February 2 1990 at 9 45 A M in the Council Chambers

PLEDGE OF ALLEGIANCE Mayor Abramowitz called for the Pledge of Allegiance
1 DISCUSSION AND POSSIBLE ACTION on proposal to extend City of Tamarac s
consumption use permit to cover homeowner and condominium associations
for purposes of compliance with the South Florida Water Management
District s mandatory water restrictions
SYNOPSIS OF ACTION
APPROVAL was given for the extension to Tamarac homeowner associations
and condominium associations giving them the opportunity to participate
under the City s umbrella consumption use permit
City Manager Kelly said when the water restrictions became imminent and
variances were applied for by many of the associations in the City Councilman
Stelzer noted that many of the associations do not have consumptive use
permits He said the City of Tamarac, as a public entity, has a consumptive
use permit He said over the past several years it has been the City s policy
to provide follow-up permits to the individual homeowner associations He
said when the associations went to the South Florida Water Management District
to get the permits for the variances, it was determined that the associations
did not have the individual consumptive use permits He said Jim Jackson of
the South Florida Water Management District has been extremely helpful in
working with the City of Tamarac and he has advised the City that there are
approximately 60 homeowner and condominium associations in Tamarac that would
need consumptive use permits to be issued by the South Florida Water
Management District at a cost of $100 00 each plus the variance permits
requests and processing fee would Total $6400 00

City Manager Kelly said they would have to pay for these permits He said the
alternate approach would be for the City to extend its consumptive use permit
as an umbrella to cover all those homeowner associations He said there would
not be any additional costs to the City and it would save the associations the
costs but the paperwork and follow-up He said this is a good solution for
the City and for the South Florida Water Management District
Jim Jackson of the South Florida Water Management District, said as the City
Manager has explained in the process of going through the first major water
shortage of this magnitude for Southeast Florida, as might be expected, having
approximately a million people under mandatory water restrictions, certain
problems occur along the way He said one problem is finding out certain
permits were not obtained a long time ago He said in fairness to the City
and the Developers prior to 1977 permits were not required for corsumptive
use He said as of June 1989 the South Florida Water Management District
began charging a fee for the permits at lower costs He said there is an
additional component for having to go back and getting a permit which is a
coat which was not there previously
Mr Jackson said for a homeowners association or any resident who Gses more
than 100,000 gallons a day, the permit fee is $800 00 He said for the
District, the cooperation of the City has been great He said to work as a
umbrella would require the City filing an application for permit with the
District He said he wanted to make one technical distinction from what th
City Manager indicated He said the South Florida Water Management District
would request a separate permit for irrigation use not a modification of the
current permit for consumptive use
Mr Jackson said there are certain components in the application, the easiest
one is the basic generic information and he can work with the City Manager a
Office to take care of this He said this would get the permit on file with
the South Florida Water Management District and the variances and permits can
be processed in a much easier and expeditious fashion He said what will be
needed is information about each individual homeowners association s
irrigation system, i e homeowners association name contact pcint and phone
number where there pump is located, how many homes it serves and fow much
consumption is being used He said there should be an understandirg or
agreement with the City that if there was a need for additional restrictions
by the District in the future, the District would direct Tamarac, as the
permit holder, to do so and request each homeowner associations to comply
Mr Jackson said it is not required to have the homeowner a or concominium
associations approach with the umbrella of the City He said each association
is free to do their own He said there are several developments Within the
City that have their own including Woodmont being the largest cf those tnd
there are a couple of others that have their individual permit He said the
District s intent is to work with Tamarac to make the overall process a lit e
less painful and more organized

