ORDINANCE NO.
AN ORDINANCE AMENDING THE ZONING CODE OF
THE CITY OF TAMARAC TO PROHIBIT ANY WALL,
FENCE OR HEDGE IN ANY ZONING CATEGORY;
PROVIDING FOR AN APPEAL TO THE BOARD OF
ADJUSTMENT; PROVIDING A SAVINGS CLAUSE;
REPEALING ALL ORDINANCES IN CONFLICT THERE-
WITH: AND FOR OTHER PURPOSES.
WHEREAS, the City of Tamarac is a planned community
and required to perform certain maintenance functions requir-
ing limitations on the use of property throughout the City;
and,
WHEREAS, the City Council deems it to be in the
public interest to prohibit certain walls, fences and
hedges, artificial or natural, in order to allow the City
to maintain the overall plan of the community and to pro-
vide for the cutting of lawns; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That a new Section 1.08 shall be
added to the general provisions of the zoning code of
the City of Tamarac; to wit, Ordinance No. 1-64; said
amended Section to read as follows:
"Section 1.08. Prohibition of Wall, Fence, etc.:
That no wall or fence, of whatever substance,
or any series of shrubs, bushes, hedges or other
growing matter placed or maintained in such a
manner as to constitute a wall or fence shall
be constructed, maintained or otherwise allowed
on any lot within the City of Tamarac; provided,
however, this prohibition shall not apply to
any existing or future perimeter fence surround-
ing the City boundary of the City of Tamarac.
. Any person seeking to maintain a wall, fence
or hedge shall apply to the Board of Adjustment

for a variance in accordance with the pro-
visions of Section 6.01 of Ordinance No.
1-64. t1
SECTION 2: Any person, owner or occupant main-
taining any wall, fence or hedge contrary to the new Section
1.08 shall be required to apply for a variance in accordance
with Section 6.01 within sixty (60) days from the effective
date of this Ordinance.
SECTION 3: Should any section or provision of
this Ordinance or any portion thereof, or any paragraph,
sentence or word be declared by a court of competent juris-
diction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part
hereof, other than the part declared to be invalid.
SECTION 4: All ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
SECTION 5: This Ordinance shall become effective
the day of ZW A.D., 1969.
