HomeMy WebLinkAboutCity of Tamarac Ordinance O-1970-006F • ORDINANCE NO. 70 - v AN ORDINANCE AMENDING THE LEGAL DESCRIPTION IN ORDINANCE 69-30; CORRECTING AN ERROR IN THE LEGAL DESCRIPTION DESIGNATED ON EXHIBIT A AS PARCEL 9 IN TRACT 2; PROVIDING A SAVINGS CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT; AND FOR OTHER PURPOSES. WHEREAS, pursuant to law, the Council of the City of Tamarac enacted Ordinance 69-30 zoning certain properties C-1 in accordance with the legal description attached to said ordinance and identified as Exhibit A; and, WHEREAS, the Council has been advised that Page 4 of said Exhibit A contains an error in the legal description, said error resulting in the improper publication required by law; and, WHEREAS, the Council has been advised that public notice must be given in accordance with the applicable law reflecting the correct legal description and the hearing held in accordance with the notice wherein the public shall be given an opportunity to be heard, and that said hearing has been held and the public heard; and, WHEREAS, the applicant accepts responsibility for the erroneous publication and legal description and has paid all costs and expenses necessary to correct the zoning ordin- ance as aforesaid; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the lands as shown on that certain legal description as more specifically stated below, are here- by zoned C-1 (Commercial District) in accordance with the zoning classifications of the City of Tamarac, Broward County, Florida. The lands described are as follows: "Parcel 9, in Tract 2, of Section 9, Township is 49 South, Range 41 East, as more particularly 0 ORDINANCE NO. 70 - 6 (Continued) -2- described as follows: Commencing at the Northeast corner of said Section 9; thence N-89001'50" - W, along the North line of said Section 9, a distance of 1780 feet; thence S-O058'10" - W, a distance of 78 feet to the Point of Beginning of this description; thence con- tinuing S-O058'10" - W. a distance of 225 feet; thence N-89 01'50" - W, a distance of 707.35 feet to a Point of Curve; thence Westerly, along the are of a circular curve to the right, having a radius of 150 feet, an arc distance of 233.04 feet to a Point of Tangency on the West line of said Tract 2; thence N-0000'56" - W. along the West line of said Tract 2, a distance of 102.59 feet; thence S-89001'50" - E, parallel with and 53 feet South of, as measured at right angles to the North line of said Section 9, a distance of 834.09 feet to a Point of Curve; thence Easterly and Southerly, along the arc of a circular curve to the right, having a radius of 25 feet, an arc distance of 39.27 feet to the Point of Beginning." The City Clerk is hereby authorized and directed to mark the Zoning change on the official Zoning Map of said City. SECTION 2: Should any section or provision of this ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 3: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. PASSED FIRST READING this day of 1970. � �9 a • • ORDINANCE NO.