Mayor Abramowitz said to clarify for the public, he cannot begin to thank Mr
Jackson because most of the people do not understand what he personally has
done He said Mr Jackson had 500 committments He said two years ago there
w a s a p r o b 1 e m a n d t h a South Florida Water Management District has cured Tamaxac I§ floods
problem to the best Of their ability He said when he a n d J i m Jackson m e t a f e w weeks
ago it came to their attention that these permits were needed and it was
mentioned that the legal staff of the District was requesting Mr Jackson to
put out a Cease and Decist Order which meant that everyone would have to stop
immediately He said he unplored Mr Jackson to not get the public excited
He said he was not only kind to the City of Tamarac but was very
understanding
Mayor Abramowitz said he has called upon the Presidents of Associations to be
here to work in conjuntion with the City He said he was very pleased to see
an individual that cares He said he would like to write a letter on behalf
of the City regarding Jim Jackson expressing the City s gratitude for his
concern for the public

Councilman Rohr said he would like to know why is the reverse osmosis being
considered in Florida
Mr Jackson said reverse osmosis is being considered and is being used quite a
bit He said a number of Cities are using reverse osmosis He said
Wellington is using reverse Osmosla on a smeller scale which is less pressure
He said the Cities of Plantation and Hollywood are exploring the idea He
said it is more expensive to use
Councilman Hoffman asked what about the individual users who have well water
or draw water from the canals behind their homes He asked if they normally
require a permit
Mr Jackson said if the use is less then 100,000 gallons a day, a permit is
not required He said if there is an ancillary use on thq property such as
the back four acres used as a nursery that would require a permit He said
the distinction which occurred in Tamarac is when the different homeowners
associations took over the responsibility for watering not Just the common
property but 220 homes with individual vidual sub -divisions
Mayor Abramowitz asked City Manager Kelly to propose the appropriate language
City Manager Kelly said a MOTION to APPROVE the proposal to extend to the City
of Tamarac s Homeowner Condominium Associations ar opportunity to participate
under the City of Tamarac umbrella permit
Mr Jackson asked if the City Manager will be authorized to sign the
applications

Mayor Abramowitz said if this is an administrative matter that is under his
purview, otherwise, it will have to be brought to Council
City Attorney Ruf said language should be added to the Motion that the City
Manager is authorized to execute whatever permit and applications are
required
Vice Mayor Bender said there should be an extension regarding residents who
have large acreage

Councilman Hoffman MOVED to APPROVE the proposal to extend to the City of
Tamarac s Homeowner and Condominium Associations an opportunity to participate
under the City of Tamarac a umbrella permit and to have the City Manager
authorized to execute permits and applications that are required SECONDED by
Councilman Stelzer
Councilman Stelzer thanked Jim Jackson for all his help He asked if the City
will provide individual permits to the associations so there will not be a
problem with the Sheriff s Office
Mr Jackson said he would like to develop a one page form that provides
necessary information that the District would need on individual ho-%downers
associations and a statement on which they would agree to comply with the C
concerning restrictions that would be applied in the future
Councilman Stelzer asked if all homeowners association and condominiums will
they have to send in their applications again because they do not have
variances on them
Jim Jackson said the associations should contact him directly
City Manager Kelly said this approval will give the associations the
opportunity to participate and the City is not forcing their participation

