CITY COMMISSION WORKSHOP MEETING
MONDAY, MAY 24, 2004
CALL TO ORDER: Vice Mayor Sultanof called the Workshop Meeting of the City
Commission to order on Monday, May 24, 2004, at 9:30 a.m. in Room 105 of Tamarac
City Hall, 7525 NW 88t" Avenue, Tamarac, Florida.
PRESENT: Vice Mayor Marc L. Sultanof, Commissioner Edward C. Portner,
Commissioner Beth Flansbaum-Talabisco, and Commissioner Karen L. Roberts.
ABSENT: Mayor Joe Schreiber
ALSO PRESENT: City Manager Jeffrey L. Miller, City Attorney Mitchell S. Kraft, Deputy
City Manager Michael C. Cernech, and City Clerk Marion Swenson.
Pledge of allegiance led by Vice Mayor Marc L. Sultanof.
1. MAY 26 2004 AGENDA ITEMS:
a. Item No. 6(I). BID AWARD AND AGREEMENT — TAMARAC LAKES NORTH
AND THE BOULEVARDS WATER MAIN IMPROVEMENTS PROJECT: (TR10450)
Awarding Bid No. 04-16B to Petro Hydra, Inc., and executing an agreement between
the City of Tamarac and Petro Hydro, Inc., for an amount of $766,175.72 for the
Tamarac Lakes North and The Boulevards Water Main Improvements Project;
approving funding for this project from the appropriate 2004 Revenue Bond account;
authorizing the appropriate City Officials to administer the contract. Utilities Director Ray
Gagnon, Assistant Utilities Director Jim Moore and Purchasing/Contracts Manager Keith
Glatz appeared before the Commission. Assistant Utilities Director Moore gave a
presentation and responded to questions regarding disruption of the neighborhood as
the work progresses. Commissioner Portner asked if there is a difference in the quality
of work between the low and high bidders and Utilities Director Gagnon said no.
b. Item No. 6(g). CONTRACT AWARD — WATER TREATMENT PLANT
DISINFECTION SYSTEM IMPROVEMENTS: (TR10440) Awarding Bid No. 04-11 B to
Florida Design Contractors, Inc., and executing an agreement between the City of
Tamarac and Florida Design Contractors, Inc., for an amount of $1,436,350.00 for the
Water Treatment Plant Disinfection System Improvements Project; approving funding
for this project from the appropriate 2004 Revenue Bond Account; authorizing the
appropriate City Officials to administer the contract. Utilities Director Ray Gagnon and
Purchasing/Contracts Manager Keith Glatz appeared before the Commission. Utilities
Director Gagnon gave a presentation and said this is an unfunded mandate. Utilities
Director Gagnon added that the two remote stations would also be retrofitted and
responded to Vice Mayor Sultanofs questions regarding cost, storage and phasing in of
the new system. Utilities Director Gagnon explained the new and old systems will run
concurrently for a full day before the change over. Commissioner Roberts asked if the

water would taste different and Water Plant Superintendent Harvey said it will not be
noticeable, but plumbers may notice a difference in the stamina of the rubber gaskets
currently in use in toilets and sinks, as the black "O" rings may not hold up as well as
the red ones.
C. Item No. 6(m). SURPLUS _EQUIPMENT AND MATERIAL: (TR10453) Declaring
certain equipment and material as surplus and directing that certain computer
equipment be disposed of via donation to Tamarac Elementary School and Challenger
Elementary School. Network Manager Gary Feinstein and Purchasing/Contracts
Manager Keith Glatz appeared before the Commission. Network Manager Feinstein
gave a presentation and explained that Challenger and Tamarac Elementary Schools
would each get 25 computers.
