CITY COMMISSION WORKSHOP MEETING
MONDAY, FEBRUARY 9, 2009
CONFERENCE ROOM 105
CALL TO ORDER: Mayor Flansbaum-Talabisco called the workshop meeting of the
City Commission to order at 9:30 a.m. In Conference Room 105 at Tamarac City Hall,
7525 NW 88 Avenue, Tamarac, FL.
PRESENT: Mayor Beth Flansbaum-Talabisco, Vice Mayor Patricia Atkins -Grad,
Commissioner Pamela Bushnell, Commissioner Diane Glasser, and Commissioner
Harry Dressler,
ALSO PRESENT: Deputy City Manager/Interim Financial Services Director Michael C.
Cernech, City Attorney Samuel S. Goren, Assistant City Manager Diane Phillips, and
City Clerk Marion Swenson.
Mayor Flansbaum-Talabisco led the pledge of allegiance.
1. Item No. 7 on the Regular Agenda. COMPREHENSIVE PLAN AMENDMENT:
T02171) Motion to adopt ordinance on first reading amending the Capital
Improvements Element, Intergovernmental Coordination Element, Infrastructure
Element and Conservation Element of the City of Tamarac's Comprehensive Plan
consistent with the City's Ten -Year Water Supply Facilities Plan; authorizing transmittal
of the 10 year Water Supply Facilities Plan and Comprehensive Plan Amendments to
the Department of Community Affairs and other agencies as required by Rule 9J-11,
F.A.C.; (Case No. 24-MI-08) providing for inclusion in the Comprehensive Plan;
providing for conflicts; providing for severability; and providing for an effective date.
Community Development Director Bramley and Assistant Director of Utilities Moore
gave presentations. Commissioner Glasser said she feels comfortable with the
advance projections. Vice Mayor Atkins -Grad confirmed the projected population.
Commissioner Bushnell questioned whether consideration has been given to ongoing
droughts and Assistant Director of Utilities Moore responded the District is meeting on
February 12th and will consider two-day a week watering. Commissioner Dressler
confirmed the DCA is being considered for sunsetting at the legislative level. Director of
Utilities Gagnon spoke of the long term solution to the water supply and regionalization.
2. Item No. 6(b) on the Consent Agenda. STATE ROAD 7 COLLABORATIVE
APPOINTMENTS: (TR11550) A resolution of the city Commission of the City of
Tamarac, Florida, appointing a voting delegate to the State Road 7 Collaborative,
appointing an alternate delegate to the State Road 7 Collaborative; providing for
conflicts; providing for severability; and providing for an effective date. Community
Development Director Bramley gave a presentation and said staff recommends
appointing a voting delegate and an alternate voting delegate, but staff does not
recommend the 15,000 donation to the collaborative. Vice Mayor Atkins -Grad and
Commissioner Dressler suggested Commissioner Bushnell to serve as the voting
delegate and Commissioner Bushnell and Commissioner Glasser suggested Vice
Mayor Atkins -Grad to serve as the alternate voting delegate. All were in agreement.
3. Item 6(c) on the Consent Agenda. CANTILEVER SHADE SYSTEM FOR
TAMARAC PARK BLEACHERS, (TR11557) Approving the purchase of a cantilever
shade system for the bleachers at Tamarac Park at a cost not to exceed $62,850.48,
from Shade Systems, Inc., utilizing the City of Jacksonville, Florida Bid #SC-0511-06
Price Agreement Contract for Park and Playground Equipment. Director of Parks and
Recreation Warner and Purchasing/Contracts Manager Glatz appeared. Director of
Parks and Recreation Warner gave a presentation. Mayor Flansbaum-Talabisco said
this is both for improvements and health issues. Vice Mayor Atkins -Grad said she is
happy to see we are providing shades. Commissioner Glasser said while we may be
under money constraints she would like to see this shade installed in other parks that
need coverage as well, and we should look to the State or County to see if there is
money available. Commissioner Bushnell questioned how the shades would be
manipulated during hurricane season and what material they are made of, and Director
of Parks and Recreation Warner said they have a quick release system that allows our
maintenance staff to take them down. The fabric is heavier than canvas and has a 10-
year warranty. Mayor Flansbaum-Talabisco questioned when the shades would be put
up and Director of Parks and Recreation Warner said there is a four -six week lead time,
and the shades will be up before the Recreation Center is completed.
