0 ORDINANCE NO. '70-8
AN ORDINANCE AMENDING ORDINANCE 2-63 PROHIBITING
THE PARKING OF CERTAIN HOUSE TRAILERS, COMMERCIAL
VEHICLES, BOAT TRAILERS AND OTHER VEHICLES IN
RESIDENTIAL AREAS OF THE CETY OF TAMARAC; REPEAL-
ING ALL ORDINANCES IN CONFLICT; PROVIDING A SAVINGS
CLAUSE: AND FOR OTHER PURPOSES.
WHEREAS, the Council of the City of Tamarac deems it
wise and expedient and in the best interest of the public health,
safety and welfare to prohibit certain vehicles from parking in
residential areas; provided, however, certain exemptions shall
be allowed providing for temporary parking for purposes of loading
or unloading in accordance with the following terms and conditions;
now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That Sections 31 and 32 of Ordinance
No. 2-63 be and they are hereby specificilly repealed.
SECTION 2: Parking Regulations in Residential Areas.
(A) No personal shall park or store any house car or
trailer, which may be used for living or sleeping purposes; any
truck, semi -trailer, or tractor; any boat or boat trailer, on
any lot,piece or parcel of land within the City of Tamarac in
any residentially zoned district, as now defined or as may be
defined in the future, whether the same be parked or stored on
a public right of way of private right of way.
(B) For purposes of determining vehicles to be pro-
hibiited from parking in residential zones pursuant to this or-
dinance, the following definitions shall control.
(i) House car of trailer - any vehicle which may
be utilized for living or sleeping purposes, whether said
vehicle be so utilized at the time or not.
(ii) Truck, semi -trailer or tractor - any vehicle
required to display a license tag issued by the State of Florida
other than license tags designated as "!automobiles" by the State
of Florida. Any vehicle bearing a license tag of a State other

than Florida shall be governed by the tag it would be required
to obtain if it were licensed in the State of Florida.
(iii) Boat or boat trailer - any boat, yacht or
vessel, regardless of size of motor capacity; and any trans-
portation device which may be utilized to transport a b6at,
yacht or vessel along public right of ways.
SECTION 3: Exceptions.
(A) It shall be permissible for any of the above
prohibited vehicles to be parked or stored in a residential
zone provided that said vehicle is parked or stored entirely
within a closed building, not visible to the eye, and not used
for living or sleeping purposes within said building.
(B) Any of the foregoing mentioned vehicles may be
parked or stored in a residential zone for purposes of loading
or unloading on a temporary basis; provided, however, any vehicle
remaining oti the premises for a continuance twenty-four (24)
hour period shall be considered as conclusive evidence that said
vehicle is not being loaded or unloaded, and, any of the fore-
going vehicles parked or stored in a, -residentially zoned dis-
trict for more than two eveings between the hours of 9:00
o'clock P.M. and 6:00 o'clock P.M. In any twenty (20) day period
shall be considered as being in violation of the prohibited
parking section of this ordinance.
SECTION 4: Should any section or provision of this
ordinaice or any portion thereof, or any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be in-
valid, such decision shall not affect the validity of the remain-
der hereof as a whole or any part hereof, other than the part
declared to be invalid.
SECTION 5: All ordinances or parts of ordinance in
conflict herewith be and the same are hereby repealed.