d. Item No. 6(n). BID AWARD AND AGREEMENT — REPLACEMENT OF
GYMNASIUM FLOOR AT MULTI -PURPOSE CENTER: (TR10449) Awarding Bid #04-
10B, entitled "Replacement of Gymnasium Floor at Multi -Purpose Center," to the lowest
responsive and responsible bidder, Robbins Sport Floors South Florida, LLC;
authorizing the appropriate City officials to execute an agreement for Bid #04-10B in the
amount of $45,005.00 for the removal and replacement of the existing floor in the Multi -
Purpose Center gymnasium; approving funding from the appropriate Parks and
Recreation account. Parks and Recreation Director Kathleen Margoles, Assistant
Director of Parks and Recreation Greg Warner and Purchasing/Contracts Manager
Keith Glatz appeared before the Commission. Assistant Director of Parks and
Recreation Warner gave a presentation and said once the roof replacement is
completed at City Hall the contractor will then make repairs to the roof over the gym at
the Multi Purpose Center. Work on the floor should begin on August 9th, and it will take
approximately three weeks to complete. Vice Mayor Sultanof asked if acoustic sub
flooring will be used, and Assistant Director of Parks and Recreation Warner said a
shock pad will be used and the cement will be properly prepped. Commissioner
Roberts confirmed there would be notification to Tamarac Elementary School regarding
the availability of the gym. Commissioner Flansbaum-Talabisco asked if the center
would be painted and Assistant Director of Parks and Recreation Warner said it will be
painted prior to the installation of the floor.
e. Item No. 6(h). GRANT FUNDING — USA TENNIS FLORIDA: (TR10452)
Accepting grant funding from USA Tennis Florida in the amount of $2,500.00, with a
City match of $2,500.00, to help promote and develop tennis on City of Tamarac public
tennis courts; amending the grants fund budget during the next quarterly budget
actions. Parks and Recreation Director Kathleen Margoles gave a presentation. Vice
Mayor Sultanof confirmed that a schedule will be posted at the tennis courts on 77th
Street for the benefit of the residents. Commissioner Roberts asked that the used
tennis balls be given to her for the schools. Commissioner Portner asked about a golf
program and Parks and Recreation Director Margoles said several years ago there was
a program in conjunction with Monterey Golf Course. Commissioner Portner asked that
the Tiger Woods Foundation be looked into for a golf program.

f. Item No. 6(o). AGREEMENT — MAINTENANCE OF PUBLIC WATERWAYS
WITHIN WOODLANDS SUBDIVISION: (TR10456) Executing an agreement between
the City of Tamarac and the Woodlands Homeowners' Association, Inc., a Florida
corporation, to provide maintenance of public waterways within the Woodlands
Subdivision. Public Works Director Jack Strain gave a presentation. Vice Mayor
Sultanof questioned the equity between what the Woodlands and the City feels is
proper maintenance and Public Works Director Strain explained the reimbursement is a
set price, and should the Woodlands decide to halt maintenance of the canals, there is
a bond clause in the agreement whereby the City would then do the maintenance.
Public Works Director Strain explained that any complaints coming to the City regarding
maintenance of the canals in the Woodlands are referred to the Woodlands
Homeowners' Association. Commissioner Flansbaum-Talabisco asked if it is a cost
effective situation, and if it has worked well in the past. Public Works Director Strain
replied in the affirmative.
g. Item No. 6(d). REJECTING BIDS — PROSPECT ROAD LANDSCAPING
IMPROVEMENTS: (TR10446) Rejecting all bids under Bid No. 04-08B for Prospect
Road landscaping improvements. Public Works Director Jack Strain and
Purchasing/Contracts Manager Keith Glatz appeared before the Commission. Public
Works Director Strain gave a presentation and explained the reason for re -bidding the
project is due to the fact that the County found some non-compliance issues when the
plans were sent to them for permit approval, which then changed the scope of the work.
Public Works Director Strain said after discussing the matter with Purchasing/Contracts
Manager Glatz, it was decided not to award the project to the low bidder with the
change order, as it would bring the bid in excess of the difference between the low
bidder and the next lowest bidder.
