TUESDAY, MARCH 6, 1990
CALL TO ORDER: Mayor Abramowitz called this meeting to Order on
Tuesday, -March 6, 1990 at 10:00 A.M. in Conference Room '#1 (City
Clerk's Office) .

1. MOTION TO ADOPT Temp. Reso. #5723 accepting the grant of
a Qu'1'E-fffa1'm`-15eej-a-KT for Land Section 7 canal
property and authorizing the appropriate City officials to
exewute said conveyance for recording in the public records
of Broward County, Florida.
SYNOPSIS OF ACTION: RESOLUTION NO. R-90-70 - PASSED
AGENDIZED�by Consent and APPROVED.
City Manager Kelly said this matter pertained to the
Public Services Administration Complex proposed for Land
Section 7. He said the City was presently paying rent
for the Public Works facility at their existing site;
therefore, a temporary site was needed until the Public
Services Administration Complex was built. He said this
matter would be discussed in the near future.
City Manager Kelly said today he would like the City
Council's approval to begin the project at Land Section
7. He said there was a Quit Claim Deed for the canal
easement, which was received and reviewed by the City.
Attorney.
City Manager Kelly said the Quit Claim Deed granted that
the canal, south of the east/west quarter section line of
Land Section 7, be used by the City. He said the item
has been delayed for several months; howevt�r, it was now
b?ing provided. He recommended approval of the Quit
Claim Deed.

Mayor Abramowitz asked if Richard Jones was the Trustee
for the canal and Interim City Attorney Ruf agreed.
Mayor. Abramowitz asked if Richard ,zones had the right to
sign the Quit Claim Deed and Interim City Attorney Rut
replied, yes.

Mayor Abramowitz asked that this matter be explained.
Bob Foy, Director of Utilities/Engineering, said this
matter pertained to property which was 120 feet wide with
80 feet of canal and 20 feet of canal maintenance
easement on both sides. He said the canal was
immediately north of the proposed Public Services j
Administration Complex.
Mr. Foy said the City has been waiting for the Quit Claim
Deed for several years, which allowed the City to
excavate the canal and use the fill, if needed. He said
the property was needed.
Mayor Abramowitz asked if the canal would be part of the
Complex and Mr. Foy said the property was part of the
canal system and would be used for the drainage of the
Complex.
Keith Emery, President of Construction Management
Services, Inc., said the City would be allowed to use
only 600 feet of the canal and this would be the area of
excavation of the fill.
Mayor Abramowitz said the City Council would be approvLngl
a Quit Claim Deed for the project, which was in the best'
interest of the City.

2. AUTHORIZED Construction Management Services, Inc., to
oceed prwith the purchase of fill for Land Section 7 feoml
Lennar Homes, Inc., for an amount not to exceed $150,0)0.�00
which would consist of 43,500 yards at $3.35 per yard.
SYNOPSIS OF ACTION:
City Manager Kelly said this Item pertained to the fill
for the property. He said there would be fill availab".e
to the City from the canal easement; however, additional;!
fill was needed for the project. He said Keith Emery,
President of Construction Management Services, Inc.,
reviewed the matter and determined that fill was
available from another area. He said because of the
additional fill available, the cost of transporting the
fill would be reduced and he recommended approval of the
proposal.
City Manager Kelly said ordinarily, this Item would have
been brought to the City Council during their Regular
meeting; however, the matter had to be acted on as soon
as possible because other interested parties were making
offers to use the fill.
Mayor Abramowitz asked why it was best for the City to
purchase the fill.
Keith Emery, President of Construction Management
Services, Inc., said when he amended the budget for the
revised plans for the proposed Public Service
Administration Complex, it was initiated on the basis of
the original program. He said during the design, he
found there was criteria change for the Public Works and

