PRESENT : Mayor Norman Abramowitz Vice-Mayor Dr. H. Larry Bender Councilman Henry Schumann Councilwoman Diane Glasser ABSENT AND EXCUSED : Councilman Irving Katz ALSO PRESENT : John P. Kelly, City Manager Kelly Carpenter, Director of Community Development Phyllis Polikoff, Secretary ************************************************************************ Mayor Abramowitz said the purpose of this meeting is to interview applicants for the Planning Commission. Mayor Abramowitz said this is a public meeting and referred his remarks only to the candidates and said if the candidates wanted to feel more comfortable by waiting outside, they were welcome to do so. He said he would refer to a list to call the candidates if they decided to wait outside. Mayor Abramowitz said he had no objections to the other candidates sitting in on the questioning. Mayor Abramowitz said he was a bit uncomfortable starting without the Vice-Mayor but he commenced the questioning of the candidates. Mayor Abramowitz read a list of the names of the candidates and he passed out the questions to be asked by Kelly Carpenter, Director of Community Development. Mayor Abramowitz called Carl Alper. Councilman Schumann asked for the number of regular members and alternate members who would be chosen. Mayor Abramowitz said there were four regular members and one alternate member positions open. He asked for Kelly Carpenter's clarification on the number of alternates and Kelly Carpenter told him there was only one alternate opening. Mayor Abramowitz introduced Mr. Alper and requested Kelly Carpenter to begin the questions. Kelly Carpenter said the City Manager had asked her to prepare a list of questions to be asked and she passed these out to the Council members. Kelly Carpenter asked Mr. Alper if he had ever served on a Planning Board, zoning Board or Board of Adjustment. He said he had served on the Planning Commission of the City of Tamarac for approximately seven years until he resigned. He said he was asked to remain and he did so. Kelly Carpenter asked Mr. Alper to describe his experience on the Planning Commission beyond what he previously had said. He said he had served for one year as an Alternate. He said he read the plans, interviewed the applicants, consulted with the Building Department, viewed the property and consulted with the other Planning Commission members to make a decision a to whether to City Council Workshop 5/3/91/PP Page 2 approve the application or not. Kelly Carpenter asked Mr. Alper what experience he would bring to the Commission. He said Council members have so much work to do that the Planning Commission should examine very closely the work put before them. He said he would study the Ordinance and try to have the applicant live according to the Ordinances and the Building Codes. Kelly Carpenter said she did not have Mr. Alper's resume and did not know what his background was. He said he was an attorney and was graduated from St. John's College with Bachelor of Science and Bachelor of Social Science Degrees. He said he was also graduated from St. John's Law School and received a Bachelor of Law Degree. He said he practiced law for 45 years until he retired and moved to Tamarac 13 years ago. Kelly Carpenter asked Mr. Alper what the role of the public or the citizen is at a Planning Commission meeting and he said his view is that the citizen has a right to present his views on any matter placed before the Planning Commission. Mayor Abramowitz asked Mr. Alper if the Code was specific in allowing a petitioner permission to do what he or she requested before the Planning Board but the issue was not acceptable to Mr. Alper, what would his feelings be. He said he would have to obey the law even if he did not like what the petitioner was planning to do. He said he would have no other obligation but to pass it. Councilman Schumann asked Mr. Alper if there were people in the audience who were very angry, would he be intimidated enough to change his position. He said his answer was the same and he would not be pressured into changing his mind. He said if the law was clear, than he must obey the law even if he did not agree with it. He said the law might have to be changed after a decision has been made. Kelly Carpenter asked Mr. Alper if he was willing to sit through a four-hour training session before sitting on the Commission. He said that so much has happened in the last four to five years, he has much to learn. He said the Code has been changed and the Council needs to explain their point of view. He said he would be happy to go through the training session again. Mayor Abramowitz asked what Mr. Alper would do if the law says that based on current Code, the Council must deny the petition. He said the Council has the legal right to override the decision of the Planning and Zoning Board. Mr. Alper said if Planning and Zoning believes in the project and desperately wants the project, they will approve it. Mr. Alper said he will do the job of the Planning Commissioner. He said Council's obligation is for the welfare, safety and health of the City residents. He said this is a much wider scope than that of the Planning Commission. He said the Planning and Zoning