Commissioner Portner questioned Item 6(e), Temporary Resolution 10451 on the
agenda, and asked what the City intends to do with the property in question. QUIT
CLAIM DEED — BROWARD COUNTY: (TR10451) Accepting a quit claim deed from
Broward County, Florida, of county owned property located in Tamarac, Florida
acquired by the county by virtue of the property being delinquent ad valorem tax
payments lands. Assistant City Attorney Steinerts said that will be addressed at another
time, as this resolution is simply formal acceptance of the property.
2. DISCUSSION OF RECOMMENDATION RE: DEFIBRILLATORS IN
MUNICIPAL PUBLIC BUILDINGS AND PARKS: Chief Jim Budzinski and Parks and
Recreation Director Kathleen Margoles appeared before the Commission. Chief
Budzinski gave a presentation and noted the City facilities that currently have AEDs:
Tamarac Community Center, the Recreation Center has an AED that is borrowed from
Public Works, the Building Department, and Public Works Supervisors carry AEDs in
their vehicles. There are AEDs on order for two sites, the administration offices of the
new fire house and the Recreation Center (when this is received the AED borrowed
from Public Works will be returned to Public Works). Additional recommended sites are
City Hall Lobby, Multi Purpose Center (when occupied and staffed), Utilities

Department, Satellite City Hall, BSO, and the Water Treatment Plant. Vice Mayor
Sultanof asked whether BSO would provide their own AED and BSO Chief Dugger said
there are no plans to fund one at this time. Commissioner Flansbaum-Talabisco said
she is anxious to have AEDs in all City buildings, and Vice Mayor Sultanof spoke about
businesses in Tamarac donating AEDs. Commissioner Portner questioned why private
facilities in Tamarac such as Bermuda Club, Lakes of Carriage Hills, the Gates, Villas at
Woodland Greens, the Boulevards, and Tamarac Lakes North and South do not have
AEDs, and Chief Budzinski said they are private locations and have been encouraged
to place AEDs in their facilities. Commissioner Portner asked who solicited the donation
of one AED to Kings Point, and Chief Budzinski said he did not know. Commissioner
Portner said he would like the Commission to authorize the purchase and placement of
AEDs in all Tamarac Clubhouses. Commissioner Roberts said consideration must be
given to training. Commissioner Portner spoke of the Good Samaritan law and City
Attorney Kraft explained immunities do not attach unless there is proper training. Chief
Budzinski suggested that if AEDs are provided to each clubhouse an agreement is also
drawn up requiring the members to participate in training and maintenance of the AEDs.
Commissioner Partner said he would like the Commission to entertain purchasing 80
AEDs for Tamarac Clubhouses, and City Manager Miller said staff would have to
prepare the information and bring it back to the Commission during the budget
discussions under the Fire Department agenda. Vice Mayor Sultanof suggested
discussing it before it appears on the budget agenda, as the associations are private
entities and he does not know how the City can become involved in making donations to
private entities. City Manager Miller said he will explore the matter further and bring it
back at a future workshop. Commissioner Flansbaum-Talabisco said her original idea
was to provide protection for the public coming onto City property. Commissioner
Roberts said she would prefer the City provide an AED to BSO rather than BSO funding
one so we will be assured the AED stays in District VII. Commissioner Flansbaum-
Talabisco said the item on today's agenda is separate and apart from the item being
discussed at this juncture, and she asked for an expression of interest to provide AEDs
in City buildings. All were in agreement to provide AEDs in City buildings. City
Manager Miller confirmed that there is an expression of interest to approve staff's
recommendation of the item before the Commission this morning, and there will be
further research and discussion before the Commission in July regarding Commissioner
Portner's suggestion to provide AEDs to clubhouses throughout Tamarac.
3. DISCUSSION RE: PIONEER DAY NOMINATIONS: Vice Mayor Sultanof
nominated Ben Chicofsky as the Pioneer representing Tamarac and said Mr. Chicofsky
was responsible for naming the Tam -A -Gram and has been extremely active on the
Tam -A -Gram, as Chairman. Public Information Officer Lucy Crockett said whoever
nominates the pioneer will accompany that person to the event which will be held in
October in Dania Beach. The criteria for Tamarac, since Tamarac's history does not go
back as far as some other cities in Broward County, is that the person nominated must
have been active in Tamarac since its early days. Vice Mayor Sultanof asked for an
expression of interest to nominate Ben Chicofsky as Pioneer for the City of Tamarac
and all were in agreement.

