MOTION TO AUTHORIZE the transfer of $33,513.00;from TUW Sewage Treatment Plant Closure Account 393-535--6PG to TUW Pump Station Rehab Account 434- 393-535-6PF to utilize funds from completed PrJ434- ject 87-9 to the on going Pump Station Rehab Project 86-15 to cover anticipated cost to cotrect electrical changes on stations. MOTION TO AUTHORIZE the transfer of $10,000.00 from TUW Appropriated Retained Earnings Account #434-389-115 to TUW Pump Station Rehab Account #434-393--535-6PF to fund Change Order #4 on Pump Station 15 installation. SYNOPSIS OF DELETED ACTION: from the Agenda. Bob Foy, Director of Utilities/Engineering, said this Item was proposed to transfer money from the Revenue Account to an Account for the Pump Station #15W Project; however, the money should be transferred from the Bond money and was Item c. on the Agenda. He suggested this Item be deleted from the Agenda. Mr. Burroughs asked if there would be enough money in the other Account and Mr. Foy replied, yes. * C/M Rohr MOVED to DELETE this Item from the Agenda, SECONDED * by C/M Bender. V/M Stelzer asked Mr. Burroughs about a figure and Mr. Burroughs said the figure was presently in the Construction Fund. V/M Stelzer asked if there was 2.5 million dollars in surplus and Mr. Burroughs said yes. V/M Stelzer asked if this contradicted Mr. Burroughs statement regarding the City having no additional surplus and Mr. Burroughs said he would like to investigate this matter because it was confusing when using the Revenue Accounts. V/M Stelzer asked Mr. Burroughs about an account containing $3,200,000.00 and Mr. Burroughs said the money was in the 425 Fund, which was not the same fund. Page 1 7UME Mayor Abramowitz asked what V/M Stelzer was questioning and V/M Stelzer said he was trying to determine where the 2.5 million dollars called "Retained Funds" came from. Mayor Abramowitz said there was a Motion on the floor for Item a on the Agenda; therefore, V/M Stelzer should detain his questions for the appropriate Item. Melanie Reynolds, Resident, asked how much was in the Fund and how much would be in the Fund after the transfer. Mr. Burroughs said when this Item was created, the new forms were not in existence. He said there was $987,000.00 of unappropriated monies in the 434 Fund. Joseph Schreiber, Resident, asked if the 434 Fund was being used for the shortfall in the Budget. Mr. Burroughs said the 434 Fund was a separate fund and would not pertain to the Budget shortfall. VOTE: ALL VOTED AYE c. MOTION TO AUTHORIZE the transfer of $33,513.00 from TUW Sewage Treatment Plant Closure Account #434-393-535-6PG to TUW Pump Station Rehab Account #434.393-535-6PG to utilize funds from completed Project 87-9 to the on -going Pump Station Rehab Project 86-15 to cover anticipated cost to correct electrical changes on stations. SYNOPSIS OF ACTION: APPROVED. Mr. Foy said this Item was to have enough money for the Pump Station #15W Project, which was to submerge the station. * C/M Hoffman MOVED to APPROVE this Item, SECONDED by C/M Rohr. Mayor Abramowitz asked if the cost of this project increased and Mr. Foy replied, no. Mayor Abramowitz said this Project was to resubmerge Pump Station #15W to its original position to alleviate complaints and problems from the surrounding residents. VOTE: ALL VOTED AYE b. SYNOPSIS OF ACTION: APPROVED. 44 J Page 2 ` mom Mr. Foy said this Item would be for remote control equipment for the valve at Grants Station. He said this valve could be opened at the Water Plant to avoid unnecessary travel with this equipment. C/M Hoffman asked what the valve did and Mr. Foy said the value controlled the water that went into and out of the water storage tank at Grants Plaza. * C/M Rohr MOVED to APPROVE this Item, SECONDED by C/M Bender. V/M Stelzer had concerns the transfers and Mr. Foy would be cancelled. MOTE: with the figures balancing in said the $10,000.00 amount ALL VOTED AYE 2. DISCUSSION AND POSSIBLE ACTION on the City's insurance require- ments. SYNOPSIS OF ACTION: TABLED disc ssion. City Manager Kelly said at a previous meeting, the City Council did not resolve the issue insurance. He said the City Council was interested in a reduced premium cost based on a $1,000,000.00 policy with a $10,000.00 deductible. He said the Personnel Director has researched this matter and had a report to present. Larry Perretti, Personnel Director, said at the City Council Workshops, the City Council agreed to use $1,000,000.00 combined single -limit with a $10,000.00 deductible. He said he submitted a break -down of the amounts quoted by the Florida League of Cities. (SEE ATTACHMENT $1). Mr. Perretti said he was waiting on quotes from other companies; however, he discussed the costs with these companies on the telephone and he would inform the City Council of those premiums after they review the quotes from the Florida League of Cities. Mr. Perretti said last year the Budget reflected $489,120.00 for this service and, of this amount, $357,102.00 was appropriated to the Florida League of Cities, $253,477.00 was for the General