Mayor Abramowitz said the purpose of this meeting is to discuss the recycling of aluminum and glass and the agreement between the five cities. City Manager Kelly said that Carol Evans, City Clerk, has a request. Ms. Evans said to ease the scheduling of other meetings, she requested the same date and time be set for Council workshop meetings. Mayor Abramowitz said under normal conditions, he would like to do this; however, meetings are scheduled as items for discussion come up in the course of business. He asked that, when possible, the City Clerk be given advanced notice. C/M Rohr said there will be a meeting on December 5, 1990 at 10:00 A.M. regarding the recycling proposal. V/M Hoffman said if the information is known in advance, there would not be special meetings. C/M Rohr suggested beginning the discussion regarding the recycling with the proposal. He said he has outlined his objections. Discussion was held regarding Item 6, Section 12. (see attachment) C/M Rohr said the aluminum has greater income potential. Mayor Abramowitz said City Manager Kelly is.going to the meeting to find out what the other four cities are doing. Discussion was held regarding the formula of percentages in the recycling agreement. V/M Hoffman asked if the agreement can be ratified and if Tamarac would be in violation of the agreement, if the City refuses to go along with it. City Attorney Ruf said that Tamarac is tied into the agreement with the other four cities. Mayor Abramowitz said any new item is subject to ratification. C/M Rohr said it is to the advantage of the City to go along with City Council Workshop Meeting 12/03/90/KJ Page 2 this. Discussion was held regarding the advantages and the provisions of trucks for recycling. Mayor Abramowitz asked what happens if the City does not agree;to the ratifications. Assistant City Manager McDermott said there will be a fine. Discussion was held regarding Page 4, Item d of the agreement �See attachment) Mayor Abramowitz asked for copies of the contractual franchise agreements with all other cities and City Manager Kelly agreed. C/M Rohr read Page 1, Paragraph 2 of the proposed agreement. V/M Hoffman suggested tying in the paper recycling with alumimmff, and glass. C/M Rohr said the items are separate commodities and the aluminum enables monies back for the recycling. V/M Hoffman said he does not want the City to be responsible for the payment of the containers. City Manager Kelly said the containers are part of the grant. Discussion was held regarding the containers and the different situations that may arise regarding the usage of these containers. City Manager Kelly said some cities take the money from their General Fund Account. He said the option would be to have it On the Utilities bill. V/M Hoffman said there is enough on the Utilities.bill. He said he wants Waste Management to be responsible for lost or stolen items. He said he does not want the agreement to end in 7 years, He asked how much and when the money will be received back to the City for the recycling. Mayor Abramowitz said the agreement should automatically be renewed within 90 days or indefinitely until either party cancels. C/M Rohr read Page 2, Paragraph b, of the proposed agreement. (see attached) Discussion was held regarding the cost and depreciation of the equipment. V/M Hoffman said if this contract is signed, the City will be locked into it. Mayor Abramowitz said Tamarac has done a good job in complying with the five cities. He said the City is trying to tie into a contract with a potential of returning revenue. He suggested having City Manager Kelly represent Tamarac at the meeting on December 5, 1990 to find out how the other cities think about the proposed agreement. Discussion was held regarding Page 4, Items d. and e. (see attached) V/M Hoffman said the agreement being reviewed is the same agreement that has already been signed. He said the deletionsi have been crossed out and the additions have been underlined. City Manager Kelly expressed his concern regarding Item 4, Section 8. (see attached) V/M Hoffman said single-family homes need to be addressed. He said the original agreement was created to adhere to the State mandate to reduce the waste in landfills. Mayor Abramowitz said it is the City's responsibility to reject or accept the contract and does have a bearing on the originals contract. He said it would not be good to send City Manager K�lly to this meeting to fight about the proposed contract. City Council Workshop Meeting 12/03/90/KJ Page 3 City Manager Kelly asked that Council give their expressions regarding the various sections of the proposed agreement. Section 1: Council had no objections. Section 2: Council came to no agreement. Section 3: Council agreed. Section 4: Mayor Abramowitz suggested 3 small containers rather than a 30 yard container and all agreed. Section 5: Council agreed. Mayor Abramowitz asked who made the determination of the minimum tonnage requirements. City Manager Kelly said this is a formula in the original contract and V/M Hoffman said it only pertains to paper. Discussion was held regarding the minimum tonnage requirements of paper, aluminum and bottles. Mayor Abramowitz said he does not feel