PLEASE BE ADVISED THAT THE CITY COUNCIL OF TAMARAC, FLORIDA
will hold a Special Meeting at 11:30 A.M. on Tuesday, July 2nd, in
Chambers of City Hall, 5811 N.W. 88th Avenue.
The Durnose of this meeting is to discuss and take action
regarding storm damage at the Satellite Recreation Building
Construction site.
Council may consider and take action on s11ch other business
as may come before it.

Tape CALL TO ORDER: Mayor Kravitz called the meeting to order
1 on Tues ay, July 2, 1985 at 11:30 A.M. in the Council Chambers
of City Hall.

and Possible Action regarding storm damage.
SYNOPSIS OF ACTION: Chief Building Official
was authorize to remove trusses and have them
stacked flat on the ground for a sum not to exceed
$2000.00.
Jon Henning, City Attorney,advised that he, the City Manager
and the Chief Building Official visited the site on Friday and
observed that the trusses were all in a perpendicular state and
installation was about ninety percent complete. :4e said that over
the weekend, apparently, the wind caused the trusses to collapse.
He said the immediate emergency seems to be to get the trusses
lifted by crane and layed on the ground stacked flat so that they
will not warp. He added that they will be inspected by engineers
before being installed and,if necessary, there will be replace-
ments of the damaged trusses not salvageable. He reported that
the installation of the sewer line is laging behind and up until
now, was the only problem.
Mr. Henning said, regarding the salvaging, that the City consid-
ered hiring the crane operator and laborers, not City workers,
to salvage and stack the trusses. He stated that Bob Jahn,
Chief Building Official, has estimates of approximately $2000.00
to do that job. He said the ideal situation is to move forward
with the job and the contractor is willing to continue to do this
and try to get the sewer line subcontractor to get that staightened
out. He said the contractor is asking for his next draw.
Mr. Henning said that originally, on Friday, there was a draw of
$20,000.00 which was withdrawn by the City and substituted with
a draw of approximately $8500.00. He said the remainder of the
$20,000.00 was to be, in part, for some of the sewer work, approx-
imately $3000.00 and to finish the roof work. He added that the
contractor has adequate liability insurance; however, the legal
question arises, if there was nothing wrong and there is no liabil-
ity, who covers the loss for wind or storm damage and that has
not been resolved. He said the contractor is on a very tight
budget and is having trouble making his checks clear and needs
the draw. He said the City is very emphatic as to what the
money would be going to. He stated the question is whether to
minimize the losses and pay $2000.00 and only salvage the trusses
or make the next draw to the contractor and have him continue on
the job.
Bob Jahn, Chief Building Official, advised that the Council
authorized a draw of approximately $20,000.00 to be paid but
said he would never release the check unless all the work that
that draw was against was competed or substantially under way.
He said that on Friday he asked the City Manager and the City
Attorney if the $20,000.00 check could be issued in three in-
crements. He said a check for $7500.00 was issued directly for
the installation of the trusses and the tie beam work, which
had been completed and another $1000.00 to Mr. Feld, the contract-
or, to pay for the crane work.

Mr. Jahn said the balance of $11,900.00 was not given because
it would have included the completion of the sewer for about
$3000.00 and for the plywood that must be sheeted on the trusses.
He said he retained the $11,900.00 check and returned it to the
Finance Department. He added that Mr Feld's contention is that
he is in such a financial condition that he must have that money
in order to move forward. He said the issue before the Council
now is, if the Council wishes and directs him to, he would ask
for the release of that check to the contractor in order for him
to proceed. He said he ascertained that, by renting the crane
directly and having a five man crew, he could accomplish pulling
the trusses out and laying them flat so that they would not warp
for approximately $1500.00 to $2000.00.
Mr. Jahn said it is not his recommendation to advance this money
to the contractor. He added that he was so dissatisfied with
the work on the sewer that he had written a letter of seven
day rescission on Friday. He said the City has not overpaid that
if trouble arises, it will still be in a position to complete
the building. He said the decision is at a Council level.
Mayor Kravitz asked Mr. Henning if it is legally possible to
pay as the work is done and hold the money in escrow.
Mr. Henning said it could be worked out that when the work is
done, the money can be released by the Chief Building Official.
He said it is agreed that this job can be salvaged for $2000.00
but there will still be no roof. He said it would take $5000.00
to $6000.00 to finish putting the roof on and the balance of the
$°11,000.00 is going to the sewer pipe.
Mr. Jahn repeated that the main problem is the sewer line.
C/M Stein suggested that the first problem of getting the trusses
salvaged should be addressed and Council should authorize Bob
Jahn to remove the trusses for a sum not to exceed $2000.00.
He said the second problem is how sure is the City that if the
money is given to the contractor, he will then proceed to put
the trusses back up, put the roof boards on and finish his job
and the sewer.

V/M Massaro agreed with C/M Stein in that presently the concern
is getting the trusses salvaged and mitigate that possible loss
and authorize the $2000.00 and have the Chief Building Official
hire the crane and salvage the trusses. She suggested this meeting
be recessed until figures are available. She asked where the
first cost estimate is, how much of that was done and what damage
there is to the trusses.
C/M Gottesman asked if these trusses are salvaged will they be
usable.
Mr_ Jahn said, in his opinion and the opinion of the engineer,
98 percent, possibly 100 percent of the trusses can be salvaged
and reusable by repair.
C/M Gottesman asked who owns these trusses at the present time.
Mr. Henning said the question at this point is to determine
ownership of the trusses. He said the recovery is going to re-
volve around two issues, liability verses storm and ownership.
V/M Massaro said the City has a responsibility to prevent
loss.

C/M Stein MOVED to AUTHORIZE the Chief Building Official to
expend a sum not to exceed $2000.00 to remove the trusses and
have them put flat on the ground.. V/M Massaro SECONDED.
Mr. Henning said, for the record, the City is not paying the
contractor, George Feld, to do this job but the City will hire
a subcontractor to do it.

C/M Gottesman asked if this is to be done immediately upon
Council's acceptance.
Mr. Jahn said he does not have a guarantee on a cranebut that
he is on standby. He said the crew is ready to work within an
hour notice. He added that the crane may have to wait until
tomorrow and would be calling Lawson Crane and the crew is
William Varker.
VOTE: ALL VOTED AYE
V/M Massaro suggested that the Acting City Manager, Larry Perretti,
get the figures together for Council of the estimated cost
of the proponents of the project, what has been done and
what remains to be done and the estimated cost of putting these
trusses back in shape so that the City can see what position it
is in.
Mayor Kravitz requested a legal opinion in writing as to where
the City stands at the present time with the entire project.
C/M Gottesman requested the contractor and his financial status
be investigated.
Mr. Henning said the contractor is very anxious to move forward
but needs more of a draw to do that. He asked Bob Jahn if the
contractor can do any further work if he does not get a further
draw.
Mr. Jahn said he is not in a position to do any further work
without a further draw.
C/M Stein asked Bob Jahn if he has certificates for merchandise
bought.
Mr. Jahn said he has releases of liens for the amount of money
that he has been paid, however, those releases are from his
main subcontractor. He said there have been several.suppliers
who have called in and have bad checks. He added that the
crane company has not been paid for $1005.00, Rinker Materials
has bad checks from a subcontractor, not from Mr. Feld, for
about $1000.00. He said it was his direction, and he believes
the checks went out, to issue two checks on that draw, one
made jointly to the truss company and Mr. Feld.
Mayor Kravitz ADJOURNED the meeting at 12:07 P.M.
