Kelly. SYN4PSIS 4r . ACTION: APPROVED AS AMENDED. RESOLUTION NO. 90-217 - PASSED Mayor Abramowitz read a memo from City Manager Kelly stating his compensation and benefits package is substantially lower than his counterparts throughout Broward County. He said the average salary for a City Manager for the three cities closest to Tamarac in population and tax base is $84,220.00. He said the disparity continues in other benefits as well. He said a draft Resolution had been submitted. V/M Hoffman said in looking over the comparative salary schedule, he recognizes that City Manager Kelly is paid less than some of his counterparts. He said he feels City Manager Kelly has done a good job for the City but does not feel Council can justify an increase to $85,000.00. He said this is beyond what the City can afford. He said the City Manager of Sunrise earns $72,500.00, Coconut Creek - $72,000.00, Deerfield - $75,000.00 and Dania - $65,000.00. He suggested a reduction of City Manager Kelly's request from $85,000.00 to $75,000.00. Mayor Abramowitz agreed and said he appreciates City Manager Kelly's work for the City. City Manager Kelly said the spreadsheet was done prior to this Fiscal Year and in June, Sunrise raised their City Manager's salary retroactive to January, 1990 to $76,234.00 and, at the end of October, it will be raised to $80,000.00. He said Coconut Creek was raised to $79,500.00 effective October 1, 1990, Deerfield to $80,000.00 and Hallandale to $88,500.00. He said this makes the average salary to be $81,000.00. He said the average salary to the cities closest comparison to Tamarac, which are Davie, Margate and Hallandale, is $85,722.00. V/M Hoffman said they pay their Councils more and each City has different circumstances. Page 1 City Council Special Meeting 10/02/90/KJ Mayor Abramowitz said City Manager Kelly has been City Manager longer than some in the area and he agrees with V/M Hoffman. C/M Bender and C/M Schumann agreed. Mayor Abramowitz said there is no change in Section 1 B of I the Resolution. He said in Section 1 C of the Resolution, the Family Health Insurance coverage was questioned. C/M Bender said he feels that the Family Health Insurance benefits should be the same for the City Manager as all other City employees. Mayor Abramowitz said in Section 1 D of the Resolution, .he' spreadsheet shows a vast difference of severance pay between City Manager Kelly and his counterparts. He said the proposal being made states: 1) If City Manager Kelly resigns - no severance pay, 2) If City Manager Kelly is dismissed for cause - no severance pay, 3) If City Manager Kelly is dismissed without cause - kie will be granted 26 weeks of severance pay to be paid periodically as payroll rather in a lump sum and, during the period of severance pay, the City Manager shall receive insurance, but no other benefits, 4) Upon death - no severance pay will be awarded. V/M Hoffman said he has no quarrel with increasing the severance pay to six months at the present time but feels the increase to a maximum of twelve months should be removed until the next contract discussion with the City Manager. C/M Bender and C/M Schumann agreed. Mayor Abramowitz said as the City progresses, the employees1will progress and he feels this places City Manager Kelly within range with his counterparts. Mayor Abramowitz said he assessed a comparison from every C-ty Attorney in Broward County. He said Ruf and Carsky have been doing work for the City for fifteen years and there are two cases being litigated in the courts being handled by Ruf and Carsky. He said he is satisfied and pleased with the legal representation the City has. He asked City Manager Kelly to review the budget of the City Attorney for any other possible cuts. He said Ruf and Carsky do not receive all the benefits an in-house attorney would receive. V/M Hoffman said to have the Resolution read, "APPOINT Ruf and Carsky at the hourly rate" outlined in the Resolution. VOTE: ALL VOTED AYE Page 2 City Council Special Meeting 10/02/90/KJ 3. authorizing the appropriate City officials to execute an Agreement with Susan Tillman pertaining to consultant services in the area of risk management, asset protection, safety, insurance and employee benefits for the period 10/1/90 through 9/30/91. RESOLUTION NO. 90-219 PASSED _. ' Z(OITJ 31 Mayor Abramowitz said he received a memo listing items handled by Susan Tillman. He said she has done a fine job and has saved the City money. He said last year there was $11,000.00 collected in subrogation. He said over a period of three years the City paid $3 million for insurance and the claims paid out $30,000.00. He said he is unhappy with the problem that the insurance companies that insured the City previously refuse to supply the City information regarding past experience. He asked Council to instruct City Attorney Ruf to institute litigation against these two insurance companies to force them to supply the information needed to Ms. Tillman. He said it is public information and they should be forced to give it to the City. He said he spoke to the President of Cigna and received no satisfactory response. V/M Hoffman asked if this is public information and does the City have the legal right to demand this information. City Attorney Ruf said he would do an analysis on this and report to Council. C/M Bender said these companies are licensed with the State and they must comply with certain regulations with the State. MOTION TO APPROVE renewal of the City's present coverage for liability, property, worker's compensation and flood insurance with Arthur J. Gallagher & Company at a cost of $195,011.00. 