that City Manager Kelly should attend this meeting. V/M Hoffman said he must attend. C/M Rohr said the other cities may agree with the thinking of the Tamarac Council. Mayor Abramowitz said the City does not need a truck for the aluminum and bottle recycling. He said the City already has 3 tucks. -Assistant City Manager McDermott said these trucks are ©rely_ for *aper. .. Disaussi�n was held regarding the various costs to the City and .the..fe" that may be charged. Discussion was held regarding the amount of the fine if a City chooses to be removed from the agreement. C/M Rohr asked if he would be permitted to attend the meeting on December 5, 1990 as a Councilman if it is going to affect the City. Mayor Abramowitz asked that he not attend the meeting to represent the City if he is going there to argue. i V/M Hoffman said the main objective in attending this meeting is to aquire the primary responsibility of the City under the existing contract. C/M Rohr suggested inviting the other four cities to a separate meeting for discussion and he asked what the legalities would be. Discussion was held regarding this. Discussion was held regarding the current tipping fees and the current contract with Waste Management. C/M Rohr read a current Contract from Wilton Manors. Mayor Abramowitz asked to have the history of the recycling matter of the City of Wilton Manors sent to him for review. TAP$ 2 Mayor Abramowitz said Eric Soroka is leaving the Recycling Committee and there is a possibility that they may want City Manager Kelly to take charge of the Task Force. He said he feels City Manager Kelly is too busy with the City business and he suggested City Manager Kelly review the possibilities. C/M Rohr said he feels that if the City would have been more involved, a lot of things may not have been handled the way they were. He said he is not looking forward to another City taking over. He said if Mayor Lieberman of Lauderhill does not take the responsibility, he would like to see City Manager Kelly involved. Discussion was held regarding the alternatives to taking the lead of the Recycling Task Force. City Council 12/03/90/KJ Page 4 Workshop Meeting V/M Hoffman asked how much time is involved in this job. He asked if City Manager Kelly feels he would be able to handle this without the City suffering. City Manager Kelly said he will attend the meeting and get the details of what the job entails. He said he will find out what the intentions of the members are for replacing Eric Soroka. Ye said he needs to determine how much work is involved. Mayor Abramowitz said it would be embarrassing if the City would be the head of the Task Force and Council decides not to go with the contract. TAPE 3 Assistant City Manager McDermott handed out the Task Force Analysis Report. (See Attachment 2) She said the Committee was formed to do the fact finding. She said this is to let Council know what is needed when the recycling is ready to begin. Mayor Abramowitz said there have been requests from residents in the multi -family units and single-family units that either feel left out or have been taken advantage of. He said there is no time table for multi -family units. He said he would like this to be done and C/M Rohr said containers are needed. A meeting has been scheduled. for December 5, 1990 at 10:O0 a,m, at North Lauderdale City Hall to review the amendment. i Tne amendment has been negotiated over several months with Waste Management based on the guidelines established by the group Cities. The major points of the agreement ere as follows: 1. 69gtlpfl_; - Revised to add clear glass and aluminum containers as recyclabie materials with an effective date of April 1, 1991, Eliminates the bundling of newspapers and provides for the placement of materials in the appropdatio container, 2. Segtiori 2 - Extends the term of the agreement in order to reduce up ' front lncreases/costs,. 3. &OPm 3 - Provides for the placement of recyclable materials in the appropeatO container. 4. s2QU1213 a - Waste Management agrees to provide the equipment and supervlsicol at its expense and the Group Cities agree to provide the manpower to deliver th containers to all residents - required to participate In the program. West: Management will provide at.no cost a thlrty.yard roll off container to be placed at a secured public facility In each one of the group Cities. This was established tO provide a collection point for those areas not included in the single family residential program, 'It Is anticipated that this will assist with meeting minlmurn tonnage requirements. The minimum tonnage requirements to maintain the current rate of .78/month h os been revised to include the additional commodities and Is based on a 42% Participation rate. The total average adjusted tons of all materials is the minimum requirement. For example, if more aluminum Is collected than newspaper and the total average adjusted tons is met, a rate adjustment would not occur at that point. - No rate adjustment from December 18, 1989 to March 31, 1992. Rate adjustment caps out at .93/month and Is subject to current formula from Aprl 1, 1992 to March 31, 1993. After April 1, 1993 the rate adjustment is subject to the formula.
