Alan F Ruf Interim City Attorney Carol A Evans, City Clerk Pauline Walaszek, Secretary --------------------- ---------------------------- Mayor Abramowitz said the purpose of the meeting was to discuss the Independent Charter Review submitted by Carla Coleman Consultant Mayor Abramowitz said the City Council could decide on their next workshop meeting concerning the Independent Charter Review at the end of the meeting He suggested the City Council decide what procedures they would use to review the Charter Mayor Abramowitz said each Councilmember should indicate what they would like to review He said the City Council could prioritize the articles and discuss the important matters more C/M Rohr said he would like the Councilmembers to indicate what items they would like to talk about V/M Hoffman said everything in the Independent Charter Review would have to be discussed; however the Councilmembers should indicate what they wanted to discuss in each item Mayor Abramowitz said the Councilmembers should indicate what items they felt should be addressed at this time The City Council AGREED City Manager Kelly asked if the City Council would be limiting themselves to what was in the Review and Mayor Abramowitz replied no V/M Hoffman said he reviewed the existing Charter and independent review He said he would personally make recommendations concerning both Mayor Abramowitz said there were things that were not listed or referred to and he would be recommending changes C/M Bender said the City Council should prioritize the items in the Charter Review He said the City Council should indicate what items they wanted to discuss He said once the City Council outlined the information they would have a basis for discussion PAGE 3 - ARTICLE 11 CITY MAP The City Council did not want to discuss this Article Page 1 4/23/90-pw PAGES 3 and 4 - ARTICLE IV LEGISLATIVE Mayor Abramowitz said he would like to discuss this Article C/M Rohr suggested the City Council discuss each Article of concern as opposed to prioritizing each Article V/M Hoffman said the City Council should set the parameters of what each Councilmember wanted to discuss He said he agreed with Section 4 03 Mayor and Vice Mayor Mayor Abramowitz said the Councilmembers had the right to discuss any Article they wanted He said if the City Council set the priorities it would be easier to discuss The City Council AGREED to discuss all of Articles IV, V, VI VII, VIII X XI, XII and additional Articles City Manager Kelly said there were several Articles that were covered by the State law He asked if the City Council would be discussing the items regardless of what other laws mandate them Mayor Abramowitz said Section 6 01 Qualifications of electors, & 6/ 05 General election law was not on his priority list He said the City Council should determine what Articles should be discussed immediately V/M Hoffman said if the State law covered certain Articles there was no point in discussing the Article Mayor Abramowitz said a Councilmember may want to disagree with the recommendation that an Article was not necessary. C/M Rohr said he would like to discuss the second paragraph on Page 13 Mayor Abramowitz suggested the City Council begin review on Page 3, Article IV Legislative Section 4 02 City Council election terms and qualifications V/M Hoffman recommended option three, which stated three year staggered terms with a two or three term limit C/M Schumann said if option three was selected the Councilmembers would only be getting a year extension aid V/M Hoffman said he would like three year staggered terO with a three term limit Mayor Abramowitz said he would like to have cross discussion because it would assist in making their final decision C/M Schumann said he read this section and he would like unlimited two year terms He said he agreed with Ms, Coleman's statement He said the U S Congress had unlimited terms the Presidency and Governor had two terms because each term was four years He said a two year term would give the Councilmembers time to learn their jobs more thoroughly C/M Schumann said if a person was not appropriate for the job the voters would have the opportunity to elect their choice however if the person was appropriate for the position, they should not be forced to resign after two terms He said the voters would make the final decision and it was very antiquated to have a two term limit in the Charter C/M Rohr said he agreed with C/M Schumann He said other than C/M Schumann, the other Councilmembers would have to resign after (two) two year terms He said his last year as Councilmember would be in 1991 He asked what incentive a person had if they could not continue their position after 11 1 Page 2 4/23/90--pw (two) two year terms He said the voters should have the right to make the decision of retaining or re --electing a Councilmember He said he recommended unlimited three year terms C/M Bender said the Miami Herald and the Fort Lauderdale News/Sun Sentinel wrote in their Editorial's last year about this matter He said it was explained that the City of Tamarac fell short in their elections due to the fact that the Councilmembers were limited to one year learning the Sob and the second to work on their re-election He said the City lost the continuity with obtaining the cooperation of the elected officials