SPECIAL CITY COUNCIL MEETING
There will be an Emergency Special City Council Meeting held
on Thursday, June 22, 1989 at _12:00 P.M. in Conference
Room #1 of City Hall, 7525 NW 88� Avenue, Tamarac, Florida.
This Emergency Council Meeting was called in connection with
the following item:
MOTION_ TO ADOPT _ Temp _Reso. #5479 authorizing the
appropriate City officials �to execute a Warranty Deed
from the City of Tamarac to the School Board of Broward
County, Florida, certain property that is being
exchanged with the School Board in connection with the
Tamarac Multi -Purpose Building.
FINAL ACTION: RESOLUTION NO. R-89-179 PASSED.
APPROVED.

CITY COUNCIL EMERGENCY MEETING
THURSDAY, JUNE 22, 1989
CALL TO ORDER: Mayor Abramowitz called this meeting to Order on
Thursday, June 22, 1989 at 12:00 P.M. in Conference Room #1 (City Clerk's
Office) .

MOTION TO ADOPT Temp. Reso. #5479 authorizing the appro-
priate City Officials to execute a Warranty Deed from the City of
Tamarac to the School Board of Broward County, Florida, for certain
property that is being exchanged with the School Board in
connection with the Tamarac Multi -Purpose Building.
SYNOPSIS OF ACTION: RESOLUTION NO. R-89-179 - PASSED
APPROVED.
City Attorney Doody read Temp. Reso. #5479 by title.
City Manager Kelly said the framework for this matter was
already approved and accepted by the City Council with
anticipation for further action. He said the City agreed
to swap property with the School Board and this Item was
for the execution of the Warranty Deed.
C/M Hoffman asked if the School Board would be submitting
a Warranty Deed to the City for the other property and
City Manager Kelly replied, yes. City Manager Kelly said
this would be submitted to the City when the School Board
received the City's Warranty Deed. He said the City
Council would need to accept the Warranty Deed from the
School Board which was already agreed upon by the City
Council; however, this was the formal action.
City Manager Kelly said the Warranty Deed from the School
Board had to be returned to them by Monday, June 26, 1989
in order for the Item to be placed on the County
Commission Agenda in July, 1989.
Mayor Abramowitz said a permit was being requested
without the parcel being platted first. He said to do
this, the City had to submit the Title Commitment to the
County Commission.

C/M Hoffman asked if it was possible that the School
Board would not submit a Warranty Deed on the exchange
parcel and City Attorney Doody said there was an existing
Agreement between the City and School Board which was
approved by the City Council to March 15, 1989. City
Attorney Doody said the Agreement outlined the procedure;
therefore, it would be a violation of the Agreement if
the School Board did not submit a Warranty Deed for the
exchange parcel.
V/M Bender said the deadline for the City to submit a
Warranty Deed to the School Board was June 26, 1989. He
asked if the School Board had a deadline to submit a
Warranty Deed to the City.
Mike Couzzo, Director of Public Works/Parks and
Recreation, said the School Board executed their Warranty
Deed. He said the City's Consulting Attorney would
submit the City's executed Warranty Deed to the School
Board for exchange of their Warranty Deed.
C/M Stelzer asked where the property was located and Mr.
Couzzo said the property was triangular and approximately
1.1 acres. Mr. Couzzo said the property was located in
the furthest west section where the maintenance area was.
He said the parcel was being exchanged for the property
to the east.
Mayor Abramowitz asked if the School Board would be
allowing the City to use the property exchanged by the
City with a lease of 99 years.
Mr. Couzzo said he did not understand this to be part of
the agreement and Mayor Abramowitz asked if the City
would be allowed to use the property. Mr. Couzzo said
not at this particular stage; however, the School Board
indicated informally that they had no desire to use the
parcel at this time; therefore, the City could continue
to use it.
City Manager Kelly said the Ray De La Feuilliez,
Associate Superintendant of Facilities and Property
Management for Broward County School Board, indicated
that they did not intend to use the land; however, they
needed the land to meet the State requirements for
acreage.
Mayor Abramowitz suggested that the City Manager and City
Attorney see that the appropriate legal documents were
submitted permitting the City to use the property.
V/M Bender suggested that the City receive a Memorandum
of Understanding from the School Board for the use of the
property.
Mr. Couzzo said it would be in the City's best interest
to pursue a Lease for the property. He said it may not
be appropriate to do this now because a Lease Agreement
was needed with the School Board for Lease of the
Multi -Purpose Building.
C/M Hoffman asked why the City would Lease the
Multi -Purpose Building when the City was building it and
City Manager Kelly said the School Board would be using
the Facility; therefore, the City would be prorating the
Utilities, etc., and the School Board would be leasing
from the City.

With no further business, Mayor Abramowitz ADJOURNED this
