HomeMy WebLinkAbout1992-02-19 - City Commission Special Meeting MinutesRECORD OF COUNCIL DISCUSSIONS/ACTIONS NOTICE OF SPECIAL MEETING CITY COUNCIL OF TAMARAC, FLORIDA There will be a Special Meeting of the City Council on Wednesday, February 19, 1992 at 1:00 p.m. in Conference Room #1 of City Hall, 7525 NW 88 Avenue, Tamarac, Florida. The purpose of this meeting is: 1. MOTION TO ADOPT Tema. Reso. #6219 approving the agree- ment between the City of Tamarac and the Joint Group of Cities Recycling Agreement and All Service Refuse Company, Inc. FINAL ACTION: RESOLUTION NO. R--92-22 PASSED. APPROVED. 2. MOTION TO APPROVE a waiver to Section 10-128(1) of the City Code to allow a building permit to be issued before the required fire hydrant is in place as required and shown on the site plan for JEHOVAH'S WITNESSES, KINGDOM HALL, 5811 NW 88 Avenue. FINAL ACTION: APPROVED with a 90 day timeframe and the City Manager is to be notified if there are problems. This will be monitored by the Fire Department and the Building Department. 3. PUBLIC PARTICIPATION - Any member of the public may speak to any issue which is not agendized for public hearing at this meeting. Speakers will be limited to three minutes during this item and at public hearings. There will be a thirty (30) minute aggregate time limit for this item, and speakers are encouraged to sign up in advance with the City Clerk prior to their participa- tion. The City Council may consider and act upon such other busi- ness as may come before it. In the event this agenda must be revised, such revised copies will be available to the public at the City Council meeting. CAE/pm Carol A. PLEDGE OF ALLEGIANCE AND MOMENT OF MEDITATION : Mayor Abramowitz called for t e Pledge of Allegiance and a Moment o Meditation. PRESENT : Mayor Norman Abramowitz Vice -Mayor Dr. H. OPSIS OF ACTION APPROVED City Manager Kelly said the Code did not allow the Chief Building Official or Fire Department to provide a waiver and only the Council could grant the waiver. He said in order to proceed, the fire hydrant had to be relocated to the other side of the street and the cost would be split between the Jehovah's Witnesses and the City. Mr. Kelly said the application was not processed in a timely manner to Broward County and the Chief Building Official and the Fire Department indicated the conditions outlined by the Jehovah's Witnesses were acceptable. Mr. Kelly said the application was submitted to Broward County and it would probably be about 30 days before the application was processed. Dan Wood, Chief Building Official, said the Fire Department would be doing a periodic surveillance to make sure the limit of combustibles did not exceed the Fire Department's guidelines of what might create a hazardous condition. David Viele, Fire Inspector, said Mr. Mackey would advise when he would start welding, etc., and the Fire Department indicated they wanted to stand by. C/M Katz said he had some concerns and there were some things he insisted on: 1) The ceiling should not be closed in until proper protection was afforded. 2) He did not care if the studs were metal or something else. 3) He said no wood construction until the Jehovah's Witnesses had proper protection. 4) The Jehovah's Witnesses had proper storage facilities. R v City Council Special Meeting 2/19/92/PP Page 2 C/M Katz said he discussed his concerns with Mr. Wood and Mr. Budzinski who agreed. He said the contractor, and not the City, should pay the bill for stand by duty. C/W Glasser asked if the fire hydrant on the east side of the street would be relocated to the west side and Mr. Kelly said there would be two hydrants. Mayor .Abramowitz said one reason the hydrant was being relocated was if there was a fire the traffic would have to be stopped in order to run the hose and Mr. Kelly said he agreed. Mayor Abramowitz asked if there was a problem temporarily running a hose across the road and Mr. Viele said, no. Mr. Viele replied there was no problem for 90 days with the Jehovah's Witnesses getting a Building Permit to start construction with the: temporary hydrant. Mayor Abramowitz said he understood C/M Katz's concerns and he would not support something the Fire Department rejected. Mayor Abramowitz asked if anyone was living in the old City Hall or would anybody live there until Kingdom Hall was completed and the applicant said, no. C/M Schumann asked if a tunnel would be cut in the road for the hose and the applicant said, yes. C/M Schumann asked about the traffic problem and the applicant said traffic would first be blocked on one side and routed to the other side. C/W Glasser asked how long the road would be blocked and the applicant said a maximum of 10 days. * C/W Glasser MOVED to approve the waiver without any conditions based on the report given by the Fire Department and the Chief Building Official, SECONDED by V/M Bender. C/M Schumann said he thought the permit should be issued before the hydrant was relocated and Mayor Abramowitz said the application had not yet been submitted to Broward County. C/M Katz asked if there was a time limit and Mayor Abramowitz requested Mr. Wood and Mr. Viele to advise Mr. Kelly if there were any delays. He said the time limit would be 90 days from today. VOTE : ALL VOTED AYE 1. MOTION TO ADOPT Tem . Reso. #6219 approving the agreement between the City of Tamarac and the Joint Group of Cities Recycling Agreement and All