in Tallahassee and Washington He suggested there be unlimited three year terms which would give the Councilmembers time to learn the Sob and the electorate would have the opportunity to remove a person if not appropriate V/M Hoffman said he did not object to unlimited terms however, the voters may not agree to this He said the voters should be informed about the need for three consecutive terms as opposed to unlimited terms He said if the majority of the Council agreed to unlimited terms he would not object V/M Hoffman said he agreed that two year terms were too short for a Councilmember to do an effective jobs however, he felt that three year terms limited or unlimited were good Mayor Abramowitz said he believed thxswould preclude any unqualified candidate from ever being in office He said this was not how Tamarac began because the provision was put into the Charter by political expediency He said the newspapers stated that elections in Tamarac were like musical chairs He said the residents had no hesitancy in eliminating a person from office Mayor Abramowitz said he and several mattersr however he qualified intelligent and a that Mr Stelzer should have time he was to be in office Jack Stelzer disagreed on felt that Mr Stelzer was worker He said he did not feel been limited to the amount of Mayor Abramowitz said there were two Cities that he looked at as role models one was the City of Plantation and the other was the City of Coral Springs He said these Cities had the same Mayors for several years and they were operating very well He said several Mayors have informed him that two year terms were very short however practically, he felt that unlimited three year staggered terms made more sense Mayor Abramowitz said he resented any limitation on the terms because the voters would vote for the person they wanted to serve He said regardless of how powerful and well known a person was if the voters did not believe in a person they would not vote for him He said the voters should be making the decisions not the politicians C/M Schumann said by following the unlimited term nothing would be taken away from the voters He said a limit of two terms allowed the voters to vote against a person that was not qualified He said with an unlimited term the voters could vote against a person during each term Mayor Abramowitz said he ran for the first time against an incumbent Mayor and Vice Mayor who had the political power and expertise and he was elected He said this nonsense about a political dynasty was ridiculous and would not continue in the future He said he was the first Mayor since Walter Falck to be re-elected Mayor Abramowitz said the voters in Tamarac were not shy about expressing their ability to vote people in or out of office He said his common sense and logic told him that there should be three year terms Page 3 4 /23 /90-pw C/M Rohr suggested the City Council should allow the voters to determine what terms should be provided Mayor Abramowitz said the City Council should not submit a recommendation to the voters but give them an opportunity to choose V/M Hoffman said if three items were listed two year terms three year terms or no change He said 10 people voted for two year and three year terms and 11 people to vote for no change He said 20 people voted for a change and the one person voting for one change would not allow any changes He said there should be a "yes" or "no" opportunity for the voters V/M Hoffman said there could not be a three part vote because there would be problems and City Manager Kelly suggested the City Council not involve themselves in the strategy of how matters were to be presented He suggested the City Council discuss what they would like to do as opposed to how it should be done Mayor Abramowitz said he hoped that the City Council did not ob3ect to the Interim City Attorney and City Manager commenting on the Independent Review City Manager Kelly said he was directly impacted by the Charter because he was responsible to administer it He�said he always favored unlimited staggered terms of office, He said he agreed with option two He said it made the most sense because when City Councilmembers were not elected -t meant a new responsibility to the elected officials and the employees of the City City Manager Kelly said it took a long time to go through the learning cycle and it did not serve the public well to Dave (two) two year terms He said three year staggered terms seemed more appropriate and would be more beneficial to everyone involved i C/M Bender said the cost of elections was high therefore, the money could be saved Mayor Abramowitz said this was an important sub3ect however, it would not be discussed at this time C/M Bender said the City wanted younger people to become involved and three year unlimited terms encouraged younger people to become involved He said he hoped that younger people would become more interested and it would help the City to progress properly V/M Hoffman suggested the City Council consider this ratter and discuss it at the next meeting Mayor Abramowitz said he agreed with V/M Hoffman Mayor Abramowitz said the existing Charter did not address Section 4 03 Mayor and Vice Mayor He said the Charter indicated, "at the earliest opportunity after elections" V/M Hoffman said the recommendation would