SPECIAL MEETING
CITY COUNCIL
Please be advised that the City Council will hold a Special Meeting on
Tuesday, May 17, 1983, at 10:30 A.M. in the West Conference Room at
City Hall, 5811 N. W. 88th Avenue, Tamarac, Florida.
The purpose of the Meeting is as follows:
1. Canal Maintenance - Report by City Manager and City Engineer.
Discussion an possible action.
The City Council may discuss such other business as may come before it.
The public is invited to attend.

SPECIAL CITY COUNCIL MEETING
MAY 17, 1983
CALL TO ORDER: Mayor Falck called the meeting to order at 10:30 A.M.
Tuesday, May 17, 1983, in the West Conference Room.

Mayor Falck read the call into the record.
1. Canal Maintenance - Report by City Manager and City Engineer.
Discussion and possible action.
SYNOPSIS OF ACTION: The City Manager was
authorized to go to bid for public bids
to clean the waterways of the City.
C/M Stelzer said there are approximately 45 miles of canals in the
City that have become a problem with algae and overgrown weeds. He
said there is a problem in the Sabal Palm area,, Sections 6
and 7. He asked the City Manager what type of program the City has
had in prior years for canal maintenance,
Laura Stuurmans said in recent prior years the City has had a contract
with PHK, Inc. who primarily used copper sulfate to treat the algae
problems. She said for the maintenance of the area at the edge of the
waterway, the Public Works people used to apply liquid chemicals and
then pull the weeds along with the debris there. She said it had been
the plan of the prior Public Works Director to discontinue that function
as of October 1 and extend the contractual service to -encompass that
effort. She said he then transferred 2 Public Works men to the streets
and drains areas of the Public Works project. She said that project was
placed on the Council Pre Agenda for sometime in latter November or
December. She said, because of transitions in the Department, this
item has been tabled.
She said she and the City Engineer have looked at the situation and
there are several options, the City could consider use of their own

personnel or contractual services. She suggested Council give her -
the authorization to go to bid for a variety of different types of
levels of service throughout the City which would enable her to make
a cost study of what is needed.
C/M Stelzer said some areas are so bad that they need a shock treatment
and he MOVED to authorize the City Manager to go for public bids to
clean the waterways of the City. SECONDED by C/M Kravitz and he said
when the City Manager goes to bid on this there would be a 6 to 8 week
time before action on this and during the interim he suggested the
Public Works Dept. do some of this canal maintenance work. The City
Manager said that 2 weeks ago they froze those positions and went to
a local labor pool and they have worked with the Public Works to clean
up these areas and they are working at the present time.
V/M Massaro said the worst has been taken care of but the men should not
be working on grasses that are simply floating as a result of people not
cutting at the waters edge. She asked if it were not the responsibility
of the contractor to remove algae and the City Manager said treating it
but not cleaning it once it has formed. V/M Massaro said the City

Attorney should review the contract with PHK, Inc. to determine their
responsibility toward maintenance of the canals. Mayor Falck asked
the City Manager if the City receives any funding from the State and
the City Manager said approximately $20,000 per year is received for
this.

City Ordinance required seawalls for all water -front constructions,
the Council decided to waive the stipulation in exchange for Bay Colony
agreeing to maintain their sewer lines up to 10' into the water and to
properly grade and sod the banks. He said no one has checked the canals
in his area. Harold Newman, resident, said he lives on a canal and there
has been no treatment of the canal in the last 6 to 8 months and the
condition is a problem.
The City Manager said it was her intention to make the specifications
for bids inclusive of all types of treatment. Lou Vladem, resident,
said there is a piece of equipment at the Woodmont Country Club which
is used to clean the canals but, in spite of that, algae still forms
and certain grasses grow. Irving Epstein, resident, said diluted chemicals
must be used to control these problems.

C/M Stelzer said another area of concern is Sabal Palm,Sections 6 and 7,
and the City has an agreement with Richard Stackhouse for the cleaning
of these canals. The City Manager said the City has a court stipulation
which indicates that the City will contribute up to $5,000 per year for
acquisition of chemicals for canal treatments. She said Mr. Stackhouse
is to supply labor for Sabal Palm Golf Course which is in the subdivision
of 6 and 7. She said after that stipulation was made, there were
arrangements made between Ed Gross, the City Manager at that time, and
Richard Stackhouse that the City would pick up their obligations toward
that $5,000 through the efforts of the contractor. She said when there
was a possibility of Mr. Miller purchasing the golf course area last
year, there was hope that other arrangements would be made.
The City Manager said there was a meeting about a week ago on this and
as a result, she requested Mr. Stackhouse solicit prices from local
companies for maintenance of those waterways and they have received a
response from Lakes Doctors, Inc. who quotedapproximately $8,600._for... one
year service. She said during the first 2 month period a shock treat-
ment would be needed to clean the condition and she proposed that
pursuant to terms of the prior stipulation, Council authorize payment
to Mr. Stackhouse of $3,000 upon his execution of the proposal from
Lakes Doctors, Inc. and, after they have done the first 2 months work
and inspection by the Engineering Dept., the Talance of $2,000 be ,paid
to him for the remainder of the year under that contract.
The City Attorney said it should be clear that the agreement on the
stipulation is $5,000 a year but the stipulation was intended to be
only reimbursement for chemicals he would expend and after the inspection,
the City would go to the chemicals. Even though the City acknowledges
the fact that it is not equal to the $8,600 which includes labor for
removing the weed growth, our position is the agreement is only for
the reimbursement of chemicals. V/M Massaro said some of that $8,600
is for the cleaning of the banks which was never part of our agreement
and the City should not touch private property. She MOVED that the
City Manager be authorized to enter into an agreement with Mr. Stackhouse
authorizing the payment of $5,000 under the terms that she mentioned,
$3,000 and $2,000 when the work is completed. SECONDED by C/M Stelzer.
C/M Kravitz asked if this were provided for in the budget and the City
Manager said they will use monies set aside for outside services. C/M
Krantz asked what the extent was of the City's contract with PHK and
the City Manager said they are presently being paid approximately $1,800
a month.

C/M Stelzer said the problem with PHK is that a contract was never
signed and he asked about consideration of the rock pit. The City
Manager said after she gets the bid documents drawn up she will route
them to Council.

The City Manager requested authorization for management to continue
using full time temporary help from a labor pool and C/M Krantz MOVED
that they continue to use the 2 men for the purpose of maintaining the
canals as long as necessary. SECONDED by V/M Massaro.
