ALSO PRESENT- Evan Cross, City Planner
Carol Evans, Asst. City Clerk
Evan Cross, City Planner, stated that he and C/W Kelch worked
to expand the B-5 and B-6 Uses by permitting more retail
businesses as it is thought that they are too restrictive.
Mr. Cross explained that he offered his work to the City Attorney
for review and comment. The City Attorney responded with 9
suggestions.
At the suggestion of V/M Massaro, the City Planner read each
of the uses with an explanation.
Abstract, advertising companies --------- included in B-5 & B-6

Art Supplies- retail use- no decision- to be discussed at future

use in conjunction with art school with
no store front or as independent operation.
The City Planner pointed out that accesory uses in B-5 & B-6
cannot have street access nor advertising. C/M Disraelly indicated
that he believes Council will have to address this point by
changing this prohibition of no street access.
Upon question of V/M Massaro, C/W Kelch explained the term
"accessory use" to mean a retail type business which is located
in -an office building for the primary use of the office personnel -- such as a 2' x 5' newstand, lunch counter, barber or hair
dressing shops, etc. The City Planner quoted from Code Section
28-171.02 wherein it states that the building shall contain a
gross floor area at least 15,000 sq. feet of commercial floor
area in order to accommodate accessory uses. Not more than
20% of the gross floor area shall be used for accessory uses.

Councilwoman Kelch said that if between the time of this meeting
and the time this matter comes up for consideration anyone wants
to review anything on the list whether covered today or not
to see what additional should be included, the Council members
should contact the rest of the Council.
-2- 6/24/80
Mr. Cook asked whether consideration had been given to lowering
the 15,000 square foot minimum and Council said that they
would have to. Mr. Cook then said he would check the size of
office buildings in the Town and would advise them at the
regular meeting so that they could discuss this further, and
also said that he would write wording separating the principal
uses from accessory uses.
Vice Mayor Massaro adjourned the meeting at 4:20 P.M.