Board has no right to tell the Council what to do. Councilwoman Glasser asked Mr. Alper if he would be willing to go to the various sites in the City. He said he must because he has to know how the community feels about the project. Councilwoman Glasser said many projects look very good on paper but when they are reviewed and inspected as far as health, welfare and safety were concerned, the look changes. She asked Mr. Alper what his thoughts were on this and said if the health, welfare and safety of the City were violated, what would his position be on the Planning Commission. Mr. Alper said his position would be to abide by the situation before him. He said if the health, welfare and safety of the City were jeopardized, than he would notify the City Council by memo why he believes the health, welfare and safety are an issue He said he would still have to go by the Code. City Council Workshop 5/3/91/PP Page 3 Mayor Abramowitz thanked Mr. Alper for attending. ******************************************************************* Mayor Abramowitz called Milton Meyer and introduced him to Kelly Carpenter. Kelly Carpenter asked if Mr. Meyer if he had ever served on a Planning Commission, Zoning Board or Board of Adjustment. He said he has never served on a Planning Board, Zoning Board or Board of Adjustment. Kelly Carpenter asked Mr. Meyer what experience he would bring to the Planning Commission which would help the City. He said his background was as an attorney. He said he went to college and law school for seven-and-a-half years at night and worked while he attended school. He said he received his law degree at St. Johns Law School and was admitted to the New York Bar Association in 1939. He said he went into the New York City Police Department (Baruch School of Criminal Justice) and retired from there in 1961 as a Lieutenant. He said he spent seven years in the Police Academy as an Instructor and Lecturer on Police Sciences. Mr. Meyer said after he retired from the New York City Police Department in 1961, he was employed for 17 years by the Allstate Insurance Company in their Legal Department. He said he handled their cases in court regarding trials, settlements and other legal pleadings. He said he retired from Allstate Insurance Company in 1978 and moved to Florida 13 years ago where he resides in the Greens. He said he was on the Board of Directors at the Greens for 6 years and served as President for one-and-a-half years. Mr. Meyer said while he was employed by Allstate Insurance Company, he was in charge of the Civil Court suits where there sometimes were 40 to 50 cases per day. He said he had six or seven attorneys working for him. He said he had appeared before the City Council and the Planning Commission, usually in opposition to a variance or special exception or zoning problem and said he believed he was successful each time. He said he was never in politics and although he has appeared as the opposition, he feels he can do an excellent job on the other side. Kelly Carpenter asked Mr. Meyer what the role of the public or the citizen is at the Planning Commission Meeting. He said the citizens role in any public hearing is to raise his or her objections by participating at the Meeting. He said the citizen's role would be to try and influence the actions of the Planning Commission or the City Council. Mayor Abramowitz asked Mr. Meyer what his response would be if a petitioner, in accordance with the Laws and the Code, had a project which was truly against what Mr. Meyer agreed with. Mr. Meyer said if the Code was unequivocal and the petitioner had the right without any restrictions that apply to the case which could be argued, he would have to go along with the Code. He said if the health, safety and welfare of the public was involved, he would make a recommendation before the Council to amend the Code. Vice-Mayor Bender said that according to the application, Mr. Meyer was also interested in the Code Enforcement Board. The Vice-Mayor asked if Mr. Meyer would be more interested in that or the Planning Board. Mr. Meyer said he prefers the Planning Board. Councilwoman Glasser said that Mr. Meyer's resume indicated he lives in District 1 when, in fact, he lives in District 3. Councilman Schumann asked Mr. Meyer how long he was on the faculty of the Baruch School of Criminal Justice and he said seven years. Mayor Abramowitz thanked Mr. Meyer for attending. ******************************************************************** Someone in attendance suggested that the candidates should be City Council Workshop 5/3/91/PP Page 4 questioned one at a time and Mayor Abramowitz said again that this is a public meeting and no one can be asked to leave. Mayor Abramowitz said the candidates must agree they are citizens and have a right to stay here according to what City Attorney, Alan Ruf, told him. Mayor Abramowitz said it was incorrect to do it this way but that anyone who is a citizen of the City cannot be asked to leave the room. Mayor Abramowitz said he suggested to the candidates, if they wished to step outside, they would be called when it was their turn. ********************************************************************* Mayor Abramowitz