A public hearing will be held on the following item: MOTION TO ADOPT Temp. Ord. #1381 on first reading to amend Section 28-129 (b) of the Code to provide that public or private golf courses with restaur- ants shall be a permitted use in the S-1 Rec- reational District. FINAL ACTION: APPROVED on first reading as amended that in the Ord- inance the word "restaurant" be changed and substituted with "a dining room, bar and grill and snack bar". Second reading and public hearing will be held at the regular Council meeting on Wednesday, May 11, 1988 at 7:30 p.m. The City Council may consider and act upon such other business as may come before it. MEDITATION AND PLEDGE OF ALLEGIANCE: Mayor Abramowitz called for the Pledge of A11egla e-followed by a Moment of Silent Meditation. PRESENT: Mayor Norman Abramowitz Vice Mayor Jack Stelzer Councilman Herman "Larry" Bender Councilman Bruce Hoffman Councilman Henry Rohr ALSO PRESENT: John P. Kelly, City Manager Richard Doody, City Attorney Carol E. Barbuto, City Clerk 1. PUBLIC HEARING - MOTION TO ADOPT Te^ mp. Ord. #1381 on first read- ing to amend Sectso 28-129 (b) ofc code to to provide that public or private golf courses with restaur- ants shall be a permitted use in the S-1 Recreational District. SYNOPSIS OF ACTION: Public Hearing Held. Approved on first reading with Amendments. City Attorney Doody read Temp. Ord. #1381 by title. * * V/M Stelzer MOVED to APPROVE Temp. Ord. #1381 on first reading, SECONDED by C/M Rohr. Thelma Brown -Porter, City Planner, said City staff was Directed to look at the needed changes for the S-1 Zoning classification. She said staff reviewed the concerns of the citizens and found that the S-1 Zoning classification should be restricted and approved by special exceptions. She said the City Council approved the construction of a restaurant for Colony West Country Club without the S-1 Zoning classifications in place. She said C/M Bender recommended that the word "restaurant" be changed in the Ordinance to read "a dining room, bar and grill and snack bar" and she recommended this Item be approved. C/M Bender said he checked the zoning code and, presently, there are restaurants permitted in Zones B-1, B-2 and B--3. He said B-1 and B-2 zones require special exceptions for restaurants and he recommended the Ordinance be changed to reflect, "a dining room and/or bar and grill and snack bar" as opposed to "restaurant". --He said this change will give golf courses and Country -Clubs the opportunity to have these services. V/M Stelzer asked if the Code stated "dining rooms" and Mrs. Brown -Porter said the City's Platting Ordinance suggested that dining rooms in golf courses are the same as restaurants; however, the Zoning classification stated "restaurants". C/M Hoffman said he agreed with C/M Bender's recommendation. Page 1 i 4/21/88 Mayor Abramowitz said the Planning Department indicated that they were not comfortable with the terminology, "restaurant". He agreed with this change. City Attorney Doody asked if the City Council was concerned with the size of the project. C/M Hoffman said he understood a restaurant to be open to the public and a dining room to be for members of an organization. He said a dining room is not as open to the public as a restaurant. V/M Stelzer said this change would not preclude the public from dining at Colony West Country Club. Mayor Abramowitz said this change clarifies the matter and he supports the change. * C/M Bender MOVED to AMEND the Ordinance to read "dining room * and bar and grill and snack bar" as opposed to "restaurant." City Attorney Doody suggested the change be "dining room, bar and grill and snack bar". C/M Bender ACCEPTED this language, SECONDED by C/M Hoffman. Mayor Abramowitz opened and closed the Public Hearing with no response. VOTE: ALL VOTED AYE Carol E. Barbuto, City Clerk, said there was a Motion on the Floor, given by V/M Stelzer and Seconded by C/M Rohr, to Approve Temp. Ord. #1381 on first * V/M Stelzer MOVED to APPROVE Temp. reading. Ord. #1381 on * first reading as AMENDED, SECONDED by C M Hoffman. VOTE: ALL VOTED AYE City Attorney Doody announced that the second reading and Public Hearing for this Item will be heard at the Regular City Council meeting of Wednesday, May 11, 1988 at 7:30 P.M.
