NOTICE OF SPECIAL MEETING
CITY COUNCIL OF TAMARAC, FLORIDA
There will be a Special Meeting of the City Council on Tuesday, January
28, 1992 11:00 A.M. in the Conference Room #1 of City Hall, 7525 N.W. 88
Avenue, Tamarac, Florida.
The Purpose of this meeting is:
1• on the ambulance contract.

issue which is on this meeting notice. Speakers will be limited to

be a thirty (30) minute aggregate time limit for this item, and
speakers are encouraged to sign up in advance with the City Clerk
prior to their participation.
The City Council may consider and act upon such other business as may
come before it.
In the event this agenda must be revised, such revised copies will be
available to the public at the City Council meeting.
Pursuant to Chapter 286.0105, Florida Statutes, if a person decides to
appeal any decision made by the City Council with respect to any matter
considered at such meeting or hearing, he may need to ensure that a
verbatim record of the proceedings is made which record includes the
testimony and evidence upon which the appeal is based.

CITY COUNCIL SPECIAL MEETING
TUESDAY, JANUARY 28, 1992
Mayor Abramowitz called this meeting to order on
Tuesday, January 28, 1992 at 11:00 a.m. in the Council Chambers of
City Hall, 7525 Northwest 88 Avenue, Tamarac, Florida.
Mayor Abramowitz called for the Pledge
of Allegiance.

APPROVED effective January 31, 1992, that no further subsidy
payments will be made to Medics Ambulance Service.
City Manager Kelly said Council had requested some information
from the Federal Government and the County Attorney assuring the
Council of their actions regarding the continuance of ambulance
service to the residents and to eliminate the subsidy.
City Manager Kelly said the Finance Department has been reviewing
the Medics Ambulance records. He said it may be Mr. Cohen's
intention that it may be in violation of Medicare and Medicaid
anti -kickback statutes to reimburse the City of some of its
subsidy, based on his revenue collected. He referred to a letter
to Mary Blasi, Finance Director dated January 21, 1992. (See
Attachment 1)
City Manager Kelly said the State's Attorney did not provide a
formal legal opinion that Mr. Cohen could continue to bill, but he
could not insist on a prepayment as a condition for transporting
anyone in the ambulance on an emergency call.
Mayor Abramowitz said the City has no control over who services
the City of Tamarac which is determined by Broward County. He said
it would not be in Mr. Cohen's best interest to detract the
services from the residents.
C/M Katz requested that the City be assured that the City is in
compliance with the law.
City Manager Kelly said Mr. Cohen's concern is that the contract
was awarded to a municipality based on the municipality being
reimbursed. He said Tamarac did not solicit Mr. Cohen to provide
his service to the City, but was assigned by the County. He said
the City tried to go by way of subsidy in an attempt to provide an
additional benefit to the residents.

Mayor Abramowitz said he does not want anyone who is in need of
emergency ambulance service to be harassed at the time of
transport for payment.
City Manager Kelly read a letter to Assistant City Manager
McDermott from the Assistant County Attorney dated January 13,
1992. (See Attachment 2)
Mayor Abramowitz said that Mr. Cohen has indicated to the City
that he will sue the individuals for what is owed to him.
C/M Schumann stated that a Medicare claim needs to be filed by the
individual prior to Mr. Cohen proceeding with form filing;
however, the law states that once Mr. Cohen gets paid, he is
responsible for the filing of the papers.
C/W Glasser asked how the information will get to the residents
regarding them not prepaying for emergency ambulance service and
Mayor Abramowitz said there is the Tam -A -Gram, Channel 19 and
through the various organizations that do work in concert with the
City.
C/W Glasser suggested that the Fire Department and BSO hand out a
notification to someone with the patient stating that they not pay
prior to transporting. Further discussion was held regarding this.
Discussion was held regarding the procedures of filing claims with
Medicare and other insurances for ambulance service.
C/W Glasser asked about the review regarding monies that were
returned to the City and if the City has been refunded the money
and Mayor Abramowitz said the City has not been refunded which is
what this is about.
Ms. Blasi said the City is looking to receive between 40 thousand
and 45 thousand dollars, based on the audit and Mr. Cohen has
admitted that this money is due to the City.
C/W Glasser asked why Mr. Cohen and the City were not concerned
about the anti -kickback law at the time of the contract and
Assistant City Manager McDermott said it is a new law, which did
not exist at the time of the contract.
C/M Schumann MOVED to DISCONTINUE the monthly payments of the
subsidy to Medics Ambulance Service effective January 31, 1992,
SECONDED by V/M Bender.

