HomeMy WebLinkAbout1999-10-20 - City Commission Special Meeting MinutesCITY OF TAMARAC SPECIAL CITY COMMISSION MEETING WEDNESDAY, OCTOBER 20, 1999 CALL TO ORDER: Mayor Schreiber called the Special meeting to order on Wednesday, October 20,1999, at 11:05 A.M. in Conference Room #1, of Tamarac City Hall, 7525 Northwest 88th Avenue, Tamarac, FL. PRESENT: Mayor Joe Schreiber, Vice Mayor Larry Mishkin, Commissioner Edward C. Portner, Commissioner Marc L. Sultanof, and Commissioner Karen L. Roberts. ALSO PRESENT: Jeffrey L. Miller, City Manager, Mitchell S. Kraft, City Attorney, Tim Hemstreet, Assistant City Manager/Interim Finance Director, and Marion Swenson, Assistant City Clerk. 1. PUBLIC TRANSPORTATION SERVICE: (TR8804) Motion to adopt a resolution authorizing the appropriate City Officials to execute an Agreement between Broward County and the City of Tamarac for Public Transportation Services. Mayor Schreiber said because the Commission has not had time to thoroughly review this item, he is not sure whether the Commission will be prepared to come to a decision today. City Manager Miller said the resignation of Mike Scanlon, the City's contact with Broward County has delayed the matter; however, the buses are available to Tamarac, if we act quickly. Tamarac has been working diligently with the County and the County Attorney's office to resolve major issues in the Interlocal Agreement. City Manager Miller said he would like to walk the Commission through the agreement and the Commission can then decide if they feel it is appropriate to move forward. The City is slated to get 3 buses, and it will cost the City $10,000.00 per year for each bus. The County will contribute $20,000.00 per year1or each bus to offset expenses. Assistant City Manager/Interim Finance Director Hemstreet explained Temporary Resolution #8804, and said City Manager Miller and City Attorney Kraft will review the agreement again, as there are some minor issues that still need to be addressed. One of the issues to be resolved is the intended routes, addressed in Article 2, Section 2.1 of the Agreement. Vice Mayor Mishkin explained that the intent of this program was to make sure that Tamarac's routes tie into Broward County's transit system, and if Tamarac wants to eliminate some connections with Broward County's transit system, Broward County will not approve those changes. Commissioner Roberts questioned why it could not be put into the contract that Broward County would not hinder Tamarac if we meet their conditions. There was discussion about the routes and the fare. Assistant City Manager/Interim Finance Director Hemstreet explained that a resolution needs to be passed in order to establish the fare. Commissioner Portner expressed concern and displeasure over the intended route in the eastern section of Tamarac. City Manager Miller said the County must assure the federal government that it has control over the routes in order for the County to get their money. But, the County will allow the City to adjust the routes. Commissioner Sultanof said after the service is started, we can make adjustments to the routes. There are 2 buses and a van in the City now, and that service will not change. The 3 buses Tamarac is to get from Broward County will be an addition to the service we now have. Commissioner Roberts expressed concern over the lack of routes in the western areas of Tamarac, and displeasure over the proposed route in the Heathgate area. 10/20/99 1 Mayor Schreiber asked City Attorney Kraft whether the Interlocal Agreement can be expanded, revised or amended in the future, and City Attorney Kraft responded, explaining that the word "shall" translates into "mandatory". There is an amendment provision in Sec. 9.13 of the Agreement, in terms of the bus routes. The City can negotiate changes in the routes subject to Broward County's approval. Mayor Schreiber and Commissioner Roberts asked about bus service on Saturdays and Sundays. Assistant City Manager/Interim Finance Director Hemstreet responded that we are starting out a new service and are not sure what the utilization is going to be until it is in service for a few months. Experiences in Coconut Creek and Margate have shown that the system is flexible. Social Services Coordinator Stadlen explained that when the agreement is finalized there will be adjustments. Social Services Coordinator Stadlen went over the routes. There was discussion about the 3 routes and the projected stops at the clubhouses. Commissioner Roberts expressed concern about people having to walk to the clubhouses in order to get the bus. Commissioner Roberts and Commissioner Sultanof said if we establish routes and the ridership is not there, then the routes can be pulled back. Vice Mayor Mishkin said other cities have had bus service for several years, and their service has changed over the years, to accommodate the residents. Some of Tamarac's areas do not need the new service, since there are County bus stops already in place in those areas. Mayor Schreiber and Vice Mayor Mishkin said the new system should be viewed as a trial, until we see what changes need to be made. City Attorney Kraft read Temporary Resolution #8804, Revision #2, by title. Vice Mayor Mishkin seconded by Commissioner Sultanof moved approval. Vice Mayor Mishkin explained that Section 2 of the Resolution states "the appropriate City officials are hereby authorized to execute the Agreement between Broward County and the City of Tamarac for Public Transportation Services ... subject to such revisions as negotiated and approved by the City Manager, and reviewed for legal sufficiency and approved by the City Attorney." There was discussion about Section 2 of the Resolution. Vice Mayor Mishkin seconded by Commissioner Sultanof moved to call the question. On calling the question, Vice Mayor Mishkin voted "yes", Commissioner Sultanof "yes", Commissioner Roberts "no", Commissioner Portner "yes", and Mayor Schreiber "no". Motion carried. Mayor Schreiber and Commissioner Roberts expressed concern about voting on the Resolution without having had sufficient time to thoroughly read the document. On the Resolution, Commissioner Sultanof voted "yes", Commissioner Roberts "yes", Commissioner Portner "yes", Vice Mayor Mishkin "yes", and Mayor Schreiber "yes". Motion carried. There being no further business, Mayor Schreiber adjourned the Special Commission meeting at 12:10 P.M.