called Joseph Stokvis next. Kelly Carpenter asked Mr. Stokvis if he ever served on a Planning Board, Zoning Board or Board of Adjustment before. He said he had. Kelly Carpenter asked Mr. Stokvis to describe his role and experience in that capacity. He said he was on the Board of Adjustment before he served on the Planning Commission. He said he is presently on the Planning Commission and has been on the Commission for the past two years. He said going to the sites of the various developments and discussing them at the Planning Commission meetings was very beneficial. Kelly Carpenter asked Mr. Stokvis what experience he brings to the Planning Commission that helps the City make better decisions. He said reviewing the Code does require common sense and intelligence. He said there are always side issues which have to be discussed. He said he has the skills to do that. Kelly Carpenter asked Mr. Stokvis if it would help if the Staff had an organized trip for the Planning Commission out to each site, rather than the Planning Commissioners going to the sites one-by-one. He said it is most important that this be done. He said from his experience, there are some who have not been to the sites and it is urgent and critical for them to do so. Kelly Carpenter said to all in attendance that the problem of an organized trip if it is done in a group is that it has to be advertised. Mayor Abramowitz said that anyone else can come along. Kelly Carpenter said it usually ends up being a major hassle. Kelly Carpenter asked Mr. Stokvis the role of the public or the citizens at a Planning Commission Meeting. He said there are situations where the Code calls for something but the citizens are very unhappy about it. He talked about the offices across from the Florida Turnpike entrance. He said the Planning Commission or the Board of Adjustment have to make certain decisions even though they may not agree with them. Mayor Abramowitz said the Code could be changed if the Planning Commission was unhappy about something in the Code. Mayor Abramowitz said he could not give a legal interpretation but all members of Council can be sued as individuals and there are pending lawsuits. Mayor Abramowitz said that Council is in a different category and there should be no confusion with Planning and Zoning as advisory boards to the Council. Mayor Abramowitz said that the Planning and Zoning Boards should adhere to the Code and if the Code is found to be incorrect, these Boards have an obligation to change the Code. Mr. Stokvis said there were circumstances where the Community Development Department made recommendations and the Planning Commission had some objections and Kelly Carpenter was asked to evaluate her recommendations. Kelly Carpenter said Mr. Stokvis has already been through the training session but she said she would plan at least a four-hour training session before new Commissioners would sit. Mr. Stokvis City Council Workshop 5/3/91/PP Page 5 said this is very important and he spoke to Al Robbins who went to a training seminar. He said Mr. Robbins said it was most beneficial and advantageous. Mayor Abramowitz thanked Mr. Stokvis for attending. ****************************************************************** Mayor Abramowitz called Joseph Schreiber into the Conference Room. Kelly Carpenter asked Mr. Schreiber if he had ever served on a Planning Board, Zoning Board or Board of Adjustment. He said he was a member of the Planning Commission as an Alternate from 1988 through 1989 but he was not re-appointed. He said prior to that he was an elected official in the Village of Spring Valley, in Rockland County, New York. He said he was a Trustee which is the same as the City Council where he acted upon matters involving variances, zoning, grievances, etc. He said he is quite familiar with zoning, plats, site plans, etc. Kelly Carpenter asked Mr. Schreiber what experience he would bring to the Planning Commission which will help make better Planning decisions. He said his prior experience was serving on these Commissions in the past. He said he was also the Chairman of the Industrial Development Agency of the Village of Spring Valley and a good portion of Planning involves how to attract new light industry which is not objectionable to the City which needs tax dollars. He said this could probably develop more employment and referred specifically to Land Section 7. He said this would involve seeking out those light-industrial companies to attract them to Tamarac. He said this would be an asset to the City. He suggested tax waivers for a period of time. Mayor Abramowitz said this was against the Law and City Manager Kelly said it was not but was called "tax abatement". Councilman Schumann asked Mr. Schreiber what kind of growth in Land Section 7 he was speaking of. Mr. Schreiber said either to build a hotel or have light industry which would not pollute the air or create an environmental problem. He said in either case, this kind of growth could employ people who could work part-time and possibly provide employment to many senior citizens. Mayor Abramowitz asked for Mr. Schreiber's feelings to the question of a petitioner coming before the Planning Commission and according