Reconvened Special Meeting 04/01/93/ew Page 1 CITY OF TAMARAC CITY COUNCIL RECONVENED SPECIAL MEETING THURSDAY, APRIL 1, 1993 CALL TO ORDER: Mayor Bender called this Reconvened Special Meeting from March 31, 1993 to order on Thursday, April 1, 1993 at 3:00 p.m. in Conference Room 1 of City Hall, 7525 NW 88 Avenue, Tamarac, Florida. PRESENT: Mayor H. Larry Bender Vice Mayor Irving Katz Councilman Joseph Schreiber Councilman Henry Schumann Councilman Norman Abramowitz ALSO PRESENT: Jo n P. Kelly, City Manager Mitchell S. Kraft, City Attorney Karen Jackson, Secretary DISCUSSION AND POSSIBLE ACTION regarding the single-family residential garbage service. FINAL ACTION: APPROVED giving direction to the City Manager to enter into discussion with any or all vendors regarding the single- family residential garbage service and to include a one year trial period for the bag system only, if and when bags are being considered. Mayor Bender said the City Attorney had requested time to set forth the findings and results that Council has to look into. Mr. Kraft said he reviewed pertinent provisions, as well as the agreement that the City is currently in with Southern Sanitation regarding picking up the trash in the City of Tamarac. Mr. Kraft said the City is currently in a month -to -month relationship with Southern Sanitation and the contract is silent as to an obligation to the vendor.. He said Council has the right to negotiate with any vendor that is in the best interest of the City. V/M Katz asked if the City was going to get a stipulation that Waste Management is going to continue to remove garbage until the process is complete. Dennis Urbanski, General Manager of Waste Management, said Southern Sanitation will continue to provide the services as required under their contract until a final. contract is awarded. C/M Schreiber asked if it would be in the best interest of the City to negotiate with all the vendors to get the best service and the best price. C/M Abramowitz said he made that suggestion yesterday. He asked the City Attorney if there is anything of a legal nature that would preclude the City Manager from talking to any vendor regarding this. Mr. Kraft said he did not think there was a legal impediment to that happening. C/M Abramowitz said a certain portion of the City is delighted with the bag system and others are terrified of the bag system. He said he would like the City Manager to have the ability to deal with anyone who is interested in speaking rv. City Council Reconvened Special Meeting 04/01/93/ew Page 2 to him on the best arrangements for the City. V/M Katz asked if this will be restricted to the eight bidders. C/M Abramowitz said in yesterday's meeting, it came up that there are vendors that are willing to go on under a six or nine month trial period with bags and if they do not work, change the system to something else, and this interests him. Mayor Bender said eight vendors have bid on this contract and he would like Council to consider taking the lowest four bidders and concentrating on that area. C/M Schumann said the bidders no longer exist. C/M Schreiber said he would like the City Attorney to inform Council if the Resolution that was passed to go with bags is still in existence. Mr. Kraft said when there is a contract for single family residential waste garbage and it will be adopted by Ordinance which will have language to eliminate anything in conflict with the task. C/M Schreiber said a Motion was passed for the bag system, and asked if the Motion is eliminated since the bidders were rejected, does another Motion needed to be passed. Mr. Kraft asked if the Motion for bags was done for direction as to how the Request for Proposal was going to go. With the response being, yes, he said by rejection of the bid, the Motion has been wiped.out as well. V/M Katz said negotiations should be limited to the eight previous bidders. He asked that the City Manager have the latitude to request bids. He said there are areas in the City which do not want anything but bags and others where it would be too expensive. He said it would be in the best interest of the residents if they could choose the type of service each wants. C/M Schreiber asked why the City has to get involved. He asked why the vendors did not go to the customers, the associations and the homeowners and offer their service. He said the City could still get the franchise fee. C/M Abramowitz suggested instructing the City Mana er to enter into conversation with any one of the eight vendors to get the best possible deal the vendor can give. He said if it is the bag system, the only stipulation should be to allow a six or nine month trial period so that the vendor will not get hurt. V/M Katz said the suggestion yesterday was to go on a trial basis and any type of service should be a trial basis. C/M Abramowitz said the cans have been used for years and it is the unknown that is disturbing. C/M Schumann asked how a vendor would figure out the number of bags to print on a short term and what they would do with the excess if the program fails. C/M Abramowitz said two