City Manager Kelly said at the last meeting in preparation of the Agreement
the City went over the individual items with Mr Gold and returned the
document to him for his review and approval He said in the process there
have been some concerns and minor modifications of the Agreement
City Manager Kelly said on Page 3 of the Agreement under Section 3, Seventh
Line, "The decision as to whether a bus shelter is needed shall rest within
the CITY and not with the COMPANY He said this was redundant and should be
deleted because the previous sentence states Bus shelters shall be placed
maintained and relocated as required by the CITY '
City Manager Kelly said at the bottom of Page 3 under Section 3, the last line
says "If electricity is unavailable at a particular location, the CITY
nonetheless reserves the right to require that COMPANY place a bus shelter at
such locations without electrical hookup' should be deleted He said it was
expressed by the attorney s for the COMPANY that there is a liability on
providing a shelter without lighting and having a resident have some harm come
to them He said he felt this was reasonable
City Manager Kelly said on Page 4 under Section 4, the Third Line the cost
that will be paid was raised from $350 00 to $500 00 for each shelter
that has been in place with the CITY and thereafter on the first working day
of Janaury of each year COMPANY shall pay to the CITY a sum of $500 00 for
each bus shelter installed and in place
City Manager Kelly said on the Bottom of Page 4 under Section 4 the word
"prorated should be included
City Manager Kelly said on Page 9 just before Section 12 Accordingly, any
majority transfer of shares of stock of COMPANY or a transfer of the interest
of any person or operator so as to cause a change in the officers or
stockholders of more than twenty (20) percent of the shares of the COMPANY
shall be deemed a transfer or assignment for purposes of this section should
be deleted
City Manager Kelly said on Page 14 under Section 15 the last sentence has been
deleted, "In the event this contract is notrenewed at the end of its term and
COMPANY has not removed shelters COMPANY and CITY expressly agree that CITY
shall have the option to purchase from COMPANY any or all of the bus shelters
for a sum of One Hundred Fifty ($150 00) per bus shelters," because the price
was unacceptable to the Company and the City had sufficient protection He
said in the previous sentence it states, "In the event this contract is not
renewed at the end of its term COMPANY shall have ninety (90) days within
which to either remove the existing bus shelters or make other arrangements
for their disposition, which other arrangements must meet with the approval of
CITY '

pity Manager Kelly said that Mr Gold has an executed copy for Page 16 with
the Company s Corporate Seal
City Manager Kelly said there are new concerns that have been raised this
fiorning He said at this time Mr Gold s company will merge with Shelter
Advertising of America He said Shelter Advertising is a larger Company
operating in Dade County and also operating in 13 Cities in the South Florida
rea He said two of the representatives are here i
ayor Abramowitz asked Council to express their concerns on each item

City Manager Kelly said in the review of the proposed Company the City did a
Corporate status check on the Company with Tallahasee which was checked out
atisfactorily He said the Company also has been checked with the Better
usiness Bureau and, from 1983 to date, is satisfactory, also with the
heriff s Department
Oayor Abramowitz asked if the Council approves and exeutes a Contract and the
proposed new addition to the Company does not pass the qualifications, then
the approval today is null and void The Council concurred
�ity Manager Kelly said on the Page 3 in the Third Sentence one of the
concerns raised is that it now states that the City and the Company agree
that the company shall erect and maintain bus shelters to place on certain
designated locations more particularly shown on Exhibit A attached to this
�greement He said in Exhibit A there are some inaccuracies He said there
�re a couple of shelters that are not properly located on the Exhibit and in
�ddition Exhibit A designates approximately 118 existing bus stops within the
City Mr Kelly said the concern was that this could be construed to mean
that bus shelters shall be placed on all of those locations He said
logistically it would not make sense to have bus stops at all 118 locations in
the City He said mass transit would not allow that many bus stops and it
would not make sense to have that many He said periodically in the past
ear the Company has been asked by mass transit or DOT to remove certain
stops He said there are also areas where electricity is not available and
there easements are not available He said the client or the applicant is
� sked in lieu of this sentence, we add thewar'd 'possible'before locations
councilmen Hoffman asked if the agreement could state that the City and
ompany agree that the Company may" erect shelters
Mayor Abramowitz said no, he would argue against that
City Manager Kelly said that language deletes the strength the City may
require He said this way the locations are the question not theiCity s

