There will be a Special Meeting of the City Council on Friday, June 23, 1989, at 9:30 A.M. in Conference Room 1 of City Hall, 7525 NW 88 Avenue, Tamarac. The purpose of this meeting is: 1. MOTION TO ADOPT Temp. _Reso._#5480 accepting the warranty deed from the School Board of Broward County regarding certain property that is being exchanged with the School Board in connection with the Tamarac Multi -Purpose Building. FINAL ACTION: RESOLUTION NO. R--89-180 PASSED. APPROVED. 2. DISCUSSION AND POSSIBLE ACTION regarding expression of interest wfor the �Cty _ Attorney to draft legislation regarding the City's opposition to off -shore drilling. FINAL ACTION: APPROVED directing the City Attorney to proceed. 3. DISCUSSION AND POSSIBLE ACTION regarding the City of Tamarac having signage on Commercial Boulevard at the exits of the Turnpike and I-95. FINAL ACTION: Staff was directed to proceed with the necessary pro- cedures. All meetings are open to the public. CAE/pm Carol A. CITY OF TAMARAC CITY COUNCIL SPECIAL MEETING FRIDAY, JUNE 23, 1989 CALL TO ORDER: Mayor Abramowitz called this meeting to Order on FridaT, June 23, 1989 at 9:30 A.M. in Conference Room #1 (City Clerk's office). PRESENT: Mayor Norman Abramowitz Vice Mayor Jack Stelzer Councilman Dr. H. Larry Bender Councilman Bruce Hoffman Councilman Henry Rohr ALSO PRESENT: Richard Doody, City Attorney Mike Couzzo, Acting City Manager Pauline Walaszek, Special Services Secretary 1. MOTION TO ADOPT Temp. VOTE: ALL VOTED AYE 2. DISCUSSION AND POSSIBLE ACTION regarding expression of interest o the City Attorney to draft legislation regarding the City of Tamarac's opposition to off -Shore Drilling. SYNOPSIS OF ACTION: DIRECTED the City Attorney to draft a Resolution. Mayor Abramowitz said a letter was submitted by Walter Falck, Director of the Broward League of Cities, regarding a request for the City of Tamarac to approve and send to the State, a Resolution opposing off -shore drilling. He submitted a copy of a similar Resolution approved by the City of Lauderdale Lakes to the City Attorney. * V/M Bender MOVED to APPROVE the drafting of a Resolution * indicating the City of Tamarac's opposition to off -shore * drilling, SECONDED by C/M Rohr. C/M Rohr said he was very concerned with this matter and he approved of the Resolution being drafted. C/M Hoffman said he was opposed to the City getting involved in the matter because it was a Federal matter. He said he remembered the long gasoline lines that Pag e 1 6/23/89 occurred in the past and he did not want to see it occur again. He said the City should not become involved. DISCUSSION AND POSSIBLE ACTION regarding City of Tamarac having signage on CommercialBoulevard at the Interstate 95 (I-95) and the Florida Turnpike exits. SYNOPSIS OF ACTION: Staff was directed to proceed with the necessary procedures. Mayor Abramowitz said the City received a letter from the Florida League of Cities regarding signage on the exits of Interstate 95 (I-95) and the Florida Turnpike. He said he would like the City Council to indicate where the signage should be. Mayor Abramowitz said the Department of Transportation indicated only two Cities would be listed at each exit. He said the City of Lauderhill already had signs at this location and they were trying to get their signage moved. He said he would like the City to immediately register with the Department of Transportation to have the signs located on Commercial Boulevard if the City of Lauderhill was able to get their signs removed. C/M Hoffman said the signs should be placed in the middle of the City, which was Commercial Boulevard. * C/M Hoffman MOVED to APPROVE the City request that the City * of Tamarac be listed at the Commercial Boulevard exits of * Interstate 95 (I-95) and the Florida Turnpike, SECONDED by * V/M Bender. VOTE: ALL VOTED AYE C/M Stelzer asked if there would be signs placed on Commercial Boulevard indicating the direction of the City of Tamarac and Mayor Abramowitz said he would investigate this matter. C/M Rohr said he received information regarding the boring that occurred at the Police Facility. Mayor Abramowitz said he refused to sign the check. He said he was informed that there would be two letters submitted, one from Construction Management Services, Inc., and the other from the Architects. He said the information C/M Rohr received was erroneous and he informed everyone that he would not accept a verbal explanation. V/M Bender said the borings were done in 1984, and Construction Management Services, Inc., knew nothing about them. He said all of the documents indicated "location (as shown on the plans)"; however, the plans were not available. He said there was no way of knowing where the holes were actually drilled. 1 IJ 1 Page 2 6/23/89 V/M Bender said Construction Management Services, Inc., indicated that the Architect, who at that time was Miller and Meier, gave instructions. He said he wanted to know where the instructions to drill were located. He said if the drilling occurred under the structure, the City had no recourse, Mayor Abramowitz said he recently requested a written statement from the two agencies and V/M Bender said Construction Management Services, Inc., indicated that the borings occurred before Construction Management Services, Inc., took over the project. Mayor Abramowitz said because of the letter submitted by Construction Management Services, Inc., he would not sign the check. He said because the check was not signed, the Police Facility would not be ready. C/M Hoffman asked what Mayor Abramowitz meant by the Police Facility not being ready and Mayor Abramowitz said the City would receive a Certificate of Occupancy. He said the Contractor would not continue working until he was paid. Mayor Abramowitz said when he read the letter, he refused to sign the payment documents because the letter indicated that the complete parcel was covered by rock which was not correct. He said Reports would be received from the Architect and Construction Management Services, Inc. V/M Bender said the Reports did not indicate where the drilling locations were. He said he found that the plans were.not available in the City; however, he wanted to krc,; if the drillings were done in the appropriate area. C/M Rok.• had concerns with the difference in the boring locations and Mayor Abramowitz said the Engineer indicated that the boring could have been done by the ^at never connected with the rock. Mayor Abramowitz said the City Council should wait until the Reports were submitted. City Attorney Doody said a member of the City Council requested that an Item be placed on the dune 28, 1989 City Council Agenda eliminating the night meetings. He asked if this matter should be scheduled for discussion or should the appropriate legislation be drafted. C/M Hoffman said a Resolution should be drafted and C/M Stelzer said the City Council expressed their interest at the June 12, 1989 Special City Council meeting. City Attorney Doody said the City Code indicated that the Council meetings would be said he would investigate at 9:01 A.M. this matter to and 1:11 P.M. He see if it was appropriate; however, the City Code in his office was kept current. City Attorney Doody said the only change that would be needed is a change to the Resolution that was adopted several years ago. Mayor Abramowitz suggested that City Attorney Doody submit further information to the City Council. Page 3 6/23/89 C/M Hoffman said he would like both meetings scheduled for 9:00 A.M. and C/M Stelzer said Land Use Plan Amendments and zoning restrictions could be heard after 5:00 P.M. Mayor Abramowitz asked the City Attorney to bring the information to the June 28, 1989 City Council meeting. C/M Hoffman asked the City Attorney to bring a Resolution to the June 28, 1989 City Council meeting. C/M Rohr and C/M Stelzer agreed. Mayor Abramowitz said he would like the information regarding the City Code, etc., submitted as well. Mike Couzzo, Acting City Manager, said at the first County Commission meeting on July 6, 1989, the City would be making a presentation for the waiver of the finalization of the plat for the Multi -Purpose Complex. Mayor Abramowitz asked Mr. Couzzo to submit a memorandum to the City Council about this information. With no further information, Mayor Abramowitz ADJOURNED this meeting at 10:55 A.M.
