No. 1149 i 1 2 3 4 5 6 7 8 9 10 11 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0- 41- 6 AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY FROM R-3 (LOW DENSITY MULTIPLE DWELLING) TO B-5 (LIMITED BUSINESS DISTRICT); LANDS DESCRIBED AS A PORTION OF TRACT 13 OF FORT LAUDERDALE TRUCK FARMS SUBDIVISION, LAND SECTION 119 TOWNSHIP 49 SOUTH, RANG: 41 EAST, AS RECORDED IN PLAT BOOK 4, PAGE 31 OF THE PUBLIC REC(RDS OF BROWARD COUNTY, FLORIDA (OTHERWISE IDENTIFIED AS THOSE LANDS. ON THE NORTH SIDE OF COMMERCIAL BOULEVARD, EAST OF THE -SOUTHERN TERMINUS OF THE "S-CURVE" OF NW 57 STREET AND COMMERCIAL BOULE- VARD); PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of 12 e City of Tamarac, Florida, public notice has been given in accordance 13 ith the applicable law of the time and place of public hearing regardinc 14 e zoning of the property described herein and the said public hearing 15 s been held in accordance with the notice and the public has been 16 iven an opportunity to be, and has been heard; and the Council has 17 examined and investigated the request for the zoning herein and has 18 ceived the recommendation of the Planning Commission of the City of 19 marac; and 20 WHEREAS, public hearing has been held on Petition 28-Z-84 by 21 e City Council, pursuant to the Charter. 22 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 7AMARAC, FLORIDA: 24 SECTION 1: That those lands described in Exhibit "A" attached 25 hereto and made a part hereof are hereby rezoned from R-3 to B-5. 26 SECTION 2: That the Official Zoning Map of the City of Tamarac 27 all be changed to reflect in the zoning, said changes to be initialed 28 hy the Mayor and the City Clerk, together with the effective date of 29 is Ordinance. 30 SECTION 3: All ordinances or parts of ordinances in conflict 31 rewith are hereby repealed to the extent of such conflict. 32 33 r I 1 SECTION 4: Should any section or provision of this Ordinance 2 Dr any portion thereof, or any paragraph, sentence or word be declared 3 y a Court of competent jurisdiction to be invalid, such decision 4 shall not affect the validity of the remainder hereof as a whole or $any part hereof, other than the part declared to be invalid. 6 SECTION 5: This Ordinance shall become effective.
