HomeMy WebLinkAboutCity of Tamarac Ordinance O-1969-006M • ORDINANCE NO. �� � 2 AN ORDINANCE ESTABLISHING REGULATIONS FOR THE TYPE AND PLACEMENT OF LAWN MARKERS; PROVIDING PENALTIES THEREFOR; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SAVINGS CLAUSE• AND FOR OTHER PURPOSES. WHEREAS, the City Council has been advised that some of the existing lawn markers constitute a traffic hazard or a potential traffic hazard, substantially hinder the City Administration in its obligatory lawn maintenance functions and detract from the general esthetic interests of the community; and WHEREAS, the City Administrator has recommended that lawn markers be regulated in order to alleviate the traffic hazards, .to prevent potential traffic hazards, to facilitate the City Administration in performing its ob- ligatory lawn maintenance functions and to enhance the es- thetics of the City of Tamarac; and 0 WHEREAS, the City Council deems it to be in the public interest to regulate the use and placement of lawn markers in the City of Tamarac; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: • • ARTICLE I: REGULATION OF LAWN MARKERS. SECTION 1. That all lawn markers utilized in the front of resident lots abutting any street or other public way shall not exceed nine (9) inches in diameter, shall not exceed 9 1/2 pounds, and shall be button or mushroom style. Each lot shall be limited to a maximum of four (4) lawn markers. SECTION 2. The general maintenance superin- tendent shall have the duty of enforcing this Ordinance in the following manner: (a) He shall first notify the owner of the lot, in writing, specifying with particularity, the alleged violation, and shall, give the lot owner ten (10) days from receipt of said notice to conform with the requirements of this Ordinance. (b) If the lot owner does not comply with this Ordinance within ten (10) days of notification of the violations, the general maintenance superintendent shall prosecute the violator in the Municipal Court of the City of Tamarac, Florida. After the expiration of the ten (10) day notification period, each day that the violation exists shall constitute a separate offense. - 2 - (c) Any person violating any of the provisions of this Ordinance, shall, upon conviction thereof, be punished by a fine not to exceed Five Hundred Dollars ($500.00), or by imprisonment, not to exceed ninety (90) days, or by both such fine and imprisonment. ARTICLE II: SECTION 1. Should any Section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent juris- diction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. ARTICLE III: SECTION 1.
