing the term with police officer;

providing for the reference to Chapter 185 Florida Statutes relating to the return to work
from military service; providing for the deletion of provisions relating to non -covered
employment; providing for compliance with Chapter 185 Florida Statutes relating to pre -
retirement death benefits and lump sum payments; providing for a savings clause;
providing for severability; providing for codification and providing for an effective date.
City Attorney Kraft read Temporary Ordinance 1908, Revision #3, on second reading by
title. Commissioner Portner seconded by Commissioner Sultanof moved approval.
Mayor Schreiber opened the public hearing. With no one wishing to speak, Mayor
Schreiber closed the public hearing. On roll call Commissioner Portner voted "yes",
Commissioner Sultanof "yes", Vice Mayor Roberts "yes", and Mayor Schreiber "yes".
Motion carried.
ORDINANCE NO. 0-2000-25
Burt Schneider, 8016 NW 72 Street, Tamarac, commended the City Clerk's office for
the assistance they provided to him. Mr. Schneider indicated that budget review
meetings should be included in the Tam -A -Gram, and mentioned Wednesday's meeting
and the grand opening of the Community Center.
4. MOTION TO APPROVE TEMPORARY ORDINANCE 1909 AS AN
EMERGENCY ORDINANCE: CHAPTER 16, PENSIONS AND RETIREMENT,
ARTICLE V FIREFIGHTERS: (TO1909) Motion to adopt ordinance on second reading
amending Chapter 16, Pensions and Retirement, Article V Firefighters Declaration of
Trust and Article VI Firefighter Pension Plan; providing for the deletion of all references
to employees and replacing the term with firefighter; providing for the reference to
Chapter 175 Florida Statutes relating to the return to work from military service;
providing for the deletion of provisions relating to non -covered employment; providing
for compliance with Chapter 175 Florida Statutes relating to pre -retirement death
benefits; providing for a savings clause; providing for severability; providing for
codification and providing for an effective date. City Attorney Kraft read Temporary

seconded by Commissioner Sultanof moved approval. Mayor Schreiber opened the

There being no further business to come before the City Commission, Mayor Schreiber
adjourned the Special Meeting of the City Commission at 9:20 a.m.