Mayor Abramowitz asked if Council objected to the addition of the word
"Possible" being added before locations
City Manager Kelly said it should read, "The CITY and COMPANY agree that the
COMPANY shall erect and maintain bus shelters to be placed at certain
designated possible locations "
City Mangaer Kelly said the next sentence, "Bus shelters shall be placed,
maintained and relocated as required by the CITY He said the applicant is
asking that the City include the words, "at mutually agreeable sites"
Mayor Abramowitz objected to this language He said he does not want to have
a situation where there is a contract whereby the City would have to go to
court He said if DOT precludes the (City from having a shelter in a certain
area or if lack of electricity prohibits the City in a certain location
legally or the Company cannot do what the contract states be questioned what
objection the proposed Company would have
Stephen Nuellj Attorney and Vice President of Shelter Advertising of America,
said he understood Mayor Abramowitz s sensitivity as a partner in this
contract He said their concerns were at some point the City may have some
idea to have the shelters put in everywhere He said he would like to make an
alternative suggestion to the Mayor and Council which he felt would satisfy
both partiesito put up a maximum of 15 for the coming year and 15 for the
following year and for the third year, 5 He said the total would be
approximately 50 shelters which gives the City and Council members flexibility
to respond to the constituents or to the members of the community and still
protects the company from a difficult position
Attorney Neull said the difficult position for the company is there is no
protection logistically He said if the City came to the Company and
requested all 30 shelters in 3 months, physically he was not sure it could be
done because permits were needed as well as surveys and location sites He
said permits are not only from the City but are from the Florida Department of
Transportation and the Broward County Mass Transit He said what he is
suggesting would protect the Council and the company
Councilman Hoffman said he understood the Company s concern He said he looks
at the bus shelters as not for only a means for the Company to make a
profit, but as a public service to the citizens of Tamarac He said if this
did not serve the public he felt he would not personally permit the shelters
He said he understood that the shelters should be put in the most traveled
areas because that w-uld give the Company a great return but it is conceivable
that there are arear that are not heavily travelled which Council may feel
requires a shelter to serve the people in that area He said he feels that
the City should be able to say where the shelters should go He said 7f the
Company wishes it to be limited to not more than a stipulated amount of
shelters per year, he cannot quarrel about that He said he feels that the

'City should have the right to determine that He said he feels that the City
should have the right to determine shelters will be placed
Mayor Abramowitz said the passible locations were discussed previously He
said he shared the concerns He said the limitations being addressed have
nothing to do with where the shelters are placed
Attorney Neull said where the Waters wnet would be the decision of the City
He said what is being changed is the number of the shelters added per year
Attorney Neull said if the language was changed it would be, "Bus Shelters
shall be placed maintained and relocated as required by the CITY aith the
COMPANY not being required to put any more that 15 shelters the first year 15
shelters the second year and five the third year ' He said these are new
structures in addition to those already up
City Manager Kelly said there are 21 shelters currently in operation He said
there are a total of 118 stops in the City He said there will never be 118
1bus shelters in Tamarac
City Attorney Ruf said the language the Council may want to consider, "Bus
'Shelters shall be placed maintained and relocated as required by the City
the COMPANY s obligation toplace shelters at the request of the CITY is
limited to 15 new locations in 1990 an additional 15 new locations in 1991
and an additional 5 new locations each year thereafter during the term of the
contract'
Attorney Neull said he had no problem with the language except if the City
would multiply the total numbers it would be 125 for the last five years and
15 and 15 for the first two He said there would be approximately 75
structures

Mayor Abramowitz asked if it was impossible because it is not econcrnically
feasible or because the company cannot get permits

Attorney Neull said not being able to get permits would answer the question
Mayor Abramowitz said the contract states if the Company cannot get a permit
from DOT or the County the Company is not obligated to install the shelters
Attorney Neull agreed
Vice Mayor Bender said his concerns were figures that were concerning
additional structures as if the City had a fixed parameter He said the City
does not have a fixed parameter He said the City has the oppert4nity to take
in unincorporated areas He said these areas may require additional bus
stops so the City cannot lock themselves in but has to give some thought as o
expanding for the future