to the Code, has an absolute right to do whatever he petitions for. The Mayor said what is being petitioned is not to this members' liking, but everything is correct and the petitioner has the right to do this project. Mr. Schreiber said that when someone is appointed to a Board, that person is sworn to uphold the law. He said if the petitioner is within the law and has the application approved, the application can not be denied. He said the Board should try to convince the petitioner that the project is not feasible and an adjustment and compromise might need to be made. He said if the petitioner still insists, it is this member's obligation to approve the project, even though he personally does not like it. Councilwoman Glasser asked Mr. Schreiber if he reviewed the site and found there could be a violation of health, welfare and safety to the citizens surrounding it, what would his position be. He said he would recommend that the applicant clear up the violation or this member would speak to the City Attorney about what the Planning Commission can do to correct this violation. Mr. Schreiber said if the petitioner corrects the violation, than the petitioner can reapply and it would be the obligation of the Planning Commission to approve it if the petitioner is within his or her legal rights. Kelly Carpenter asked Mr. Schreiber what his feelings would be if a four-hour training session was implemented before the Commissioners take office and would he be willing to participate in this session. He said it would be his pleasure. City Council Workshop 5/3/91/PP Page 6 Vice-Mayor Bender said that Mr. Schreiber's application also indicated the Advisory Board. Mr. Schreiber said he was a licensed insurance agent in the States of New York and Texas for about 30 years and he served on the Insurance Advisory Board at the same time he served on the Planning Commission. Vice-Mayor Bender asked Mr. Schreiber if he would be more comfortable on the Insurance Advisory Board or the Planning Board Mr. Schreiber said he could handle both but the City would be better served if he were on the Planning Board. Mayor Abramowitz thanked Mr. Schreiber for attending. Tape 2 **************************************************************************** Mayor Abramowitz asked Kelly Carpenter if the Planning and Zoning Boards are Advisory Boards to the Council. Kelly Carpenter said they were. Mayor Abramowitz said the City Council does not need, by law, Planning and Zoning. Kelly Carpenter said under the Laws of the State of Florida, that is correct. Mayor Abramowitz said these Boards could be abolished but he said he never would. Mayor Abramowitz said the Planning Commission could assume a petitioner comes before them and presents a project which is valid as well as being extremely beneficial to the City. Mayor Abramowitz said the Code conveys the petitioner has not met all the criteria and as a result, Staff recommends disapproval of this project. Kelly Carpenter said the Board has taken this position. Kelly Carpenter said there is a book and she has to live by that book. Mayor Abramowitz said the Council has a right to make those changes and nobody else can make them. Kelly Carpenter said if a petitioner came to her with a project which was not allowed by the Code, she would need to find out if it was supported by the plan. Kelly Carpenter said if the project was not supported by the Code, she would tell the petitioner that to make the project workable, they would need to see if Council is willing to amend the Code to support the project. Ms. Carpenter said if the project proposed is not supported by the Code or the plan, the petitioner would be told an amendment to the Code would have to be made to make the project workable. She said the petitioner would be told that Staff would not be willing to support the project but the petitioner could speak to Council if he or she wanted to. She said only Council can change the Code. Mayor Abramowitz said the reason he supports what is being done is if sections of the Code inhibit the City from doing what should be done in order to exist and prosper, the Code must be changed. He said many things Staff does not support are very good for the City. Kelly Carpenter said this is the correct position and the Planning Commission can point out what is wrong and take the position of going along with a project because the Code indicates they have to. She said through Motions and reports, the Planning Commission can say this is wrong and needs to be looked at again. Kelly Carpenter said the Planning Commission does not have to go along with a project because the Code says they have to but they are legally obligated to do that. She said if the Planning Commission is the keeper of the local Planning agency under State Law, they are obligated to point out what they believe to be wrong. Mayor Abramowitz said Kelly Carpenter has an obligation as Director of Community Development to tell Planning and Zoning that if something comes before them which is allowed, it might not be passed because there may be problems ahead. Kelly Carpenter said she is obligated to do this and has already said this to the Planning Commission. She said she makes