Carl. Alper, resident, quoted from the Charter which states that the Charter Board shall consider and propose amendments to the Charter. He suggested that there should not be two bodies. C/M Stelzer stated that the present Charter Board has placed an amendment an the Charter whereby they can place any amendments on referendum without dis- cussion or approval of the City Council. He added that they have made many changes which restrict the actions of the City Council. C/M Stelzer suggested that the Charter Board now has the power to place a completely new Charter on the ballot, without approval of the Council. He explained that the purpose of a Charter Review Committee is to recommend revision to the Charter to the mutual satisfaction of both the City Council and the Charter Board. 21 11/14/84 /cmt Vice Mayor Stein clarified that the Charter Board has always been able to propose amendments to the people over and above the Council, but the number required for a vote has now been changed from four to three. C/M Stelzer stated that it was previously required that the Charter Board present such amendments to the Council and they are not now required to do that. Vice Mayor Stein advised that the subject of the discussion is that the Council has the right to appoint any advisory committee to make recommenda- tions for action on any subject. He added that this Comuittee is not intended to take any power away from the Charter Board. City Attorney Henning pointed out that C/M Munitz proposed this Committee and he has requested that the Committee membership be five members of the public, rather than as originally proposed. Jim Godin of the Charter Board suggested that there is a lack of cooperation evident by this action. He referred to Section 8.02e which establishes a specific framework and suggested that the Council only needs to ask the Charter Board for whatever Council requires. He stated that establishing this Committee is demeaning to the Charter Board. Ben Lieber, Chairman of the Charter hoard, agreed with both Mr. Godin and Vice Mayor Stein. Mr. Lieber added that the Charter Board has the right to propose amendments to the Charter, with a majority of the vote and advised that no one has taken away the rights of the Council to propose amendments. He suggested that at the last two Workshops, Council has ignored every suggestion made by the Charter Board and the Charter Board has found it impossible to work with the Council. Mr. Lieber advised the Council that the Charter Bnard has not and does not intend tD encroach on Council's right to legislate, the Charter Board is an investigatory group and they will not permit Council to take away their prerogatives. Mr. Lieber stated that the Charter Board is opposed to a Charter Review Committee and he will personally do whatever he can to assure that there is no cooperation with such a Comittee, as he believes the intent is to remove the Charter Board. Alice Norian of the Charter Board, referred to the September 5th Pre -Agenda Meeting when this item was proposed by C/M Munitz, for the purpose of writing a new Charter. Ms. Norian said that at that time, she indicated that the Charter Board was currently in the process of reviewing the Charter in that anticipation. She continued that after that meeting, she was advised by C/M Munitz that she would regret it if she did not go along with this pro- posal, and that he intended to pursue the proposal to its approval. She said that in response to her question of why the Charter Board could not do this, C/M Munitz replied that the Charter Board did not know how to do it. Ms. Norian agreed that the Charter Board has always had the right to take action to amend the Charter without discussion with the Council, but they do want to respect the Council. She stated that likewise she wants the same respect and she objects strongly to any such demeaning of the Charter Board with lies, as was done with the recent amendment. Ms. Norian suggested that the original Charter was written at the pleasure of the Council and added that the amendments enacted by the Charter Board were to fill the needs of the people. City Attorney was instructed to prepare Ordinance for this amendment to go to referendum. City Attorney Henning read his Memo #84-11-9 regarding a possible Ordinance calling for a referendum to amend the City Charter on the subject of redis- tricting. He emphasized that nowhere in the previous amendment does it state that the final plan must have between 22�% and 27;-2% of the City voters in each district and added that with these requirements, it is possible that redistricting would be required every year. The City Attorney asked for Council direction for this Ordinance. 31 11/14/84 /cmt Vice Mayor Stein suggested that the splitting of condominiums should be amended. He continued that the prohibition should be removed or there is the possibility of Kings Point having 10,000 voters in one District. Mr. Henning pointed out that under the 1 person/l vote concept, all residents vote for a candidate. The Vice Mayor stated that his concern was for the candidate and the requirement to live in the District that he would represent. C/M Stelzer pointed out the problems in other Cities, specifically Coconut Creek with four councilmembers from WynmDor. He suggested that only one delegate should be permitted from a District no matter what the voting ratio is. Vice Mayor Stein recmvended that the percentage for redistricting be changed to 5% either way. Carl Alper, resident, stated that when a candidate is elected by all of the voters, he does not represent a specific District. Mr. Alper suggested that the entire redistricting procedure be eliminated and quoted several articles stating that a Councilman depending on a City-wide electorate must represent the entire City no matter which District he lives in. The Vice Mayor referred to the savings associated with the debt service on the facility and pointed out that this would be realized each year. Mr. Johnson advised that a contract price for one year does not necessarily establish the price for succeeding years. He said that he would interpret these findings and report back to Council. 52. Johnson, DATE: November 9, 1984 SUBJECT: B.S.O. PROPOSAL REFERENCE: City Manage After Council action on October 10, 1984, to refer the item of the B.S.O. proposal back to my office, I have had staff review the financial benefits of the proposal. As I stated in my previous memo, the exact dollar savings could only be arrived at after the City and B.S.O. arrive at an acceptable contract. The contract itself would establish the level of service the City would expect from the B.S.O. In reviewing the other cities that contract with B.S.O., the average saving is equal to 30% of the cities budget prior to B.S.O. In Tamarac, the saving, using the estimated 30%, would equal approxi- mately $994,674. As you can see the saving figure appears to be quite high, but this is the percentage that the B.S.O. suggested we use without negotiation. it is my personal opinion that the actual saving would be less once all the areas have been addressed in the contract. It is still my recommendation that we stay with our own Police, and proceed with the building plans for the future. With this change in the Sheriff's Office, and other factors such as local control of our Police, I don't feel that now is the time to go with B.S.O. I feel that each of you know the residents in your area, and their feelings regarding the local Police vs. B.S.O. I will be happy to answer any questions you might have.