6 _1T*1j1:Y#__]W*Y"� 44,11 • Ms. Tillman said she did a study and tried to get other insurance companies and brokers interested in quoting with similar coverages the City had with Arthur J. Gallagher & Company. She said companies are still not very interested in writing municipalities. She said proposals were requested from Sedgwick James, American States Insurance, Florida League of Cities and Arthur J. Gallagher. Ms. Tillman said Sedgwick James was interested in quoting for next year, American States Insurance only quoted on a claims -made basis, which means any claims must be filed in the policy year or they are not paid. She said the Florida League of Cities, quote had competitive prices; however, they did not cover discrimination or civil rights acts. She said the Florida League of Cities also has a plan that if there are three types of coverage losses in an accident, there are three different deductibles; whereas, with the City's current plan with Arthur J. Gallagher there is one deductible. She said she recommends a renewal of the present plan with Arthur J. Gallagher and Company. She said the initial quotation for renewal was $244,000.00 for which the City paid approximately $185,000.00. She said after negotiations, they settled on a cost of $179,000.00, which is lower than last year. C/M Schumann asked if the discrimination and civil rights clause is included in this plan. Ms. Tillman said yes, and there is one deductible per occurence. City Manager Kelly complimented Alan Ruf and the negotiatin��team on both parts, the Union people and the. Management people, Ir the work done on this three year contract. City Attorney Ruf said he was pleased to have resolved this contract and able to become a City Attorney again, rather than a Labor Consultant. He said in the closed sessions with Council he had indicated what the parameters of the agreement would-be and Council needs to focus on Article 11 on Page 24 regarding wages. He said effective October 1, 1990, a 6% increase, October 1,1 1991, a 5% increase, October 1, 1992, a 4% increase, which is the heart of the wage issue. Mayor Abramowitz said there has been a vast difference in the past three years. He said he is pleased with the three year contract that has been negotiated. City Manager Kelly congratulated the negotiating team and Rex Van Mehren from the Fire Department and his group of negotiators for a job well done. City Attorney Ruf said the Local Number should be corrected to read "Local 3080". He said there were lengthy negotiations with the Fire Fighters and there were peripheral issues which were important in the negotiation. He said the Fire Inspectors had petitioned for a separate bargaining unit. He said this did not make sense to bargain with two Fire Inspectors which was resolved by moving the Fire Inspectors into Unit 3080. He said an arbitration was pending between the City and the Union regarding the imposition of a Kelly Day scheduled which the Unit had contested. He said this was resolved with language added to the new contract; therefore, the arbitration which was scheduled for the end of October is saving the City Attorney's office and staff approximately $10,000.00. City Attorney Ruf said the wage increase is 3% in 1990, 5% in 1990-91, 5% in 1991-92, and there are added educational incentives for the EMT training. He said the Fire Fighters are trained as Emergency Medical Technicians and their educational incentive is being brought in line with most of the other cities in Broward County. Mayor Abramowitz said he is pleased that rank and file represented by Rex Van Mehren understands Chief Briant's concerns to serve the City in a better way. SYNOPSIS Off' , ACTION: RESOLUTION NO. 90-220 - PASSED APPROVED City Attorney Ruf read by title. * C/M Bender MOVED to ADOPT , SECONDED by * V/M Hoffman. V/M Hoffman asked if this includes or excludes the City Manager. Mayor Abramowitz said it excludes the City Manager. City Manager Kelly said this covers all employees in the building such as the confidential secretaries , Department Heads and supervisory personnel throughout the City. He said this provides that they will be getting a 6% increase effective October 1, 1990. Mayor Abramowitz said ,of all things done throughout the year that he-1.is not fond of, this is number one on the list. He said the knovlecige of wanting to do much more and the knowledge of not being `able bothers him. He said he is pleased with the way the ggreements have worked out. He said the better the City does, the better -the employees will do. Page 5 City Council Special Meeting 10/02/90/KJ C/M Bender suggested that the date of October 1, 1990, be inp_uded in Section 1 of the Resolution and C/M Schumann said it is's1tated in Section 3. VOTE: City Manager Kelly said he is pleased as the new Finance Director and of her Fagelbaum as Deputy Finance Director. TAPE Z ALL VOTED AYE to have appointed Mary Blasi selection of Thelma City Manager Kelly said he is pleased with the Grants Committee for allowing a grant for one 25 horsepower engine with a trader to tow it. He said this still needs to go before the County Commission but the Grants Committee has given their support. City Manager Kelly said regarding the capital expenditures tat are now in the budget, there will be no authorization for purchases of capital expenditures until the issue of the old; City Hall or some other resolution is addressed. He said he has informed the Department Heads and Finance of this. City Manager Kelly said he has a memo going to Council regarding an article in the Sunday Miami Herald. He said the article 1, addressed suspended drivers licenses and he has attached a recommendation to Council. He said in reviewing the police records there are, on occasion, people with 15 to 23 suspended drivers licenses. He said in Portland, Oregon, the City passed an Ordinance allowing them to confiscate and sell the vehicle with the City profiting from the sale. He said there is a law in the State of Oregon and they are able to confiscate and sell the vehicle for the City. He suggested this would be a strong farce of action and highly recommended this. He said he has spoken to Captain Goldstein from the BSO who agrees. He asked Mayor Abramowitz to exert his abilities through the League of Citifies and the Mayors Council. V/M Hoffman asked if this would only be applied to the residents of the City or to anyone and City Manager Kelly said Tamarac leads the County in D.U.I. arrests and it is important to pursue and review the legal aspects involved. V/M Hoffman said this will send a message to both the County and State Legislature and should be pursued. Mayor Abramowitz said the number one arrester who has been clited by Mothers Against Drunk Drivers is in Tamarac's BSO office. He said the arrests of drunk drivers have tripled or quadrupled. He said this would make people think twice before driving through Tamarac drunk. City Manager Kelly said this affects the cost of City insurance and the loss of lives. V/M Hoffman said there is a State Law regulating the height of bumpers. He said there are vehicles with bumpers about eight feet above the ground which is a violation of the State Law. He requested the BSO Deputies stop and ticket these people for this violation. He said this is a dangerous situation because if they get into an accident, the bumper could decapitate someone.