Utilities/Engineering Department. He said the criteria
was mandated and the Public Works Department required
additional change in the structure of the building for.
more efficient and effective operations.
Mr. Emery said the criteria change of the structure
included the restructuring of the Fleet Maintenance area.
He said with this change, the budget increased
approximately $125,000.00.
Mayor Abramowitz asked if the budget should have
decreased and Mr. Emery said the budget increased because
of the additional Code requirements, especially for the
Utilities/Engineering Department.
City Manager Kelly said Mayor Abramowitz was concerned
because the scope of the project was reduced. He said
the Fleet Maintenance responsibility of the Public Works
Department was reduced; however, Construction Management
Services, Inc., had to increase their costs because of
additional criteria changes required by the Code. He.
asked Mr. Emery to explain why there was an increase in
the costs since the Fleet Maintenance requirements were
reduced.
Mr. Emery said the increase was caused by criteria that
had to be met for the utility surface water drainage,
elevation of the property, infrastructure for water and
sewer. He said criteria had to be met now, which was not
required on the original plans.
Mayor Abramowitz asked why the criteria Changed and Bob
Foy, Director of Utilities/Engineering, said the original
plan provided a specific drainage design, which was
acceptable; however, when Construction Management
Services, Inc., estimated the project, they assumed that
another drainage plan could be used, which could not be
used.
Mr. Foy said the changes were not caused by the
Utilities/Engineering Department; however, the original
drainage plans were not acceptable. Mr. Emery agreed.
Mr. Foy said the original plan requirements were not
changed; however, there may be a storage room change. He
said the additional costs only pertained to the drainage
criteria.
C/M Rohr asked if the original plan was approved by the
Utilities/Engineering Department and Mr. Foy replied,
yes. C/M Rohr asked if the costs increased because the
plans had to be changed and Mr. Emery replied, no.
;Mayor Abramowitz said there were two alternate plans
proposed. He said one plan was proposed by Construction
Management Services, Inc., because it may have saved the
City money; however, the Utilities/Engineering Department
reviewed the proposed plans and found that they could not
be used.
C/M Hoffman said there was a reason for suggesting the
alternate plan and Mr. Emery agreed. C/M Hoffman asked
why the plan was not applicable to the project and Mr.
Emery said he and the civil engineer felt that the
alternate system would work; however, it was determined
by the Utilities/Engineering Department that the plans
were not appropriate.

C/M Hoffman asked if the alternate plan could work and
Mr. Emery replies, yes; however, it did not comply with
the Codes for the Utilities/Engineering Department.
Mr. Foy said the alternate plan was denied because the
percolation of the system would not work in the area.
C/M Rohr asked what the cost difference would be and Mr.,
Emery said with all of the changes, the cost would
increase approximately $100,000.00.
Mayor Abramowitz said the City knew that the drainage ha$
always been a problem in the area. He said if the scope,
of the project was down and the costs were increased, th4
City Council needed an explanation.

Mr. Emery said regardless of this change, the project wa$
a savings to the City. He said in the normal market
place, the fill costs were approximately $2.40 per yard
in difference. He said Lennar Homes, Inc., was contacted
regarding what was being done with their excess fill fro
their various projects in the area. He said he was
informed that Lennar Homes, Inc., was selling the fill.
Mr. Emery said he informed Lennar Homes, Inc., that the
City may be interested in the fill and they negotiated a
cost. He said the cost included the trucking, dumping,
etc., and the cost was very good compared to using the
services of the General Contractor. He said because of
the cost savings, he informed Lennar Homes, Inc., that hey
would be asking the City Council and City Manager to
approve the purchase of the fill from them.
Mayor Abramowitz said the City Council was anxious to
save money; however, documentation should be submitted
concerning the savings and cost factor of purchasing the
fill from Lennar Homes, Inc., as opposed to other
companies. He said the City should be careful regarding!
who they bought things from and, as long as the
transaction was good for the City, the City Council would
be interested.
C/M Hoffman said he agreed that documentation concerning
the difference in cost should be submitted.
Mr. Emery said Lennar Homes, Inc., did not have to sell
the City the fill and Mayor Abramowitz said the City was
interested in the fill; however, they wanted to be aware,
of what was being purchased.
C/M Rohr asked if it would cost the City more money by
using another contractor for the fill and Mr. Emery
replied, yes, because it was difficult to find fill.
C/M Rohr asked if bids should be obtained proving that
the costs were greater. He said this would provide tha
City with additional documentation.

