HomeMy WebLinkAboutCity of Tamarac Ordinance O-1970-029BCITY OF TAMARAC, FLORIDA ORDINANCE # Y-LA9 AN ORDINANCE PROVIDING FOR SPECIFICATIONS, REGULATIONS, AND CONTROLS FOR EXTERIOR RADIO, TELEVISION OR ELECTRONIC ANTENNAE OR AERIALS; PROVIDING FOR NOTICE OF VIOLATION; PROVIDING A PENALTY FOR THE VIOLATION HEREOF; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE. WHEREAS, the City Council deems it necessary in protection of the public health, safety and welfare to regulate outdoor antennae or aerials, and WHEREAS, the City Council deems it necessary for the aesthetic quality and beauty of the City of Tamarac to control outdoor antennae and aerials. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL of the City of Tamarac, Florida. SECTION l: That all exterior or outdoor radio, television and electronic antennae or aerials or antennae or aerials of any other nature constructed upon, affixed to, structurally repaired or altered, or otherwise emplaced to service or act in conjunction with the use of any property for not more than two family residential use, must comply with the requirements of this Ordinance and any future amendments hereto after the effective date hereof. SECTION 2: That all antennae or aerials provided for in Section One (1) above shall be mounted on a metal tubing, suitable for the specific purpose, for support. SECTION 3: That all such antennae or aerials be provided with a lightening arrester and driven ground rod suitable for the particular purpose. SECTION 4: That all such antennae or aerials must be placed or attached to the rear wall of the dwelling. Cornor lot dwellings or dwellings having double street exposure must locate the antennae or aerials on the side of the dwelling that will provide the least street ex- posure. In no event shall the placement of the antenna or aerial mast exceed two feet in distance from the roof overhang it is most closely located to. SECTION 5: All such antennae or aerials shall at no time be mounted in a manner that will exceed a height of 15 feet above the crown of the road at a point directly in front of the dwelling. SECTION 6: Installation of and/or structural repair or alteration to antennae or aerials for use in con- nection with commercial properties, multiple dwellings, or situations not provided for herein above shall be done in a manner such as not to violate or offend the aesthetic, safety, health, and welfare intent of this Ordinance. That in such cases the City Building and Inspection Depart- ment shall have the authority to approve or disapprove the installation of antennae or aerials as aforesaid. SECTION 7: The requirements and regulations provided for in this Ordinance shall in no way authorize the in- stallation of aerials or antennae in sections or areas of the City wherein they are otherwise prohibited either by deed restriction or law. 2 • 0 SECTION 8: That any property owner, lessee, person, firm or corporation responsible for the erection of an antenna or aerial or responsible for the maintenance of an antenna or aerial in violation of this Ordinance, shall have thirty (30) days from the delivery of written notice as hereinafter provided for, to correct said violation. Written notice shall be provided by the City Building and Inspection Department or the City Clerk or any other designee of the City Clerk by leaving same at the residence of the alleged violator or by mailing by regular mail to the alleged violator or by leaving same on the premises wherein the alleged violation is taking place. SECTION 9: That the City Building and Inspection Department shall have the authority to investigate and to make such inquiry as shall be necessary to determine whether or not a violation is taking place. Said Department shall also have the authority to provide written notice of violation as hereinabove referred to and to issue summonses for violation of this Ordinance. All powers authorized and provided to the Building and Inspection Department are also equally and concurrently provided to the City Clerk and/or his designees. SECTIONIO: Any person who shall be convicted of a violation of this Ordinance shall be punished by a fine not exceeding the sum of Five Hundred ($500.00) Dollars or by imprisonment for not more than ninety days or both such fine and imprisonment. SECTION II: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. - 3 -- r f 4 SECTION 12: Should any Section or provision of this Ordinance or any portion hereof, or any paragraphs, sen- tence or word be declared by a Court of competent juris- diction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
