PUBLIC EZARING - on second reading to amend Section 7.06 of the Tamarac Charter to provide that the City shall prepare and maintain a capital program pursuant to Chapter 163, Florida Statutes, "Local Government Comprehensive Planning and Land Development Regulation Act". PUBLIC. --PARTICIPATION - Any member of the public may speak to any issue which is not agendized for public hearing at this meeting. Speakers will be limited to three minutes during this item and at public hearings. There will be a thirty (30) minute aggregate time limit for this item, and speakers are encouraged to sign up in advance with the City Clerk prior to their participation. The City Council may consider and act upon such other business as may come before it. In the event this agenda must be revised, such revised copies will be available to the public at the City Council meeting. Pursuant to Chapter 286.0105, Florida Statutes, if a person decides to appeal any decision made by the City Council with respect to any matter considered at such meeting or hearing, he may need to ensure that a verbatim record of the proceedings is made which record includes the testimony and evidence upon which the appeal is based. Proposed Charter Amendment 92-7 ,SYNOPSIS OF AICTION: ORDINANCE 0-92-4-PASSED Public Hearing was held. APPROVED on second and final reading. City Attorney Ruf read Temp. Ord. #1585 by title. V/M Bender MOVED to APPROVE Temp. Ord. #1585, SECONDED by C/M Schumann. City Manager Kelly said this is to state that the existing referendum requirements of the City of Tamarac shall not apply to capital projects that fall within the water and sewer utility systems of the City nor shall it apply to expenditures mandated by Federal or State governments. He said the referendum requirement could be rather restrictive for the City and if the City were mandated to move ahead for a certain vital function of the Utilities Department, Staff feels that it should not be covered under this restriction. Mayor Abramowitz OPENED the Public Hearing. Joe Schreiber, resident of Kings Point, asked why it is necessary to exclude the water and sewer utilities. He said if this is permitted the City is able to spend as much money as needed without public approval. City Attorney Ruf said one of the reasons that it is being recommended to remove this is that water and sewer utility system improvements are paid for by revenue bonds rather than general obligation bonds. He said this means that the revenue that flows through the utility pays for the bonds. He said the second reason is that there is nothing more important to the residents of the City than water and sewer and if the City needs to move forward to City Council Special Meeting 1/16/92/KJ Page 2 provide pure water or to treat sewage, there is no time to go through a two to four month process to complete it. Mr. Schreiber asked if there has ever been an emergency where the City could not do what had to be done under the present Charter requirements. Mayor Abramowitz said Broward County could mandate that the City spend 1.75 million dollars to dig new wells or put in a new system in the next couple of years. He said it takes months to go to Referendum and he asked what would happen if the Referendum was defeated. Mr. Schreiber referred to Section 7.13 of the Charter and asked what the current budget is. Mayor Abramowitz said that will be discussed in Item 2 on this agenda. Nathan Peretzman, resident, referred to the bond issue which allowed for the sewer system. He questioned the Renewal and Replacement Fund, the CIAC Fund, the Bond Construction Fund, the Capital Project Replacement Fund and the Sewer CIAC Bond Fund. He said the City made sure there would be money if an emergency occurred. Mayor Abramowitz CLOSED the Public Hearing with no further response. Nathan Peretzman, resident, asked if there is a typographical error in the proposed amended ordinance and City Attorney Ruf said the draft is correct. Discussion was held regarding the format. Joe Schreiber, resident of Kings Point, referred to Section 7.13 of the Charter, which refers to the current budget. He said the existing budget for 1991/92 shows numerous funds and the total of these funds. He asked if this is what the entire budget is. Mayor Abramowitz said that is the purpose of this Referendum which was recommended by Carla Coleman to remove all of the old language which necessitates litigation. Mr. Schreiber said in the Referendum amendment the City states that only the General Fund is to be used. Mayor Abramowitz said the City has used both for years. Mayor Abramowitz asked if this means that Charter Board members will not be entitled to any additional benefits and City Attorney Ruf agreed. Mayor Abramowitz OPENED the Public Hearing. Nathan Peretzman, resident, requested that Council remove this item from the Referendum due to the past history of the Charter Board. Mayor Abramowitz CLOSED the Public Hearing with no further response. VOTE: ALL VOTED AYE C/W Glasser said she has enough confidence in the residents of the City to decide whether or not the Charter Board should be paid. 4. LIC HEARING - on second reading to amend Section 7.04 of the Tamarac Charter to provide that the City shall prepare and maintain a capital program pursuant to Chapter 163, Florida Statutes, "Local Government Comprehensive Planning and Land Development Regulation Act". City Manager Kelly said this is a housekeeping measure recommended by Carla Coleman which is a duplication effort with a Charter requirement as opposed to Chapter 163 of the Florida Statutes. He recommended that the City follow the State proposal. Mayor Abramowitz OPENED the Public Hearing. Nathan Peretzman, resident, asked if this means that past administrations operated the City in violation of Florida Statutes. City Attorney Ruf said no, the City has followed the obligation of Chapter 163.3177, which is a requirement that the City put a capital program in the Tamarac Land Use Plan, but the City has also followed the Charter sections which is a duplicity. He said the City is proposing to simply follow what the State Statutes require the City to do so that there will not be a duplication of City Council Special Meeting 1/16/92/KJ Page 4 effort. He said the requirements of a State Statute exceeds the requirement of the Charter. Mayor Abramowitz CLOSED the Public Hearing with no further response. City Council Special Meeting 1/16/92/KJ Page 5 Mayor Abramowitz expressed his appreciation for the public's attendance at the Town Meeting on January 15, 1992 regarding the proposed bus depot. C/M Katz said a memorandum was received from Assistant City Manager McDermott regarding pending items and he requested that a meeting be held to discuss them. Mayor Abramowitz said a meeting will be scheduled as per availability of those involved. Mayor Abramowitz congratulated C/M Schumann, unopposed for Council, District 2 and Oscar Brawer, who was unopposed for Charter Board, District 2 for the March election.
