CITY COMMISSION OF TAMARAC, FLORIDA
CALL TO ORDER: Mayor Schreiber called the Special Meeting of the City Commission
to order at 2:30 p.m. on Thursday, November 8, 2001, in Conference Room 105 at
Tamarac City Hall, 7525 NW 88 Avenue, Tamarac, FL.
PRESENT: Mayor Joe Schreiber, Vice Mayor Marc L. Sultanof, Commissioner Edward
C. Portner, Commissioner Gertrude Mishkin, and Commissioner Karen L. Roberts.
ALk PRESENT: City Manager Jeffrey L. Miller, City Attorney Mitchell S. Kraft,
Assistant City Attorney Vanessa T. Steinerts, City Clerk Marion Swenson, Special
Counsel Michael T. Burke, and Court Reporter Katherine Milam.
City Attorney Kraft stated the purpose of the closed -door meeting is that the City
Attorney desires advice concerning litigation regarding Nob Hill Landings, L.L.C. vs. City
of Tamarac, Case #01-16152(08).
Mayor Schreiber said the length of the closed -door session is anticipated to be
approximately one hour. In accordance with Section 286.011(8)(2001), F.S., Mayor
Schreiber announced those who would be present at the closed door session: Mayor
Joe Schreiber, Vice Mayor Marc L. Sultanof, Commissioner Edward C. Portner,
Commissioner Gertrude Mishkin, Commissioner Karen L. Roberts, City Manager Jeffrey
L. Miller, City Attorney Mitchell S. Kraft, Assistant City Attorney Vanessa T. Steinerts,
Special Counsel Michael T. Burke, and Court Reporter Katherine Milam. The special
meeting would be recessed and the City Clerk would leave the room, and when the
closed -door session is over, the City Clerk would be brought back into the room, and
the special meeting reconvened. The closed -door session is closed to the public.
Mayor Schreiber recessed the special meeting at 2:40 p.m.

ATTORNEY -CLIENT SESSION
Pursuant to Florida Statutes 286.011(8)(2001), the City Commission held an attorney -
client session concerning Nab Hill Landings, L.L.C. vs. City of Tamarac, Case #01-
16152(08), at 2:40 p.m. on Thursday, November 8, 2001, attended by Mayor Joe
Schreiber, Vice Mayor Marc L. Sultanof, Commissioner Edward C. Portner,
Commissioner Gertrude Mishkin, Commissioner Karen L. Roberts, City Attorney
Mitchell S. Kraft, Assistant City Attorney Vanessa T. Steinerts, City Manager Jeffrey L.
Miller, Michael Burke, Special Counsel, and Katherine Milam, Court Reporter. In
accordance with Section 286.011(8) (2001), F.S., Katherine Milam, Court Reporter, will ;
prepare a transcript of this session.

Mayor Schreiber reconvened the special meeting of the City Commission at 3:00 p.m.
Commissioner Portner seconded by Commissioner Mishkin moved to reconsider
Temporary Resolution 9432, Special Exception — Westwood Apartments; Temporary
Resolution 9433, Issuing Revised Development Order No. 229.5 and granting New
Development Site Plan approval — Westwood Apartments; and Temporary Resolution
9404, Water and Sewer Developer's Agreement — Westwood Apartments, on
December 12, 2001 at or after 7:00 p.m. in Chambers at Tamarac City Hall, 7525 NW
88 Avenue, Tamarac, FL.
SPECIAL EXCEPTION - WESTWOOD APARTMENTS: (TR9432) Motion to approve
Resolution granting a Special Exception to allow the construction of more than one (1)
principal building on a plot in an R-4A (Planned Apartment District) zoning category to
Westwood Apartments, located on Nab Hill Road and Westwood Drive; specifically
Parcel "A" of the "Nob Hill/Westwood Plat", according to the Plat thereof as recorded in
Plat Book 144, Page 3 of the public records of Broward County, Florida; Case No. 2-Z-
01; providing for conditions of approval.
REVISED DEVELOPMENT ORDER - WESTWOOD APARTMENTS (TR9433) Motion
to approve Resolution issuing Revised Development Order No. 229.5 and granting New
Development Site Plan approval to Westwood Apartments to allow the construction of
sixty-two (62) garden apartment units with associated parking, landscaping and
infrastructure improvements, located at Nob Hill Road and Westwood Drive; specifically
Parcel "A" of the "Nob Hill/Westwood Plat", according to the Plat thereof as recorded in
Plat Book 144, Page 3 of the public records of Broward County, Florida; Case No. 2-
SP-01.
WATER AND SEWER DEVELOPER'S AGREEMENT - WESTWOOD APARTMENTS
(NOT PUBLIC HEARING): (TR9404) Motion to approve Resolution accepting and
executing a Water and Sewer Developer's Agreement with Nab Hill Landings, L.L.C.,
for the Westwood Apartments Project, located on the north side of Westwood Drive just
east of Nab Hill Road for three residential water and sewer building connections
requiring 45.9 ERC's for water and 45.9 ERC's for sewer; requiring the payment of
$146,880.00 in CIAC fees; authorizing and directing the City Clerk to record said
Agreement in the public records of Broward County. On roll call Commissioner Partner
voted "yes", Commissioner Mishkin "yes", Vice Mayor Sultanof "no", Commissioner
Portner "yes", and Commissioner Roberts "yes". Motion carried.
There being no further business to come before the City Commission, Mayor Schreiber
adjourned the special meeting at 3:05 p.m.