3. Discussion and moss' action on report by City Manager
regarding Jeffrey Berkowitz and the old Public Works site.
FINAL ACTION
Discussion was held and direction was given to City Manager Kelly
to meet with Mr. Berkowitz and proceed with negotiations.
City Manager Kelly said Mr. Berkowitz had an option on Parcel 2 of
the property where the old Public Works Site existed which he has
opted not to exercise. He said the City retained the $85,000 and
inherited an obligation to pay the taxes to Broward County, the
payment of which the Council authorized, and the balance of the
monies would remain with the City.
City Manager Kelly further explained the history of the situation
between Mr. Berkowitz and the City as well as the obligation of
the City to pay the taxes.

City Manager Kelly said Mr. Berkowitz has requested that a meeting
be held with him on Thursday, January 30, 1992, and requested that
Council give direction on this matter.
Mayor Abramowitz asked if the City has any recourse with Chevron
in this matter and City Attorney Ruf said the City has no recourse
with the party who purchased this parcel from Mr. Berkowitz.
Mayor Abramowitz asked if the City can recapture legal costs when
the City goes to litigation with Mr. Berkowitz and City Attorney
Ruf said the City is entitled to legal costs if successful.
C/M Katz said Mr. Berkowitz has given the City a tough time every
month when the City's $18,000 was due to him and agreed with
beginning legal action.
City Attorney Ruf said this money is in escrow and has been in an
interest bearing account for the past three years. He said there
has been some suggestion from Mr. Berkowitz that there is a legal
basis for making this claim. He said he has requested information
from Mr. Berkowitz' attorney as to what this basis is, which has
not yet been received.
Further discussion was held regarding this.
Mayor Abramowitz asked Council to show an expression as to City
Manager Kelly entering into negotiations with Mr. Berkowitz
regarding this.
C/M Schumann said he does not want any compromise with Mr.
Berkowitz and all agreed.

Discussion was held and instruction was given to the City Attorney
and City Manager to proceed with amending the language for the
following pending ordinances:

Council reviewed the list of ordinances for discussion. (See
Attachment 31
City Attorney Ruf said Council tabled this Ordinance during the
October 23, 1991 meeting based on discussion as to whether or not
restrictions should be made on the parking of recreational
vehicles and other such vehicles in commercial zoned districts.
Mayor Abramowitz requested clarification as to what commercial
district is and City Attorney Ruf said a vacant lot, shopping
center lot and other such areas.
Discussion was held as to various parking situations.

C/M Katz said this proposed ordinance was developed due to
situations occurring such as trucks dropping their rigs for
unloading and leaving them sit for a week or more at that
particular location. He said this had been discussed with several
key Staff members and the concensus was that as this proposed
ordinance was written, this was the intent.
Mayor Abramowitz asked where the carnival is supposed to park
their trucks when the carnival comes to the City and C/M Katz said
Council would need to make a provision for this.
Discussion was held regarding the parking of vehicles in
unauthorized locations.
Mayor Abramowitz said he feels that those parking illegally should
be cited. He suggested that this ordinance needs to be clarified
and specifics need to be created.,
C/M Katz said the duration and time limit for parking needs to be
established.
V/M Bender said he feels there has been work done regarding this
throughout the United States and Community Development probably
has this information and it should be investigated thoroughly.
City Attorney Ruf said this is the Pension Plan change that will
allow for a COLA increase of 2% paid out of profits. He said the
City is waiting for the Actuarial letter to be delivered regarding
this. He said at present, the corrected Actuarial letter has not
been delivered to his office.
Assistant City Manager McDermott said as soon as the letter is
received and reviewed by the City Attorney's office, it will be
agendized for consideration and Mayor Abramowitz agreed.
City Attorney Ruf said this is an item that comes up regarding
trespassing and other such violations due to people fishing. He
said the various homeowner's association and condo associations
have requested that the City tighten up the fishing controls. He
said he contacted the various State agencies which set forth all
of the people who have jurisdiction over the fishing in the City
and County. He said fishing is being encouraged, not discouraged
by some groups, and is not sure whether the City can legally
control fishing off bridges on State and County highways.
Mayor Abramowitz said the City of Coral Springs has their own
canal management and does not fall under the jurisdiction of the
South Florida Water Management District and they banned fishing
from their canals. He said the South Florida Water Management
District encourages fishing.
Mayor Abramowitz said the problem is not necessarily the fishing,
but the parking on the right-of-way. He said the City has a law
against parking on the right-of-way.
Discussion was held regarding the parking on right-of-way
regulations.
City Attorney Ruf read from the City Code, Section 14-4, which
does not allow for parking on median strips. He said Section 14-26
states that there shall be no vehicular parking in the paved
portions of the dedicated public right-of-way areas within the
limits of the City between the hours of 2 a.m. and 6 a.m., except