Attorney Neull said he agreed but there was another factor that was not
considered which was the transit authority over the years changes He said
they change stops, routes or add and delta routes He said from the Company s
point of view they are a business and a profit making venture He said he
understood Vice Mayor Bender s point that it was service he was thinking of
and not revenues He said what is suggested needs to be addressed at the time
the contract goes through regarding the different areas
Councilman Hoffman said he did not think it was necessary to have any
requirement that the Company puts shelters in during the last two years of the
contract He said the Company needs a certain number of years to get their
investment back He said it was conceivable that at the end of the contract
they may not get a renewal He said why should the City force the Company to
put a specific number in the last two years when the Company may not be able
to amortize it He said if the City extends this for seven years he thought
the obligation of the Company should be a certain amount of shelters for a
five year period and after that it could be a matter of negotiation
Councilman Rohr said he had comment on the future of the unincorporated land
which is a considerable factor that may happen He asked Attorney Neull if he
had a certain figure He said he wanted to state that this should not include
any additional unincorporated areas that may be annexed into the City and, at
that point this should be negotiated for further discussion
Attorney Neull said these figures are figures which the City would provide to
the Company
Mayor Abramowitz said he would like to see some figures because he would not
like to see an ambiguous contract because at any given time the Company may
decide they do not want to put in any more bus shelters right now He said he
does not want to go to the Company and complain they have not done their work
He said the faster the shelters go in would benefit the Company but he does
not like to have an incomplete contract

Mayor Abramowitz said he would like to see a contractual obligation for the
Company to install a certain amount of shelters every year
Mayor Abramowitz asked if Council will accept the suggestion of Attorney Neull
of 15, 15 and 5
Councilman Hoffman siad he would sugger having 15, 15, 15, 5, and 5 over five
years without forcing a figure for the sixth or seventh year
Mayor Abramowitz said he wanted a consensus on the figures
Councilman Rohr said the figures should be 15, 15 and 5 as proposed

City Manager Kelly said Attorney Neull offered 15, 15 and 5 three years with
no coverage for the last two years He said Attorney Ruf countered at 15, 15,
5, 5 and 5
Mayor Abramowitz said this was a seven year contract Councilman Hoffman said
let the City be covered for five years Mayor Abramowitz said the language
that Attorney Ruf gave is the differential for the last couple of years the
City may require the Company to put to 5 bus shelters each year
Attorney Neull said to put a shelter up the last thirty days before the
omtract expires and have other companies bidding is not fair
Mayor Abramowitz asked Attorney Neull if he felt Councilman Hoffman s
suggestion was the way to proceed and Attorney Neull said yes 15, 15, 5, 5, 5
and 5 except for the last year Mayor Abramowitz said he approved and Council
concurred
ttorney Ruf said on Page 5 the language has been changed He said the
anguage should reflect an additional five new locations each year thereafter
for four years
ayor Abramowitz said with the exception of the last year and Attorney Neul
aid that was fine
t ty Manager Kelly said on Page 5 Section 5, All bus shelters shall be built
in accordance with specifications attached hereto as Exhibit "B" Any
variation from the specifications contained in Exhibit B' must be approved by
both CITY and COMPANY because of the propsed merger which should be
consummated within the next 60 to 90 days He said this Company has a slight
difference on the specifications He said he felt the difference is slight
He said they could be brought back at the time of the merger or C01=11 can
becept them now
Mayor Abramowitz asked if he saw the specifications and City Manager Kelly
isaid he has and they were sent to the Building Department Mayor Abramowitz
oei d he hoped it was more stringent for the City
Attorney Neull said the Company had over 650 and this Company man4fsctureres
them and sells them across the country He said they meet every $ouch Florida
Building Code and every State Code City Manager Kelly said when they are in
Council could add this to an agenda for review The Council concurred
Councilman Stelzer asked what benches this company puts in thtit shelters
and Attorney Neull said the four foot bench is preferable because it seats
more people looks better and lasts longer