Service Refuse Company, Inc. SYNOPSIS OF ACTION APPROVED Mr. Kelly said the City finally came to an agreement which had been approved by the Cities of Coconut Creek and Lauderhill. He said the agreement was waiting for approval from the Cities of North Lauderdale and Margate. Mr. Kelly said the agreement was between the City and All Service Refus Company, Inc., and the expiration date is December 18, 1994. He said th date could be extended to June 15, 1995. Mr. Kelly said the service was for single-family units at an additional cost of 60 cents. He said it covered clear glass and aluminum in addition to the newspapers. He said the service for multi -family units was an additional cost of 57 cents or 54 cents, according to the contract, and covered newspapers and aluminum cans. Mr. Kelly said the definitive cost would be determined when the participants agreed on what the residents would be charged. He said there was discussions about charging 60 cents to 65 cents for the multi -family units and Tamarac had considered additional pennies to cover any City Council Special Meeting 2/19/92/PP Page 3 replacement costs for lost or stolen containers and the extra pennies would go into a reserve fund. He said nothing had been finalized yet. Mr. Kelly said if approved by Council, All Service Refuse Company, Inc., will be paid 57 cents. He said if the City provided an additional recycling truck, the cost would be reduced to 54 cents. Mr. elly said there would be 40 cubic yard roll -off containers at several loca ions in the City. He said these containers, at the contractor's expe.se, would hold clear glass, amber glass, green glass and mixed plas ics. He said aluminum cans and newspapers would be held in containers at all City owned facilities. Mr. Kelly said the pages 22 and 23 of Appendix A pertained to Tamarac and they were sent to the Council today and indicated where the containers would be located. He said the locations were at the Public Services Complex on Nob Hill Road, City Hall, at both Fire Stations and at Tamarac Park on University Drive. Mayor Abramowitz asked if containers would be placed at the Multi -Purpose Center, the ball park and at Tract 27 and Mr. Kelly said there would not be any at Tract 27. C/W Glasser said containers should be placed in the area of Tamarac Lakes North and South and the Boulevards and Mayor Abramowitz said he agreed. Mayor Abramowitz said he did not want to see any area left out of the recycling container locations. He said five facilities were identified but facilities for Tamarac Lakes North and South and the Boulevards were not. C/W Glasser asked if there was a passive park east of State Road 7 and Mr. Kelly said yes. He referred to the park near Prospect Road and said there were two potential areas, one of which was Caporella Park. He said Caporella Park was more centrally situated for a container. Mayor Abramowitz asked what containers would be put at Tamarac Lakes North and South and the Boulevards. Mr. Kelly said the drop-off points covered everybody. Mr. Kelly said it would be advantageous for the City to have the sixth container at Caporella Park. Harold Carter, All Service Refuse Company, Inc., said Page 4(b), Section D, covered the scope of services and the drop-off points. He said the 90 gallon carts would be put at the designated locations and one 40 cubic yard roll -off would be provided and it would be put at a designated site for the other items. He said the 90 gallon carts would be for newspapers and aluminum cans. Mr. Carter said one potential problem that Council should be aware of was contamination. He said there seemed to be a contamination problem with containers at ball parks due to the refuse left by teenagers and that Council might want to take this into consideration when they made their decision. C/W Glasser said in her opinion, a container at Tamarac Park was not a good idea and Mayor Abramowitz said they used a lot of aluminum cans there because it was an active place. C/W Glasser said the discussion was on drop-off points and Mayor Abramowitz asked what kind of container would be there for aluminum cans. Mr. Kelly said there would be containers for newspapers and aluminum cans and Mayor Abramowitz said there was a difference between a drop-off point and a stationary point. Mr. Carter said he would not have igloo -shaped containers but he would use 90 gallon to 100 gallon mobile carts and each drop-off center would have one 40 cubic yard roll -off box in each City. He said there would be service -to -City facilities which were the 90 gallon mobile carts to hold newspapers and aluminum cans, etc. Mr. Carter said this service was in the agreement to cover every facility and all City facilities would have recycling abilities. City Council 2/19/92/PP Page 4 Special Meeting C/M Katz said the dumpsters would be for recyclable materials such as plas ics and which to -date were not being picked up. He said glass was not teing picked up at single-family homes and a method would have to be implemented where glass, which was not part of the agreement, would be picked up. Mayor Abramowitz said he disagreed because there would be one very large facility in each City for the recyclable materials which were not being picked up. Mayor Abramowitz said putting one facility in one area would not guarantee that all the citizens from the City would put their recyclable materials there. Mayor Abramowitz