SPECIAL CITY COMMISSION MEETING
CALL TO ORDER: Mayor Flansbaum-Talabisco called the Special Meeting of the City
Commission to order at 9:00 a.m. on Monday, October 15, 2007, in Conference Room
105 at Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL.
PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Marc L. Sultanof,
Commissioner Patte Atkins -Grad, and Commissioner Harry Dressler.
ABSENT: Commissioner Edward C. Portner.
ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Samuel S. Goren, and
City Clerk Marion Swenson.
PLEDGE OF ALLEGIANCE: Mayor Flansbaum-Talabisco led the pledge of allegiance.
1. Request for authorization of Shade Session to be held on Tuesday, October 16,
2007, beginning at 9:30 a.m. in Room 105, Tamarac City Hall, 7525 NW 88 Avenue,
Tamarac, FL to discuss the following lawsuits: B. Commercial, Inc., a Florida
corporation, et al., v. City of Tamarac, Florida, a municipality of the State of Florida,
(Case No. 0725250 02), and Cinnamon Tree Plaza, Inc., a Florida corporation v. City of
Tamarac, Florida, a municipal corporation of the State of Florida, (Case No. 07025413
04).
City Attorney Goren said the City of Tamarac is a defendant in the above -two lawsuits,
which challenge the City's imposition of a special assessment regarding Main Street.
On Friday, both Plaintiffs filed petitions for an emergency hearing and injunction for
collecting the assessments for Main Street. Assistant City Attorney Mike Cirullo and Ed
Dion, Special Counsel are in court this morning asking for consolidation of both cases
before one judge, and for an expedited treatment for the injunction hearing; they will
ask to have the hearing deferred until tomorrow, after our Shade Session. City Attorney
Goren explained the process for the Shade Session and asked for a motion authorizing
the session to be held on Tuesday, October 16, 2007 at 9:30 a.m.
Commissioner Dressler seconded by Vice Mayor Sultanof moved for a Shade Session
to be held on Tuesday, October 16, 2007, at 9:30 a.m. in Room 105, Tamarac City Hall.
On roll call, Commissioner Atkins -Grad voted "yes", Vice Mayor Sultanof "yes",
Commissioner Dressler "yes", and Mayor Flansbaum-Talabisco "yes". City Attorney
Goren said the notice will be posted, giving 24 hour's legal notice for the Shade
Session. Those present at the Shade Session will be the Mayor and City Commission,
City Manager Miller, City Attorney Goren, Assistant City Attorney Cirullo, Ed Dion,
Special Counsel and a Court Reporter. Mayor Flansbaum-Talabisco confirmed all
members of the Commission were noticed for the meeting. City Attorney Goren said
this is an emergency procedure and can not be postponed.

There being no further business to come before the Mayor and City Commission, Mayor
Flansbaum-Talabisco adjourned the Special Meeting at 9:10 a.m.
