CITY COMMISSION WORKSHOP MEETING
MONDAY DECEMBER 7, 2009
CALL TO ORDER: Mayor Flansbaum-Talabisco called the workshop meeting to order
at 9:30 a.m. on Monday, December 7, 2009 in Room 105, Tamarac City Hall, 7525 NW
88t' Avenue, Tamarac, FL.
PRESENT: Mayor Beth Flansbaum-Talabisco, Vice -Mayor Harry Dressler,
Commissioner Pamela Bushnell, Commissioner Patricia Atkins -Grad and Commissioner
Diane Glasser.
ALSO PRESENT: City Manager Jeffrey L. Miller, Assistant City Attorney Julie Klahr,
Deputy City Manager/Interim Financial Services Director Michael C. Cernech, and City
Clerk Marion Swenson.
Mayor Flansbaum-Talabisco led the pledge of allegiance.
1. Item No. 6(e) on the Consent Agenda: RELEASE OF LETF: (TR11735)
Authorizing the appropriate City officials to approve an application by the Broward
Sheriffs Offices for the release of Law Enforcement Trust Funds in the amount of
$20,000.00 to provide funding for Tamarac District Explorer Post 7, the request
complies with the agreement between the City of Tamarac and the Broward Sheriffs
Office (BSO). BSO Chief Duguay gave a presentation. Commissioner Atkins -Grad
asked if grades were considered a requirement for the program and said she has been
fortunate to work with Resource Officer DelSol over the past few years at Millennium
Middle School. Commissioner Glasser said due to the changing demographics, this
program is needed in Tamarac at this time and questioned whether at risk children are
included. Commissioner Bushnell questioned the age requirements and asked if
recruitment is made from areas other than Millennium Middle School. Mayor
Flansbaum-Talabisco asked if the explorers are allowed to participate in programs held
during the day. BSO Chief Duguay explained doing well in school is requisite for entry
into the program, and a participant must have no negative dealings with law
enforcement. All students are looked at but some find the para-military structure of the
program too rigid. The age for participation ranges from 14-18 and recruitment is done
via word of mouth and other programs in the area. Explorers may participate in daytime
events with permission from parents and school.
2. Item No. 6 (c) on the Consent Agenda. INSTALLATION OF PHOTOVOLTAIC
PANELS: (TR11739) Authorizing the appropriate City Officials to execute an open end
term Agreement with Roofing Concepts Unlimited, Inc. for the construction of the
Photovoltiac Project, located at the Tamarac Community Center, 8601 West
Commercial Boulevard, providing for fixed pricing for construction of photovoltaic cells
for up to four (4) additional facilities at the City's option for a period of twelve (12)
months from date of award in accordance with Bid No. 09-18b, for an amount of
$184,600 and a 10% contingency of $18,460.00 for a total not to exceed $203,060.00

for the initial project and for each facility, subject to receipt of funding from the
appropriate accounts; authorizing budget amendments as needed for proper accounting
purposes. Assistant Public Works Director/City Engineer Doherty and
Purchasing/Contracts Manager Keith appeared. Assistant Public Works Director/City
Engineer Doherty gave a presentation and confirmed that Station 78 is not included.
3. Item No. 6 (b) on the Consent Agenda: AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE AMENDMENT #2 TO THE AGREEMENT BETWEEN
THE CITY OF TAMARAC AND JEFF ELLIS MANAGEMENT, LLC: (TR11717)
Authorizing the appropriate City Officials to execute Amendment #2 to the Agreement
between the City of Tamarac and Jeff Ellis Management LLC, exercising the option to
renew the Agreement to provide Swimming Pool Management Services for the
Caporella Aquatic Center at a cost of $639,339.72. Parks and Recreation Director
Warner; Parks and Recreation Assistant Director Probert; Recreation Superintendent
Zimmer and Purchasing/Contracts Manager Glatz appeared. Director of Parks and
Recreation Warner gave a presentation. Vice -Mayor Dressler asked if health care or
pension benefits are included; Commissioner Glasser asked if there are any City
employees at the pool; Commissioner Atkins -Grad said she is pleased we meet the
minimum numbers allowed for; and Mayor Flansbaum-Talabisco said since the facility
has opened there has been only one complaint and going there is like being on
vacation. Director of Parks and Recreation Warner responded in the negative to Vice -
Mayor Dressler's question, and said cashiers and onsite supervisor as well as the
fitness center and concession center staff are city employees.
4. Item No. 7 on the Regular Agenda: APPROVAL OF CONSOLIDATED ANNUAL
PERFORMANCE EVALUATION REPORT (CAPER): (TR11711) Authorizing the
appropriate City officials to approve the Consolidated Annual Performance Evaluation
Report (CAPER FY2008-2009) for the US Department of Housing and Urban
Development (HUD'S) Community Development Block Grant (CDBG) programs for
HUDS fiscal year 2008-2009; Case No 31-MI-09. Community Development Director
Bramley and Housing Administrator Bauldree appeared. Housing Administrator
Bauldree gave a presentation. Commissioner Glasser asked when funds will be
available; and Commissioner Bushnell questioned the process to apply for
improvements. Housing Administrator Bauldree said funds are received yearly and
decisions are made by Public Works; the money is to be spent in low to moderate
income areas. Community Development Director Bramley added the Commission
approves the Annual Action Plan every year and through the neighborhood meetings
we hear from our residents and then Public Works responds to their needs as
appropriate. Vice -Mayor Dressler questioned the difference in numbers for some
programs and Community Development Director Bramley said the programs are
advertised well by Parks and Recreation; some are more needed or popular than
others. Mayor Flansbaum-Talabisco asked if there was any news on the $10 million
and Housing Administrator Bauldree said we should know in a few weeks. There are
issues with NSP1 recipients not spending the funds; however Tamarac has a higher
possibility of getting NSP2 funding since we did spend our money properly. Mayor
Flansbaum-Talabisco said out of 309 cities involved, 300 did not spend the monies as

appropriate; Tamarac is in the top nine. Vice -Mayor Dressier expressed concern that
given the fiscal restraints on a national level some committee or sub -committee might
say the program is not working and decide to give nothing more. Housing Administrator
Bauldree replied HUD is looking at feedback from the recipients as to obstacles and
HUD is considering modifying some regulations to allow for flexibility.
5. Item No. 6 (d) on the Consent Agenda: KINGS ARBOR KEYS, LLC
EXCEPTION TO CODE AND MOU: (TR11740) Authorizing the appropriate City
Officials to approve an exception to City Code Section 22-131(a), "Adjustment to Bills"
and approving execution of a Memorandum of Understanding between the City and
Kings Arbor Keys, LLC, relating to monies owed to the City by the Kings Arbor Keys,
LLC, Association. Parks and Recreation Director Warner; Utilities Director Gagnon and
Community Services Manager Maldonado appeared. Director of Parks and Recreation
Warner and Community Services Manager Maldonado gave presentations and
discussed metering, interface with HTE and reading of the meters. Director of Utilities
Gagnon discussed the MOU and water saving techniques. Commissioner Bushnell
thanked everyone for their participation and said she walked the property and saw
firsthand what is going on. Commissioner Glasser said the fact they are showing good
faith is an opportunity for the organization and the City to help each other, and asked if
anyone is checking the abandoned properties to see if the water is left on; Director of
Utilities Gagnon said it is private property but we are working with the management
company and most buildings have been checked for leaks. Deputy City
Manager/Interim Financial Services Director Cernech thanked everyone for what they
are doing to correct the situation.
There being no further business to come before the Mayor and City Commission, Mayor
Flansbaum-Talabisco adjourned the workshop meeting at 10:40 a.m.