be appropriate, if staggered terms were enacted and there was one year with no election He suggested the City Council consider this recommendation because it did not change the existing provisions V/M Hoffman asked Interim City Attorney Ruf to comment obi this matter and Interim City Attorney Ruf said he felt it made sense to have the recommended wording; however, 'chef ballot for the amendments should be considered Page 4 4/23/90-pw Mayor Abramowitz said if the City Council wanted to change their minds about an item by the next meeting, they should speak up Interim City Attorney Ruf said Ms Coleman made several suggestions with housekeeping items He said he classified Section 4 03 as a housekeeping item and the City Council should determine if they wanted housekeeping items on the ballot Mayor Abramowitz asked if the amendments could be done with a referendum and Interim City Attorney Ruf said the length of the ballot to be presented to the voters should be determined He said the ma3or items could be handled in one election and the housekeeping items at another City Manager Kelly said the City Council did not want to experience what the City of Davie experienced He said 35 amendments on a ballot was not appropriate Mayor Abramowitz requested each Councilmember comment on Section 4 04 Compensation and Expenses of Mayor and Council C/M Bender said the expense account compensation was $2,000 00 for the Councilmembers and $3,000 00 for the Mayor He said he did not disagree with this amount at this time; however, he disagreed with the City keeping records of the expense account which could cost approximately $50,000 00 per year He said it did not make sense to spend this amount of money to control $9 000 00 He said the money should be given to the Mayor and City Council in the beginning with a voucher submitted to cover the accountability V/M Hoffman said he had no quarrel for the salary because the City Council did not run for office because of the salary He said he agreed with C/M Bender that vouchers for every expenditure was needless, costly and should be eliminated He said the expense money should be given to the City Council in monthly increments and they be required to contact IRS regarding the taxes on the money C/M Schumann said he was on a Federal account for 6 years prior to his retirement He said he received $2 500 00 monthly in advance from the Finance Department He said when he came back from a trip every expenditure had to be accounted for on the expense voucher and signed under the penalties of perjury He said if this was not done taxes would have to be paid to IRS and the expense account would be classified as income He said the City Council could draw in advance however all the funds must be accounted for as a bonafide expense Mayor Abramowitz asked who would be responsible for sending the money to IRS and C/M Schumann said the person receiving the money should be responsible C/M Bender said the City Council could retain the money and pay taxes or return the money if not needed and C/M Schumann said if this was done it was considered as income as opposed to expenditure funds Mayor Abramowitz said the City Council may want to claim the money as income He asked if C/M Schumann wanted to remain with the same procedure as it was now He said V/M Hoffman made a suggestion that the expenditures not spent be claimed as salary which would have to be filed with IRS Mayor Abramowitz asked if C/M Schumann had a suggestion on how to handle the expenditures C/M Schumann said the City Council could do what they wanted with the expenditures; however, he felt the money should be drawn in advance He said the City Council could submit a Page 5 4/23/90-pw voucher quarterly under oath stating that this was the bonafide expense was He said if there was extra funds rafter the expenses, the City Council should submit the money back to the City through a voucher Mayor Abramowitz asked who would monitor the expenses or the return of funds He asked who would stop the City Council from spending the expenditures for needless items C/M Schumann said he did not know what the procedures were presently however, he felt it was inconceivable to spend more money for the maintenance of the expenditures than the expenditures themselves Mayor Abramowitz said it was feasible to do the expenditures the way it was presently being done He said this was w`hy the City Council wanted to change this provision City Manager Kelly said the City Council did not get the expenditure funds in advance He said the City Council .had to submit a voucher to the City and staff had to do the necessary procedures for sums such as $17 64 for travel He said C/M Schumann suggested the City Council get the money in advance and submit a voucher containing the monthly expenditures He said anything remaining during that period of time could be submitted back to the City Mayor Abramowitz asked A' what would occur with the itemized list and City Manager Kelly said the City would retain the information in their records V/M Hoffman asked if it differed from the existing procedures and Mayor Abramowitz said presently the City Council had to submit a voucher to their Secretaries to City Manager Ke�1y to the Finance Department for recordation, etc TAPE 2 C/M Schumann said his suggestion would require