it very clear when the Planning Commission must take the only action allowed. City Council Workshop 5/3/91/PP Page 7 Councilwoman Glasser asked if Kelly Carpenter or the Planning Commission see that something must be addressed by the Council and there is concern about saying it in public, is there a reason why Kelly Carpenter can not see the Council Members individually. Mayor Abramowitz said he saw no problem with that. ****************************************************************** Mayor Abramowitz called Gerald Lehman into the Conference Room and introduced him to those in attendance. Kelly Carpenter asked Mr. Lehman if he ever served on a Planning Commission, Zoning Board or Board of Adjustment in the past. He said he had not. Kelly Carpenter asked Mr. Lehman what experience he brought to the Planning Commission which would help the City make better Planning decisions. He said he had 45 years of very extensive national and international business experience, dealing with the Federal Government, the State Government and the municipalities. He said he was Chief Executive Officer and President of seven corporations, which were held by his family. He said he started these corporations. Kelly Carpenter asked Mr. Lehman to describe what the role of the citizen or the public is at a Planning Commission Meeting. He said the citizens are there to voice their options to the elected officials as to their desires and thoughts. He said the public must do its part by participating in Government. Mayor Abramowitz asked Mr. Lehman what his response would be if a petitioner, in accordance with the Law and the Code, was allowed approval of a project because it fits all the parameters of the Code but the project was against what this Member agreed with. Mr. Lehman said the Code is Supreme. He said in this type of situation, everything is negotiable and by negotiating, the individual who would want to do something outside the Code could possibly be convinced to change his or her mind or even to move this project to another location. He said in this way, the Code would not be violated and the petitioner would be satisfied. Mayor Abramowitz said the petitioner now says he or she understands what is being said and appreciates the recommendation. Mayor Abramowitz said the petitioner comes before Council with a plan which adheres to the Code and allows the petitioner permission to do this project. Mayor Abramowitz asked Mr. Lehman what he would do. Mr. Lehman said the Planning Commission must go along with the Code. Kelly Carpenter told Mr. Lehman there would be a four-hour training session before sitting on the Planning Commission and questioned whether he would be willing to participate. He said he has a big educational back-ground as he was graduated from Townsend Harris High School (an Honor School which was part of City College) and when that closed, he went to Tilden High School. He said he also went to City College of Mew York. He said he would be happy to participate in this session. Mayor Abramowitz asked if it would be a problem if Mr. Lehman were to visit the various sites in the City and Mr. Lehman said it would not. Councilman Schumann wanted to know if Mr. Lehman would change his mind if many angry people, sitting in Council Chambers were very vocal about opposing what this Member and the Planning Commission were getting ready to decide on. He said these people would not change his mind. Mayor Abramowitz thanked Mr. Lehman for attending. *********************************************************************** City Council Workshop 5/3/91/PP Page 8 Mayor Abramowitz called Harold Rosen into the Conference Room and introduced him to those in attendance. Kelly Carpenter asked Mr. Rosen if he had ever served on a Planning Commission, Zoning Board or Board of Adjustment before and he said he had served on the Planning and Zoning Board in the City of Coconut Creek. Kelly Carpenter asked Mr. Rosen to describe his role and experience at the City of Coconut Creek and Mr. Rosen said he served as Chairman for five of the seven years he was there. Kelly Carpenter asked Mr. Rosen what experience, other than being on the Planning and Zoning Board in Coconut Creek, would he bring to this City which will help the City make better decisions. Mr. Rosen said his background is that of an engineer and an architect and any Board should be diverse in terms of the people who serve on them. He said Board members should have a wide variety of background and experience and his expertise and knowledge relates to projects and what goes into a project and he feels he has the qualifications for this position. Councilman Schumann said Mr. Rosen has a Degree in Chemical Engineering from the City College of New York. Mayor Abramowitz asked Mr. Rosen what his feelings would be if a petitioner presented a project and the Code specifies the petitioner has an absolute right to get approval for a project which is in accordance with the Laws and the Code. Mayor Abramowitz said the project was adverse to what this Member was in agreement with and this project would cause an uproar in the community. Mr. Rosen said he would have to go with the Law for the most part. He said if the Law is