vendors have indicated a willingness to do bags on a trial system. He said Mr. Carter, All Service Refuse, and Mr. Urbanski, Southern Sanitation, have made that stipulation. Mr. Kelly said this was correct. Dick Marant, with I.S.W.R. and not representing Seacoast Sanitation, asked if there could be a side agreement that the vendor would continue on, if the bags did not work. 1 1 C/M Abramowitz said that is what was meant. He said after the City Council Reconvened Special Meeting 04/01/93/ew Page 3 six to nine month period, there would be an agreement where that vendor would be willing to go to another system of collecting garbage. Mr. Marant asked the procedure for the City Manager to talk to the vendors and if each vendor needs to beat the one before. Sal Coniglio, County Waste, asked if the price would be built in for cans if the bags do not work. He said it all has to be set above board now. He said the price could be higher with two vendors. Discussion was held regarding off-season service. C/M Abramowitz said Council is looking out for the welfare of the City. He said the City Manager will handle the situation appropriately. Tony Spadaccia, Industrial Waste Service, suggested considering a 5--year agreement with a 3-year option and giving a 1-year trial test for the bags. He said the City would need to pre -determine the service desired if not the bags and a price would be given for the whole package. He said everything should be determined at one time. V/M Katz asked if the trucks are any different with the bag or can service. Mr. Spadaccia said it could be one more or one less truck but the physical truck would be the same for I.W.S. C/M Abramowitz said there have been certain problems specified, such as yard waste, which needs to be addressed. C/M Schumann MOVED to APPROVE giving direction to the City Manager to enter into discussion with any or all vendors regarding the single --family residential garbage service. Mayor Bender said it has been decided to solicit all eight vendors and to give direction to the City Manager. C/M Schumann said the City Manager needs to know whether to go into a 3 or 5 year contract. Discussion was held on a trial period. C/M Abramowitz suggested a one year trial period where there could be a change to another system. C/M Schreiber suggested a one year trial period for the bag system only. C/M Schumann agreed to add to the Motion, a one year trial period for bags, SECONDED by C/M Abramowitz. VOTE: ALL VOTED AYE Mr-. Xa%iarii.� asked if Council intended to give the City Manager param!etar�r beyond the ones just given. V/M Katzsaid the same questions will be asked of all the vendore=-and not mix and match. He said the City Manager will give. the criteria for the negotiations and then ask the vendors to'come-'back with'a number. Mr. Kelly said he hai some annoyance with this whole process. He said vendors led the Council to believe that the. City would get better prices with the second bid. He said vendors were intimidating and threatening. He said Browning Ferris came in with $2.49 on the second bid and with the first bid the low price was down at $1.20. 'Pape 2 x l% City Council Reconvened Special Meeting 04/01/93/ew Page 4 Mr. Kelly said $2.49 is out of the ball park. He said this is not a viable competitor. He said Seacoast was the lowest bidder at $1.33 which was more than Council was considering with the first bid. Mr. Kelly said he would talk with the representatives from each of the companies but he would not talk to lobbyists. He said he wants to see the General Manager or the authorized agent for the firm and does not want to see legal staff or agents. He recommended they be prepared to discuss terms that the City can be satisfied with and that he can report back to Council. C/M Abramowitz suggested that if anyone does not want to do business under these rules and regulations that they not meet with the City Manager. Mr. Kelly said he will make appointments with vendors beginning April 2, 1993. Mr. Kelly said Ms. McDermott is not at this meeting because she is with EMS. He said the State Director of EMS has offered to provide the City with a pre --evaluation of what EMS service the City should have. C/M Abramowitz said he would like a Consensus of Opinion regarding the temporary holiday sales ordinance for the next Council meeting. It was agreed to have the item put on the agenda. Mr. Kraft asked which alternative is of interest to Council, fireworks or the one with three holidays. C/M Abramowitz said to put all alternatives on the agenda. Mr. Coniglio, County Waste, asked if a one year or five year contract was passed. Mayor Bender said a one year trial period would be pursued if it is bags, which will be part of the overall contract. He said directions will be given by the City Manager. Mr. Kelly said that Council needs to be prepared to schedule meetings on the Fire Department, EMS, Social Services and Beautification. He said a workshop will be needed before a Council meeting. He said the 9:30 a.m. Workshop scheduled for April 2, 1993 is cancelled so he can begin meeting with the vendors.
