SPECIAL MEETING
CITY COUNCIL OF TAMARAC, FLORIDA
There will be a Special Meeting of the City Council on
Thursday, June 4, 1981 at 10:00 A.M. in the West Conference
Room at City Hall, 5811 N. W. 88th Avenue, Tamarac.
The purpose of the Meeting is to discuss and take possible
action on F & R Builders Stipulation 9.
The City Council may consider such other items as may come
before it.
The Public is invited to attend.
Pursuant to Chapter 80405 of Florida Law, Senate Bill No. 3681
If a person decides to appeal any decision made by the City
Council with respect to any matter considered at such meeting or
hearing, he will need a record the proceedings and for such

NOTICE OF SPECIAL MEETING
CITY COUNCIL OF TAMARAC, FLORIDA
A Special Meeting of the City Council had been scheduled
for Thursday, June 4, 1981, at 10:00 A.M. in the West
Conference Room at City Hall, 5811 NW 88 Avenue, Tamarac,
to discuss and take possible action on F&R Builders
Stipulation 9.
The Council will also discuss and take possible action on
the water conservation restrictions.
The Council may consider such other items as may come before
it.
The public is invited to attend.

SPECIAL CITY COUNCIL MEETING
JUNE 4, 1981
CALL TO ORDER: Mayor Falck called the meeting to order on Thursday, June 4,
1981, at 10:00 A.M., in the West Conference Room of the City Hall.
ROLL CALL: PRESENT: Mayor Walter W. Falck
Vice -Mayor Irving 14. Disraelly
Councilwoman Helen P4assaro
Councilman Irving Zemel
Councilman Philip B. Kravitz
ALSO PRESENT:
City Manager, Laura Z. Stuurmans
City Attorney, Arthur M. Birken
Assistant City Clerk, Carol A. Evans
Mayor Falck read the Meeting Notice into the record, indicating that conside-ta--
tion will be given to the items of F & R Builders - Stipulation 9, and Water
Conservation Restrictions.
1. Water Conservation Restrictions - Discussion and possible action to
repeal Emergency Ordinance 0-81-23, pertaining to nonessential uses
of water, by Tem . Ord. #893. First and Second Reading.
SYNOPSIS OF ACTION: Adopted on 1st and ORDINANCE NO.O- f/,
A 02Z PASSED.

Mayor Falck read a paragraph that was issued by the South Florida Water
Management District;
"If you are a County or Municipality located in the 10% reduction
area, then it is not anticipated that the mandatory ordinance should
remain in effect. To determine whether your ordinance should be re-
pealed, the following factor should be evaluated and discussed with
the Utility which services your area; 1) whether there is a local
facilities problem, 2) whether there is a treatment plant problem,
3) whether there is a local shortage of water due to the low levels
of the local reserves, or the possibility of saline water intrusion."
Mayor Falck recommended that action be taken to repeal Ordinance 81-23,
and read Temp. Ord. #893, by title.
C/W Massaro said that the Council members received a memorandum from
the City Engineer, and felt that Ordinance 81-23 should be repealed.
She PROVED to adopt Temp. Ord. #893, on first reading, and C/M Zemel
SECONDED. Temp.Ord.1#893 was then read in its entirety.
VOTE: 'ALL VOTED AYE.
V/M Disraelly MOVED to adopt Temp. Ord. #893, on second and final
reading, repealing Ordinance 81-23, and C/M Zemel SECONDED. The title
of the ordinance was read by V/1-2 Disraelly.
C/W Massaro advised that due to the high elevation of the water, the
canals were presently being pumped, and the ordinance is being enacted
based on the South Florida Water Management District, as to a suffi-
ciency of water and sewer being provided.
VOTE: ALL VOTED AYE.
MAYOR FALCK RECESSED THE MEETING TO 1:30 P.M.
MEETING WAS CALLED TO ORDER, ROLL CALL TAKEN, AND ALL PRESENT.
2. F & R Builders -- Stipulation 9 -- Discussion and possible action.
SYNOPSIS OF ACTIO14: No action taken, and
a reconvened meeting date to be established.
Julian Bryan represented F & R Builders, and introduced the various

people who were in attendance; namely, Dan Carnahan, the Consulting
Engineer, Martin L. Riefs, Project Manager, Charles Jacobson, the
Marketing and Sales Director, Jim Holland, the Director of Planning,
and Bob Haber, House Counsel for F & R Builders.
Mr. Bryan explained that last summer the City Council reviewed a
project called Tamarac Gardens, Parcels K, L and M, which were just
west of Lime Bay; and approved. After the review, he said, discussions
were held with Council members and the professional staff of the City,
as to the development of the balance of the property, in Land Sections
5 and 6, with a probable necessity for a stipulated agreement to
augment the 1976 Judge Weissing Order.
He advised that a final agreement was submitted of draft #5 approxi-
mately one week previous, which incorporated input received from the
Council members and the City's professional staff. But, it was deter-
mined on Wednesday, June 3rd, that additional changes were required,
as relates to the verbiage. He additionally requested that a review
be made at this time, of each paragraph, with input to be solicited
by Council.
Mayor Falck felt that if a determination or conclusion could not be
obtained this day, the meeting could be reconvened.
MEETING WAS RECESSED FOR FIVE MINUTES.
Mr. Birken advised that the City was in receipt of a document, which
is not in final form, and cautioned Council that they could be held to
statements being made at this time. Fie said the proposed Exhibit D
in the stipulation, relating to setbacks, appeared to be less restric-
tive than some setbacks which would have to be complied with under the
existing Court Order. The former City Planner, he said, did not concur
with this, but his point of view was that additional review is required,
prior to his recommendation of approval by Council. He stated that
C/W Massaro brought up several matters, and the City Engineer did agree
that it is not up-to-date, especially some major areas. Mr. Birken
felt that most concepts have been agreed to, but required changes in
language.
C/W Massaro indicated that she reviewed matters with the gentlemen
representing F & R Builders, in order to determine acceptable language,
and felt that clarification could be made, if necessary.
Mayor Falck felt the meeting should be recessed, especially if there
are questions of setbacks involved.