said Tamarac Park was probably the busiest location and had the most traffic and a container would be put there for recyclable materials from Tamarac Park. He said C/M Katz was of the opinion that single-family home owners would put recyclable materials there which were not being picked up. C/M Katz said it did not seem feasible to put a dumpster for certain recyclable materials if the same materials were being picked up on a regular basis and C/M Schumann asked how the City could get people to take recyclable materials to a dumpster. C/M Katz suggested having a container at Tamarac Park just for aluminum cans and Mayor Abramowitz said he agreed. C/M Katz said there was a difference between a large dumpster and a small container and Mayor Abramowitz state that All Service Refuse Company will provide one large dumpster for each City. C/W Glasser asked where the large dumpster would be placed and Mayor Abramowitz replied it would be anywhere the Council wanted it. He said every single-family home would get one container to hold aluminum cans and newspaper. Mr. Kelly said the additional container would hold clear glas and aluminium. Mayor Abramowitz said All Service Refuse company would place a container in a strategic place at a multi -family unit to do the same thing as the single-family homes and Mr. Kelly said he disagreed. Mr. Kelly said the container at the multi -family units would hold newspaper and clear glass. C/M Schumann asked who would move the containers to the collection points and Mayor Abramowitz said, All Service Refuse Company. C/M Schumann asked where the containers would be placed at multi -family units and Mr. Carter said the agreement indicated they would be in the same room or next to the garbage container. He said multi -family units were handled this way throughout Broward County and the State. He said his vehicles would take it from there to his trucks. Mayor Abramowitz said there were no pick-ups at the multi -family units of glass. C/M Schumann asked who picked up the newspapers on Monday and Mr. Kelly said this was a separate contract. Mayor Abramowitz said the City took care of the multi -family units. Mr. Kelly said Mr. Carter's contract covered single and multi-famil units. Mr. Carter said garbage, old newspapers, aluminum beverage cans, and clea glass would be picked up at curbside on one day. He said garbage, old newspapers and aluminum beverage cans would be picked up at the condominiums and multi -family units. Mr. Carter said the State provided Grants to the City for recycling carts or collection equipment and he will. provide other collection equipment. He said his Company would charge either 54 cents if the Cities decided to add the third collection truck from the Grant Fund or the charge would be 57 cents if he added the third vehicle. Ll City Council Special Meeting 2/19/9:2/PP Page 5 Mr. Carter said each individual City would have a 40 yard roll -off box for cleat glass, amber glass and qreen glass and mixed elastic_ C/M Schumann asked who filled up the 40 yard roll -off box and Mr. Carter said some commercial customers and some residents. He said the City would have a 40 gallon cart at a designated facility to pick-up clear glass,, aluminum beverage cans and old newspaper. He said no other material w4s identified for the 90 gallon carts at. the City's facility. C/M Schumann asked if he could put another color of glass into his garbage bag and Mr. Kelly said, yes. Mr. Carter said temporarily, there was a limit on how much the recycling program could do while waiting on a decision for Materials Reprocessing Facility (MRF). He said when a comingled MRF was available in Broward County, all three colors of glass and and mixed plastic could also be added in a cart presently being used at condominiums for aluminum beverage cans. He said currently, they were separated at the collection point. Mr. Carter said Broward County recently put out an RFP for a comingled MRF and a real MRF was to be available in one year. Mr. Carter said two contractors were interested in the City's recycling program and were actively recycling. He said both could expand. Mayor Abramowitz asked when the contract with Waste Management expired and Mr. kelly said it dovetailed with the proposed agreement with All Service Refuse Co. Mayor Abramowitz said Broward County would not take any money away from any City which did not sign the agreement with All Service Refuse Co. but that city would lose its Grant. Tape 2 C/M Schumann said there would be a pick-up for newspaper, a pick-up for garbage and a pick-up for aluminum cans and glass. Mayor Abramowitz asked if an MRF was in the process of being built and Mr. Carter said, yes, and the location had already been selected and he received approval from the City of Fort Lauderdale. He said he could not do anything about a comingled MRF until he knew how the MRF would be funded. Mr. Carter said he could not compete if Broward County charged each city extra tipping fees to pay for the processing of an MRF but he could compete if Broward County found other revenues which did not come from the cities who did not participate. Mr. Carter said his trucks would not be in the way of the other trucks which also picked up on the same day. C/M Katz said the 40 yard dumpster would accommodate the materials which were not picked up by the truck. Mayor Abramowitz asked what would be put in the container