TamaracUtilities West - Sludge Farm Acquisition - Temp. Reso. #9 s_ .._ ^
Amending Resolution #83-150 as to period of acquisition or use of the
property and the description of access to the sludge farm.
SYNOPSIS OF ACTION: APPROVED
as conditioned.
RESOLUTION NO. R-83- F PASSED.
Alan Ruf, Consultant City Attorney, said the hearing on the Quick -
Take Procedure will be on Wednesday, 10/26/83. He said in reviewing
the Resolution that was used as the basis for the Taking, they have,
through the process of preparing for the hearing, made two determina-
tions; one that the 30 month period that was originally asked for is
probably short in terms of doing what is necessary to have an alter-
native sludge procedure available and they have increased the period
in Section 3 from 30 to 36 months at the request of the City Engineer
and Consulting Engineers. They also changed the access from the
roadway that is currently being used through an area that is being
developed at this time for residential uses through an access road
that runs north from Commercial Boulevard just inside the westerly
boundary of Land Section 8. This will remove sludge trucks from the
residential area that is being developed. Except for these two
changes, Mr. Ruf said, this Resolution is entirely similar to the
one that was passed earlier and he read Tem . Reso. #2906 by title.
V/M Massaro asked if the City of Lauderhill was joining in this suit
and Mr. Ruf said since Lauderhill uses approximately 42% of the land,
they agreed to pay the cost of the percentage 'of their use,
including the cost of maintaining, leasing, court costs and attorneys
fees. C/M Krantz asked what would happen after the 36 month period and
Mr. Ruf said it is hoped that the City would be in an alternate site
and doing an alternate type of sludge disposal within that period of
time. He said this would be in July, 1986 and if the City was not in this
position at that time, this procedure would have to be gone through
again.
V/M Massaro MOVED the APPROVAL of Temp. Reso.#2.906 as read into the
record by Mr. Ruf, SECONDED by C/MTKrantz.
VOTE: ALL VOTED AYE
The meeting was adjourned at 9:10 A.M.