those vehicles commonly designated as emergency vehicles, and
applies 7 days per week.
C/M Katz said at this time, it is permissible to park on a grass
right-of-way, but not a paved right-of-way.
City Attorney Ruf said the Council can specify and restrict the
areas as to where parking is not permissible.
Discussion was held regarding the parking areas for fishing.
C/W Glasser suggested that "No Parking" signs be placed throughout
the City to be a deterrent. Discussion was held regarding the
installation of various types of signage restricting the parking.
Assistant City Manager McDermott read the ordinance from Coral
Springs regarding this and suggested that the City list the
various locations where parking will not be permitted.
C/W Glasser said the concern is not with the fishing as much as
who is fishing, especially strangers.
City Attorney Ruf said language will be drafted for Council
consideration.
Mayor Abramowitz RECESSED this meeting at 12:30 p.m. and RECONVENED
the meeting at 1:25 p.m.

City Attorney Carsky said the City's current Code is
constitutional in this matter and is the best that the City can do
in this situation. She said the language requiring that two or
more circumstances make a vehicle non -operational exists in every
Code in the County at present. She gave specific examples for
this.
Mayor Abramowitz asked what type of action the City can take on
violators of this ordinance and City Attorney Carsky said in
certain situations, under the State Statutes, the vehicle can be
towed once a notification sticker is placed on the vehicle.
City Attorney Carsky said going before the Code Enforcement Board
produces a fine, and not necessarily compliance. She said the City
can take the violators to County Court and issue a Notice to
Appear where the Judge is able to take more action if the fine is
not paid.
City Attorney Carsky said non -operational vehicles are a Code
Enforcement problem everywhere based on the due process
considerations. Discussion was held regarding these violations.
City Attorney Carsky said this is a constant problem throughout
the County and very few cities tow, unless there is an emergency
situation involved.

City Attorney Carsky said she feels that the issue is whether the
Council wants to incorporate the State Statute into the Code,
which is not necessary. She said the City does have a
constitutional ordinance on the books with respect to towing.

City Attorney Carsky said the City's current Code section states
that the enforcement of this division shall be by the Code
Enforcement Officer and Code Enforcement Board of the City.
C/M Katz suggested that the City should follow the State Statute
which would allow the BSO to post the sticker and in four days,
tow the vehicle in violation.
Assistant City Manager McDermott suggested that the State Statute
be researched regarding this and Mayor Abramowitz disagreed.
C/M Schumann said the State Statute allows for towing after a four
day notification has been in place.
Mayor Abramowitz requested that the language for this ordinance be
prepared for Council consideration for the next Regular Council
meeting and City Attorney Carsky agreed.

Mayor Abramowitz said cars for sale were parked at the corner of
University Drive and Southgate Boulevard. Discussion was held
regarding the various locations in the City with cars parked for
private sales.
Mayor Abramowitz said the City needs to create an ordinance
prohibiting the parking of cars for sale on streets.
Assistant City Manager McDermott said this was approved on first
reading.
Mayor Abramowitz asked why the City is dealing through Code
Enforcement when the City has the ability to take someone to
County Court for violations and City Attorney'Carsky said the
County Court cannot do anything except impose a fine, issue a
capus if it is a jailable offense, which parking violations are
not.
City Attorney Carsky said the City can prepare a Motion to show
cause why they should not be held in contempt for failure to
appear for arraignment. She said this is an expensive and long
process. She said Code Enforcement does not have to allow 30 days
to comply. She said they can give as many days as they prefer,
which is decided by the Code Enforcement Office and the Council.
Discussion was held regarding this.
City Attorney Carsky said the Code Enforcement Board hears
property maintenance. She said parking does not go before the Code
Enforcement Board, but is handled by the BSO. She said she
receives authorized vehicles and handicaps, through the BSO, from
Tamarac.
Mayor Abramowitz asked what can be done to stop the City from
being a dumping ground for private used car sales.
City Attorney Carsky said the enforcement provision for this
ordinance should indicate these cars to be towed. She said this is
a task that is much more difficult than it looks on paper.

