NOTICE OF SPECIAL MEETING
CITY COUNCIL OF TAMARAC, FLORIDA
There will be a Special Meeting of the City Council on Tuesday,
November 19, 1991, at 2:30 p.m., in the Conference Room #1 of City
Hall, 7525 NW 88 Avenue, Tamarac, Florida.
The City Council will consider the following items:
1. DISCUSSION AND POSSIBLE ACTION regarding Tract 24.
FINAL ACTION -
APPROVED letter of support of Tract 24 Associates Ltd. application
to obtain a mortgage loan through the State Apartment Incentive
Loan Program.
2. PUBLIC PARTICIPATION -- Any member of the public may speak
to any issue which is on this meeting notice. Speakers will
be limited to three minutes during this item and at public
hearings. There will be a thirty (30) minute aggregate time
limit for this item, and speakers are encouraged to sign up
in advance with the City Clerk prior to their participation.
The City Council may consider such other business as may come
before it.
All meetings are open to the public.
In the event this agenda must be revised, such revised copies will
be available to the public at the City Council meeting.

CALL TO ORDER: Mayor Abramowitz called this meeting to order on
Tuesday, November 19, 1991 at 2:30 p.m. in Conference Room #1 of
Tamarac City Hall, 7525 Northwest 88 Avenue, Tamarac, Florida.

1. DISCUSSION AND PO,9,9IBLX ACTION regarding Tract 24.
FINAL ACTION*
APPROVED letter of support of Tract 24 Associates Ltd. application
to obtain a mortgage loan through the State Apartment Incentive
Loan Program.
Kelly Carpenter, Director of Community Development, said this is a
request by American Land Management Group, Inc., to the City for a
letter of support to the State of Florida, Department of Community
Development, supporting American Land Management in its
application for State Apartment Incentive Loan Program Funds
(SAIL) .
Ms. Carpenter said the applicant is proposing to build a project
which is 100% units for persons 55 and older. She said the units
will have one or two bedrooms with a minimum of 700 square feet
and a maximum of 850 square feet. She said the applicant states
that this will be submitted to the State on November 22, 1991.
Ms. Carpenter said Council considered a similar application in the
Past year for Florida Affordable Housing, Inc. She said the City
sent a letter stating the City's position on affordable housing as
outlined in the City's housing element to the State of Florida,
Department of Community Development SAIL Program. She said the
City did not send a letter of support at that time.
Ms. Carpenter read the requested letter of support. (Attachment 1)
She said the project is platted and is zoned R-4A. She said it has
a set of covenants and deed restrictions which limit it to 300
units, the smallest of which is 700 square feet in size. She said
there can be two story buildings only on NW 96 Avenue and NW 81
Street and the three story buildings are limited to the interior
of the project. She said there will be no access, except for fire
access on NW 96 Avenue, as the deed restrictions are currently
written. She said a site plan does not exist at this time but will
be required.
Mayor Abramowitz asked if this is the same project that had been

discussed in the past and City Manager Kelly agreed.
Mayor Abramowitz said Council had endorsed this project in the
past because there was a definite need, it would have a minimal
impact on traffic and it was not a low cost housing project.
City Manager Kelly said the letter that was sent was carefully
created.
Mayor Abramowitz asked if sending a letter of support would place
the City under obligation and City Attorney Carsky said people can
be sued for anything and if the City were to change its feelings,
the City could be sued.
City Attorney Carsky said this seems to be a very generic kind of
support and she does not feel that the City would be legally
bound; however, that does not mean that the City could not be
sued.
C/W Glasser asked how the City is going to be guaranteed that
everything is going to comply with the new Federal Housing Act for
the Elderly.
Ms. Carpenter said she does not know if the Code provides for
language in the site plan that the project be limited to 55 years
of age and older.
C/W Glasser said there are many amenities in the Federal Housing
Act and City Attorney Carsky said she is not familiar with it.
Mayor Abramowitz asked if the program is based on the 55 years of
age and older situation.
Bruce Jarvis, applicant, said it is based on the elderly category
and at least one occupant must be 62 years of age or older. He
said as long as the developer, through design and operating
program, commits the project to an elderly orientation, the
project is protected. He said the developer's questionnaire is
aimed towards anything that relates to the elderly.
C/W Glasser asked about the construction requirements for the
elderly and Mr. Jarvis said the project will meet all of the
handicapped requirements of the Code.
Mr. Jarvis said there are little things that would be different
for an elderly or handicapped person, such as a shelf at the
entryway for grocery bags. He said there is a two story deed
restriction on the project but they are placing one story
buildings along 96 Street and 81 Avenue and three story buildings
along the canal with elevators.
Mayor Abramowitz asked if the funding for this program is geared
for 55 years of age and older and Mr. Jarvis said, yes.
Mr. Jarvis said the funding program is divided into two parts. He
said the State has approximately 8.8 million dollars in SAIL funds
in the current funding period. He said the State then takes the
program and divides it; 45% goes to families, 45% goes to the
elderly and 10% goes to farm workers.
C/W Glasser asked how this applies to the continuance of the
project other than the funding and construction.
Mr. Jarvis said there are 14 forms and one of them asks if the
applicant commits to having the project remain for 15 years or
perpetuity and they intend to check perpetuity. He said when
perpetuity is selected, it remains for the elderly for at least 15
years.