the information to go through the procedures once V/M Hoffman asked who the City Council would submit the voucher to and City Manager Kelly said the voucher wouldlbe given to him V/M Hoffman asked if the City Council's Secretary would have to collect the vouchers and submit them to the City Manager and City Manager Kelly replied yes if this was the procedure I V/M Hoffman said this was the existing procedure and City Manager Kelly said when the voucher was submitted to him the City Council would have the money in advance V/M Hoffman asked what the difference would be and Mayor Abramowitz asked if the only place the voucher would go was to the City Manager City Manager Kelly said he would submit the information to the Finance Director C/M Schumann asked how many vouchers the City Council filed per year and V/M Hoffman said he submitted a voucher every two months He said he would not file a voucher for $6 P3 however, he accumulated the expenditures and filed them every two months V/M Hoffman said the sign offs would be the same as they were presently and the City had to keep records of what was returned if the money was given to the City Council in advance C/M Rohr said he was informed for several years that it required more money to record the City Council's expenditures than the expenditures themselves He said he did not ag4ree with this and would not instruct the City on how to handle fl 11 j Page 6 4/23/90-pw the matter He said staff should have a feasible procedure that would not require additional costs Mayor Abramowitz suggested the City Council keep the funds remaining and claim the money as salary He said the Councilmembers should be accountable for the money used as salary and file the amount with IRS Mayor Abramowitz said the City Council should stop spending additional funds to monitor a lesser amount of funds He said he would not be offended if someone stated the City Council was being under paid He said if the City wanted to increase the salaries of the City Council to a larger amount, he would not objects however increasing the amounts to $1,000 00 or $2,000 00 would not change his lifestyle He said if the City Council could accomplish saving money for the maintenance of the City Council's expenditures he would not object to paying IRS more taxes V/M Hoffman said many Cities have given their elected officials a flat non -reportable expense account He said it was actually a salary that was not reportable to IRS1 however IRS recently reviewed this matter and decided to claim the unexpended funds as salary He said if IRS wanted to claim the unexpended funds as salary taxes would have to be paid Mayor Abramowitz asked if C/M Schumann objected to this matter and C/M Schumann said he did not agree with this because classifying the funds as salary when the money should be used for expense would be a cause for members to use their salaries for expense items that were normally covered under expenses which were not taxable Mayor Abramowitz asked if C/M Schumann could state an example C/M Schumann said there were several expenses that could be used as an example V/M Hoffman said if the funds were declared as an expense they would not be taxable at this time Mayor Abramowitz said he was looking for the most feasible way to handle the City Council expenditures He said the last two trips he made to Tallahassee was for the benefit of the City He said the money he spent in Tallahassee came from his expense account and this did not mean he would not go to Tallahassee Mayor Abramowitz said everyone was interested in stopping the City from paying a certain amount of funds to monitor the funds C/M Schumann said an advanced expense twice a year would save the City money and V/M Hoffman said this procedure could be done at this time C/M Bender asked how the State handled expense accounts and Mayor Abramowitz said State officials received funds of approximately $80 000 00 He said these funds were used for staff and offices He said this was an allotment He said he did not know what occurred with the funds when they were not used C/M Bender asked if the surrounding Cities were contacted to see how this matter was handled and City Manager Kelly said this matter varied considerably Mayor Abramowitz said most of the surrounding Cities gave their officials an expense account on a quarterly basis He said the officials submitted reports concerning their expenditures He said he felt it was ridiculous to spend $3 00 to monitor $1 00 Page 7 4/23/90-pw C/M Bender said he felt that the quarterly reports submitted by the Finance Department required a lot of work He said he would lake to see the expenses given to the City Council yearly or monthly whereby the City Council would be responsible for filing any unexpended funds with IRS City Manager Kelly said there could be a procedure where the vouchers could be turned in to the Finance Department, He said the existing procedures required the vouchers to go through a chain of command V/M Hoffman suggested this matter be discussed at the next workshop He said the City Council should think about their concerns before making a final decision C/M Rohr asked if the City Manager knew approximately how long it took to operate and take care of vouchers for the City Council City Manager Kelly said the City Council did not exceed