City Manager Kelly said on Page 6, Section 7, the third sentence states,
"Additionally, CITY may require the COMPANY place trash receptacles in any or
all bus shelters '
Attorney Neull said they have a serious concern regarding this He said the
sentence prior to this one, "The CITY s decision as to the need for trash and
debris removal shall be conclusive He said the City has very strong
language in which to require the Company to keep it clean He said the
Company has over 650 structures and arrangements with 13 municipalities in
South Florida He said no where have they been asked to put in a trash
receptical He said in North Dade County there is one shelter which has a
trash receptical by the private property owner right next to the bus shelter
and for a period of eight months the Company would receive a memo from the
County to remove the trash receptical because it was causing problems He
said the Company would write back and tell the County 7t was not the Company s
receptical He said the problems it causes is that it encourages people to
dump trash, it is not just the cleanup, but the structure needed to be
deflead because the bugs were drawn by the trash He said he would strongly
recommend Council delete this language
Mayor Abramowitz said the sentence before the one in question "The CITY s
decision as to the need for trash and debris removal shall be conclusive He
asked if the City was to contract the Company and tell them there is a problem
around the shelter and wanted them to clean it up and the Company did not
respond or was in continuous violation, would that indicate or be a breach of
contract
City Attorney Ruf said that would be a cause to cancel the contract
Mayor Abramowitz said he had concerns and there were competative companies
that do, in fact place trash receptacles He said he was interested in not
having to pick up the phone and receive constant complaints about trash being
around a bus shelter He said this City is made up of wide awake people who
do daily patrols in their cars and the City does not need the hassle He said
he just wants it clean
Attorney Neull said the Company wnat to keep it clean also to keep the public
happy
Councilman Rohr asked Attorney Ruf if there were not the requirement for trash
bins and if the City found the response of the Company to let the bus shelters
not being kept in sanitary condition, would that be used for breach of
contract Attorney Ruf said yes that would be just caus- Mayor Abramowitz
asked if the City could clean it and charge the Company and Attorney Ruf said
there is language concerning removal of the shelters and charging the Company

Mayor Abramowitz said everyones concern is cleanliness which is very important
in this City The Council concurred not to require trash recepticals
City Manager Kelly said the Insurance Coverage is what the City requires He
said those changes addressed all the concerns the Company had He said the
last concern was raised by Councilman Stelzer on his review of Pace 14,
Section 15 which proposed the term of the agreement from the data of
execution to 9/30/97 to bring it through the fiscal year
Councilman Stelzer said he would like to bring it to the calendar year He
said he did not know how the fees would be collected for the lest year He
said the fees should be collected as of December 15th payable January 13t

Stelzer said he would recommend December 31, 1997 Mayor Abramowitz asked if
this was alright with Attorney Neull and Attorney Neull said he was going to
suggest this also i
Mayor Abramowitz said notations have been made regarding the compromises and
the acquiescence of Council and this is on record to be incorporated into a
Contract

City Manager Kelly said there is a requirement to have an auditor and the City

interviewed Grant Thornton the City Finance Director and Deputy Finance
Director and Assistant to the City Manager in this review He said Council
saw this and approved and authorized a contract to be drafted He said -it has
been forwarded to Grant Thornton and they returned the agreement for the
Council s approval
Mayor Abramowitz asked Kenneth Burroughs Finance Director if he was
satisfied with this agreement
Mr Burroughs said yes, he was comfortable with the contract and agreement

City Manager Kelly said there is an Agreement with Susan Tillman to provide
Risk Management services to the City He said this agreement provides her to
work for the city not more then twenty hours per week and to be compensated at
$35 00 per hour up to a maximum not to exceed $35 000 00 He said what the
agreement states is that there are provisions within the Personnel Department
to allow people in that capacity to attend conferences workshops and
seminars He said as a consultant Ms Tillman is not entitled to go to
those, however as a regular City employee would be

City Manager Kelly said the purpose of the Agreement is to modify this and
allow her to represent the City fratt the budgeted Fund for general employees

to that he wanted Council to be aware that she has agreed that any
lime spent attending a conference or seminar to learn about the skills that
would be assisting her and the City will not be a part of the twenty hours
He said that would be on her own personal time He said she willlnot be paid
P35 00 per hour to go to a conference and this was agreed upon
Vice Mayor Bender stated that the anticipated costs for the year would be
$350 00 City Manager Kelly said Page 2 of the Agreement will be amended to
reflect this change
Mayor Abramowitz said the Motion that has been made and Seconded should
hndicate as amendede Both Councilman Rohr and Vice Mayor Bender agreed
