HomeMy WebLinkAboutCity of Tamarac Ordinance O-1969-002ORDINANCE NO. k? 2 AN ORDINANCE ADOPTING THE SOUTH FLORIDA BUILDING CODE, 1957 EDITION, TOGETHER WITH AMENDMENTS THROUGH MAY 2, 1967, WITH CERTAIN EXCEPTIONS, AMENDMENTS AND ADDITIONS AS SET FORTH HEREIN; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; AND FOR OTHER PURPOSES. WHEREAS, The Board of Commissioners of Dade County, Florida, adopted a Building Code on October 29, 1957, known as the "South Florida Building Code", and the City of Tamarac, Florida, desires to adopt said Code as originally enacted, along with subsequent Amendments adopted up to and through May 2, 1967, and further, along with certain exceptions, amendments and additions thereto; and WHEREAS, the City Clerk has certified to the City Council that three (3) copies of the aforesaid "South Florida Building Code" as originally adopted and with amendments through May 2, 1967, as well as the exceptions, amendments and additions provided for herein, have been on file continuously *1 in his office since December 6 W, 1968, and there open to the public for inspection; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1. That the "South Florida Building Code", 1957 Edition, as adopted by the Board of Commissioners of,Dade County, Florida October 29; 1957, together with all amendments thereto which have been adopted up to and through May 2, 1967, is hereby adopted as the Building Code of the City of Tamarac, Florida, except as subsequently modified, amended or changed in this adopting Ordinance. SECTION 2. That Sections 201 and 201.1 of Chapter 2 of the "South Florida Building Code" are amended to read as follows: 201 BUILDING DEPARTMENT: The "South Florida Building Code" shall be administered by the City of Tamarac Building Department. All references in the "South Florida Building Code" to the "building official", shall mean the "City of Tamarac Building Department. 201.1. The appointing authority shall des- ignate certain members of the Building De- partment as "building inspectors", "plumbing inspectors" and "electrical inspectors". The appointing authority shall further have the power to appoint other classes of inspectors and to delegate powers and assignments of all employees working in the City of Tamarac Building Department. SECTION 3. That Section 203 is amended to provide as follows: That the City Council of theCity of Tamarac shall constitute the Board of Rules and Appeals provided for under the "South Florida Building Code." The powers, duties and res- ponsibilities bestowed on the Board of Rules and Appeals are hereby bestowed upon the City Council of the City of Tamarac. The City Council may employ an architect, structural engineer or other person to act as an expert advisor to the Council when sitting as a Board of Rules and Appeals, at such compensation as the Council may provide. The City Council shall serve as a Board of Rules and Appeals without compensation unless otherwise provided by it. SECTION 4. That Section 302.2(b) of Chapter 3 of the "South Florida Building Code", is amended to add thereto the following sentence: �cn �fi�``evenC�b�icif more than one u xng of identical size is to be constructed on various lots within the City, the City of Tamarac Building Department may waive the requirement for individual plans and allow a master set to be submitted. SECTION 5. That Sub -sections 4505.3(a) and (q) are amended to read as follows: 4505.3 - GENERAL REQUIREMENTS: (a). Approved rigid metal conduit, surface metal raceways or electrical -metallic tubing shall be required for light, heat and power in the wiring of apartment buildings for three (3) families or more, in churches, schools, hotels, theaters, public buildings, commercial buildings, manufacturing establishments, private clubs or similar occupancy, and in unfinished basements. (q) The use of non-metallic sheathed cable, referred to as "Romer" shall be restricted to single family and duplex dwellings. SECTION 6. That Section 4601.2 shall be amended by omitting the first unnumbered paragraph and substituting the following therefor: There shall be appoint.ed,,,.b.y the appointing authority, a Plumbing 'fiqsp,pctor who shall . have the responsibility of enforcink.<the°-", plumbing code. SECTION 7. That Sub -sections 4604.2(c) and (d) shall be amended 0 to read as follows: (c) ABOVE GROUND PIPING WITHIN BUILDINGS: Piping for a drainage system within a building shall be of cast iron galvanized wrought iron, galvanized steel, brass, approved plastic (ABS or PVC) D.W.V. piping or copper pipe, or copper tube type K, L, and M in sizes 1 1/4 inch and larger and DWV in sizes 3 inches and larger. No brass or copper tubing. (d) UNDERGROUND PIPING WITHIN BUILDINGS: All drains within buildings where underground, brass pipe, approved plastic (ABS or PVC) D.W.V. piping, except that copper tube and fittings Type K or L may be used for underground drainage installations for private residential or duplex work only, and for indirect waste lines. - 3 - Fj SECTION 8. That Sub -paragraph 4604.3(d)(1), and all sub -sections 40 therein, is hereby repealed in its entirety. SECTION 9. That Sub -sections 4604.5(b) and (c) of the "South Florida Building Code" are amended to read as follows: 4604.5 MATERIALS FOR VENTING: (b) PIPING ABOVE GROUND: Vent piping shall be of cast iron, galvanized, wrought iron, galvanized steel, brass, approved plastic (ABS or PVC) D.W.V. piping or copper tube. (c) UNDERGROUND: Vent piping placed under- ground shall be cast-iron soil pipe, lead pipe, approved plastic (ABS or PVC) D.W.V. piping or brass pipe. SECTION 10. That Table 46-C "Materials for Plumbing Installations" as set forth in Section 4604.6 of the "South Florida Building Code" is amended to include, in addition to the material therein, the following: 1. U.S. DEPARTMENT OF COMMERCE - NATIONAL BUREAU OF STANDARDS. - Commercial Standard CS 270-65, Acrylonitrile-Butadiene-Styrene (ABS) Plastic Drain, Waste and Vent Pipe and Fittings. 2. U.S. DEPARTMENT OF COMMERCE NATIONAL BUREAU OF STANDARDS. - Commercial Standard. CS 272-65, Polyvi.nal Chloride (PVC) Plastic Drain, Waste and Vent Pipe and Fittings. 3. NATIONAL SANITATION FOUNDATION TESTING LABORATORY. - _Seal of 4pproval and testier _ of plastic pipe, fittings and appurtenances. SECTION 11. Any reference in the "South Florida Building Code to "Building Official" is hereby changed to "City of Tamarac Building Department", and any reference to "appointing authority" or "legislative authority" is hereby changed to "City of Tamarac, is Florida, acting by and through its City Council." SECTION 12. Any person, firm or corporation who shall violate a provision of the "South Florida Building Code" as adopted hereby, or fails to comply therewith, or with any of the requirements thereof, shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of the "South Florida Building Code" is committed or continued, and upon conviction of any such violation, such person shall be punishable by a fine of not less than fifty ($50.00) dollars nor more than five hundred ($500.00) Dollars, or by imprisonment not exceeding sixty (60) days, or by both such fine and imprisonment. SECTION 13. Should any section or provision of this ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part thereof, other than the part declared to be invalid.