Liability Accounts and $103,625.00 was for Auto Liability. Mr. Perretti said if the City stayed with the same type of coverage this year, which was $1,500,000.00 with no deductible, the cost would have been $488,223.00 less a 3% credit at difference was a total premium of $467,604.00. He said the $110,502.00 more than last year. Mr. Perretti said for $1,000,000.00 with a $10,000.00 deductible, it would cost $334,070.00 less the incentive credit of 3% ($9,619.00), the total premium would be $324,451.00. He said this would be a savings $32,651.00. C/M Hoffman asked if the total paid -out claims against the City for the past 3 years was approximately $100,000.00 and Mr. Perretti said this included in the Page 3 - �A" figure paid off. Mr. Perretti said there were several open cases; therefore, this could not be determined. Mayor Abramowitz asked if the break -down submitted to the City Council on September 1, 1988 came from the City's records and Mr. Perretti replied, yes. (SEE ATTACHMENT #2) Mayor Abramowitz said he would be basing his judgement on the City's experience and Mr. Perretti said the increase originally projected was based on the exposure and experience rating of the City for years 1984, 1985 and 1986. C/M Rohr asked if the open cases would be settled under the new policy and Mr. Perretti said the open cases would be settled under the old policies. C/M Hoffman asked what coverage had the most claims in the past. He said it may be more feasible to drop the deductible from the policies that have no claims. Mr. Perretti said the answer had to be determined by reviewing which policies were being increased in premiums. He said Equipment and Automobile Liability was increased. V/M Stelzer asked why the Automobile premiums were increased so much and Mr. Perretti said there were new cars purchased. V/M Stelzer asked if accidents were a cause and Mr. Perretti said not necessarily; however, there have been several accidents in the Police Department. V/M Stelzer asked if Fire and Extended Coverage Insurance would be purchased and Mr. Perretti said this Insurance was with another carrier. V/M Stelzer said the other Insurance should have been included in the reports because they had to be compared with the Budget and Mr. Perretti said the main concern of insurance coverage was for the Florida League of Cities' Policies. Mr. Perretti said the remaining Policies are not up for review until March 1, 1988. V/M Stelzer asked why the reports submitted did not include all of the Insurance coverages in the Budget and Mr. Perretti said there were different carriers. V/M Stelzer said then the figures should not be compared and Mr. Perretti said he was not comparing these figures. V/M Stelzer asked what the savings were based on and Mr. Perretti said the savings were strictly based on the Florida League of Cities' quotes. V/M Stelzer said if the discussion was for Budget purposes, all of the Policy information was needed. Mayor Abramowitz said the discussion was for the quotes submitted by the Florida League of Cities. Mr. Perretti said the purpose of discussion was to give the Florida League of Cities an answer as to the Policies which are due October 1, 1988. Page 4 9/8/88 V/M Stelzer said he asked the City Manager to set up a meeting to discuss the Insurance Budget because the second reading of the Budget should not take place without the City Council reviewing that Budget. City Manager Kelly said the entire Budget could not be compared because there were some Policies that were not. up for renewal until March 1, 1988. He said the Florida League of Cities' Policies were due for renewal October 1, 1988; therefore, the City Council had to decide what costs they would like to spend for the Policies of the League of Cities. V/M Stelzer asked how the Budget would be determined and Mr. Perretti said the premiums for the Policies due for renewal on March 1, 1988 had to be carried over. V/M Stelzer said the figures for Insurance in the Budget should be addressed and then this matter could be discussed. Mayor Abramowitz said he was reviewing last year's Budget compared to this year's Budget and found a difference in ,,Ate figures by using the recommended coverage for the Policies carried with the Florida League of Cities. He said the City Council had to decide what coverages and costs the City should have so that the Florida League of Cities' renewal requirements are met. C/M Bender asked what was needed for the Budget and Mr. Burroughs said he asked the Risk Manager to provide a break -down of each Department's Insurance with the anticipated premiums. He said at this time in the General Fund and the TUW Budget there was $509,716.00 for the Florida League of Cities' Policies. Mr. Burroughs said in the TUW Budget there was $76,168.00 for Multi -Peril Insurance which he assumes was the same as General Liability Insurance. He said if it was, thon the total Budget for the Florida League of Cities' Policies was $509,716.00. C/M Hoffman said if the Policy for Automobile Liability for $1,000,000.00 with a $10,000.00 deduction would be implemented there would be a savings of $38,000.00. He said if the projected exposure was greater, it may be better to obtain -0-- deductible for this Policy and take $1,000,000.00 with a $10,000.00 deductible on the other Policies. *I�yor Abramowitz said the new premium would be implemented for the other Policies if this was done. Joe Schreiber, Insurance Advisory Board member, said he has had 30 years of experience in Insurance matters and he could not believe that the City Council was discussing this matter without having the Risk Manager or someone knowledgeable about Insurance present. He said the City had a Risk Manager who would be available until the end of the month; therefore, they should be utilizing the Risk Manager's knowledge. He said Mr. Perretti was providing the City Council with figures; however, Mr. Perretti could not give the City Council the complete background like the Risk Manager could; therefore, he could not see how the City Council was able to come town intelligent decision. He said the Insurance Advisory Board should have been asked to attend this meeting to give the City Council their advice. Page 5 9/8/88 TAPE 2 Mayor Abramowitz asked Mr. Schreiber for his opinion since he had 30 years experience. Mr. Schreiber said if the City Council was going to make an intelligent decision on these matters, they should have someone knowledgeable. He said the City Council was not paying him for his opinions; however, they were presently paying a Risk Manager who could answer their questions. Mr. Schreiber said it seems that the City Council wanted to save money and, based on what he has heard, because he did not have all of the information the City Council had, the City's exposure did not seem to be any higher than $5,000.00 per claim. He said if the City wanted to save money, they may want to consider a $100,000.00 to $200,000.00 self retention policy which would bring the premium down to $11,000.00 resulting in a savings of approximately $203,000.00. He said the savings could be placed in a Fund for any future claims. Mr. Schreiber said if the claims are not as high, a larger amount could be placed in self retention for future claims. He said Gallagher & Bassett submitted a proposal for a Policy of a $1,00,000.00 coverage with a $50,000.00 self retention and a $200,000.00 aggregate which meant that the City could not go beyond $200,000.00 in payment of claims during the policy period. He said this premium would be approximately $256,000.00 which was a savings of approximately $82,000.00. Mr. Schreiber said the type of Policy purchased could be based on the City's experience; however, the City could go for several years with little if any claims and one year be hit very hard with claims. Mayor Abramowitz asked if the Florida League of Cities quoted everything they had available for insurance and Mr. Perretti said the Florida League of Cities carried other Policies; however, the Risk Manager decided to use other carriers. C/M Hoffman asked if there were other carriers that would quote these Policies and Mr. Ferretti said if the City went to Bid on the Policies, they would probably receive other quotes. Mayor Abramowitz thanked Mr. Schreiber for his opinion and he said he learned a few things that he was not aware of. Mayor Abramowitz said the purpose of insurance was to protect yourself against claims. He said the recommendation given on the Florida League of Cities' Policies seemed to be the best premiums to take; however, the City Council had to decide if they wanted to implement the Policies recommended by staff. He said he would be making his decision on the past history. C/M Rohr had concerns with Florida Laws for Sovereign Immunity and City Attorney Doody said Florida did have the Sovereign Immunity Law; however, the courts have chipped away the doctrine of Sovereign Immunity,and would probably continue doing so. He said the courts have 1 C Page 6 �: found creative ways to go around the law and it should not be counted on in the City Council's decision for Insurance Policies. C/M Hoffman said the City Council had to do two things,, one was to select the appropriate figure for the Budget and the other was to take a look at the insurance to be carried. He said if the City Budgeted too much money for the Policies, it would not be a disaster. He suggested a figure be implemented for the Budget and a determination regarding what Policies were sufficient and feasible could be made in the future. Mayor Abramowitz said the City Council needed to inform staff which premiums were to be accepted and paid. He. asked if the City Council had to submit an amount for Budget purposes. Mr. Burroughs said the total Budget for Insurance premiums was $556,649.00; therefore, this money was budgeted. He said the concern should be on the premiums coming out of the figure because some accounts may be short and some may be over. He said $510,000 was identified as coverage for the Florida League of Cities. Mr. Burroughs said he would like to implement