4. DISCUSSION RE: UPDATE ON OPEN SPACE PARCELS: City Manager Miller
and Assistant City Manager Phillips appeared before the Commission. Assistant City
Manager Phillips said the City is in the process of acquiring additional open space and
applied to the Land and Preservation Advisory Board for reimbursement for open space
acquisition for two parcels; one parcel lying in County Commission District 1 and one in
County Commission District 3. There is ongoing discussion at the County level
regarding parity with the land preservation process, and money for open and green
space acquisition being spread equally through the County. The Board agreed to place
the two parcels on the eligibility list for the open space program and we are waiting to
see if the County will accept the Land and Preservation Advisory Board's
recommendation of the parcels. The third parcel, south of the Cummings parcel,
previously owned by the Church of Spiritual Warfare was not submitted since the City
has not decided on its use. Commissioner Roberts said Assistant City Manager
Phillips, Assistant Director of Parks and Recreation Warner and the City's lobbyist were
at the meeting and Assistant City Manager Phillips made a great presentation. The two
parcels were added to the inventory for open space. The County Commission asked for
a report from staff regarding equitability in the districts receiving funding and the County
Commission now needs to decide if they want to move forward with Phase 6.
Commissioner Roberts suggested in addition to a letter the City Commission talk to the
County Commissioners to see if they would put this item on their agendas. Vice Mayor
Sultanof asked that a letter be drafted and City Manager Miller said he would do so.
Commissioner Flansbaum-Talabisco questioned the time frame and Commissioner
Roberts said within the next two weeks the County Commission should come back to
address Phase 6. City Manager Miller spoke of development of Southgate Boulevard,
and said in a title search performed for property east of University Drive it was
determined that not all of the 14 acres was titled to the City of Tamarac. The City would
like legal title of the property to develop for recreation and parks and for stormwater
management. City Manager Miller asked for an expression of interest from the City
Commission to authorize commencement of negotiations for the property. Vice Mayor
Sultanof questioned whether the City of Tamarac has a governmental claim to the
property, and City Attorney Kraft said with land not owned by the City it is best to
proceed through negotiations. Commissioner Roberts said she believed the property
was sold for tax purposes in 1994 and asked if the City had been notified. Assistant
City Attorney Steinerts responded there is a long history of notices regarding the
property which came at different times prior to 1994. Vice Mayor Sultanof asked what
the present owners could do with the land and City Manager Miller said there is no
private use for the property. All were in agreement to authorize negotiations for the
purchase of the property.
Commissioner Portner announced that Senate Bill 1184, sponsored by Senator
Campbell, has been approved by the legislature; it addresses revival of community
covenants.
Commissioner Portner asked the status of the color palette for Tamarac, and Building
Official Jones said research was done on color palettes for other municipalities, as well
as the color palette created for the Woodlands Community, which he would be happy to

bring forth at a future workshop so the Commission can evaluate the best options for
Tamarac. Vice Mayor Sultanof asked about a time frame for adherence to the
regulations, and Building Official Jones said most ordinances require adherence to the
regulations when the building is repainted which is usually between 7-10 years.
City Manager Miller introduced the new Economic Development Manager Henry
Tarquine, who has experience in the private and public arena. Community
Development Director King said Mr. Tarquine spent the past few years working for the
extension service in Broward County and University of Florida helping small businesses
get started and grow.
Commissioner Portner said he is president of the Lauderdale Lakes Alzheimer's
Foundation and will be attending today's meeting where Speaker of the House Johnnie
Byrd is scheduled to appear.
There being no further business to come before the City Commission, Vice Mayor
Sultanof adjourned the workshop meeting at 10:50 a.m.