4. Item 6(d) on the Consent Agenda. EMERGENCY OPERATION CENTER
UPGRADES: (TR11568) Authorizing submission of a grant application, acceptance and
execution of the grant agreement if awarded pending legal review, to the Department of
Homeland Security Emergency Operations Grant Program through the Florida Division
of Emergency Management for upgrades to the City of Tamarac Emergency Operations
Center in an amount not to exceed $55,600, providing for an in -kind match of $125,000
or a 25% cash match of $13,900 for a total project cost not to exceed $180,600. Fire
Chief Budzinski, Division Chief Moral, and Special Projects Coordinator Gresek
appeared. Special Projects Coordinator Gresek gave a presentation. Vice Mayor
Atkins -Grad confirmed lightning rods are included. Commissioner Dressier questioned
the $125,000 in -kind match and Fire Chief Budzinski explained the County's upgraded
software and how it interfaces with the local EOC's. There was discussion regarding
internet and fiber optics usage, as well as redundancies. Commissioner Bushnell
questioned how we find out about emergencies, and Fire Chief Budzinski explained
local emergencies v. those on the state and county level. Mayor Flansbaum-Talabisco
asked if the interoperability system we are lobbying for will tie into this and Assistant
City Manager Phillips explained the use of our radio system and this upgrade are both
components of our response capabilities. Mayor Flansbaum-Talabisco confirmed that
after a natural disaster the City of Tamarac works with FEMA.
5. Item No. 6(e) on the Consent Agenda. APPOINTING RESIDENT TRESTEE TO
THE POLICE PENSION BOARD: (TR11572) A resolution of the City Commission of
the City of Tamarac, Florida, appointing one resident trustee to the Police Pension
Board to serve a two-year term ending February 11, 2011 or until new appointments are
made; providing for conflicts; providing for severability; and providing an effective date.
6. Item No. 6(f) on the Consent Agenda. APPOINTING ONE RESIDENT
TRUSTEE TO THE FIREFIGHTERS PENSION BOARD: (TR11573) A resolution of the
City Commission of the City of Tamarac, Florida, appointing one resident trustee to the
Firefighters Pension Board to serve a two-year term ending February 11, 2011 or until
new appointments are made; providing for conflicts; providing for severability; and
providing an effective date. Mayor Flansbaum-Talabisco suggested Items 5 and 6 on
the consent agenda be discussed together. Human Resources Director Swanson gave
a presentation. All were in agreement to appoint Joe Schreiber to serve on the Police
Pension Board and appoint Rolando Hernandez to the Firefighters Pension Board.
Vice Mayor Atkins -Grad left the room at 10:24 a.m. and returned at 10:27 a.m.
7. UPDATE REGARDING RED LIGHT CAMERAS — HOUSE BILL 439: City
Attorney Goren gave a presentation, spoke of Tamarac's ordinance and explained the
....Bill should it pass. City Attorney Goren added several cities already have cameras in
place and those cities will begin ticketing March 1. If the Bill passes in Tallahassee,
those cities would then have to modify their ordinances. Commissioner Glasser
questioned the division of the fines and selection of locations for the cameras. City
Attorney Goren explained 3/5 of the fine would come to the cities and 2/5 would go to
the state. The vendor would provide appropriate locations for the cameras with the
City's input. There was discussion regarding the current situation with the traffic
magistrates and various scenarios with or without passage of the Bill pending in
Tallahassee. There was discussion regarding placement of cameras on State, County
and City roads. There was discussion regarding the process to find and hire a vendor
for the service, the vendor's responsibilities, the possibility of joining with surrounding
cities to contractor for a vendor, and economies of scale. Commissioner Dressler asked
who would authorize issuance of the citation and enforce the violation, and City Attorney
Goren said it would be a designated police officer or person in the police department.
Vice Mayor Atkins -Grad questioned red turn on red violations and City Attorney Goren
said that could be discussed with the vendors; the main issue at this point is running
through red lights at intersections. Commissioner Glasser and Vice Mayor Atkins -Grad
questioned state and county permission to place cameras on their roads
Mayor Flansbaum-Talabisco called for a recess at 11:05 a.m. and reconvened the
meeting at 11:15 a.m. with all present as before.
B Commissioner Bushnell questioned the pro card and Purchasing/Contracts Manager
Glatz explained the uses of the card and limitations. Commissioner Glasser said it is a
very good presentation and should be scaled down and presented at the Town Hall
meetings. Mayor Flansbaum-Talabisco agreed. Vice Mayor Atkins -Grad questioned
the sunshine law as it applies to purchasing, and said she would like to receive a copy
of the slide show. Mayor Flansbaum-Talabisco questioned conversations between
lobbyists and the Mayor and City Commission, and City Attorney Goren explained City
administration has the ability to regulate as part of the preparation of the documents.
Deputy City Manager /Interim Financial Services Director Cernech explained if language
regarding prohibition of conversation with lobbyists is included in an RFP, staff would
discuss that with the Mayor and City Commission prior to issuance of the RFP. We
have not utilized that provision up to this point in the City of Tamarac, which is
attributable to the Commission and the way our Commission conducts itself.
Commissioner Bushnell asked if the Mayor and City Commission could ask staff to
include that language and Deputy City Manager/Interim Financial Services Director
Cernech said yes. Commissioner Glasser spoke of the benefits and detriments
associated with talking to lobbyists.
There being no further business to come before the Mayor and City Commission, Mayor
Flansbaum-Talabisco adjourned the workshop meeting at 12:10 p.m.