crystal clear, a man who owns land is entitled to the use of that land. Mr. Rosen said he worked very closely with the Staff at the City of Coconut Creek to try to get them to work with the developers. He said he also tried to get the developers to bend to meet the needs of the City. He said the Planning and Zoning Board would try to delay the application for a few months while asking the Staff to work more closely with the developer. He said the Developer would be asked to meet some of the demands made by the City. Councilwoman Glasser asked Mr. Rosen how long he was living in the City of Tamarac and he said four months. Councilwoman Glasser asked Mr. Rosen, if he visited the site of a project which was agendized to come before the Planning and Zoning Board, it was found to pose a threat of either health, safety or welfare, what would his position be. Mr. Rosen said that the Law is precise in that area and the Member would have no alternative but to meet those requirements. Councilman Schumann said that part of Mr. Rosen's background is that he authored several books on specifications and construction materials. Mr. Rosen said they were primarily concerning building and construction. Kelly Carpenter told Mr. Rosen that a four-hour training session might be implemented before any individual would sit on the Commission and she questioned whether that would be something that would fit into his schedule. He said that was fine. He also suggested that before and even after he sat on the Planning and Zoning Board in the City of Coconut Creek, he took helicopter flights over the City to get a better feel of what the City was like. He said that Broward Sheriff's Office has many helicopters which might be utilized. Kelly Carpenter said that she does not do this but has ongoing training sessions for the Commissioners, almost on a monthly basis. Mayor Abramowitz asked Mr. Rosen if he had any problem visiting the sites and he said he did not. City Council Workshop 5/3/91/PP Page 9 Councilwoman Glasser asked Mr. Rosen when he last served at the City of Coconut Creek and he said he left in December, 1990. He said he moved to the City of Tamarac about the same time when he terminated with the City of Coconut Creek. Mayor Abramowitz thanked Mr. Rosen for attending. Mayor Abramowitz said he did not want to influence anyone but he received a telephone call from an official from the City of Coconut Creek who said that Mr. Rosen was excellent on their Planning and Zoning Board. ***************************************************************** Mayor Abramowitz called the last candidate, William Sherman, and introduced him to those in attendance. Kelly Carpenter asked Mr. Sherman if he had ever served on a Planning Commission, Zoning Board or Board of Adjustment and Mr. Sherman said he had appeared before them on behalf of his clients. Kelly Carpenter asked Mr. Sherman what experience, regarding his representation of clients, could he bring to the Planning Commission which would help the City make better Planning decisions. Mr. Sherman said he is familiar with applications and forms which have to be filed with the City and also that he is a quick learner. He said he is both an attorney and a CPA and has the expertise regarding the financial aspect as to whether a project is feasible and whether it fits within the parameters of the Code of the City. He said he practices in New York and Florida but is selling both practices and is a full-time resident of Tamarac as of April, 1991. Kelly Carpenter asked Mr. Sherman what the role is of the public, or a citizen, at a Planning commission meeting and he said he did not know if he was at an unfair advantage because he heard what the previous applicants said. He said he has the same views and the public is entitled to attend the hearings and make their views known. Mayor Abramowitz asked Mr. Sherman what his response would be if a petitioner presented a project and the Code specifies the petitioner has the right to get approval for this project which is in accordance with the laws and the Code. Mayor Abramowitz said the project was in opposition to what this Member believes in. Mr. Sherman said he would have to vote in favor of the petitioner. He said what the Law said can be done must be done. He talked about a client he had in Nassau County, New York. Kelly Carpenter asked Mr. Sherman if he would have a problem with a four-hour training session she would like implemented before a Member of the Planning Commission actually sits on the Commission. He said he would not have any problems, however, he could not do it the following week as he would not be in the City. Kelly Carpenter asked Mr. Sherman if he could take a look around the City on a monthly or bi-monthly basis to see the various projects and he said he would because that would be part of his duties and the obligation of the Office. Mayor Abramowitz noticed other Boards were indicated on Mr. Sherman's application and asked if the Planning Board was his first choice. Mayor Abramowitz said there were very many applications for this position. Mayor Abramowitz asked Mr. Sherman if he was interested in other Boards if he was not selected for the Planning Commission.