Mr. Schreiber's suggestion regarding the Reserve Fund. He said the City had intentions to become self -insured; however, a Reserve Fund had to be established in order to do this. He suggested that all of the insurance premiums be placed in a "Self -Insurance Fund" in an amount of $557,000.00. He said the premiums are paid through this account and any monies remaining go into an account for future claims. V/M Stelzer asked if this was being done for Workers Compensation and Mr. Burroughs replied, yes. Mr. Schreiber said the City's present experience indicates that there would be a savings of $250,000.00 and Mr. Burroughs said this procedure would slowly build up a reserve to pay the claims. Mayor Abramowitz said he would like a Workshop meeting called involving the Insurance Advisory Board, etc., for further discussion of these matters. He suggested the City Council vote on the proposals available. V/M Stelzer said Exhibit "G" indicated Option 1 to be $1,500,000.00 with a $10000.00 deductible with a premium of $351,000.00. He said Option 4 indicated $1,000,000.00 with a $10,000.00 deductible with a premium of $311,014.00. He said there was a $40,000.00 difference in these premiums which the City would be saving; however, the liability would be reduced by $500,000.00. He said Options 2 and 5 indicated the same savings and deductions. V/M Stelzer said Options 1 and 2 indicated a difference of $203,000.00. He said if the City was to deposit $351,000 (Option 1 premium) into a fund and pay the premium of $148,586.00 (Option 2 premium), there would be a savings of approximately $200,000.00. He said this would be the difference of being Self --Insured. He said City would have a fund of $200,000.00 to start a Self -Insured Program and any claims could be paid out of this fund. Page 7 9/8/88 V/M Stelzer said the City Council was considering saving $40,000.00 while eliminating $500,000.00 in protection. He suggested the City take Option 1 and place the premiums into a Self -Insurance Fund, pay the premiums and keep the remaining funds in the account as a self insurance base. Mr. Perretti said he can see having a self insurance program in the future. He said V/M Stelzer and Mr. Schreiber were overlooking the additional costs needed for the City obtaining a Claims Manager, Attorneys and miscellaneous fees. He said if the claims are under $200,000.00 the Attorney would be working full time handling the claims and the City Attorney would not be able to do this. Mayor Abramowitz said he was very interested in V/M Stelzer and Mr. Schreiber's comments; however, Mr. Perretti made a valid point. He said it would be very expensive to have a self insured program for outside legal services. V/M Stelzer said this matter was not discussed at the previous Workshop meetings; however, he was concerned with what coverage the City was going to take. He suggested the City take the 1.5 million dollar limit with a $10,000.00 deductible. City Attorney said the City Council should also consider that the Florida League of Cities' Policy had 32 Exclusions. He said this was the same Policy as the prior year; however, the City Council should be aware of this. Mayor Abramowitz said he was very concerned with this matter and it should be addressed at a Workshop meeting. V/M Stelzer said the City Council should not be responsible for reviewing the Policies to see if they were adequate. Mayor Abramowitz asked when the Florida League of Cities needed an answer and Mr. Perretti replied, October 1, 1988. He said Mr. Schreiber opened very interesting doors and before he closes the door, he wanted more information. Mayor Abramowitz asked Mr. Schreiber to attend the next meeting and he said he would. Mr. Perretti said the Florida League of Cities said they would be happy to send a Representative to answer the City's questions. AGENDIZED 8Y CONSENT 3. C/M Hoffman asked if the City Council had to decide on what the Budget should contain for Insurance. V/M Stelzer MOVED to AGENDIZE for discussion, the approval of the Budget for insurance, SECONDED by C/M Hoffman. VOTE: ALL VOTED AYE V/M Stelzer MOVED to APPROVE the Budget for insurance as presented by the City Manager and Insurance Department, SECONDED by C/M Rohr. City Attorney Doody said this matter was approved at the first Budget Hearing and would be finalized at a second hearing on September 22, 1988. Page 9 9/8/88 V/M Stelzer said the City Council never agreed to this budget at the Workshop meetings and he wanted the record to reflect that the City Council agreed to the Budget figures for insurance. City Manager Kelly said this may be a moot point; however, V/M Stelzer wanted the record to reflect that the City Council agreed with this Budget as they have at the previous Budget Workshop meetings. C/M Hoffman said the Motion should reflect that this was not the Final Approval on the Insurance Budget and the Final Approval would be made at the September 22, 1988 Budget Hearing. * V/M Stelzer MOVED to APPROVE the amount in the proposed Budget * for consideration, SECONDED by C/M Rohr.
