HomeMy WebLinkAboutCity of Tamarac Ordinance O-1968-007AORDINANCE NO. 6$-7A AN ORDINANCE REGULATING THE OPERATION OF AIRCRAFT OVER THE CITY OF TAMARAC AND PRO- VIDING FOR THE VIOLATION THEREOF 0 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1. FINDINGS. The Council hereby finds that it is necessary for the safety, health and general welfare of the citizens of the City of Tamarac that aircraft flying within the corporate limits of said City be regulated in order to prevent the ever-present danger to the safety, health and general welfare of the inhabitants of the City of Tamarac. SECTION 2. DEFINITION. Aircraft as used in this Ordinance means any airplane, flying machine, or other contrivance now known or hereafter invented, used or designed for navigation of or flight in the air. SECTION 3. MINIMUM HEIGHT LIMITS FOR AIRCRAFT. No person, firm or corporation shall fly or permit any aircraft to be flown within the corporate limits of the City of Tamarac, Florida, except at a height sufficient to permit a reasonably safe emergency landing, which in no case shall be less than 1500 feet, provided that the provisions of this section may be deviated from when special circumstances render a departure necessary to avoid immediate danger or when such departure is required because of stress of weather conditions or other unavoidable cause. SECTION 4. OPERATION OF AIRCRAFT TO BE SUBJECT TO AIR TRAFFIC RULES OF FEDERAL CIVIL AERONAUTICS AUTHORITY. No person, shall operate any aircraft over or within the City of Tamarac in violation of any valid air traffic or other rule or regulation established by the Civil Aeronautics Authority or the Federal Aviation Agency, or the successors thereof. SECTION 5. NOISE BY AIRCRAFT OPERATION. Unnecessary noise by operators of aircraft within or over the corporate limits of the City of Tamarac is hereby prohibited. SECTION 6. VIOLATION PENALTIES. Any person, firm or corporation violating any provision of this Ordinance shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined by not more than $500.00 40 or be imprisoned for a term not exceeding ninety (90) days, or by both such fine and imprisonment. SECTION 7. SEPARABILITY. It is the intention of the Council for the City of Tamarac that each separate provision of this ordinance shall be deemed independent of all other provisions herein, and it is further the intention of the Council that if any provision of this Ordinance be declared invalid, all other provisions thereof shall remain valid and enforceable. SECTION 8. EFFECTIVE DATE. This Ordinance shall become in full force and effect immed- iately upon its final passage. PASSED ON FIRST, SECOND AND THIRD READING, THIS 17th DAY OF JUNE, 1968.