their expense accounts this year C/M Rohr said if a person did not like the existing arrangements it should not be changed for one individual. He said if the City Manager found that another procedure would benefit the City it should be implemented Mayor Abramowitz said this determination was not the responsibility of the City Manager and C/M Rohr said the City Manager should recommend any changes in procedures to the City Council Mayor Abramowitz said it was not the administration's responsibility to make amendments to the Charter He said the City Council was responsible for any amendments C/M Rohr said the City Council had to have information about something before making a decision C/M Bender said he was concerned with the storage and retention of the records He said the information had to be held for a specific amount of years, retained and stored He said the costs depended on several procedures which cost money C/M Rohr said it was fortunate that the Councilmembers did not need a big salary from the City He said he felt it was unfair to ask people to give their time and effort without providing an increase in salaries He said everyone in the City received an increase because of the cost of living increase He said he felt the City Council should be given a cost of living increase every three years or so C/M Rohr said volunteering for a position was different from being elected by the voters He said the City Council came into the office every day attend meetings at night, etc He said this was worth more than $2 000 00 or $3,000 00 per year He said cost of living increases should be considered for the City Council Mayor Abramowitz said when the City Council reviewed this Section no one indicated that the salaries of the City Council should be increased i i V/M Hoffman said a 4 7% cost of living increase would be, nothing C/M Bender said he did not feel the City Council could make a determination on this matter at this time; however, he would like this Section to be discussed later He said when the Charter was written approximately 17 years ago, there was less than half the population of the City He said he felt the salaries could be determined by the size of the Cityl He Page 8 4/23/90-pw said the City Council needed information concerning what the other Cities legislators of like size were receiving Mayor Abramowitz said this information was sent to the City Council and C/M Bender said he has not reviewed this information Mayor Abramowitz said the salaries of the Mayor and City Council of the surrounding Cities was provided C/M Bender said the City Council should review this information and base their decision on the information Mayor Abramowitz said he felt the present salary of the Mayor and City Council was an insult City Manager Kelly said the City Council was not required to be at City Hall every day He said because a specific amount of time was put in by the City Council, some consideration of an increase of salaries was needed He said the decision should not be based on the dedication of the existing Mayor and Councilmembers Mayor Abramowitz said the salaries did not seem appropriate for the City Council if they came in half the time the existing City Council did C/M Bender said if the City Council wanted to be informed with the operations of the City, time had to be spent in the office He said to keep up with everything the City Council had to spend time in the office Mayor Abramowitz said the City Council had to consider the methods of how expenses were paid and he would like the City Council to reconsider the remunerations SECTION 4 05 vacancies; forfeiture of office; filling of Vacancies .� Mayor Abramowitz said this Section was a housekeeping matter V/M Hoffman said he did not agree with Ms Coleman's recommendation He said he felt the remaining Councilmembers should appoint someone to fill the vacant position until the following March when the normal election was conducted Mayor Abramowitz said this may be different if the terms of office were amended and V/M Hoffman said if there was a year skipped because of the terms of office, the City Council should hold a special election in March at the regular election time to fill the vacant position V/M Hoffman said he felt that during a vacancy in the Mayor's position, the Vice Mayor should be appointed until the following March, which would be the normal election time Mayor Abramowitz asked if the City Council should select someone to take a person's place until the following March election if a position became vacant 2 days after an election V/M Hoffman said the City Council should appoint a successor He said if a United States Senate position became vacant one week after the election, the Governor appointed a successor until the term expired, which was six years He said he felt the City Council could appoint a successor for the vacancy Mayor Abramowitz said he did not agree with this He said the recommendation indicated that the position should remain vacant until the next election if there was less than 6 months remaining in the term Page 9 4/23/90--pw Mayor Abramowitz said the recommendation was made in conjunction with the surrounding Cities' language He said he hesitated in the appointment of a successor by the City Council because it opened the doors to the City Council selecting