at Tamarac Park and Mr. Kelly said aluminum cans and newspapers. C/M Katz said the dumpster would be in specific areas where certain types of recyclables were not picked up. Mr. Kelly said in lieu of Fire Station #1 on Pine Island Road, the dumpster should be at Caporella Park and Mayor Abramowitz asked that the dumpsters be strategically placed. Mayor Abramowitz asked if a designated area could be changed if it was found not to be heavily trafficked and Mr. Carter said he had no problem with this. Mr. Carter said there was no additional charge to change a location but asked to be notified when the 40-yard roll -off was full and he would take it to a new location; Mr. Kelly said he agreed. Mr. Carter said handouts or brochures would be given out by the Recycling Committee when the bins were delivered to the single-family homes and arrangements were being made to communicate with the representative at the multi -family dwellings. He s there was a recurring problem. C/W Glasser asked if there were any video tapes which could be given to a condominium association and Mr. Carter said he did not know of a specific tape. He said Broward County had a. series of tapes from their library. She asked if Mr. Carter would be willing to speak to a condominium if there were any problems and he said, yes. Mr. Kelly said the hours of operation throughout the program were from 7:00 A.M. through 7:00 P.M. and Mr. Carter will be advised the 'City's hours of operation would be 8:00. C/W Glasser asked if pick-up service was the same day as newspaper pick-up and Mr. Carter said, yes, at the single-family homes, and All Service would pick-up. He said All Service Refuse Co. was in the process of setting up routes to coincide with the other pick-ups. C/M Katz said he would like to get started with making contacts at each condominium so a committee could be formed because he did not know if everything could be accomplished in the 45 days allowed by the contract. Mr. Kelly suggested that he could coordinate this with Dina McDermott and the 45 days was when the contract was fully signed by all interested parties. Mr. Kelly said North Lauderdale and Margate's agreement with All Service Refuse Co. was by ordinance. Mr. Kelly said the City of Margate had a serious problem with an Inter -- local agreement which was addressed by Margate's City Attorney Steinfeld. He said Attorney Steinfeld stated the agreement with All Service Refuse Co. could stand alone and separate from the Inter -local agreement. C/W Glasser asked what would happen if the Cities of Margate and North Lauderdale did not sign the agreement and Mr. Carter advised that Tamarac could go it alone and he would look at the equipment and down -size the expense accordingly. V/M Bender MOVED to ADOPT Temp. Reso. #6219 , SECONDED by C/M Schumann. VOTE : ALL VOTED AYE Mr. Kelly asked if Mr. Carter agreed to drop Fire Station #1 and substitute Caporella Park and Mr. Carter said, yes. Mayor Abramowitz said there had not been any Parks and Recreation meetings for a while and C/M Schumann said two people resigned and the openings had not been filled. He said the Chairperson did not attend two or three meetings and many times they did not have enough members to have a quorum. Mayor Abramowitz said the President of T.A.F. had submitted an application and C/M Schumann said several other people had submitted applications. C/W Glasser said there were four or five openings on the Consumer Affairs Board and C/M Schumann said the insurance Advisory Board also had two vacancies. Mayor Abramowitz asked Mr. Kelly to agendize all three matters for the.next Council meeting. Mayor Abramowitz said he would ask his Legislative Aide to compile all the applications and an announcement will be put in the next Tam -A -Gram and C/M Katz suggested putting a notice on Channel 19 instead of waiting for the Tam -A -Gram. Mr. Kelly said Chairman Assenzio of the Insurance Advisory Board had found it very difficult to get a quorum and this was agendized for the next Council meeting of February 26. C/W Glasser said she wanted to see a few Boards filled and wanted to address all the Boards that had openings at Li� City Council Special Meeting 2/19/92/PP Page 7 the same time. Mayor Abramowitz said there was a carnival, in the City of Sunrise which resulted in many problems regarding security. He asked what the Code indicated regarding carnivals and the number of hours there had to be security on the premises. Mr. Kelly said Capt. Goldstein from the Tamarac Broward Sheriff's Office was waiting for a legal opinion from his counsel to provide security to the carnival in Tamarac. He said Capt. Goldstein had reservations about signing off on the approval sheet. Mr. Kelly said he signed off with the indication that he opposed the carnival. He said Capt. Goldstein was concerned about the liability and BSO should be providing security. C/M Schumann asked if any BSO personnel were taken away from their duties and Mr. Kelly said, no. Mayor Abramowitz again asked about the Code and Mr. Kelly said he would check it out. V/M Bender said the City would have something to worry about if a carnival only had security during the hours they were operating and this matter should be revisited. C/W Glasser said some Ordinances should be written which would address the problem of security in the future. Mayor Abramowitz ADJOURNED the Special Meeting at 2:10 P.M. CAROL A.
