ROLL CALL: PRESENT: ABSENT -AND EXCUSED: ALSQ PRESENT: Mayor Bernard Hart Vice Mayor Sydney M. Stein Councilwoman Helen Massaro Councilman Jack Stelzer Councilman Arthur H. Gottesman Larry Perretti, City Manager Richard Rednor, Acting City Attorney Marilyn Bertholf, City Clerk Patricia Marcurio, Secretary MEDITATION AND_PLEDGE OF ALLE IA CE: Mayor Hart called for a Moment of Silent Meditation followed by the Pledge of Allegiance. 2. Utilities West - New Bond Issue - Temp. Reso. #4084 -- Discussion and possible action to select a bond underwriter or underwriters to implement the sale of bonds for Utilities West Improvements. 31NQP,SIS OF ACTION: Mayor Hart TABLED this item to the Special eeting on 4/12/86 at 2:00 P.M. Mayor Hart said he has a memo from V/M Stein requesting that this item be Tabled since the complete report on this matter is not ready at this time and both the Finance Director and the Utilities Director/City Engineer be present and they are unable to attend tonight. C/W Massaro asked that this item be Tabled to a Special Meeting of Council on Tuesday, 4/15/86 since the Finance Director has been away and requesting his attendance at this meeting would be on short notice. Mayor Hart said Mr. Etheredge and the underwriters have stated that they would be present tomorrow. He said it is within his jurisdiction as Chairman to adjourn this item to tomorrow at 2:00 P.M. C/W Massaro asked Mr. Rednor if an item can be Tabled from this meeting without a vote and Mr. Rednor said he believed a Motion would have to be passed to Table. V/M Stein said if this item is not passed tonight the Mayor can put it on the agenda for the next meeting. Mr. Rednor said he feels any Motion must be voted upon and must be passed by 3 people. He said an agenda has been prepared for tomorrow with this item already on it and Mayor Hart said the Special Notice for tomorrow states, "This item appears on the Special Meeting Notice for Friday, 4/11/86 at 7:00 P.M.; however, it is anticipated that on 4/11/86, Council will table this item to the meeting on 4/12/86." First Reading and Public Hearing. SYNOPSIS OF ACTION: APPROVED on first reading. Public Hearing was held. Second reading will be on 4/28/86 at 6:00 P.M. Mr. Rednor read T m d 1234 by title. Mayor Hart opened the public hearing. Nick Condorousis, Vice President of Lennar Homes, said they are objecting to this Ordin- ance since at this point in time they are faced with many other fees as well. He said in their community they provide a private bus transportation system and the County recognizes the utility of this and has considered credit to developments on their road impact fees. He urged Council to seek input from the developing community so that they can provide the City with detail regarding their concerns. Louis Fehder, resident, noted that there are many problems with traffic on Commercial Blvd. and 79 Ave. and he requested consideration be given to a traffic light at that location. He also suggested property be bought for use as a parking lot by the Post Office to avoid traffic problems. Louis Silverman, Co -Chairman of the Safety Committee of the Tamarac Presidents Council, said they know about the problem and are trying to work on it. He said the D.O.T. presently feels that a T--corner such as this area does not warrant a traffic light. He noted that more help is needed from Council and the residents on this problem. Kurt Rosenfeld, resident, said more traffic will be generated at that location because of the nursing home and new shopping center at that location. Edna Jasom, resident, said she has complained about walking safety problems with the City and she had a petition signed by 200 people. She read her cover letter which suggested that walkways could be built on 70 Ave. with reflectors. Mayor Hart asked the City Planner to give the public a report on the reason for this Ordinance. Thelma Brown, City Planner, said although the concerns of the residents are well taken, this Ordinance will require developers coming into the City to provide for the future need of impact fees that will correct existing problems. Ms. Brown said this item was heard at a public hearing at the 3/26/86 Council meeting and this is being heard tonight because there was a failure to announce the next public hearing date. C/W Massaro asked why the A.C.L.F. units are different than the hospital units since the impact on the roads will be the same. Ms. Brown said she agreed but the study that was prepared from Kimley-Horn in November, 1985, indicated that an A.C.L.F. unit is considered a residential classification whereas a nursing home is considered a commercial classification and requires additional consideration. C/W Massaro said the fee is based on the number of beds throughout the building. 2 � 4/11/86 /pm r Ll Ms. Brown said when the study was conducted by Kimley--Horn it was based on the same theory the County was using in establishing their TRIPS per day. C/W Massaro said she would like to see this considered before the second reading. V/M Stein said the only way to substantiate an Ordinance of this kind is based upon a study and if the Council disregards the study there will be a problem enforcing the Ordinance. He said the advice of the Attorney was to follow the study. He noted that this is not extremely important since there are no A.C.L.F. units in the City and, if there were a few, they would not affect the Ordinance. C/W Massaro said she felt the City Planner might contact Kimley- Horn to determine if an adjustment cannot be made on their study which would support a change. Mayor Hart closed the public hearing with no further response. V/M Stein MOVED APPROVAL of Temp. Ord. #.1234 on first reading, SECONDED by C/W Massaro. MOTE: ALL VOTED AYE Mayor Hart announced that the second hearing will be on Monday, 4/28/86 at 6:00 P.M. and he adjourned the meeting at 7:40 P.M.