City Manager Kelly said Mr. Emery could secure quotes
from various companies verifying the costs for the fill.
City Manager Kelly said he asked Mr. Emery to provide
documentation indicating that Construction Management
Services, Inc., was not affiliated with Lennar Homes,

Inc., and would not be receiving profit from the
transaction. He said he asked for this documentation to

Mayor Abramowitz said it was unfortunate that this was
needed; however, the documentation would protect everyone
involved. Mr. Emery said he did not object to providing
the documentation.
C/M Hoffman asked what the City Council should act on and
Mr. Emery said he was requesting the City Council's
approval to expend no more than $150,000.00 for fill from
Lennar Homes, Inc., for the Public Service Administration
Complex.
Mayor Abramowitz suggested that the cost be determined by
the yards of fill needed and delivered. He said the cost
should not exceed $150,000.00 but should be determined by
the amount of fill needed and the delivery cots.
Mr. Emery said 43,500 yards was needed at a cost of $3.35
per yard. He said $3.35 included several fee structures
such as, loading, trucking, etc.
Mayor Abramowitz asked the City Manager to submit a
memorandum to the City Council regarding the costs from
various contractors for the fill.
Interim City Attorney Ruf suggested that the Motion be to
Approve the purchase of the fill in the parameters
discussed.

City Manager Kelly said the relocation of the existing
Public Works facility would be brought to the City
Council at their Regular City Council meeting on March
14, 1990.
City Manager Kelly said the Public Works Department has
sought other sites for relocation. He said there were
negotiations on leases and tentative leases were
retained; however, he did not feel that these leases were
in the City's best interest; therefore, more negotiations
would be taking place. He said the City Council would be
informed of the matter at the City Council meeting of
Marc 14, 1990.
Mayor Abramowitz said he wanted to be sure that the
evacuation of the existing Public Works Department was
approved by the present owner. He said he was very
conscious of the costs of the projects; however, he
wanted the services of the City to continue as opposed to
being disrupted. He said it was not true that the
cheapest costs were the best.
Mayor Abramowitz said he did not want this matter decided
without planning and it was important that the services
continued in the best way they could.

C/M Hoffman said the City presently had an Ordinance in
the Code at Section 4-5, pertaining to the feeding of
ducks. He said this Ordinance prohibited anyone to feed
ducks. He said he received several complaints concerning
the feeding of stray cats.
C/M Hoffman asked if the City could include in the Code
the prohibition of feeding stray cats. He said he had
several complaints and people were not receiving relief.
Mayor Abramowitz asked the City Manager to investigate
this matter.
C/M Rohr said he appreciated these problems; however, he
was concerned about how the laws could be enforced. He
said there was difficulty in enforcing the law regarding
the feeding of ducks.
C/M Hoffman said
enforcement could not be done if there
were no laws to
do so.
C/M Rohr said he
agreed that it was s great to control
certain things and
it would be good if the drug use law
was enforceable.
C/M Hoffman said
he did not agree with eliminating all
the laws because
they could not be enforced. He said the
speeding laws could
not be totally enforced; however,
they should not
be eliminated.
Mayor Abramowitz
asked the City Manager and Interim Cityl,
Attorney to look
into this matter.
Mayor Abramowitz
said the Public Service Administration
Complex would be
an unusual project for a municipality
and City Manager
Kelly disagreed. City Manager Kelly
said the City of
Pompano recently went through a similar
situation.
Mayor Abramowitz said he did not want the City to do
something that would delay the project further. He said
he would like the record to reflect that staff should
review every aspect possible and nothing should be done
without the City Council's approval. He said he wanted
the City Council to be responsible for anything done and
he was willing to hold as many meetings as needed
regarding this matter.
C/M Rohr asked how many square feet there was in"the old',
City Hall and Mr. Emery said approximately 1,500. Mayor
Abramowitz said it would cost a lot of money to refurbish
the old City Hall.

Mayor Abramowitz said there were people who expressed
interest in the building; however, no one continued with
their interest.
C/M Hoffman said regardless of whether someone was
interested, the City should be aware of what the property
was worth.
Mayor Abramowitz suggested that a reappraisal of the
property be done.
Mr. Emery asked that the Quit Claim Deed be executed as
soon as possible by the City because it had to be filed
with Broward County for an O.R. number.
With no further business, Mayor Abramowitz ADJOURNED this
meeting at 10:40 A.M.
