AN ORDINANCE PROHIBITING THE LITTERING AND
POLLUTING OF CANALS WITHIN THE CITY; PRO-
VIDING A PENALTY FOR THE VIOLATION HEREOF;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING A SAVINGS CLAUSE.
WHEREAS, it has come to the attention of the City
Council that various persons, firms and corporations have
been littering, polluting, and otherwise mistreating and
abusing canals and other waterways within the City, and
WHEREAS, the City Council deems it necessary and
in the public interest to protect health, safety, welfare,
and aesthetics.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL of
the City of Tamarac, Florida.
SECTION 1: That it shall be unlawful for any person,
firm or corporation to in anyway and/or in any manner, litter,
pollute or otherwise mistreat or abuse any canals, lakes, ponds
or other waterways within the City of Tamarac. Said littering
and/or pollution shall include but not be limited to the throwing
of debris, whether construction or otherwise, into waterways,
the throwing of grass cuttings or other trimmings into waterways,
and the dumping of garbage into waterways.
SECTION 2: It shall also be unlawful for any person,
firm or corporation to either allow, permit, or have any of its
employees, agents, servants, sub -contractors and other persons
working under their direction, to violate this Ordinance.
SECTION 3: Any person who shall be convicted of a
violation of this Ordinance shall be punished by a fine not ex-m
ceed.ing the sum of Five Hundred ($500.00) Dollars or by imprison-
ment for not more than ninety days or both such fine and imprison-
ment.

SECTION 4: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 5: Should any Section or provision of this
Ordinance or any portion hereof, or any paragraphs, sentence
or word be declared by a Court of competent Jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder hereof as a whole or any part hereof, other
than the part declared to be invalid.