City Attorney Carsky suggested this item be skipped at the present
time.
Mayor Abramowitz said there are many instances where the Code
requires that there be a hardship be proven by the applicant in
order to receive a waiver. He requested that the hardship
provision be reviewed.
City Manager Kelly said the meeting scheduled to discuss the
single family curbside recycling program with the other cities has
been postponed until Monday, February 3, 1992. He explained the
reasons for the delay.
C/W Glasser requested that the small difficulties be solved and
commence with the program.
C/M Katz asked the deadline for this procedure and City Manager
Kelly said the deadline is February 12, 1992.

Mayor Abramowitz requested that Council express their feelings
regarding the most recent City Attorney applicants.
C/M Schumann nominated Mitchell Kraft for the position.
V/M Bender nominated Mitchell Kraft and Jeffrey Olson. He said
money has not been discussed, which is one of the reasons for
interviewing for the City Attorney position. He said he would like
to evaluate the dollar value of a new attorney versus what the
City currently has.
C/M Katz nominated Mitchell Kraft pending reference checks by the
City Manager's office.
C/W Glasser nominated Mitchell Kraft, who has a good resume and
has the expertise that the City is seeking.
Mayor Abramowitz said Mitchell Kraft has the qualifications, but
nominated both Mr. Olson and Mr. Kraft. Discussion was held
regarding the presentations made by both candidates.
City Manager Kelly said the financial aspect should not be
discussed amongst Council as part of the consideration of the best

person for the job. He explained the Competitive Selection
process. Discussion was held regarding this.
C/M Katz suggested that Council give City Manager Kelly permission
to negotiate with one of these candidates.

Assistant City Manager McDermott said the review of the commercial
garbage haulers contact is ready to be presented to Council by
MAS. She suggested a meeting be held for discussion on February 7,
1992. She said MAS is incorporating the Solid Waste Management Act
revisions into the new contract.
Assistant City Manager McDermott said there is an 8:15 a.m. kick-
off at Lauderhill City Hall on Monday, February 3, 1992 for the
Tri-City Recycling Program.

Assistant City Manager McDermott said the Diabetes Research
Institute is doing a cannister drive and requested authorization
from Council for this from February 1 through February 9, 1992.

Research Institute from February 1 through February 9, 1992,

Assistant City Manager McDermott requested that Council consider
reviewing the Senior Peer Counseling report and possibly have a
representative from the Jewish Family Service in attendance for a
workshop for discussion and Mayor Abramowitz agreed.
Mayor Abramowitz said the Area Agency on Aging spends over
$400,000 in the City of Tamarac.

RE: Letter Requesting Clarification dated January 10, 1992
Dear Dina:
As we discussed on the phone last Friday, this office will provide
the City of Tamarac with the County's position on those matters
addressed in your letter requiring clarification of County
ordinances, resolutions, and rules and regulations pertaining to
emergency medical service transportation; however, this office will
not agree to furnish the City with ai written legal opinion on these
issues. If it is determined that the City requires a legal
opinion, I would recommend that you request same from the City's
legal counsel.
Accordingly, pursuant to Section 23.4 (i)(1), Broward County
Administrative Code, pertaining to ambulance rules and regulations,
no emergency medical technician or paramedic shall fail or refuse
to promptly attend or transport any sick or injured person after
responding to a call, to the nearest appropriate medical facility.
it is the County's position that this provision applies regardless
of a patient's ability to pay at the time of transport and, in
essence, would prohibit a medical technician or paramedic from
requiring a patient to pay a pre -payment as a prerequisite to being
transported to a hospital on an emergency call.
My review of the applicable rules and regulations does not reveal
any prohibition against an emergency medical transportation
provider charging an additional fee or surcharge to a resident for
transportation if the patient requests a hospital other than the
closest appropriate one; however, as noted above, it would be