C/M Schumann asked if they meet the HUD requirements for Housing
for Older Persons and Mr. Jarvis said there is a State Agency that
administers the funds.
C/M Schumann asked if the City is being asked to act as a conduit
in order for them to get this funding and Mr. Jarvis said no,
there is a three line question on one of the forms regarding
support from the local municipality and is rated on a point
system. Discussion was held regarding the point system.
C/M Schumann asked if this project is qualified under the IRS
501"C" and Mr. Jarvis said no, they are a "for profit"
corporation.
V/M Bender asked if the 8.8 million dollars is for other projects
or is this the only project and Mr. Jarvis said he is competing
with every developer in the State who are submitting new
applications as well as for existing projects.
V/M Bender asked if these funds will be made available annually or
as the development progresses and Mr. Jarvis said this is a one-
time grant to the project which is a 9% loan that will accrue 30
interest.
Mr. Jarvis said this means that he will pay until his cash flow is
sufficient to pay 9% and he will pay 3% on this mortgage. He said
he is requesting approximately one million dollars in SAIL funds
for this project. He said he will need a first mortgage including
the SAIL funds for the project and will possibly receive the first
mortgage from First Housing Development Corporation in Tampa.
Mayor Abramowitz asked where the building funds will come from and
Mr. Jarvis said this will be a construction loan that slides into
a permanent loan and he has a commitment from First Housing
Development Corporation for $6,500,000.
Mayor Abramowitz asked if the million dollars and the $6,500,000
will be enough funding to complete the project and Mr. Jarvis
said, no.
V/M Bender said he wants to be sure that the project is properly
funded and that the project will reach completion.
Mr. Jarvis said the SAIL loan is step one of this project. He said
if they are successful in accessing the SAIL allotment, in May,
1992, they will apply for a tax credit to the State. He said
annually, the State is allocated by the Federal Government
approximately 19 million dollars in tax credits to be used fore
affordable housing. He said if they receive the SAIL funding, they
automatically receive the tax credits, which are saleable to large
corporations who have the first mortgage. Further discussion was
held regarding the financing of the project.
C/M Katz asked how the elderly tenant would benefit and Mr. Jarvis
said one bedroom apartments rent from approximately $585 per month
and the elderly tenant would benefit from a rental that is $150
below market value.
C/W Glasser asked if there will be a maintenance charge to the
residents in addition to the rent and Mr. Jarvis said, no.
C/M Katz expressed his concern regarding the exclusion of the
people who need affordable housing such as young people who are
starting out.
Mayor Abramowitz said the concept of a development that is for a
particular age group is created to provide certain services for

that age group. Further discussion was held regarding the
differences between developments for young people and for the
elderly.
Ms. Carpenter said there are a number of impact fees and other
such fees that must be paid prior to the beginning of this project
and Mr. Jarvis agreed.
Mayor Abramowitz said the City is being inundated by traffic from
Coral Springs and this project will not produce much traffic.
Ms. Carpenter said the County waived the traffic impact fees for
the prior applicants of this project. She said she does not know
if that waiver will stand for this applicant. She suggested that
Council request that Mr. Jarvis voluntarily agree to a note on the
plat that would use the Broward County language regarding the age
limit of 55 and older dealing with school impact fees.
C/W Glasser said she would like some assurances that while this
project is being constructed it will meet all of the Federal
Housing Rules and Regulations for the Elderly.
Ms. Carpenter said the City cannot enforce this unless it is in
the South Florida Building Code, but the lenders may enforce it.
City Attorney Carsky said the regulatory agencies will be
enforcing these requirements and Mr. Jarvis agreed.
City Manager Kelly read the proposed Letter of Support into the
record. (Attachment 1)
C/W Glasser said there is a need for this type of project for the
elderly. She said her concern is that this be built to comply with
all of the Federal requirements for elderly housing and to
maintain it.
Mayor Abramowitz said the City has control and can place whatever
restrictions are necessary. Discussion was held regarding the
wording of the Letter of Support.
V/M Bender MOVED to APPROVE the Letter of Support, as read by
City Manager Kelly, SECONDED by C/M Schumann.

Mayor Abramowitz suggested that this project not be started if it
cannot be completed.

Mary Seidel, resident, asked if the applicant will have a
development whereby people who may be infirmed could have
assistance and Mayor Abramowitz said this is not an ACLF or
nursing home but is for those elderly who no longer want to live
in single family homes which will be provided with transportation
and other such services.

V/M Bender asked what the time limitation is for completion and
Mr. Jarvis said if all of the financing is received, construction
will begin in January, 1993, and should be completed by January,
1994.
C/M Schumann asked if all of these apartments will be rental units
and Mr. Jarvis said, yes.
With no further business, Mayor Abramowitz ADJOURNED this meeting
at 3:15 p.m.