who they wanted to fill the position V/M Hoffman said he felt the City Council should select someone to fill a vacant position until the next March election Mayor Abramowitz said the City Council should think about this matter SECTION 4 06 Procedures Mayor Abramowitz said this Section mandated the City Council take a month's vacation He said he would like to see this determination made by the individual Councilmembers V/M Hoffman said he felt the recommendation was correct by not mandating the City Council to take a month's vacation. The City Council AGREED with the recommendation in the Independent Charter Review SECTION 4 08Board and Advisory Groups V/M Hoffman said there certain Boards mandated by State law and C/M Bender said the Board of Ad3ustment and Planning Commission were mandated At 10 20 A M , Mayor Abramowitz WITHDREW from the meeting and V/M Hoffman RECESSED the meeting At 10 25 A M , Mayor Abramowitz R =NVENED the meeting with ALL PRESENT V/M Hoffman said the City Council had no control over the Boards required by State therefore they did not have to be listed He said the ones appointed by the City Council *ere advisory Boards therefore the City Council should have the right to appoint the Boards they felt were needed Mayor Abramowitz said he did not want the appointments to be the administration's responsibility and Interim City Attorney Ruf said the recommendation indicated that this mattes was not appropriate for the Charter but was for the Code V/M Hoffman said if it was in the Charter it could only be eliminated by the voters He said the City Council had i control over the Code Mayor Abramowitz said the recommendation was to remove this provision from the Charter and place it into the Code. The City Council AGREED with this recommendation Interim City Attorney Ruf said he agreed with the recommendations however, this Section may be a housekeeping item because there would be some suspension if the City Council tried to take the Boards out of the Charter He said the feeling may be that the City Council was trying to eliminate the Boards Mayor Abramowitz asked that the matter be addressed as housekeeping and Interim City Attorney Ruf said there would be no harm with the information remaining in the Charter) V/M Hoffman said the City Council should review the areas they wanted to address and determine which of the items were of priority Page 10 4/23/90-pw ARTICLE V _City Manager C/M Rohr said the second paragraph suggested that a new Article V be created entitled "Administration" He said there were things placed in different portions of the Charter referring to the City Manager He said it was being suggested that a new Article be made indicating everything that the City Manager was responsible for V/M Hoffman said he favored most of the recommendation; however, he did not understand the purpose of Section 5 01 of the Independent Charter Review V/M Hoffman said he felt the offices of the City Attorney and City Clerk should be exempt from this Section He said he felt that the City Council should be asked to decide on the termination and appointment of the City Clerk C/M Bender said there was a Section which pertained to the City Clerk and he would like to address this matter -� Mayor Abramowitz asked why Ms Coleman recommended the City Attorney be administered by the City Manager and City Manager Kelly said he never considered the City Attorney a Department Head V/M Hoffman said the next City Manager may consider the City Attorney a Department Head He said the Charter should provide a clear understanding about the City Manager's administration of Department Heads C/M Schumann said the City Attorney and City Clerk should be exempt from the City Manager's appointment C/M Rohr said he would like to see this Section provide that the City Council would be informed of the dkmissal of any Department Head before the City Manager fir4lized it V/M Hoffman asked if the City Manager should consult with the Councilmembers before he dismissed someone and C/M Rohr said this was his opinion C/M Rohr said he did not want Tamarac to be like the City of Sunrise He said the City Council of Sunrise was not aware of why a Department Head was dismissed He said he did not want the Mayor and City Council in the position of not knowing why the City Manager dismissed someone Mayor Abramowitz said he would be embarrassed if the Mayor and City Council did not make sure that the City Manager's desk was cleaned out if the City Manager did not inform them of a dismissal City Manager Kelly said when this occurred it was reported incorrectly He said there were three Councilmembers in the City of Sunrise supporting their City Manager's decision Mayor Abramowitz said he agreed that the City Manager should inform the City Council before making a complete decision C/M Rohr said he wanted the City Council to have prior knowledge and give their consensus to the City Manager before he acted on dismissing a person V/M Hoffman said C/M Rohr wanted the City Council to give their consent before acting on a dismissal and C/M Rohr said he meant consensus not consent V/M Hoffman said he would like to discuss Article X City Clerk in the future Page 11 4/23/90-pw Mayor Abramowitz said most of the Cities had the City Clerk administrating the Oaths of Office He said Section 5 05.
