ROLL CALL: PRESENT- Mayor Palter U. Falck Vine, Mayor helen Hassaro Councilman Philip D. Kravitz Councilman Jack Stelzer ASSENT .11 AND ....EXCUSED:E. ALSO PRESENT: Laura Z. Stuurmans, City Manager Joseph McIntosh, Police Chief Patricia Marcurio, Secretary Mayor Falck read the official notice of the workshop meeting which was Section called1400f thesCnd rrrta prohibit 7, proposingamendment to _.._.. pit parking of vehicles on unpaved portions of publicly or privately owned lands. C/M f;ravitz said at they time he introduced this amendwent to the Code, he had received requests from several residents for legislation limiting the parking in certain areas so that people would not park their cars on grassed areas. He said since that time, he has received. calls and visits from residents of this sane area that were not in favor of this Ordinance. He said he has received calls from FP&L, Southern Dell and the ambulance people objecting as well. He said it is his intention at this time to request that nothing be done on this until a system can be devised that will be agreeable to the majority of the residents, therefore, he objected to acting on igT Ord 1107 7 V/M Massaro said she had the same situation as C/M Kravitz except that she had no requests for this Ordinance. She said after dis- cussing this with the residents they realized it was better to occasionally park on the grass when they had an overflow during special events. She said she is not in favor of this Ordinance unless some way can be found to protect everyone. C/M Stelzer said this complaint originally cane from the Sunflower/heathgate section and throughout: this area there are cars parked in the swales, the grassed area between the sidewalks and the roadway. He said there is overflow parking at City hall, the Post Office, the Temple, Tamarac Nark, Toni Norris' Restaurant, Cypress Creek Commons, various clubhouses, `cabal Palm Driving Range, etc. and to put an Ordinance through because a few people are annoyed is wrong, he said there are 2 Ordinances, #70-25 and #70-30 which prohibit parkins; on any grassed area that has an underground water sprinkling system. City Manager Stuurmans said these have been repealed by the passing of Ordinance ;#73-33, V/M Ma4saro said people can park in the Swale in the daytime, however, cannot park at night. C/M Kravitz said one of the reasons that he initiated this was that some people from Sunflower/hieathgate, who have more than one car, would park overnight from 2:00 a.m. to 6:00 a.m. violating the Code. He said they received requests to have the Code Enforcer naive tickets and that would have to be for everyone. Mayor Falck said he will make it: unanimous by adding his disapproval, he said the City has something today that is workable, is not causing the people problems and he is against doing anything to create a situation that cannot be enforced. V/M Massaro said this Ordinance would not be workable but she agreed that any cars parked during those hours specified as prohibited should be tackled. Police Chief McIntosh said any law that is unenforceable is a waste of time. 1 _ 2/16/84 / pill Elmo Hilderbrand, President of Section 3, Mainlands, asked if the restriction against parking between 2:00 a.m, and 6:00 a.m. applies to private property and V/M Massaro said not on private property but in front of private property. City Manager Stuurman s react from the existing Code: "There shall be no vehicular parking in the braved portions of the dedicated public right-of-way areas within the l imi is of the City during the hours between 2:00 a.m. and 6:00 a.m. except those vehicles commonly designated as emergency vehicles. This pro- hibition shall apply 7 days a week" C/M Stelzer said that means that ,you may park overnight in the swales and V/M Massaro said in the grassed area or on your lawn. Mr. Hilderbrand said he disagrees with Council and has gone to the point of hiring a lawyer for court injunctions. he said as Pres- ident of his area, he has had success with keeping people off the swales by threatening them and he questioned why the City, who goes to such expense endorsing beautification standards would allow cars to park on lawns and Crassed areas. He said thc,y :ark over sprinkler systems and this crakes the lawns and grassed areas difficult to maintain properly. He said he will not give up on this as long as he is president of his Section and most deed restrictions prohibit parking on the grassed areas, therefore, if they are not enforceable they will he unimnortant. V/M MAsnorn said the City does not enforce deed restrictions, the Home Owners Association must. Mr. Hilderbrand said he understands this but is asking for assistance from the City. Mr. Hilderbrand- saio "whbn this rorriri'unity as built they made the streets very narrow since it was primarily a retirement City but now there are families there requiring more cars and there are many problems. V/M Massaro said as soon as the developers stopped controlling this City, they changed the width of the streets. She said east of 441 some streets are only 12-feet in width and the law must apply to everyone. John lachmann, resident, said in past discussions there was some consideration given to installing cir- cular driveways to avoid this problem and Mayor Falck said they are stall working on the requirements for this. C/M Kravitz said he would recommend Council study this problem further to determine a solution that would he workable for everyone. V/M Massaro said the original Ordinance was repealed because it was unenforceable. C/M Stelzer suggested a solution to Mr. Hilderbrand's problem might be that since they have no penalties now, they could issue a Resolution in the Home Owners Association that there would he a fine of S15 if people park on the grass and then, to collect this fine, they could go to `:mall Claims Court, Mayor f'alc;k said the Council has voiced their opinions as they relate to this particular proposal and should pursue it to the satisfaction of all of the residents.
